[PUBLIC COMMENTS]

>> JUDGE BECERRA. >> HERE. PSO WE'RE GOING TO GO RIGHT INTO PUBLIC COMMENTS. THOSE IN THE AUDIENCE WHO HAVE SUBMITTED A PUBLIC PARTICIPATION WITNESS FORM WILL NOW HAVE THREE MINUTES TO SPEAK ON NONAGENDA RELATED TOPICS.

UNFORTUNATELY TO ACTION WILL BE TAKEN BY THE COURT DURING PUBLIC COMMENTS.

WE ARE EXPECTED NOT TO RESPOND. ANY QUESTIONS WILL BE TAKEN AS RHETORICAL.

PLEASE KEEP YOUR CELL PHONES. LET ME START OVER ON THAT SENTENCE.

PLEASE KEEP YOUR COMMENTS AND LANGUAGE CIVIL AND RESPECTFUL OR YOU WILL FORFEIT THE REMAINDER OF YOUR TIME. IN THE SPIRIT OF RESPECT, PLEASE SILENCE YOUR CELL PHONES.

FIRST SIGNED UP TO SPEAK IS MR. DAN LYON. >> GOOD MORNING JUDGE BECERRA AND COMMISSIONERS ABOUT. A MONTH AGO I ASKED A QUESTION AS TO HOW MUCH THE STATES SPEND TO ELIMINATE A -- WHERE THE STATE PAID AND MATCHED THAT AMOUNT. SINCE THIS IS THE FINAL MEETING I HERE BY ASK THE COURT TO RESTORE THE OLD VALIANT PROGRAM. IT WOULD SAVE THE COUNTY MONEY.

ALL RIGHT. THE GREATER SAN MARCOS PARTNERSHIP IS THE PRIVATE CORPORATION IN THE PUBLIC-PRIVATE PARTNERSHIP AMONG OTHERS, HAYS COUNTY, THE CITY OF SAN MARCOS AND SAN MARCOS SCHOOL DISTRICT ARE THE PUBLIC PART. AS A PARTNER HAYS COUNTY HAS THE PRIVILEGE OF THE EXPENSES. IN THE PAST THAT MEANT HAYS COUNTY PAID $250,000 PER YEAR.

AS FAR AS I KNOW IT'S BEEN REDUCED TO A MERE $100,000 YEAR. FOR THIS HAYS COUNTY SENDS TWO REPRESENTATIVES OF MEETINGS TO THE GMMP AS THROW WOULD BE A LEGAL QUORUM UNLESS THE PUBLIC WAS ALLOWED TO ATTEND. WHAT IS BESIDE IT AND PRIVATE IN THESE MEETINGS THEY BROUGHT COMMISSIONERS COURT THE RUBBER STAMP. PEOPLE OF HAZE COUNTVEY NO SAY IN THIS PROCESS -- HAYS COUNTY HAVE NO SAY IN THIS PROCESS WHICH WE'RE FORCED TO PAY FOR.

THE GMP'S MEETINGS SHOULD BE OPEN TO THE PUBLIC. LET'S GET TO THE DISBURSEMENTS.

WE HAVE COUNTY TREASURER AUGUST 2020 INMATE HOUSING JAIL, $100,430 BUCKS.

WHEN THAT KIND OF MONEY IS PUMPED OUT OF THE COUNTY WE MISS OUT ON ALL SORTS OF TAXES HAD A MONEY WOULD PAY FOR. O'REILLY AUTOPARTS ROTORS, DISC PADS THE SHERIFF $3140.18.

PBS TEXAS OCTOBER 2020 JANITORIAL SERVICES. SHERIFF, $725 BUCKS.

[00:05:03]

TIME-WARNER CABLE TV SHERIFF 2, $29.56. AMAZON CAPITAL SERVICES QUOTE, I VOTED UNQUOTE STICKERS. ELECTION TALKS. $357.50.

AND NOW MY FAVORITE WORKPLACE RESOURCE PUBLIC SAFETY BILLING, 30 DISBURSEMENTS, $271,443.06.

I JUST CHASTISED ABOUT A MONTH AGO, I BELIEVE IT WAS THE JAIL, THAT IT ORDERED OVER 40,000 FURNITURE. THIS IS THE PROVERBIAL MIDDLE FINGER TO THE TAXPAYER OF HAYS COUNTY FOR OVER 270,000 FURNITURE. THAT IS APPALLING, ATROCIOUS,

AND NOBODY SAYS ANYTHING BUT ME. THANK YOU VERY MUCH. >> THANK YOU, SIR.

>> NEXT UP WE HAVE JORDAN BUCKLEY. >> GOOD MORNING, COMMISSIONERS.

IN JULY THERE WAS A HEAD LINE IN THE SAN MARCOS DAILY RECORD ON THE VERY TOP OF THE PAGE IT SAID COUNTY TO ENACT SIPHONED PROGRAM BECAUSE THE PRESS RELEASE ANNOUNCED THIS ON BEHALF OF THE SHERIFF AND D.A., AND ANNOUNCED SEPTEMBER 1ST WOULD BE THE IMPLEMENTATION OF THE SITE AND DIVERT PROGRAM WHICH COMMISSIONER SHELL AS THE JUSTICE COMMISSION.

THAT PRESS RELEASE WAS RUN IN THE AUSTIN AMERICAN STAR. WHEN AMIGA QUOTED THOSE WE SAID THERE NEEDED TO BE TRANSPARENCY AND INTELLIGENT IN-PERSON MEETINGS COVID.

SEPTEMBER 1ST CAME AND WENT AND SAID OH, WE CAN'T IMPLEMENT IT BECAUSE OF COVID.

WE DON'T HAVE ANY ALTERNATIVES TO MEETING IN PERSON. OCTOBER 1ST IS WHEN WE'LL IMPLEMENT. OCTOBER 1ST HAS COME AND GONE AND THIS IS AFTER SEVEN MONTHS AFTER THE D.A. PROMISED IT LAST YEAR. THEY KEEP ON KICK THE CAN DOWN THE ROAD. I DON'T KNOW IF THIS IS TO WAIT FOUR THE ELECTION TO COME AND GO. IT'S BEEN SENT OUT BY THE COUNTY AND THERE'S NO ACTION.

THERE'S NOTHING HAS HAPPENED. LAST WEEK YOU GUYS VOTED TO CREATE A NEW BOND OFFICER.

WHAT WE HEARD FROM COURT-APPOINTED ATTORNEYS HAD A SEVERAL PEOPLE WHO HAVE BEEN ARRESTED WITH NO PREVIOUS CHARGES AND LOW-LEVEL OFFENSES HAVE BEEN GIVEN CONDITIONS OF THEIR RELEASE. WHERE AS YOU GUYS DEEM WORTHWHILE TO MONITOR PEOPLE WHO ARE ARRESTED FOR CROITATION OFFENSES AFTER THEY HAVE BEEN BOOKED, ARRESTED AND MAGISTRATED THE D.A. SAYS THERE'S NOBODY TO MONITOR THE SITE AND VERT PROGRAM? IT SEEMS LIKE YOU GUYS HAVE YOUR PRIORITIES SCREWY AND CONTRADICTING YOURSELF IN PRESS RELOISS PROCLAIMING YOU'RE GOING TO UNDERTAKE AND NEVER END UP UNDERTAKING THERE'S TWO YEARS OF HAVING TEXT MESSAGE REMINDERS. YOU CAN'T KEEP BLAMING PEOPLE FOR NOT COMING TO COURT WHEN YOU DON'T THE BASIC REFORM. THIS IS TWO YEARS THAT IT'S BEEN SITTING IN Y'ALL'S HANDS.

OUR FAILURE TO APPEAR RATE REFLECTS A FAILURE ON BEHALF OF COUNTY OFFICIALS.

OUR FAILURE TO APPEAR RATE REFLECTS THE COUNTY OFFICIALS WHO SAY -- DO NOT DO WHAT THEY ARE GOING TO SAY THEY WILL DO. AND FOUR YEARS AGO, IT'S STILL NOT IN EFFECT.

THIS IS THE THIRD THING HAD A YOU STILL HAVE NOT DONE. IF YOU'RE GOING TO CHAIR THE CRIMINAL JUSTICE COMMITTEE PLEASE FOLLOW THROUGH ON THINGS. DON'T WRITE PRESS RELEASES AND SAY IT'S GOING TO HAPPEN AND DON'T SEE IT INTO FRUITION. OTHERWISE IT MIGHT BE WORTHWHILE TO SEE SOMEONE ELSE WHO DOES DO THE WORK. YOU WENT SEVEN MONTHS WITHOUT HOLDING A MEETING. OUR JAIL HIT ONE OUT OF FOUR PEOPLE INFECTED WITH THIS VIRUS AND YOU DIDN'T DEEM IT WORTHWHILE TO DISCUSS THE ISSUES IN THE JAY.

I THINK IT'S A TRAVESTY. WE'RE SPENDING MILLIONS OF DOLLARS TO OUTSOURCE PEOPLE.

OUR BAIL FUND PAID $150,000 AT THE MOST TO GET PEOPLE OUT OF PRETRIAL DETENTION.

OUR ATTORNEY GENERAL IN TEXAS THE CORRUPT AG NOW FACING ADDITIONAL FELONIES FOR POLITICAL BRIBERY. HIS BAIL WAS $35,000. THE MOST WE'VE EVER SPAYED $10,000. THESE ARE PEOPLE SITTING IN JAIL FOR MONTHS IF THEY DON'T NEED TO BE. IF ONLY ACCESS TO WEALTH THEY WOULD BE IN A HOME.

THEY WOULDN'T BE IN A CAGE. >> THANK YOU, SIR. >> NEXT UP WE HAVE SAMANTH

BENEVIDAS. >> GOOD MORNING, EVERYONE. THANK YOU FOR ALLOWING ME TO SPEAK BEFORE YOU THIS MORNING. MY NAME IS SAMANTHA AND I COME BEFORE Y'ALL TODAY NOT EDGE TO EXPRESS MY SUPPORT FOR CITE AND DIVERT BUT EXPRESS THE DELAY OF IMPLEMENTATION.

ON JULY 8TH IT WAS AGREED UPON BY COUNTY OFFICIALS THE PROGRAM WOULD BE IMPLEMENTED ON SEPTEMBER 1ST AND OCTOBER 1ST. AND NOW NOVEMBER 1ST QUICKLY APPROACHES WITH US NO SIGN OF IMPLEMENTATION. WHILE OUR OFFICIALS DRAG THEIR FEET AND IMPLEMENT A POLICY THEY AGREED UPON NEARLY FOUR MONTHS AGO, OUR COMMUNITY MEMBERS CONTINUE TO HAVE THEIR LIVES

[00:10:03]

SUDDENLY DISRUPTED OVER OFFENSES THAT HAVE ALREADY BEEN DEEMED ELIGIBLE NOR PROGRAM BUT NOT ONLY OUR STATE OXES BUT BY THE VERY PEOPLE IN LAW ENFORCEMENT HERE AS WELL.

SO WHY ARE WE -- STATE OFFICIALS -- WHY ARE WE SEEING PEOPLE HAVE THEIR LIVES DISRUPTED OVER PETTY OFFENSES WHILE THE OPTION ALLOWS COMMUNITY NOBODY'S STAY OUT OF THE CRIMINAL LEGAL SYSTEM SOME WHY DO WE HAVE PEOPLE GOING THROUGH BOOKING, GETTING THEIR FINGERPRINTS TAKE N, MUG SHOTS, GETTING A LAWYER ATTENDING COURT DATES AND PAYING COURT COST AND FINES.

THESE POTENTIALLY LIFE-ALTERING EVENTS SHOULD NOT BE AFFECTING OUR COMMUNITY MEMBERS WHEN OUR COUNTY OFFICIALS ALREADY AGREED IT IMPLEMENT A CITE AND DIVERT PROGRAM.

ADDITIONALLY, THE ELJINL CASES FOR CITE AND DIVERT -- ELIGIBLE CASES FOR CITE AND DIVERT ARE LOW-LEVEL OFFENSES MEANING THEY ARE NOT A DANGER TO SOCIETY AND SHOULD NOT BE ISOLATED FROM COMMUNITY MEMBERS. MORE OFTEN THAN NOT BEING ISOLATED IN A JAIL IS NOT THE BEST COURSE OF ACTION TONE ASSURE THE PEOPLE WHO COMMITTED THE OFFENSE STAYS OUT OF THE CRIMINAL LEGAL SYSTEM. THIS IS WHY WE SEE SUCH HIGH RATES OF RECIDIVISM IT.

SHOULD ALSO BE NOTED THAT AS OF JULY 30TH OVER 100 DETAINEES AND 30 STAFF MEMBERS AND HAYS COUNTY JAIL HAVE TESTED POSITIVE FOR COVID-19. THIS IS ROUGHLY 24% OF THE JAIL'S POPULATION OR ONE IN EVERY FOUR DETAINED PEOPLE. WITH CASES HAVING SPIKED SINCE THEN THERE'S NO DOUBTING THESE NUMBERS HAVE INSDS YET WE CONTINUE TO CITE OUR CONTINUE -- SEND OUR COMMUNITY MEMBERS TO THESE COVID-19-FESTED CAGES. THIS IS NOT OUR WE KEEP OUR COMMUNITY SAFE. INSTEAD WE COPE THEM SAFE BY ALLOWING THEM TO PERFORM COMMUNITY SERVICE, PAY RESTITUTION. THIS WILL HELP THEM KEEP THEM OUT OF THE LEGAL CRIMINAL SYSTEM MAYBE MORE EFFECTIVE THAN JAILING AND LESS EXPENSIVE FOR BOTH THEM AND THE COUNTY CONSIDERING WE SPEND $4 MILLION IN TAX DOLLARS ANNUALLY TO OUTSOURCE DETAINEES. IN CONCLUSHTION I URGE -- CONCLUSION, I URGE YOU ALL TO TAKE AUR CALLS FOR CITE AND DIVERT SERIOUSLY AND IMPLEMENT IT LONG OVERDUE PROGRAM TO SECURELY KEEP OUR COMMUNITY SAFE. THANK YOU.

>> THANK YOU, MA'AM. AND OUR FINAL SPEAKER IN PUBLIC COMMENTS NOW WAS WRITTEN LITTLE SMALL SO IT'S HASHED TO SEE, BUT IT LOOKS LIKE JOELTON? -- HARD TO SEE, BUT IT LOOKS

LIKE JOEL TRIP TTON? >> JUST GOT THIS NOTICE ON CERTIFIED MAIL DAY EVENING SO IT ONLY GAVE ME ONE DAY TO PREPARE. I DON'T SEE ANY OF MY NEIGHBORS HERE.

I'M HERE TO SNEAK OPPOSITION -- OWE SERVICED BY RAIN WATER AND SUBDIVIDE ON FIVE ONE-ACRE LOTS ACCORDING TO DATA FROM PLUM CREEK CONSERVATION DISTRICT THE AMOUNT OF WATER FOR A GIVEN AREA.

IT DOESN'T LOOK SUSTAINABLE. IT LOOKS LIKE IT'S GOING TO BE A SEGUE INTO DRILLING MORE WATER WELLS ON A LOT DESIGNED FOR ONE WATER WELL, ONE FAMILY AND ONE SEPTIC TANK.

ON THE FACE OF IT IT LOOKS LIKE IT'S GOING TO DEVALUE THE ADJACENT PROPERTIES AS AS ITS OWN. I DON'T UNDERSTAND WHY WHAT THE STROONG THIS IS, BUT IT DOESN'T LOOK LIKE -- WHAT THE ADVANTAGE TO THIS IS, BUT IT DOESN'T LOOK LIKE IT'S SUSTAINABLE.

THAT'S ALL I HAVE TO SAY. I'LL CONTINUE TO OPPOSE ANY WATER WELLS.

THERE'S WAS AN AGREEMENT FOR 16 ON THE PLAT TO ELIMINATE ALL THEREAFTER.

THERE WAS SOME REFERENCE TO SOME KIND OF TESTING TO BE DONE TO ALLOW FURTHER WATER WELLS.

IT'S NOT DEFINED PROPERLY. ANYWAY, THAT'S ALL. >> THANK YOU VERY MUCH, SIR AND

I'M SORRY ABOUT YOU RECEIVING SUCH SHORT NOTICE. >> MY NEIGHBORS WEREN'T ABLE TO

ATTEND. >> THANK YOU. THANK YOU VERY MUCH.

[1. Update from the County Judge and staff regarding the Local Disaster Declaration and COVID-19. Possible discussion and action may follow. BECERRA]

WILL YOU PLEASE OPEN AGENDAITE NUMBER ONE? >> NUMBER ONE, UPDATE FROM THE COUNTY JUDGE AND STAFF REGARDING THE LOCAL DISASTER DECLARATION AND COVID-19.

POSSIBLE DISCUSSION AND ACTION MAY FOLLOW:. >> GOOD MORNING, COURT, ALEX VILLALOBOS EMERGENCY COORDINATOR. WE HAVE SOME DATA AS OF 5:30, OCTOBER 26TH, WHICH IS YESTERDAY WITH THE CURATIVE TESTING. WITHIN THE OVERALL NUMBERS ARE 5108. BUT WITHIN THE LAST SEVEN DAYS WITHIN ALL THE JURISDICTIONS TO THE POINT WE ARE DISSEMINATING TESTS ON THE CURATIVE DEPLOYMENT THAT WE HAVE DISSEM NATED 923

[00:15:01]

TESTS. THE LAST SEVEN DAYS HAVE REALLY PICKED UP -- DISSEMINATED.

AT UNIVERSITY WITHIN THE LAST THROW WEEKS WE DISSEM NATED 1320 TWEFTS 12 -- DISSEMINATED 1320 TESTS WITH TWO POSITIVE AND A .9% POSITIVITY RATE IN A DOWNWARD DECLINE, A SLIGHT DOWNWARD DECLINE AT THE UNIVERSITY. ALSO, IN DISCUSSIONS WITH OVERALL SERVICES, OUR CONTRACT FOR THE -- THAT HAVE BEEN DEPLOYED FROM THE STATES WE HAD ONE HIRE FOR PERMANENT POSITION. WE STILL HAVE ONE THAT IS A CONTRACT EXTENDED UNTIL THE END OF JANUARY HERE. WE'LL SEE HOW THAT FILTERS DOWN TO HAYS COUNTY BUT THAT WENT OUT YESTERDAY AT AROUND JUST BEFORE:00. THAT IS -- 7:00.

THAT IS ALL I HAVE. ANY QUESTIONS? >> COMMISSIONER INGALSBE?

>> WE HIRED ONE OF THE STATE EPPIES. >> I'M SORRY TO INTERRUPT BUT

FOR THE VOWING PUBLIC STATE YOUR NAME AND TITLE. >> TAMMY CRUMLEY DIRECTOR OF COUNTYWIDE OPERATIONS. WE HAD TWO EPPIES ON A STAR Q-WE HIRED ONE UNDER OUR GRANT SO WE STILL CURRENTLY IS ONE EPPIES THROUGH THE END OF THIS MONTH, AND THEN THE STATE IS LOOKING FOR ANOTHER EPPY FOR US. ONCE THAT IS FILLED WE'LL HAVE THAT EPI THROUGH THE END OF

JANUARY, SO WE'LL BE STACKED AS WE ARE NOW. >> AND SO JUST TO DOUBLEDOWN COMMISSIONER INGALSBE'S QUESTION WILL THAT BE ENOUGH FOR THE EFFORT ON CONTRACTING -- CONTACT

TRACING? >> I BELIEVE, SO UNLESS WE HAVE A SURGE GREATER THAN WE DID IN THE SUMMERTIME, THEN WE'LL HAVE TO REEVALUATE AND ASK FOR NORPTH EPI THROUGH A STAR REQUEST.

>> -- FOR ANOTHER EPI THROUGH A STAR REQUEST. >> THE WAY THINGS ARE GOING I WOULD RECOMMENDED US MAKING THAT REQUEST NOW PERSONALLY BECAUSE ALL THE NUMBERS ARE SHOWING GENERALLY A SHIFT IN THE DIRECTION THAT IS NOT AS FAVORABLE AS WE WOULD LIKE ALTHOUGH MANY PEOPLE IN OUR COMMUNITY AS MR. VILLALOBOS JUST STATED, THE NUMBERS ARE OPTIMISTICALLY GOOD ON TEXAS STATE'S FOOTPRINT. AND EVERYONE IS DOING A WONDERFUL JOB ON THEIR PART THE JUST THE WAY THIS THING IS MOVING THAT IT WOULD BE BETTER FOR THIS TO DO HOW IT ORIGINALLY STARTED IN MARCH, AND GET AHEAD AND THERE'S AN OPPORTUNITY TO

CHARGE ON THAT FRONT. >> TO HAVE THOSE REQUESTS FULFILLED WE HAVE TO SHOW A CURRENT NEED FOR THOSE POS POSITIONS. I DON'T THINK WE SHOW THAT LEAD

WITH THE CASELOAD. >> UNDER THE CURRENT ASSISTANCE WITH POSITIVE NUMBER OF TESTS CURRENTLY, IT IS NOT SHOWING ANY BUT WE'RE STILL ASSESSING DATABASES.

ITMAY CHANGE I THINK. THAT IS IN DISCUSSION WITH TAMMY AS WE DISCUSS THROUGHOUT THE DAYS, WEEKS AND MONTHS AND WE START SEEING A PATTERN. WE START SEEING AN INCREASE.

I BELIEVE THOSE NUMBERS AND TATISTICS WILL UTILIZE THOSE NO JUSTIFY AN ADDITIONAL STAFF.

>> YES. I'M SORRY. WE DO EVALUATE THAT.

WE HAVE TO SUBMIT. I'VE BEEN HAVING TO SUBMIT A NEW REQUEST ONCE A MONTH TO KEEP THE -- SO AS THAT REQUEST RENEWS I DO EVALUATE WHETHER OR NOT WE CAN SUSTAIN THE WORKLOAD THAT WE HAVE WITH THE CONTRACT EPIS THAT WE HAVE. MONTHLY THAT IS EVALUATED AND IF

IT BECOMES AN ISSUE I WILL REQUEST ANOTHER EPIDEMIOLOGIST. >> VERY GOOD.

COMMISSIONER JONES? COMMISSIONER SHELL? >> I WOULD JUST AGREE WITH THE

JUDGE THAT WE LOOK AT THAT CLOSELY AND PROBABLY -- >> THANK YOU, SIR.

COMMISSIONER SMITH? >> YEAH. THE -- MY ONE QUESTION IS AS YOU RAN THROUGH NUMBERS ON A DOWNWARD TREND.

[00:20:42]

>> GIVE ME A SECOND PLEASE. >> MY QUESTION IS, WHEN YOU LOOK THE AT NUMBERS IT DOESN'T LOOK LIKE WHAT WE HAVE HERE. WHEN YOU LOOK AT SAN MORE COSE UNIVERSITY, THE UNIVERSITY ITSELF THOSE STEWED REBTS THE REPORTING TO THE UNIVERSITY. I -- STUDENTS I KNOW THAT'S SOMETHING THAT WE'VE DISCUSSED BEFORE. THE OVERALL TREND IS NOT FOLLOWING. SO MY QUESTION IS, DO YOU KNOW IF THIS CITY OSH THE UNIVERSITY INTO CONSER WITH THE WHAT WE'RE DOING IS TRYING TO IMPLEMENT ANYTHING TO HELP WITH THAT? AROUND TOWN WHERE THEY ARE SERIOUS ENFORCEMENT ISSUES, MASKS AND NO SOCIAL DISTANCING, NOTHING -- NOTHING AWE DISCUSSED AS FAR AS POSITIVE. DO YOU KNOW OF ANY COORDINATION

GOING ON? >> WHEN YOU'RE TALKING ABOUT PROGRAMMING WITH REGARD TO SOCIAL DISTANCING, THE NUMBERS ARE SOMETHING YOU POINTSED OUT THAT WE WANT TO HAVE COMMUNICATION WITH THE PROGRAMS THEY ARE IMPLEMENTING AT UNIVERSITY BECAUSE THAT REFLECTS ON OUR COMMUNITY HERE IF SAN MARCOS AND COUNTY WIDE BECAUSE THEY ARE THROUGHOUT THE COUNTY I KNOW THERE ARE PROGRAMS HAD A HAVE GONE OUTSIDE THE BOUNDS OF THE UNIVERSITY.

OTHER PRECINCTS LIKE SOCIAL DISTANCING, MASKING THOSE TYPES OF THINGS.

I KNOW THERE'S BEEN SHE DISCUSSION WITH ALL OF OUR PARTNERS THROUGHOUT THE COUNTY IN UNDERSTANDING WHAT SOCIAL DISTANCING LOCKS LIKE, WHAT THE PERCENTAGES WITHIN THEIR ESTABLISHMENTS AND HOW THAT SHOULD BE TAKEN CARE OF AS WITH. I KNOW THERE'S BEEN A LOT OF DISCUSSIONS WITH THAT. A LOT OF INFORMATION HAS GONE OUT IT THOSE BUSINESS OWNERS.

AS FAR AS ANY ADDITIONAL EFFORTS WE HAVEN'T HAD THOSE. >> I GUESS MY BIGGEST QUESTION, MY CONCERN IS WHENEVER WE LOOK AT THE NUMBERS THERE'S A DOWNED TREND.

THE FACT THE UNIVERSITY HAS POPPED RIGHT IN THE MIDDLE OF THE BIGGEST UPWARD TREND.

>> SURE. >> I DON'T KNOW IT'S NECESSARILY -- WE HAVE TO TAKE THOSE NUMBERS AS A WHOLE AND NOT TAKE A SNAPSHOT OF THE UNIVERSITY ITSELF BECAUSE IF WE DON'T IF WE DO THAT WE'RE BEING SHORT SHORTSIGHTED. THERE'S AN 800 POUND GORILLA STANDING OUTSIDE THAT SCHOOL THAT DOESN'T KNOW WHERE THAT BOUNDARY IS.

>> IT'S A SMALL PART WITHIN THE OVERALL COUNTY AS FAR AS NUMBERS.

I COMPLETELY UNDERSTAND THAT. ON THE LARGER NUMBER, THE NUMBERS ARE INCLOSING.

THEY ARE. ALTHOUGH IN HAYS COUNTY AS FAR AS THE NUMBERS ARE CONCERNED AS FAR AS SPEAKING WITH TAMMY AND OTHER OFFICIALS IN THE COUNTY THEY HAVE SEEN SOME GOOD RESPONSE TO SOME INFECTION RATES THAT ARE COMING IN. ALTHOUGH WE JUST HAD A WEATHER CHANGE. GOING TO START SEEING PEOPLE DO THINGS INDOORS WHICH WILL INCREASE THOSE NUMBERS. I KNOW THAT THERE'S BEEN A HUGE MARKETING CAMPAIGN WITH REGARDS TO UNDERSTANDING THAT, LETTING PEOPLE KNOW LOOK, AS WE GET COLDER PEOPLE ARE GOING TO BE DOING A LOT MORE THINGS INSIDE. I KNOW THERE'S BEEN LOTS OF DISCUSSIONS AND LOTS OF STUFF IN THE MEDIA TO DISCUSS THAT BUT OVERALL THE RESPONSE TO IT THE GUIDANCE FROM THE CDC IS SOMETHING WE SHOULD BE FOLLOWING. I KNOW THERE MAY BE CHANGES TO THE GOVERNMENT OFFICE DRIVING DOWN. I KNOW THERE'S AN ASSESSMENT ON A REGULAR BASIS TO REDUCE PERCENTAGES WITHIN THE PERCENTAGES OR INCLOSE THEM ON OVERALL NUMBERS AND WE'RE LOOKING AT THAT. I APPRECIATE THAT.

>> I'D LIKE TO ADD THAT OUR COMMUNICATIONS DIRECTOR KIM HILLSENBECK LAST WEEK THE OUT A REPORT A PRESS RELEASE STATING THAT -- STATING THE STATE IN ITS ATTEMPTS TO KEEP UP WITH COVID REPORTING IN THE MOST ACCURATE WAY POSSIBLE SOME NUMBERS HAVE STATEWIDE SLIGHTLY SHIFTED IN SPACES AND IF SOMEONE WATCHES VERY CLOSELY WHAT OUR NUMBERS ARE REPORTING THAT THERE WILL

[00:25:02]

HAVE BEEN A SMALL SETTLEMENT SHIFT AND THAT SOUNDS TERRIBLE SAY IT THAT WAY BUT THAT'S WITH A IT IS. MODIFYING THEIR SOFTWARE AND THEY HAVE, FOR EXAMPLE A FATALITY THAT HAPPENED IN HARRIS COUNTY THAT MAY NOT HAVE BEEN PROPERLY CATALOGUED MONTHS AGO.

IS NOW BEING CATALOGUED IN THE PROPER COUNTY. THERE'S A FEW.

ONE IS TOO MANY, OF COURSE, BUT THERE ARE A FEW NUMBERS THAT HAVE BEEN SHIFTED TO BE MOST ACCURATE. AS THE STATE REFINE AND GET A STRONGER HOLD OF REPORTING ADDITIONAL NUMBERS HAVE SHIFTED AND SETTLED. AND BUT THAT RELEASE WAS MADE AT THE END OF LAST WEEK, AND IF ANYONE HAS ANY QUESTIONS ABOUT IT OR NEEDS CLARIFICATION, THEY CAN ALWAYS REACH OUT TO KIM AND GET THAT UNDERSTANDING MORE COMPLETELY.

I JUST DIDN'T WANT THAT -- >> I THINK THAT GOES WITH THE PANDEMIC.

THIS IS SNAG IS VERY UNIQUE AND DIFFERENT, AS FAR AS A RECORDING PIECE AS THEY CONTINUE TO UPDATE THE SOFTWARE AND CHANGE HOW THEY DO THEIR RECORDING, I WOULD IMAGINE IT WOULD BE EVEN MORE DETAILED COMING OUT WITH DATA THAT MAY SHIFT THEIR NUMBERS IN VARIOUS PARTS OF THE RESPONSE TO

COVID. >> THROUGH MR. VILLALOBOS. WILL YOU PLEASE OPEN AGENDA ITEM

[2. Recognition of organizers and volunteers for the countywide law enforcement and community barbecue events held in August of 2020. JONES/PETERSON]

NUMBER TWO. >> NUMBER TWO, RECOGNITION OF ORGANIZERS AND VOLUNTEERS FOR THE COUNTYWIDE LAW ENFORCEMENT AND COMMUNITY CUE EVENTS HELD IN AUGUST OF 2020.

>> AND COMMISSIONER JONES?

>> I APPRECIATE THAT.

ANYTHING, BARBECUE GURU.

>> WE HAD JOHN THOMPSON IN TWICE THE IS. SAN MARCOS HELPED A LOT.

THE SAN MARCOS POLICE DEPARTMENT WITH CHIEF STAFF, LEROY TAYLOR, RICHIE PRADO, PHILLIP NAVARRO, DJ CASTILLO, REBECCA HAHN, LEE LEONARD. SAN MARCOS ACADEMY LUM NIGH ASSOCIATION. THEY WERE A HUGE HELP. SAN MARCOS CSID GOOD MIDDLE SCHOOL. SAN MARCOS FIRE DEPARTMENT AND TEXAS STATE WE HAD LORI KLAUS AND PATRICK COCHRAN FROM KYLE. JEFF BURNETT AND HIS DEPUTIES COUNS WHILE WAS ACTING AS COUNCIL AT THAT TIME ALEX VILLALOBOS WAS OUT THERE, CAL FIRE DEPARTMENT.

WANT TO THANK THE NORTH HAYS OPTIMIST FIELD FOR LETTING US USE IT AND NORM BACA SETTING IT UP FOR US, BRITTANY TATE, SAN MARCOS BARBECUE DONATED A LOT OF STUFF FOR US.

[00:30:02]

JUDGE DAVID DUNCAN I THINK HE GOT BETTER OFF EACH TIME HE WAS OUT THERE BUT HE OPENED ALL FOUR WITH OUR SAUSAGE HACIENDA MEAT MARKET AND GAVE US A DISCOUNT ON THE CHICKEN FOR ALL OUR EVENTS, AND LEWIS SIGNS MADE OUR BANNERS AND SIGNS. I APOLOGIZE IF I FORGOT ANYBODY BUT THAT WAS A HUGE THE. I DON'T KNOW IF WE'VE ALREADY BEEN INVOLVED IN ANYTHING THAT WAS MORE RECEPTIVE AND SUCH A GOOD RESPONSE FOR THE COMMUNITY. SO IT'S POSSIBLE.

>> YOU KNOW, THANK YOU, COMMISSIONER. IT WAS A LOT OF TEAMWORK.

THE COMMISSIONERS -- COMMISSIONER SMITH, COMMISSIONER SHELL, AND I GOT TO GIVE A LOT OF CREDIT TO YOU COMMISSIONER JONES BECAUSE HE DID NOT MISS ONE BARBECUE EVENT.

>> THE ONLY CREDIT I DESERVE THE FIRST TIME I'VE BEEN INVOLVED IN A BARBECUE I DIDN'T SAMPLE ANY

OF THE FOOD. WE GAVE IT ALL AWAY. >> I'M PRETTY SURE WHEN HE WENT HOME HIS WIFE WAS PROBABLY GLAD TO SEE HIM STEP MANY AND TAKE HIS CLOTHES OFF IN THE LAUNDRY ROOM BECAUSE HE DEFINITELY PROBABLY SMELLED LIKE A LOT OF BARBECUE SMOKE.

THE EVENT COMMISSIONER JONES WAS A BIG PART OF THAT ALL THE COMMISSIONERS WERE.

THE TEAM EFFORT WITH DENNIS, WITH HIS TEAM SERVING WAS REALLY GREAT.

IT WAS HOT. BUT EVERYBODY WORKING AS A TEAM WORKED OUT VERY, VERY WELL.

BAB SHOWED UP WHICH TURNED OUT REALLY, REALLY REALLY GOOD. ALL THE GUYS FROM THE BARBECUE PITS LIKE WITH LORRAINE TAYLOR AND THEN THERE WAS ANOTHER GENTLEMAN THAT SHOWED UP.

I CAN'T WLOB IT WAS WITH HIS BARBECUE PIT ALSO. BUT OVERALL THE EVENT WENT VERY WELL. THERE'S A LOT OF CITIZENS, A LOT OF CITIZENS IN THIS COUNTY REALLY DID APPRECIATE WHAT RYAN THOMPSON AND COMMISSIONER JONES AND ALL THE COMMISSIONERS, AND THOSE THAT CAME AND WAS INVOLVED IN. IT REALLY WORKED OUT REAL GOOD.

JUDGE JENKINS, HIS FIRST TIME COOKING WITHS BARBECUE PIT LEARNED HAD YOU TO COUNT THE SAUSAGE THIS WERE ACTUALLY -- HOW MANY HE WAS PUTTING ON THERE.

SO HE COULD GET 350 LINKS OF SAUSAGE ON HIS BASH CUTE PIT. AND HE HAD HIS GRANDDAUGHTER -- BARBECUE PIT. HE HAD HIS GRANDDAUGHTER AND TWO GRANDSONS WITH HIM.

HE LEARNED HOW TO BE SAFE FOR ONE THING CAN TURNED OUT REALLY GOOD.

BOB'S TEAM WITH RICHIE PRADO AND YOUR SUGGEST -- SERGEANT? I'M SORRY? YES, WAS VERY, VERY HELPFUL WITH THAT. EVERYTHING TURNED OUT FANTASTIC AND WE WOULD DO IT AGAIN. THANK YOU, COMMISSIONER. THANK YOU VERY MUCH FOR YOUR BIG SUPPORT IN THAT I DON'T NECESSITY HOW YOU DID IT. YOU WERE OUT THERE IN THE SUN

FOR A LONG, LONG TIME. >> IT WAS A LOT OF FUN. >> I DID LEAVE OFF CONTABLE DON

MONTAGUE WAS OUT THERE. >> YES, HE WAS. DON BEING THE KING KING OF BARBECUE DID A GREAT JOB, TOO -- CONSTABLE. AS A MATTER OF FACT, I WAS TALKING TO HIM A COUPLE OF WEEKS AGO AND HE HAD AN OLD BARBECUE PIT HE WAS TRADING OFF AND BARTERING AND HE GOT IT BACK. HE SAID HE'S BACK INTO THE BARBECUE BUSINESS? THANK YOU ALL. JUDGE I APPRECIATE IT. WE'RE ALSO GOING TO TRY TO LOOK AT DOING SOMETHING FOR THANKSGIVING WITH TURKEYS. I'LL GIVE YOU MORE INFORMATION.

>> THAT'S A WONDERFUL REMINDER COMMISSIONER OF THE COMMUNITY ENGAGEMENT THAT WE'RE AULS PARTICIPATING IN. YESTERDAY HERE IN SAN MARCOS, OUR COUNTY SEAT AT THE HISTORIC CLUB. THEN WE'LL CALL IT, I ALSO PARTICIPATED IN A FOOD GIVEAWAY AND YOU'RE RIGHT. THE PEOPLE SHOWED UP ON SHORT NOTICE AND WRAPPED AROUND THE PARKING LOT, RIGHT PAST CHILI DOG AND WE'RE ON THE STREET. HUNDREDS OF PLATES WERE GIVEN AND THEY WERE MANY, MANY WONDERFUL PEOPLE. I DIDN'T EVEN THINK TO BRING IT UP OR MAKE A LISTEN BEFORE YOU SAID IT. WE HAD ESTHER GARCIA.

WE HAD PETE, RICHARD ANSALDUA, PETE'S SON, OMAR BACA, ZACH, ALYSSA GARCIA.

THERE WERE JUST SO MANY PEOPLE THAT JUST OFF THE TOP OF MY HEAD I CAN THINK OF WHAT YOU'VE SAID AND DONE IS EXACTLY RIGHT. HOW MANY PEOPLE ARE SO EFFORTLESSLY WILLING TO STEP UP AND DO THE GOOD WORK. MR. VILLALOBOS, CAN YOU HELP ME FOR ONE SECOND AND TELL ME A LITTLE -- I FEEL BAD. COMMISSIONER -- COMMISSIONER JONES, DIDN'T WANT IT LEAVE ANY

NAMES OUT AND I KNOW I SAID -- >> I THINK IT'S SAFE TO SAY ALL THE EVENTS WERE DONE SAFELY AND

[00:35:01]

PROVIDED TO THE COMMUNITY WITH THE HELP OF ALL THE PUBLIC SAFETY RESPONDERS.

WITHOUT THEM WE COULDN'T HAVE DONE THESE EVENTS. THAT'S CRITICAL.

ALSO WITHIN THOSE THEY ALL SAW A NEED FOR PEOPLE IN THE COMMUNITY AS THEY DROVE UP.

YOU CAN SEE IN THEIR EYES IT WAS SOMETHING HAD A WAS NEEDED AND THEY APPRECIATED IT BECAUSE IT WAS OUT OF NECESSITY, NOT JUST BECAUSE IT WAS SOMETHING THEY WANT?

THEY WERE LINING UP AN BLOUR THEY OPENED. >> YES, THEY WERE, SIR.

-- AN HOUR BEFORE THEY OPENED IT. WE AVERAGED 1450 DISTRIBUTIONS A DAY. WE WILL DO IT AGAIN 30K9ST AND DECEMBER 14TH AGAIN.

WE'LL PROBABLY AVERAGE HIGH NUMBERS. -- OCTOBER 31ST.

THESE ARE ALL COUNTYWIDE DISTRIBUTIONS. THOSE ARE HUGE NUMBERS.

WE COULDN'T HAVE DONE ANY OF THIS WITHOUT OUR FIRST RESPONDERS.

ALONG WITH THE PPE DISTRIBUTIONS AND THE MEAT AS WELL. >> THE REASON I ASKED HIM TO

COME UP BECAUSE HE KNOWS A LOT MORE ABOUT THOSE PIECES. >> I DO WANT TO DISAGREE WITH ONE THING CONSTABLE SAID. MY WIFE HAS NEVER BEEN EXCITED TO SEE ME TAKE MY CLOTHES OFF.

OH, THAT'S FUNNY. >> HOLD ON ONE SECOND. >> I DO WANT -- FORGIVE ME FOR INTERRUPTING I DID JUST WANT TO SAY THAT THE GROUP THAT -- I WANTED TO SAY THANK YOU FOR THE PEOPLE OF DRIPPING SPRINGS FOR HAD A EVENT. THE ONE THING I DID WANT TO SAY FOR EVERY ONE OF THOSE LAW ENFORCEMENT OFFICERS OUT THERE, EITHER THEIR WIFE OR THEIR HUSBAND WAS ALSO OUT THERE SERVING AND THOSE VOLUNTEERS THIS WE TALKED ABOUT -- I'LL USE CONSTABLE'S OFFICE AS AN EXAMPLE. ALL OF HIS DEPUTIES WERE OUT THERE BUT WE PROBABLE HIS 15 FAMILY MEMBERS INTEREST THEIR FAMILY WHO ALSO DISPAY THED.

I THINK ANY TIME THEY DO ANYTHING IT INVOLVES THEIR FAMILIES.

AND I APPRECIATE THAT AND I KNOE COMMUNITY SO I JUST WANT TO MAKE SURE.

>> THANK YOU VERY MUCH. DR. CARDENAS, WILL YOU PLEASE OPEN AGENDA ITEMS 3, 4, 5, 6 AND

>> THAT'S THE PART I'M REFERRING TO SPECIFICALLY AT THE END. I UNDERSTAND AND APPRECIATE THAT

[00:40:03]

WE SPEND A LOT OF EFFORT IN COURT TO TELEVISE IT, BUT REALIZE THAT FEW HAVE THE OPPORTUNITY TO WATCH IT, SPECIFICALLY BECAUSE IT'S DOING THE WORK HOURS FOR THE MOST PART. IN THE EVER PRESENT REALITY THAT THE NEWSPAPERS ARE -- I WANT TO BE POLITE, BUT DYING ON THE VINE RIGHT? MORE AND MORE PEOPLE ARE GETTING THEIR MEDIA, THEIR INFORMATION FROM OTHER SOURCES THAN THE PRINT.

I KNOW WE'RE SATISFYING THE LEGALITIES BEHIND IT, BUT THE LET CHER HAS BROUGHT ONE OF OUR CITIZENS HERE TODAY. [16. PLN-1470-PC; Hold a public hearing with possible action to approve the final plat of the Replat of Lot 7, Rolling Oaks, Section Four Subdivision. SHELL/PACHECO]

FOR I MOVED UP SPECIFICALLY NUMBER 16, PLEASE. >> 16, PLN-1470-PC.

HOLD LICK HEARING WITH POSSIBLE ACTION TO APPROVE THE FINAL PLAT OF THE REPLAT OF LOT 7, ROLLING

OCCASION, SECTION FOUR SUBDIVISION. >> SO MOVED.

>> SECOND. >> WE HAVE A MOTION AND A SECOND.

AT THIS POINT IN TIME I WILL OPEN A PUBLIC HEARING. IF ANYONE WISHES TO SPEAK FOR OR AGAINST THIS AGENDA ITEM, PLEASE APPROACH THE PODIUM. SORRY TO INTERRUPT BUT IF YOU

WILL PLEASE STATE YOUR NAME FOR THE RECORD. >> MAXIE JOEL TRIPLE, JR. LOT TOWN ABOUT 100 FEET FROM LOT SEVEN. I JUST SPOKE WITH THE OWNER OF LOTS EIGHT AND NINE WHICH ARE DIRECTLY ADJACENT. SHE DIDN'T GET NOTICE OF THIS.

SHE SAID SHE GOT THE LETTER YESTERDAY. I DON'T KNOW ANYTHING MORE ABOUT THAT. PERHAPS A MONTH, 30 DAYS. I DON'T KNOW WHAT THE

EXAMINATION IN THE COURT. >> BECAUSE WE'RE ON THE PUBLIC COMMENTS PART IT RUNS A LITTLE DIFFERENTLY THAN CITIZEN COMMENTS. I'M GLAD YOU UNDERSTOOD AAND STUCK AROUND AND WERE PATIENT FOR ME TO OPEN THIS PUBLIC DISCUSSION.

THIS IS THE SPACE WHERE I COULD INTERACT WITH YOU A LITTLE DIFFERENTLY.

>> THANK YOU. >> AND SOME FOLKS I FEEL BAD STAYING SOME FOLKS DON'T UNDERSTAND AAND THEY FEEL THAT MAURJINALIZED OR BAMBOOZLED OR WHATEVER.

MY -- MARGINALIZED. MY BIGGEST HOPE IS THAT THIS COURT BECAUSE I DO BELIEVE THOSE ON THIS COURT HAVE THE HIGHEST DESIRE TO COMMUNICATE EFFECTIVELY WITH THE COMMUNITY.

I REALLY DO BELIEVE THAT AND DOES THE STAFF. MY HOPE IN TAKING AN EXTRA MOMENT TO CLARIFY RIGHT NOW IS WHATEVER WE'VE DONES WE NEED TO DO BETTER.

HOWEVER IT'S BEEN, IF YOU JUST GOT YOUR NOTICE ON SATURDAY, THE THING THAT YOU CAN TOUCH.

IF YOU DON'T RECEIVE THE PAPER AND IF YOU'RE NOT ON SOCIAL MEDIA, THEN THAT'S THE ONLY OPPORTUNITY THAT YOU HAVE HAD AND I DON'T BELIEVE PERSONALLY THAT THAT IS FAIR TO YOU AND YOUR NEIGHBORS. SO I WANT TO THANK YOU FOR TAKING THE TIME TO COME OUT HERE ON THIS VERY FRESH DAY AND I DON'T KNOW. IF YOU TOOK A DAY OFF FROM WORK TO BE HERE BECAUSE IT'S VERY IMPORTANT, CLEARLY. I JUST WANT TO DO MY PART AS YOUR SITTING COUNTY JUDGE TO MAKE SURE THAT YOU GET ALL THEPD BECAUSE THIS IS -- WE ARE HERE FOR YOU. THIS IS YOUR COUNTY. THIS IS YOUR COURT.

WE ARE YOUR SERVANTS. SO I'M GOING TO ECHO BECAUSE IT'S NOT WASTED ON ME THAT I GOT UP AND DID THIS. I'M GOING TO ECHO MY REQUEST AND DO OUR VERY BEST TO MAXIMIZE THAT RESPONSE TIME, BECAUSE YOUR NEIGHBOR GETTING YESTERDAY AND YOU GETTING IT SATURDAY FOR A TUESDAY COURT. IT'S UNACCEPTABLE IN MY MIND. I'M NOT TRYING TO BEAT UP ANY OF THE STAFF HERE BECAUSE I AGAIN, I KNOW THEY ARE DOING -- THEIR PART THIS A PROCESS THAT EXISTS.

BUT I THINK IT'S TIME TO POTENTIALLY REINVEST IN THAT PROCESS, AND THANK YOU, SIR.

>> IS IT EXPECTED LEGAL NOTICE THROUGH THE MAIL, THROUGH CERTIFIED MAIL? HASN'T THAT BEEN THE CONVENTION IN TEXAS FOR MANY YEARS? THAT IS REALLY THE SURE WAY TO

[00:45:03]

APPROVE SOMEONE THAT'S BEEN NOTIFIED. >> SO MISS STRICKLAND CAN YOU IN THIS MOMENT JUST ROAD MAP FOR THE VIEWING PUBLIC, OUR MAIL NOTIFICATION PROCESS AND TIMING?

>> OF COURSE. SO ONCE WE HAVE CALLED FOR THE PUBLIC HEARING, WE NORMALLY WILL GET WITH THE NEWSPAPER NOTICE FIRST, AS THAT IS THE STATUTORY REQUIREMENT FOR OUR REGULATIONS, AND THEN WE'LL THE CERTIFIED MAIL. I SPOKE WITH MR. PACHECO WITH REGARDS TO THIS AND THERE'S A BIT OF AN ISSUE WITH THE NOTICE SO HE WAS A LITTLE DELAYED WHEN IT CAME TO CERTIFIED NOTICE. WE NORMALLY GET IT OUT TUESDAY AFTERNOON THAT WE CALL FOR THE PUBLIC HEARING, SO THIS ONE UNFORTUNATELY IS DELAYED AND IS NOT THE NORM, BUT WE ARE LOOKING INTO UPDATING OUR PUBLIC NOTIFICATION PROCESS FOR NEW KIND OF PROCESS, SO THAT ISING THAT WE'RE CURRENTLY WORKING ON INTERNALLY FOR THE NEW RURAL UPDATES REQUEST FROM THE

COMMISSIONERS. >> AND I DON'T WANT TO USE THIS OPPORTUNITY, AND THANK YOU, SIR.

YOU DON'T HAVE TO STAND THERE IF YOU DON'T WANT TO. >> THANK YOU FOR YOUR

CONSIDERATION. IT'S TOUGH TIMES FOR EVERYONE. >> YES, SIR, EXACTLY.

I APPRECIATE THE SYMPATHY YOU'RE CONVEYING BECAUSE I'M NOT INTERESTED IN RIBBING MR. PACHECO OR ANYONE YOUR OFFICE BUT I CONTINUE TO PRAISE YOUR DEPARTMENT.

YOU GUYS ALWAYS DO A GREAT JOB. PLEASE DON'T TAKE THIS LINE-UP IN AN ATTACK IN ANY BUT IT'S NOT ENOUGH WHAT YOU JUST SAID AND I WANT TO GET FURTHER DOWN INTO IT HOW WHAT ARE THE TIME LOINS THAT WE CAN SHARE WITH OUR NEIGHBORS ABOUT WHEN WE JUST CALLED. THAT'S WHY I OPENED 15.

WE JUST CALLED NOR AND YOU'VE SAID HISTORICALLY TYPICALLY, LATER TODAY WE'LL RUN IT IN THE PAPER. WE WILL PAY OR MOVE THAT PIECE IN MOTION KNOB THE PAPER.

WHAT ARE THE NEXT TWO PARTS THAT YOU'VE DESCRIBED? >> SO ONCE IT'S GONE HAD THE PAPER IT'S GONE THROUGH THE NEWSPAPER NOTICE TWICE, THEN THE CERTIFIED NOTICE FOR ALL THE CONTIGUOUS PROPERTY OWNERS GET SENT OUT TO EVERYBODY. SO THAT IS THE STANDARD PROCESS

THAT COMES FOR NOTIFICATION. >> OK. I'M STILL LOOKING FOR DATES.

SO TODAY. >> SO TODAY. >> HOLD ON A SECOND.

TODAY AGENDA ITEM NUMBER 15, WE JUST VOTED ON, HOLDING A PUBLIC HEARING.

WE JUST VOTED ON. SO IF YOU WILL COMPLETELY REPEAT YOUR STATEMENTS WITH TIME LOINS.

>> OF COURSE. SO BY THE END OF THIS AFTERNOON THE CERTIFIED NOTICE WILL BE PUT INTO ENVELOPES AND SENT OVER TO THE GOVERNMENT CENTER TO BE ADDRESSED AND SENT OFF.

SO THAT SHOULD BE OUT BY THURSDAY OF THIS WEEK, AND THEN THE NEWSPAPER NOTICE SHOULD BE PUT INTO THE NEWSPAPER PROBABLY END OF THIS WEEK, BEGINNING OF NEXT WEEK.

IT JUST DEPENDS ON THE NEWSPAPER ITSELF. DIFFERENT NEWSPAPERS HAVE DIFFERENT TIMELINES ON WHEN THEY WILL BE ABLE TO PUBLISH IT. SO SOME OF OUR LOCAL NEWSPAPERS HAVE TO HAVE THAT TWO-WEEK NOTICE TO GET THE TWO NOTIFICATIONS IN OR WE WOULD REQUIRE THAT THEY PUT IT INTO A DIFFERENT LOCAL NEWSPAPER SUCH AS THE AUSTIN AMERICAN STATESMAN BUT THAT NOW COSTS PEOPLE $200 EACH TIME TO PUT THAT NOTIFICATION IN.

SO WE NORMALLY TRY ONCE THE COURT HAS ACTUALLY CALLED FOR THE PUBLIC HEARING, BECAUSE THAT GIVES THEM THE LEGALITY TO MOVE FORWARD WITH CALLING FOR IT IN THE NEWSPAPER THAN WE SEND THAT NOTICE TO THAT LOCAL NEWSPAPERS. THOSE ARE THE ONES THAT PEOPLE ARE NORMALLY READING.

>> SO JUST TO REPEAT OFFER IS SLIGHTLY, THE NOTICE AWAS REFERENCED IN PUBLIC COMMENTS THAT WAS JUST RECEIVED SATURDAY BEEN AGENDA ITEM WE'RE VOTING ON TODAY.

THIS CALL ON AGENDA ITEM NUMBER 15 FOR A NOVEMBER 17TH PUBLIC HEARING, THAT NOTICE WILL GO TO

MAIL THURSDAY. >> IT WILL BE PROCESSED. IT WILL GO TO THE GOVERNMENT

CENTER TODAY AND THEN THURSDAY, IT WILL ACTUALLY GO OUT. >> IT WILL GO OUT FROM THE MAIL.

THAT SEEMS LIKE A GOOD AMOUNT OF TIME. I KNOW YOU APOLOGIZED FOR THIS NOTICE HAVING TO PICK UP OR DELAY, BUT USUALLY SPEAKING, SIR THAT NOVEMBER 17TH DATE OF THE PUBLIC HEARING FOR THE OTHER AGENDA ITEM. THAT NOTICE IS GOING TO HIT MAILBOXES PROBABLY THREE DAYS THURSDAY MORE OR LESS GIVING A MORE REAL OUT OFIC AMOUNT OF TIME -- AGENDA ITEM 16, WHICH IS WHY YOU'RE HERE. I WANT TO SHARE THAT PERSPECTIVE WITH YOU GUYS AND I THANK YOU AGAIN FOR DECLARING THE PROCESS AND HICCUP ON THESE AGENDA ITEMS

TODAY AND I THANK YOU FOR SPEAKING ABOUT IT SIR. >> I ASKED YOU TO SEND HER AN E-MAIL. ADJACENT PROPERTY OWNER? SHE'S JUST BECOME -- SHE'S

SPEAKING TO MARCOS RIGHT NOW. >> OK, THANK YOU. >> THANK YOU, SIR.

COMMISSIONER INGALSBE WE'LL START WITH YOU FOR ANY COMMENTS. >> NOS PUBLIC COMMENTS.

[00:50:08]

WE OPEN FOR PUBLIC COMMENTS ANY TO SPEAK FOR OR AGAINST. ONE MORE.

>> GOOD MORNING, JUDGE COMMISSIONERS. MY NAME IS JOHN THOMPSON SPEAKING ON BEHALF THE OWNERS LINDSEY AND PIERCE. WE'VE GONE THROUGH THIS PROCESS WITH THEM SINCE I BELIEVE WE SUBMITTED MARCH, AND I'M ALSO THE PROJECT ITEM 15 IS ALSO MY PROJECT. AS A GOOD EXAMPLE BY COMPARISON, WE'VE PUT UP A PUBLIC SIGN.

WE'VE SENT OUT CERTIFIED LETTERS AND WE'VE DONE A -- THE NEWSPAPER KNEW ALREADY FOR LOT 35. THOSE NEIGHBORS HAVE APPARENTLY CONTACTED COMMISSIONER SHELL WITH A BIT OF PREAGAINSTY. AND ON -- FREQUENCY. AND ON ROLLING OCCASION SECTION FOUR SUBDIVISION 7. NOT PUBLIC NOTICE BUT -- PUBLIC HEARING BUT NOTIFIED THE SIGNED PAPERS AND CERTIFIED LETTERS THE PROJECT WAS SUBMITTED. WHEN I SPOKE TO MR. PACHECO YESTERDAY WHEN THOSE LETTERS AND NOTICES SENT OUT MONTHS AGO THEY HAD NO RESPONSE OR COMMENTS FROM ANYBODY UNTIL THE E-MAIL WENT TO THE COUNTY JUDGE A FEW DAYS AGO ON THE RECENT ROUND OF THE COUNTY MAILED OUT FOR CERTIFIED ELECTION CALLING FOR THE PUBLIC HEARING.

AND THE THING WITH CERTIFIED LETERS IS THAT WHEN THEY ARE MAILED OUT, THE -- LETTERS -- THE POST OFFICE PUTS A NOTICE IN A BOX, WHETHER IT'S POST OFFICE MAILBOX OR WHATEVER THAT YOU HAVE A CERTIFIED LETTER WHICH MEANS YOU HAVE TO PHYSICALLY GO DOWN TO THE POST OFFICE AND COLLECT THAT. A LOT OF TIMES IN MY EXPERIENCE OVER THE LAST 20 YEARS WORKING WITH HAYS COUNTY, DRIPPING SPRINGS AND WIMBERLEY WE CAN HAVE CERTIFIED LETTERS AND USUALLY IT'S NOT UNCOMMON TO GET HALF OF THOSE BACK BECAUSE THEY GO UNCLAIMED.

WHEN I SEND THEM OUT FROM THE PRIVATE PRACTICE I USUALLY GET 30 TO 50% BACK BECAUSE BY THE TIME OF NOTICE GETS DELIVERED THE TIME GETS PERSON PICKED UP BECAUSE THEY WORK DURING POST -- AND THE POST OFFICE OPEN ISN'T OPENED LATER HOURS. SOME OF IT IS AN ISSUE OF WHEN THEY CAN GET DOWN TO PICK IT UP WHICH AT TIMES YEARS PAST I WOULD SEND A CERTIFIED LETTER AND FIRST CLASS LETTER BECAUSE AT LEAST I KNOW THE FIRST CLASS LETTER WOULD LAND IN THE BOX WITHOUT SPECIAL REQUIREMENTS TO PICK SOMETHING UP. JUST BY WAY OF BEING PROACTIVE, THE CONSIDERATION MAYBE THAT THE COUNTY MAY CONSIDER SENDING CERTIFIED LETTERS, CHECK THE BOX. THAT'S WHAT THE LAW SAYS. BUT EVEN THOUGH IT'S ANOTHER I DON'T KNOW WHAT THE POSTAGE STAM SUBPOENA NOW 42 CENTS, 50 CLENTS WHATEVER -- STAMP, 50 CENTS, WHATEVER. SEND IT FIRST CLASS SO IT ARRIVES IN THE MAILBOX WITHOUT HAVING TO DO A SPECIAL ACT TO PICK IT UP. THERE'S NO WAY TO TRACK IT, NO WAY TO PROVE IT WAS RECEIVED BUT AT LEAST YOU CAN SAY YOU CAN TRY TO GO ABOVE AND BEYOND THE

EFFORT THAT WAS REQUIRED TO DO A LITTLE BIT. >> THAT'S PERFECT SIR, AND I REALLY THANK YOU FOR CLARIFYING BECAUSE YOU CAN SEE MY CONCERN AND I REALLY, REALLY APPRECIATE WHAT YOU CONVEY. WHEN YOU SAY YOU SENT OUT THE NOTICES FOR LOT 35 AS YOU HAVE.

WELL DONE PERFECT, BECAUSE THAT'S WHAT YOU NEED. THAT'S WHAT YOU WANT I BELIEVE

AND YOU'RE DOING. >> IT'S REQUIRED. YOU HAVE TO DO THAT TO SUBMIT

REQUIREMENTS. >> SO I WANT TO DOUBLE BACK TO WHAT YOU SAID ABOUT WHAT YOU'VE DONE FOR LOT SEVEN. SO THE COUNTY SUBMITTED OUR LEGAL CHECK THE BOX, AS YOU'VE STATED REQUIREMENT TO NOTIFY THEM, CERTIFIED MAIL, BUT YOU ALSO SENT CERTIFIED MAIL TO THE

NEIGHBORS IS. >> YES. >> OK.

>> BECAUSE WE'RE REQUIRED TO. >> AND CAN YOU TELL ME WHEN YOU SENT THOSE OUT?

BALLPARK? >> OH, PROBABLY APRIL POSSIBLY. BECAUSE IT'S PART OF THE SUBMITAL REQUIREMENTS THAT WE HAVE TO SUBMIT THE CERTIFIED THE TO WHERE I GO DOWN AND DROP THEM OFF AT THE POFS OFFICE AND -- POST OFFICE AND THEY STAMP IT. I TAKE THE GREEN SHEETS AND SCAN THEM AND SEND THEM TO OFFICES. I BELIEVE WE SUBMITTED THEM IN MARCHAND THOSE NOTICES I THINK IF YOU'RE ASKING FOR A CLOSE GUESS IS PROBABLY MID-APRIL AND WOULD HAVE BEEN TO THE SAME INDIVIDUALS THAT WE ALL USE HAYS COUNTY -- THEIR PARCEL DATE AIS SORT OF THE BIBLE TO GO BY.

IT'S GARBAGE IN, GARBAGE OUT. GOOD ADDRESSES, BAD ADDRESSES, SOMETIMES NO ADDRESSES.

YOU GO THROUGH THAT. THAT'S YOUR LIST. YOU SEND IT TO THE PROPERTY OWNER NOT NECESSARILY RENTERS. AND THE OWNER SENDS THEM A COIN OF IT OR SOMETHING LIKE THAT.

AND AND SO THOSE NOTICES ONLY SAY WHEN THERE'S A SUBMITAL NOT DECLARING A CALL FOR PUBLIC HEARING OR ANYTHING LIKE THAT -- SUBMITAL. OF COURSE THE COUNTY SENDS OUT A

DATE CALLING HEARING. >> ANY QUESTIONS? I'M GOING TO CLOSE THE PUBLIC

[00:55:02]

HEARING. THANK YOU SIR. IS THERE ANYBODY HERE TO SPEAK FOR OR AGAINST THIS AGENDA ITEM? I'M GOING TO CLOSE THE PUBLIC HEARING.

COMMISSIONER I THINK WE'LL START WITH YOU. >> THANK YOU, JUDGE.

SHE ANSWERED SOME OF THE QUESTIONS. SOUNDS LIKE IT'S A STRANGE ONE ARE THE LETTERS GOT OUT SENT A BIT LATE. CAN YOU EXPLAIN TO US THE STATUTORY TIMELINES WE'RE WORKING WITHIN RIGHT NOW SO WE CAN GET AN UNDERSTAND OF THAT?

>> OF COURSE. SO THE STATE OF TEXAS HAS PUT COUNTIES UNDER THE NEW HOUSE BILL 3167 THAT STATES THAT ONCE A PROJECT HAS MOVED INTO THE ADMINISTRATIVE REVIEW, THAT THERE'S A 30-DAYTIME LINE THAT IT HAS TO BE APPROVED WITHIN, AND IT'S APPROVED, DENIED OR APPROVED CONDITIONS THAT THE COUNTY CAN MOVE FORWARD WITH. THIS PROJECT WENT INTO ADMINISTRATIVE REVIEW EARLIER THIS MONTH, SO WE ARE STILL WITHIN THAT 30-DAY ADMINISTRATIVE REVIEW TIMELINE. I WOULD LIKE TO NOTE THAT THE SUBDIVISION HAS MET ALL OF OUR ADMINISTRATIVE REGULATIONS, AND THAT IT DOESN'T -- IT'S NOT ASKING FOR ANY VARIANCES SO IT'S

MET OUR ENTIRE CODE. >> AND WHEN SINCE THIS IS A RAINWATER SUBDIVISION AND THE REASON THEY ARE GOING DOWN TO THIS DENSITY IS BECAUSE OF RAINWATER?

>> THAT IS CORRECT. >> WHAT RULES THERE THAT PROHIBIT THEM FROM DRILLING

GROUNDWATER WELLS IN THE FUTURE? >> SO THERE IS GOING TO AN ADDITIONAL PLAT NOTE ON THE CURRENT PLAT THAT IS SUBMITTED TO Y'ALL FOR APPROVAL. AND ONE OF THE RECOMMENDATIONS FROM THE NEIGHBORS IS TO UPDATE PLAT NOTE 16 OR A REQUEST IS TO STATE THAT INSTEAD OF THESE LOTS SHALL NOT INSTALL THE LIES GROUNDWATER WELLS UNTIL AN UPDATED WATER AVAILABILITY DEMONSTRATION IS APPROVED, DOCUMENTING SUFFICIENT GROUNDWATER IS AVAILABLE.

JUST REMOVING THE UNTIL AND UPDATED WATER AVAILABILITY DEMONSTRATION IS APPROVED.

SO THAT LOT OR PLAT NOTE 16 WILL STATE, THESE LOTS WILL NOT INSTALL OR UNITE LIES GROUNDWATER WELLS SO THAT WAY THEY CAN NEVER PUT A WE WILL ON ANY OF THESE LOTS INTO THE FUTURE UNLESS A SURFACE WATER PROVIDER GETS OUT TO ROLLING OCCASION, WHICH IS KIND OF A

PIPE DREAM OF THE YES. >> DO YOU KNOW? I KNOW WE HEARDED FROM MR. THOMPSON. DO YOU KNOW IF THE OWNERS THAT SUBMITED THIS WOULD BE WILLING TO WAIT IF WE WERE TO TABLE THIS FOR THE NEXT COMMISSIONERS COURT MEETING?

DO YOU KNOW HOW THAT WILL AFFECT THEIR TIMELINES? >> WE SPOKE WITH THEIR REPRESENTATIVE AND THEY STATED THAT IF THEY HAD TO MOVE TO THE NEXT AVAILABLE COURT DATE, THAT THEY WOULD NOT MAKE ANY CHANGES TO THE PLAT SINCE IT DOES MEET ALL OUR REQUIREMENTS.

>> SO THIS POINT OF THE GROUNDWATER WELL WOULD NOT BE CHANGED?

>> CORRECT. IT WOULD BE PLAT NOTE 16 WHICH WOULD STATE EXACTLY WHAT IT STATES CURRENTLY. IT WOULD BE NEAR TO IMPOSSIBLE TO FIND A GROUNDWATER -- PERSON, BUT SOMEBODY WOULD DOES THE GROUNDWATER AVAILABILITY STUDIES TO GO INTO WIMBERLEY AND STATE ONE-ACRE LOTS DO NEED TO HAVE A PRIVATE WELL. SO JUST REMOVING THAT LAST PIECE WILL ENSURE THAT THERE'S NO GROUNDWATER WELDS, BUT THE SCIENCE OUT ON WIMBERLEY DOES

NOT ALLOW FOR MORE WELLS TO BE ADDED. >> IS THAT THE COMMON NOTE FOR

16? >> IT'S THE COMMON NET DUE TO THE FACT THAT MOST DEVELOPMENT WE ASSUME THAT DWAUN WATER MAY OR MAY NOT CHANGE IN THIS PART OF THE COUNTY AND THIS PART OF TEXAS. THE EXCHANGE THAT THERE'S NORMALLY GOING TO BE LESS WATER NOT MORE WATER. SO THE SCIENCE NORMALLY MOVING TOWARDS LESS WATER.

BUT IF ONE DAY WE DO, OUR AQUIFER DOES RECHARGE, THEN THAT GIVES THEM THE OPPORTUNITY, BUT I DON'T SEE THAT THE AQUIFER RECHARGING IS GOING TO HAPPEN ANY TIME SOON.

>> DO YOU MIND IF WE HAVE THE CITIZEN BACK UP? >> OH, NO PLEASE.

>> WOULD YOU MIND? >> IF YOU'D PLEASE APPROACH THE PODIUM ONE MORE TIME, OUR COMMISSIONER THAT PRESIDES OVER THAT PRECINCT WOULD LIKE IT ASK YOU A FEW QUESTIONS.

>> I APPRECIATE Y'ALL HEARING ME. >> I KIND OF JUST WANTED TO GET YOUR OPINION ON WHAT WE JUST HEARD ABOUT THAT, THAT 16 NOTE ON THE GROUNDWATER WELLS, BECAUSE THAT IS VERY IMPORTANT TO US AS WELL. WE -- THE PART OF THE RULES THAT DEVELOPERS ARE ABLE TO USE TO GET TO ONE-ACRE LOTS OR CLOSE TO ONE ACRE LOTS IS THAT THEY HAVE TO USE WATER ESPECIALLY THAT PART OF THE COUNTY. THE CHANGE OF THAT RULE 16 TO SAY THAT GROUNDWATER WELLS WOULD NOT BE ABLE TO BE USED. I WAS WONDERING SINCE DID YOU BRING THAT UP WHAT YOUR OPINION WAS ON THAT WORKS THAT SATISFY YOUR CONCERN ON THE POTENTIAL

FUTURE USE OF THE GROUNDWATER RULE. >> IF THAT NOTICE IS AMENDED TO AVOID ANY MISUNDERSTANDING A POTENTIAL FIRE MIGHT HAVE ON THE CHANCES OF GETTING WATER.

[01:00:06]

ON THE FACE OF IT THE SIZE OF THE RAINWATER COLLECTION DEVICE TO PROVIDE WATER OF A FAMILY OF DMOUR TIMES FIVE IS MASSIVE. IT COMES UP WITH HUNDREDS OF THOUSANDS OF GALLONS PER YEAR.

THE SIZE THE EXACT CONCRETE IS A THOUSAND SQUARE FOOT LIKE THE SIZE OF THE -- WOULD YIELD 50 GALLONS. IF ANYONE HAS HAD A WATER WELL OR YOU KNOW YOUR WATER USAGE, THAT'S NOT GOING TO MAKE IT. SO THEY ARE GOING TO BE FORCED TO THIS SITUATION WHERE THEY WILL USE THEIR HOME WATER OR HOPING IMPROPERLY -- I'M NOT SAYING THAT'S GOING TO HAPPEN.

BUT THEY COULD BE MISLED.

THERE'S A STUDY PRESENT. IF THERE'S A STUDY HELD OUT THERE'S THE POSSIBILITY SOMEONE COULD -- WON'T BE PERMITTED ON A LOT LESS THAN TWO ACRES. TO DO HAT ALL I'M ASKING IS TO MAKE A SIMPLE NOTE CHANGE SO THERE'S NO HEARTACHE OR NO FURTHER, YOU KNOW EXPECTATIONS AND HOME OWNERS THAT ARE JUST -- I MOVED FROM SAN ANTONIO, WHERE WE HAD CARPET GRASS.

PEOPLE STILL COME OUT TO THE COUNTY AND EXPECT TO WATER THEIR YARD.

UNAMBIGUOUS. I WOULD BE UNOPPOSED. >> OKAY.

I APPRECIATE YOU COMING IN. I APOLOGIZE ON BEHALF THE COUNTY.

>> IT'S TOUGH TIMES FOR EVERYONE. >> WE'LL GET THAT CLEANED UP.

I APOLOGIZE. >> I'M RETIRED NOW SO IT'S MY DUTY TO DO THESE THINGS.

MELISSA IS AWARE OF IT AND I ASKED YOU TO SEND YOU AN E-MAIL. SHE'S AN ATTORNEY.

SO SHE CAN TALK TO YOU ABOUT IT. THAT WAS MY POINT TO MAKE AN UNAMBIGUOUS NOTE -- SEPTIC SYSTEMS. I DIDN'T KNOW WHETHER THAT DEFINITION MEANT AS LONG AS THAT

COULD BE IMPROVED INSTEAD OF CONVENTIONAL. >> OK.

THANK YOU, SIR. APPRECIATE YOUR TIME. CAN WE MAKE THIS CONTINGENT

UPON THE CHANGING OF THAT PLAT NOTE? >> YES, WE CAN DO APPROVE WITH CONDITIONS WHICH WOULD ALLOW US TO UPDATE THAT PLAT NOTE FOR LOT 16 OR PLAT NOTE 16 TO STATE THESE LOTS WILL NOT INSTALL OR UTILIZE GROUNDWATER WELLS. WE'VE DISCUSSED WITH THAT PROPERTY OWNER, AND THEY SAID THEY ARE AMENABLE TO THAT CHANGE.

WITH REGARDS TO HIS COMMENT ABOUT ADVANCED SEPTIC SYSTEMS THAT IS ALSO IN PLAT NOTE NUMBER 15. ALL LOTS IN THE SUBDIVISION ARE RESTRICTED TO ADVANCE SUBSERVICE DISPOSAL ON SITE TO THE FACILITY. SO THERE COULD BE A CONVENTIONAL SYSTEM THERE. IT'S GOING TO BE ALL BELOW GROUND ADVANCED SYSTEMS THAT ARE

REQUIRED TO HAVE MAINTENANCE CONTRACTS WITH THE COUNTY. >> OKAY.

UNDERSTANDIG THAT HERE WOULD BE UP TO THE OWNER TO CHANGE A PLAT NOTE 16.

I THINK THAT IS DEFINITELY WORTH OUR WHILE TO CONSIDER THAT AT THIS TIME.

I DO APOLOGIZE TO THE NOTICE BUT I WOULD LIKE TO TAKE ADVANTAGE OF MAKING SURE NO WELLS ARE DRILLED ON THIS PROPERTY. SO I'LL MAKE A MOTION FOR APPROVAL BASED ON THE

CONTINGENCY OF CHANGING ON PLAT NOTE 16. >> THAT IS -- I'M SORRY.

THAT IS APPROVED WITH CONDITIONS TO AMEND PLAT NOTE 16 TO MAKE SURE THAT IT IS CLEAR THAT NO

WELLS WILL BE DRILLED IN THE FUTURE. >> CORRECT.

ON THE COMMENTS PART OF THIS FROM THE COURT I WANT TO ADD A COMMENT AND I JUST SAW THIS, COMMISSIONER SMITH, AS WITH. I'VE BEEN PRIVILEGED, BLESSED AND GREAT TO HAVE PURCHASED A HOME BEFORE. AND THE STACK OF NAPES GO WITH IT -- PAPERS THAT GO WITH IT THAT REQUIRE SIGNATURES. I WOULD LIKE TO IF THERE'S A WAY TO DOUBLE DOWN IN COMMUNICATION TO THE FUTURE OWNERS OF THIS PROPERTY, TO FIND SOME WAY TO IN RED PRINT I DON'T KNOW BOLD EYE TAL SIZED TO SIGN SOMETHING THAT THESE SHE KNOW NO WELLS ARE ALLOWED ON THE PROPERTY.

I THINK THAT WOULD BE A REALLY GOOD THING IF THERE SOME KIND OF POSSIBILITY POINT SO WE'RE NOT HAVING PITCHFORKS IN FRONT OF THE COURTHOUSE STEPS SAYING WEP. WE HAVE A RIGHT TO WATER.

IT'S UNDER MY LAND AND ALL THE OTHER ANGALS THAT COULD BE BROUGHT UP.

I'D LIKE TO JUST REITERATE THE COMMITMENT FROM THE PROPERTY OWNERS AND THE COUNTY'S

[01:05:08]

CONDITION TO FIND SOME WAY TO BE HIGHLIGHTED. >> SBOOEC MR. THOMPSON AFTER

COURT. >> THANK YOU. COMMISSIONER?

>> I WAS JUST GOING TO COMMENT BUT SAY THAT SINCE IT DOES FALL UNDER OUR CURRENT REGULATION AS IT'S SUBMITED WITH NO VARIANCES WE ALSO HAVE A DUTY TO APPROVE IS, THAT NOT CORRECT?

>> CORRECT. IT MEETS ALL OF OUR CURRENT RULES AND REGULATIONS AND THE COUNTY NORMALLY ADMINISTRATIVELY REQUIRED TO APPROVE SUBDIVISIONS THAT MEET THOSE RULES.

>> THANKS. AND AGAIN, I APPRECIATE THE COMMISSIONER LISTENING TO THE CONCERNS TO THE CONSTITUENT. I DO HAVE OUR PORTION OF THE COUNTY HAS A LOT AND WE'RE GOING TO HAVE A WHOLE LOT MORE THE ONE THING WE ARE INTIMATELY AWARE OF AND HOPEFULLY MOST OF OUR TITLE COMPANIES ARE AWARE OF IS, THAT WHENEVER THEY ESPECIALLY THOSE THAT WORK IN THE WIMBERLEY DRIPPING SPRINGS AREA, WHENEVER THEY GET PLATS LIKE THIS, THIS PLAT THAT WE'RE LOOKING AT WILL BE INCLUDED THAT PACKET. IN ORDER FOR THEM TO GET -- TO GET TITLE INSURANCE AND THOSE KIND OF THINGS, THIS WILL HAVE TO BE REVIEWED. IF THERE IS A DISCLOSURE PURCHASE ON THAT, THAT WOULD BE VERY PROBLEMATIC FOR NOT ONLY THE PURCHASER BUT THE SELLER AS WELL AS THE TITLE COMPANY. SO JUST THROUGH THE SYSTEM THAT THERE ARE SEVERAL NUMBERS OF CHECKS THAT HAVE TO BE DONE AND THANKFULLY NOT ONLY DO WE HAVE TO ENFORCE THOSE, BUT THERE ARE SOME PETTY SIGNIFICANT FINANCIAL BURDENS IF THOSE ARE NOT MET.

SO I THINK THAT'S GREAT. >> JUDGE? EXCUSE ME REAL QUICK COMMENT.

PARDO ME. I JUST WANT TO THANK PERFECT TRIPTON FOR COMING OUT -- MR. TRIPTON. I APPRECIATE IT. AND I APPRECIATE ANY REVISIONS TO OUR SUBDIVISION RULES AND REGULATIONS THAT WILL HELP US IMPROVE OUR PROCESSES.

SO THANK YOU FOR BRINGING THAT UP AND I LOOK FORWARD TO SEEING THOSE IN THE FUTURE.

>> I AGREE WITH MR. THOMPSON'S COMMENT TOO THAT IF THERE IS A WAY IT SEND FIRST CLASS MAIL WE'RE TALKING 50 CENTS A PIECE AND PAPER. AND YOU GET THE THING IN YOUR MAILBOX YOU DON'T SEE WHAT IT IS YOU WAIT TO PICK IT UP IT WOULD BE NICE TO DOUBLE IT UP WITH THE

MAILBOX. >> MOVING FORWARD YOU'LL GET UNCERTIFIED POSTAGE IN ADDITION

TO CERTIFIED? >> YES, SIR. >> PERFECT, THANK YOU.

ARE THERE ANY OTHER COMMENTS? >> YES. I JUST CHECKED THE E-MAILS AND WE AVEN'T RECEIVED ANYTHING SO THE PROPERTY OWNER MAY HAVE SENT IT TO THE JUDGE BUT PROBABLY

WANT TO SEND IT TO COMMISSIONER SHELL ALSO. >> I THINK WE'VE ADDRESSED THE CONCERN AT THIS POINT IN TIME SO I THINK RECOVERED ANY WAY? I THANK YOU AGAIN FOR COMING OUT. THIS IS YOUR COMMUNICATE. WE ARE YOUR REPRESENTS AND WE TAKE EVERYTHING YOU SAY SERIOUSLY AND IT'S IMPORTANT TO US.

I KNOW THE DISTRICTS ANXIOUS TO GET THIS. THE EXAMPLE WITH THE MONEY HAYS IS RECEIVING THEY CAN BUY THE DEVICES THEY NEED. IT'S A BIG HELP AND I THINK IT'S

A GOOD USE FOR THEIR FUND. ANYTHING YOU WANT TO ADD. >> IF YOU PLEASE APPROACH THE PODIUM AND GIVE US AN ADDITIONAL -- THANK YOU COMMISSIONER FOR THAT HIGHLIGHT, IF YOU PLEASE GIVEN US ADDITIONAL INFORMATION AND INTRODUCE YOURSELF FOR THE RECORD.

AND I KNOW I'LL ADD A LITTLE BIT TO THIS. MIKE, I KNOW THAT WE'VE TALKED ABOUT THIS IN THE PAST. WE HAVE FOR THE COMMUNITY WATCHING, WE HAVE DIFFERENT SEGMENTS OF BLOCKS OF COVID MONEY THAT IS FOR OUR USE IN OUR COMMUNITIES.

AND THEY ARE DOLED OUT IN CERTAIN PERCENTAGES AND CONSUMPTION RATES AND THEN YOU GET TO GO TO THE NEXT PART. I KNOW EARLY ON AS SOON AS I HEARD ABOUT THIS MONEY COMING OUR WAY I KNOW THAT WE TALKED ABOUT ALSO WORKING ON AND I BRING THIS UP BECAUSE I WANT TO GIVE THIS A HEADS-UP FOR THE COMMUNITY. WE HAVE BEEN WORKING ON THE RENTAL ASSISTANCE PART OF THIS, AND OTHER COMMUNITY SERVICE PIECES THAT I DON'T WANT TO SOUND LIKE I'M STEALING IDEAS, BUT WE DIRECTLY BORROWED IT FROM FORT BEND COUNTY KP GEORGE, THE COUNTY ZWR PUDGE FORT BEND COUNTY HAS BEEN VERY INSTRUMENTAL -- COUNTY JUDGE FROM FORT BEND -- WITH THAT PIECE OF EVOLUTION. THAT IS IN THE WORKS AND SHORTLY COMING IDEALLY AFTER THIS. I KNOW THAT WE HAVE BEEN MOVING IT AROUND AND WE GOT TO HIT CERTAIN PERCENTAGES OF USES BEFORE WE CAN EVEN TALK ABOUT IT THIS.

AGENDA ITEM ADDRESSES THAT. SO WE'VE REACHED A THRESHOLD AND NOW WE GET TO OPEN UP TO DO OTHER THINGS, SO NOW THAT THAT CONVERSATION CAN MOVE ALONG AND NO LONGER SIT AS IT'S HAD TO.

SO I JUST WANTED TO POINT THAT OUT. IF YOU WANT TO PROVIDE ANY INFORMATION OR UPDATE ON THAT AS WELL BUT YOU DON'T HAVE TO.

>> THAT'S RIGHT. YOU CONTINUOUSLY HAVE DONE A GREAT JOB AND I THANK YOU, SIR.

>> ALSO WANT IT THANK MIKE AND TAMMY FOR WORKING ON THIS, BUT MAKE SURE WE CROSS ALL THE TS AND DOT THE IS TO MAKE SURE WE GET THE REIMBURSEMENT AND PROPER FUNDING.

OK. THANK YOU. >> YES, THE ISBS WILL EACH GIVE US THEIR ROAD MAP OF HOW THEY PLAN ON USING THE MONEY AND WE'LL MAKE SURE THAT WE'LL EXECUTE IT EFFECTIVELY WHICH WE KNOW WE HAVE HIGH FAITH HAD THEM AND THEY WILL BUT THAT'S EXACTLY RIGHT. IT'S A GOOD ARTICULATION. COMMISSIONERS ANY FINAL COMMENTS
