I AM A NATURALLY CURIOUS PERSON, SO WHEN I HEARD THAT THERE WAS AN AMAZING OPPORTUNITY TO PARTIALLY FUND A PUBLIC DEFENDERS OFFICE IN HAYS MY FIRST THOUGHT WAS WAIT, THERE'S NOT ALREADY A PDO IN HAYS? I HAD TO FIND THE MORE.

FOLLOWING THAT CURIOSITY LED ME HERE FOR THE FIRST TIME A FEW WEEKS BACK WHERE I FOUND OUT FAIRLY QUICKLY THAT THE OPPORTUNITY TO ACCESS THAT GRANT FROM THE TDIC HAD BEEN PASSED OVER BY THIS BODY. THAT MADE ME SUPER CURIOUS. WHY WOULD WE TURN DOWN FREE MONEY THAT COULD HELP US GET A BETTER HANDLE ON OUR CRIMINAL LEGAL SYSTEM HERE IN HAYS.

I WENT BACK TO THE DISCUSSIONS HERE AROUND THE GRANT AND WATCHED COMIG COMMISSIONERS SPEAK ABOUT ALL THE OTHER GREAT IMPROVEMENTS HERE IN THE SYSTEM, BUT HEAR THAT THE PDO GRANT WASN'T REALLY NECESSARY. SO YOU CAN IMAGINE HOW CURE YULS I WAS TO SEE MR. MAO IN COURT TWO WEEKS AGO ASKING FOR HIS 81ST EMPLOYEE, AN ATTORNEY HIRED SOLELY TO STAND FOR THE STATE DURING THE NEW MAGISTRATION STUDY BEING CONDUCTED, A PROCESS WHICH I'LL NOTE THAT MR. MAO'S OFFICE HAD NO INTEREST IN PREVIOUSLY. I THINK THAT'S CURIOUS.

TRYING TO BETTER UNDERSTAND ALL THESE CURIOUS THINGS I CROSS THE MARCH 24TH MEETING WHERE MR. MAO GOT IMMEDIATE AND UNQUESTIONED APPROVAL FOR TWO ADDITIONAL STAFF ATTORNEYS.

I HAVEN'T BEEN COURT WATCHING FOR LONG, BUT MR. MAO HAS ADDED THREE NEW ATTORNEYS IN AS MANY MONTHS WITH LITTLE OR NO QUESTIONING FROM THE COMMISSIONERS AND THE PUBLIC.

I THINK THAT'S CURIOUS. ESPECIALLY WHEN YOU CONSIDER THAT MR. MAO IS SOLE ANY CHARGE OF HIS OFFICE'S WORKLOAD. HE ALONE GETS TO DECIDE WHAT DOES AND DOES NOT GET PROSECUTED WHICH MEANS HE HAS CREATED A PERFECTLY DESIGNED SELF-CONTAINED WORK-GENERATION DEVICE FOR HIMSELF. ONE, CHOOSE TO PROSECUTE EVER MORE OFFENSES.

TWO, OVERLOAD YOUR CURRENT STAFF. THREE, COME TO COURT AND ASK FOR MORE STAFF. FOUR, GET UNQUESTIONED APPROVAL. FIVE, RINSE AND REPEAT.

AND YET WE ARE TOLD THAT THINGS ARE GOING SWIMMINGLY IN THE SYSTEM IN A PUBLIC DEFENDERS

OFFICE ISN'T REALLY NECESSARYS WE HAVE A GREAT COURT-APPOINTED ATTORNEY SYSTEM WHICH WE SPEND AROUND $2 MILLION A YEAR ON FOR INDIGENT DEFENSE. THAT WE JUST DON'T REALLY NEED A DEDICATED OFFICE FOR DEFENSE THAT WOULD BE THE ANALOG OF OUR PROSECUTOR'S OFFICE.

AND THAT IS ALL TRUE. NO ONE IN THIS ROOM NEEDS THAT OFFICE.

BUT THERE ARE LITERALLY HUNDREDS OF HAYS CITIZENS SITTING THROUGH THEIR TENTH OR 8 09SDS OR 280TH DAY OF DETENTION WHO CLEARLY DO NEED THAT OFFICE -- 80TH. I THINK THEY WOULDBE CURIOUS WHY YOU THINK THEY DON'T DESERVE IT. WHY IS IT THAT WE HAPPILY FUND AND SUPPORT THE STRUCTURES OF PROSECUTION AND INCARCERATION BUT REFUSE TO BRING OUR DEFENSE SERVICES INTO THAT SAME ALIGNMENT? I FIND THAT SO CURIOUS.

THIS PAST MONTH I'VE HAD THE PRIVILEGE OF OBSERVING THE PROCEEDINGS OF THIS COURT.

MY OBSERVATION HAVE LED ME TO BELIEVE THAT IT MAY BE POSSIBLE THAT YOU'RE OPERATING UNDER A FALSE ASSUMPTION. THIS MORNING I'D LIKE TO TAKE THE TIME TO CLEAR THAT UP FOR YOU. I UNDERSTAND THAT WHEN EACH OF YOU TOOK YOUR OATH OF OFFICE YOU PLEDGED TO THE BEST OF YOUR ABILITY TO PRESERVE, PROTECT AND DEFEND THE CONSTITUTION AND LAWS OF THE UNITED STATES AND THE STATE OF TEXAS. I BELIEVE YOU TOOK THIS OATH ALSO WITH THE INTENT TO REPRESENT AND PROTECT THE CITIZENS OF HAYS COUNTY.

THIS IS I BELIEVE THERE MAY BE A MISUNDERSTANDING. REGARDING WHO WE NEED PROTECTION FROM. AS A CITIZEN OF HAYS COUNTY, I'D LIKE TO MAKE IT PERFECTLY CLEAR TO YOU AND TO EVERYONE IN THIS COURTROOM THAT I DO NOT FEEL MY SAFETY OR THE SAFETY OF MY FAMILY IS THREATENED OSH HAS EVER BEEN THREATENED BY INDIVIDUALS COMMITTING THE FOLLOWING OFFENSES. TRAFFIC VIOLATIONS, VIOLATIONS OF CITY ORDINANCES, CLASS-C MISDEMEANORS OR POSSESSION OF LESS THAN TWO OUNCES OF MARIJUANA.

TO BE CLEAR, EVERY ONE OF THESE INDIVIDUALS HAS BROKEN THE LAW. EVERY ONE OF THESE INDIVIDUALS NEED TO BE HELD RESPONSIBLE FOR THEIR ACTIONS OR INACTIONS. AND SEE THAT THEY LINE WITH THE LAWS THAT GOVERN OUR CITY AND COUNTY. HOWEVER, I WANT YOU TO HEAR IT DIRECTLY FROM THIS HAYS COUNTY CITIZEN THAT I DO NOT NEED YOU TO PROTECT ME FROM THESE CITIZENS. THEY DO NOT BELONG IN JAIL. THEY BELONG AT HOME BACK AT THEIR JOB, AND EVEN BETTER, IN PROGRAMS THAT WE CAN CREATE THAT SERVE OUR COMMUNITY.

IN THE PAST WEEKS WE'VE QUOTED FOR YOU BUDDHIST MONKS, MARTIN LUTHER KING, AND THE TEXAS STATE CONSTITUTION. I'M NOT SURE ANY OF THESE WORDS HAVE RESONATED WITH YOU, SO TODAY ALLOW ME TO SHARE THE WORDS USED BY TEXAS SUPREME COURT JUSTICE NATHAN HECK.

IT IS TIME. IT IS ACTUALLY PASTIME ENSURE THAT DEFENDANT WHO'S POSE NO RISK TO THE PUBLIC ARE NOT JAILED. AND THOSE WHO DO ARE.

THEY NEED TO FIX THAT. I KEEP GETTING CALL AFTER CALL ABOUT THE SAME STUFF.

THESE INDIVIDUALS BEING WRITTEN UP FOR TICKETS, INCARCERATED, CARS IMPOUNDED AND THEIR OFFENSES SHOULDN'T HAVE THAT DISPOSITION. THEY SHOULDN'T BE IN JAIL.

AND THEN THEY GET LOCKED UP IN THE SYSTEM. LIKE THAT INDIVIDUAL THAT THEY HAVE BEEN PROFILING ON FACEBOOK MR. LOZANO NOW HAS COVID-19, BEEN 200 SOME DAYS IN FORT BIN COUNTY. THAT COMMISSIONER JONES, I REMEMBER A WHILE BACK WHEN THEY HAD THAT LADY THAT DID SOME TIME FOR HAD A HOT CHECKALITY HB, THAT REALLY HAPPENED IT.

AFTER A LONG PAUSE COMMISSIONER SHELL SAID SOMETHING TO THE EFFECT THAT WHEN HE HAD HIS HOME AC REPLACED, HE BELIEVED THAT THE CONTRACTOR MARKED UP THE PRICE OFS UNIT.
