[CALL TO ORDER]

[00:00:09]

I SEE OUR COMMISSIONER UP THERE, LOOKING GOOD. OKAY, ONE OF THE MOST IMPORTANT THINGS FOR ME TOO TELL YOU IS I TRIED MY BEST TO STICK TO A TIMELINE AND THAT'S WHY WE ARE CALLING THIS MEETING TO ORDER RIGHT AT 9:00 A.M. OUR INVOCATION WILL BE THE REFERENCE FROM SEVENTH-DAY ADVENTIST CHURCH. IF YOU WOULD ALL RISE.

>> I WOULD LIKE TO READ FROM PAUL WHO SAID PEACE I LEAVE WITH YOU, MY PEACE I GIVE TO YOU.

NOT AS THE WORLD GIVES DO I GIVE TO YOU. DO NOT LET YOUR HEART BE TROUBLED NOR LET IT BE FEARFUL. LET'S PRAY. FATHER, GOD, THANK YOU FOR THE PROMISE THAT IN THE MIDST OF ANY CHALLENGE YOU OFFER US YOUR PEACE.

LORD WE ASK THAT THIS MORNING YOUR HOLY SPIRIT GRANTS ALL OF US THE PEACE AND THE FORTITUDE NEEDED TO CAST OUT FEAR THAT WE MAY CONTINUE TO MAKE THE BEST DECISIONS AND CONTINUE TO TAKE THE BEST ACTIONS TO SERVE AND PROTECT EVERY PERSON IN OUR COUNTY, IN OUR COUNTRY AND IN THIS WORLD. LORD WE ASKED FOR ALL OF THIS IN THE NAME OF JESUS CHRIST, AMEN.

>> AMEN. >> I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA. AND TO THE REPUBLIC FOR WHICH IT STANDS ONE NATION UNDER GOD INDIVISIBLE WITH LIBERTY AND JUSTICE FOR ALL. HONOR TEXAS FLAG, I PLEDGE ALLEGIANCE TO THE. TEXAS, ONE STATE UNDER GOD, ONE AND INDIVISIBLE.

>> AND PLEASE CALL THE ROLL.

[PUBLIC COMMENTS]

THOSE IN THE AUDIENCE WHO HAVE SUBMITTED A PUBLIC PARTICIPATION FORM WILL NOW HAVE THREE MINUTES TO SPEAK ON NON- AGENDA RELATED TOPICS. UNFORTUNATELY NO ACTION MAY BE TAKEN BY THE COURT AS WE ARE EXPECTED NOT TO RESPOND. ANY QUESTIONS WILL BE TAKEN AS RHETORICAL. PLEASE KEEP YOUR COMMENTS AND LANGUAGE CIVIL AND RESPECTFUL OR YOU WILL FORFEIT THE REMAINDER OF YOUR TIME. IN THE SPIRIT OF RESPECT PLEASE SILENCE YOUR CELL PHONES. FIRST UP TO SPEAK, WE HAVE MR.

>> THANK YOU JUDGE, COMMISSIONERS, A COUPLE THINGS I WAS JUST WANTED TO LET YOU KNOW LAST TIME WE WERE HERE FOR THE COMMISSIONERS COURT MEETING IT WAS PRETTY, WE NOTICED THAT THE JUDGES ADMINISTRATIVE ASSISTANT WAS WORKING ON THE TECHNOLOGY STUFF.

WE WERE JUST WONDERING SINCE YOU ALL DO HAVE TECHNOLOGY DEPARTMENT, WHY IS THIS ADMINISTRATIVE ASSISTANT WORKING ON IT. JEFF OVER HERE AND HIS PEOPLE, ARE THEY RESPONSIBLE FOR THAT? IT SEEMS LIKE THAT'S QUITE A BIT OF AN ONGOING THING SO IF WE COULD IMPROVE ON THAT WE'D APPRECIATE IT. THE OTHER THING WHEN I WAS SITTING OUTSIDE, I NOTICE THOSE LIGHTS BY THE FLAG, IT WAS 740 WERE STILL ON.

THAT'S A WASTE OF ENERGY. AS TAX PAYERS WE'D LIKE YOU TO BE MORE RESPONSIBLE WITH OUR TAX DOLLARS. SO COMMISSIONERS, AS FAR AS THE COUNCIL, THE OFFICE OF LEGAL COUNSEL, WE BEEN FILING OPEN RECORD REPORTS, REQUESTS, THEY'RE NOT BEING SENT BACK IN A TIMELY MANNER. THE LAW SPECIFIES TEN DAYS UNLESS YOU HAVE SOME STUFF THAT HASN'T BEEN DISPOSED OF. A FRIEND OF MINE WANTED TO ASK ABOUT THAT $25000 THAT THE JUDGES GET PAID BACK IN NOVEMBER AND STILL NO ANSWER. WERE JUST WONDERING WHAT THE STATUS IS OF THAT. I HATE THAT IT HAS TO COME TO THIS FOR ME TOO COME UP AND ASK, BUT IF THAT'S WHAT IT TAKES, THAT'S WHAT I WILL DO BECAUSE THE RULES ARE VERY SIMPLE AND WHEN YOU'RE IN THAT POSITION YOU NEED TO HONOR THOSE RULES. AGAIN, I DON'T EVEN KNOW WHERE TO START COURT. I'VE GOT SO MUCH GOING ON. I CAME LAST WEEK AGAIN, PERSONAL MATTER INVOLVING SOME ISSUES WITH LEGAL COUNSEL. I CALLED, I'VE BEEN BY SEVERAL

[00:05:06]

TIMES AND THERE'S STILL NO RESPONSE. EVERYTHING IS SUPPOSED TO BE DONE IN A TIMELY MANNER AND IT'S NOT HAPPENING SO I JUST WANTED TO LET YOU ALL KNOW THAT SOMETHING NEEDS TO BE DONE ABOUT THAT BECAUSE MY REQUEST, I CAME IN LAST WEEK, I TAKE TIME, I PARK I'M A BUSY PERSON. I MANAGE A BUSSING COMPANY AND I HAVE TO REARRANGE MY SCHEDULE AND THEN I COME APPEAR AND IT REALLY MAKES ME FEEL BAD WHEN I COME UP HERE AND THE OFFICES ARE CLOSED OR WHATEVER NEEDS TO BE DONE ISN'T DONE LIKE IT'S SUPPOSED TO.

I GET TO USE THE THREE MINUTES I HAVE APPEAR TO BRING UP THOSE ISSUES AND HOPEFULLY WE CAN FIX

THEM. THANK YOU. >> THANK YOU.

NEXT UP TO SPEAK WE HAVE MR. DION LIEN. DAN LIEN.

>> THANK YOU JUDGE IN COUNTY COMMISSIONER. LET ME SAY I AM THE ORIGINAL SOCIAL DISTANCE ARE. WOMEN HAVE REMAINED AT LEAST 6 FEET AWAY FROM ME ALL OF MY LIFE. I WOULD FIRST OF ALL LIKE TO THINK MY HEAVILY FATHER WITHOUT WHOM NONE OF US WOULD EXIST, AND SECONDLY PSALM 91 IS MY GUARANTEE THAT I HAVE PROTECTION FROM FEAR. FURTHERMORE I WOULD LIKE TO THANK ATTORNEY GENERAL KEN PAXTON FOR ISSUING A MORATORIUM ON ABORTION WHICH, IN MY OPINION HAS BROUGHT THIS CURRENT CURSE OF THE CORONAVIRUS ON OUR COUNTRY. WHILE MANY GOVERNMENT OFFICIALS TELL US WE HAVE BRILLIANT SCIENTISTS AND BIOLOGISTS WHO WILL SOLVE THE PROBLEM, THE TRUTH IS THIS PROBLEM WILL NOT BE OVER UNTIL THE CREATOR SAYS IT'S OVER.

ON MARCH 15, AN ORDER WAS ISSUED BY THE COUNTY, ACTUALLY BY THE COUNTY JUDGE WHICH STRONGLY SUGGESTED, BUT DID NOT REQUIRE BUSINESSES TO CLOSE THEIR SEATING AREAS.

LET ME READ A FEW THINGS FROM THIS ORDER. FOR PURPOSES OF THIS ORDER, IT SAYS, QUOTE, COMMUNITY GATHERING IS ANY OUTDOOR EVENT OR CONVENING SUBJECT TO THE EXCEPTIONS AND CLARIFICATIONS BELOW THAT BRINGS TOGETHER OR IS LIKELY TO BRING TOGETHER TEN OR MORE PERSONS TOGETHER IN A SINGLE ROOM OR OTHER CONFINED SPACE SUCH AS AN AUDITORIUM, THEATER, STADIUM, INDOOR OR OUTDOOR ARENA OR EVENT CENTER. MEETING HALL, CONFERENCE CENTER OR ANY OTHER CONFINED INDOOR OR OUTDOOR SPACE. FOR CLARITY THIS INCLUDES BUT NOT LIMITED TO WEDDINGS, RELIGIOUS GATHERINGS, PARTIES, FUNERALS, SPORTING EVENTS, SOCIAL EVENTS, CONFERENCES AND OTHER LARGE GATHERINGS. ALL RIGHT.

NOW THE FIRST AMENDMENT GUARANTEES US, OR DEFINES FOR US THE RIGHT TO PEACEABLY TRADE PEACEFULLY ASSEMBLE. I'VE NOTICED THIS ORDER IS A DIRECT ATTACK ON THAT.

NOT ONLY THAT, MANY PEOPLE WILL WANT TO HAVE GATHERINGS OF FAMILIES FURTHER EASTER CELEBRATION THIS YEAR. ACCORDING TO THIS ORDER YOU CAN'T HAVE TEN OR MORE PEOPLE IN A ROOM. I'M SORRY, THIS STOP HAS GONE TOO FAR.

LET ME EXPLAIN WHAT THIS IS REALLY ALL ABOUT. THIS ORDER IS SO THE COUNTY CAN GET MONEY FROM THE FEDERAL GOVERNMENT AS WELL AS THE STATE GOVERNMENT AND THEY'RE WILLING TO STEP ALL OVER OUR CONSTITUTIONAL RIGHTS TO DO THAT.

NOW, LIKE MR. MAIA, I HAVE MANY MORE THINGS TO SAY BUT I GUESS IT WILL HAVE TO WAIT.

THANK YOU VERY MUCH. >> THANK YOU VERY MUCH. >> THAT CONCLUDES OUR PUBLIC COMMENTS. IF SOMEONE HAS COME INTO SPEAK ON AGENDA NUMBER 38, I HAVE BEEN ASKED TO PULL IT. IS THERE ANYONE HERE THAT WISHES TO SPEAK ON AGENDA 38 FOR ANY REASON? ALL TELL YOU WHAT 38 IS. I SEE SOME PEOPLE LOOKING AROUND. ADVANCE FUNDING AGREEMENT, SO NO ONE'S HERE ON THAT, NO ONE'S TAKING TIME OUT OF THEIR BUSY DAY TO ADDRESS THAT. OKAY, WELL DONE.

38 IS PULLED OKAY, SO FIRST THING OUT OF THE BOX IS OUR DECLARATION COVID-19 UPDATE.

[1. Update from the County Judge and staff regarding the Local Disaster Declaration and COVID-19. BECERRA]

I'M UP. BATTER UP. OKAY, QUICK RECAP FOR EVERYONE,

[00:10:08]

FOR ME IT SEEMS LIKE A LOT LONGER BUT IT WAS JUST OVER A WEEK AGO THAT WE MADE THIS DECLARATION, LOCAL DISASTER DECLARATION AND WE ARE FOLLOWING A SYNCHRONIZED, TO THE BEST OF MY ABILITIES, ROADMAP WITH OUR LOCAL ELECTED OFFICIALS FOLLOWING OUR STATES GUIDANCE AND BEING SUPPORTED BY THE FEDERAL GOVERNMENT IN REFERENCE TO CDC GUIDELINES, ET CETERA.

SO ON MARCH 15 WE MADE THE DECLARATION AND THANK YOU TAMMY FOR COMING TOGETHER SO QUICKLY.

WHERE ARE YOU TAMMY? THERE YOU ARE. THANK YOU FOR COMING SO QUICKLY TOGETHER TO PUT THIS SPACE TOGETHER FOR US. I TRULY APPRECIATE, THAT WAS ONE LAST THING MY OFFICE HAD TO DO AND I'M GENUINELY GRATEFUL FOR YOU AND CHRIS AND WHOEVER ELSE WAS PART IN THAT. EVERYTHING I AM DOING BECAUSE THIS IS MY LANE, COMPLETELY EXCLUSIVELY BECAUSE I AM.

NOTHING TO DO WITH ME, THIS IS IN US. UNLESS SOMETHING GOES WRONG THEN SO EVERY TIME I MAKE A DECLARATION OR DECISION OR THOUGHT PROCESS, I WILL HAVE 14, 15 PEOPLE EFFORTLESSLY COMPLAIN AND THAT'S OKAY. I DIDN'T THINK ANYTHING I WAS GOING TO DO IN THIS SPACE WAS GOING TO BE POPULAR. I DIDN'T THINK I WAS GOING TO PICK WINNERS AND LOSERS. MY GOAL IS PURELY AND EXCLUSIVELY WHAT IS BEST FOR OUR APPROXIMATE 3 300 CITIZENS OF HAYS COUNTY. IF SOMEONE DOESN'T LIKE IT IS MY JOB TO DO THE BEST I CAN TO COMMUNICATE. I HAVE BEEN DOING THAT, I BELIEVE, EXCESSIVELY WELL THROUGH SOCIAL MEDIA, SMOKE SIGNALS, THE OFFICE OF GENERAL COUNSEL WHO I ALSO WANT TO THANK FOR BEING SO WONDERFUL AND HELPING ME THROUGH THIS.

I CALL MARK KENNEDY AND HE IMMEDIATELY DROPS WHATEVER HE WAS DOING AND HAS GIVEN ME FULL ATTENTION, FULL BANDWIDTH TO HELP ME WRITE IN ORDER ON THE DROP OF A HAT.

I HAVE HAD NOTHING BUT WONDERFUL SUPPORT FROM THE COMMISSIONERS. I HAVE HAD EVERY SPACE, OF COURSE OUR CHIEF OF STAFF, EMERGENCY MANAGEMENT COORDINATOR ALEX, I CAN'T SAY ENOUGH ABOUT HIM. I DON'T KNOW IF HE IS SLEEPING AND IF SO HE MIGHT DO THAT MOVIE MICRO NAPPING WHILE STANDING, HE IS ABSOLUTELY IMPRESSED THE HECK OUT OF ME WITH THE TIME, THE ATTENTION, THE DETAIL. I'M GRATEFUL FOR HIS ACADEMIC BACKGROUND BECAUSE HE HAS REALLY JOVIAN AND SPACES IN WAYS I WOULDN'T HAVE -- DOVE IN IN SPACES AND WAYS I WOULDN'T HAVE. IF IT WOULDN'T HAVE BEEN FOR HIS ACADEMIC TRAINING, TRULY.

THAT WAS LAST SUNDAY, AND THEN WE MAKE A DECLARATION, WELL WE DO AN ORDER TO GIVE CLEAR DIRECTION ON MARCH 17. THE DECLARATION, THE ORDER AGAIN IS CRAFTED BY OUR GENERAL COUNSEL MARK KENNEDY AND HIS STAFF, HIS TEAM, AND IT IS TO CREATE SOME ARTICULATION AS TO WHAT IS GOING ON BECAUSE I'M NOT LOOKING AT A STREET, I'M NOT LOOKING AT A CITY, I'M LOOKING AT AN ENTIRE COUNTY THAT'S ALMOST 300,000 PEOPLE. I DON'T TAKE ANY DECISIONS LATELY. REGARDLESS WHAT SOMEONE MIGHT THINK I DON'T.

WHAT WE WANT TO DO IN THIS ORDER WAS ARTICULATE WHAT OUR GOALS WERE AT THE TIME AND IT CONTINUES TO REMAIN ALL THE BUSINESSES AROUND THIS COMMUNITY ARE, FOR THE MOST PART, SHUT DOWN OR A TRICKLE BECAUSE THE FIRST DECLARATION OF LOCAL DISASTER WAS SO WELL FOLLOWED AND I'M SO GRATEFUL TO THE COMMUNITY THAT WE DIDN'T HAVE TO SHUT IT DOWN AS SOME PLACES MIGHT BE DOING. I'M CAUTIOUSLY OPTIMISTIC AND I DECLARED IN ORDER TO SAY NO MORE THAN TEN PEOPLE IN A ROOM BECAUSE THE OTHER PART WAS ALREADY BEING FOLLOWED.

I DIDN'T HAVE TO SAY CLOSE YOUR DOOR BECAUSE THERE IS ALREADY ONLY A HANDFUL OF PEOPLE IN EACH

[00:15:04]

BUSINESS ALREADY. THAT IS WHAT SHAPED THE DECISION TO ADDRESS THIS PART.

THE 6-FOOT SOCIAL DISTANCING, OUR EPIDEMIOLOGIST IS ANOTHER ONE STANDING UP AND TAKING MICRO NAPS. IT'S ABSOLUTELY NOT WHAT OUR HEALTH DEARTMENT IS DOING AND EVERYBODY IN IT. IT ALMOST MAKES ME EMOTIONAL FOR APPRECIATION.

WOW. I'VE NEVER SEEN SO MANY PEOPLE COME TOGETHER SO HARD FOR SUCH AN EFFORT. WHERE WAS I? I'M JUST GRATEFUL.

I'M GRATEFUL TO SEE THIS TEAMWORK AND I'M GRATEFUL FOR THIS MOMENT TO PUT MY PERSPECTIVE ON THINGS, TO PUT MY SPIN ON THIS BUT THE 6-FOOT SOCIAL DISTANCING WAS A BIG PART ABOUT MAKING SURE WE DON'T SPREAD. ARE WE DOING THE RIGHT THING, ARE WE DOING THE WRONG THING? WELL IT IS SQUARELY ON MY SHOULDERS.

WE ALL KNOW THE CLICHé THE BUCK STOPS HERE, IT STOPS WITH ME SO I WEIGH EVERY DECISION CAREFULLY. I LISTEN TO ALL THE PROFESSIONALS AND THEN WE MAKE A DECISION. I KNOW SAN ANTONIO, THEIR COUNTY, AUSTIN TRAVIS COUNTY, WILLIAMSON COUNTY AND THAT'S JUST IN THIS LITTLE CORRIDOR OF OUR GREAT STATE IS TODAY GOING TO DECLARE THEY ARE SHELTER IN PLACE. I WAS ASKED ABOUT IT YES I AM IN CONSTANT MEDICATION WITH ALL THE OTHER COUNTY JUDGES IN THE AREA.

I AM VERY GRATEFUL TO WORK TOGETHER TO FIND THE HIGHEST AND BEST USE FOR OUR REGION SO WE HAVE A DESIRE TO BALANCE OUR LOCAL ECONOMY AND THE MANAGEMENT IN DIMINISHING THE SPREAD OF COVID-19. I'M NOT INTERESTED IN THE BELLYACHING THAT IS HAPPENING BECAUSE IT'S UNFORTUNATE. THERE'S NO WINNERS, NO LOSERS. IT'S A TOUGH ROAD TO BE ON BECAUSE AT THE SAME TIME YOU'VE GOT TO MANAGE COVID, YOU'VE GOT TO DO THIS ORDER THAT WE PUT OUT BUT IF WE DON'T FOLLOW IT EFFECTIVELY, THEN SHOOTING OURSELVES IN THE FOOT.

WE HAVE ALL THESE MOMENTS, SMALL SPACES, I WON'T MENTION COMPANY NAMES BUT THERE ARE FEW, VERY SMALL HANDFUL OF ORGANIZATIONS, COMPANIES THAT ARE NOT FOLLOWING AS WE WOULD LIKE THEM TO, OUR ORDER. SO YESTERDAY I ASKED OUR GENERAL COUNSEL ON A MOMENTS NOTICE TO HELP ME ENFORCE WHAT WE VERY PUT OUT, THE ORDER WE PUT OUT BECAUSE I CREATED A GROUP TEXT WITH ALL THE MAYORS OF OUR COUNTY AND THE MAYOR PRO TEM'S. WE ARE ALSO IN A CONFERENCE CALL EVERY DAY WITH ALL THE ELECTED OFFICIALS AND MAYOR HAHN SUGGESTED WELL JUDGE, BEFORE WE DO ANYTHING ELSE WE SHOULD ENFORCE WHAT'S IN PLACE AND I SAID MAYOR HAHN YOU'RE EXACTLY RIGHT, THANK YOU FOR THAT SUGGESTION AND DIRECTION SO YESTERDAY OUR GENERAL COUNSEL HELP ME DRAFT A MEMORANDUM TO LAW ENFORCEMENT AND PUBLIC INSPECTORS AND WHAT WERE SAYING HERE IS MUNICIPALITIES SHERIFF, RANGERS, MARSHALS, CHIEFS OF POLICE, HELP US WHEN YOU SEE SOMEONE THAT'S NOT IN YOUR DESIGNATED FOOTPRINTS, WHEN YOU SEE SOMEONE THAT'S NOT FOLLOWING BY THIS EFFORT, THE KEY PART WAS THE SOCIAL DISTANCING AND, IN A SMALLER SPACE NO MORE THAN TEN PEOPLE IN A ROOM. THAT IS JUST TO CURTAIL THE SPREAD OF COVID-19.

WE PUT THAT OUT YESTERDAY SO WE CAN GET THE FULL SUPPORT BECAUSE ALTHOUGH EVERYONE IN OUR VICINITY IS DOING SHELTER IN PLACE AND SOMEONE MAY SEE IT AS INEVITABILITY, I HAVE A TRUE DESIRE NOT TO PARALYZE OUR SMALL BUSINESS OWNERS WHICH I HAVE ALWAYS CALLED THE BACKBONE OF OUR ECONOMY. THEY ARE ABSOLUTELY DISCONNECTED FROM ANY KIND OF FEDERAL STIMULUS ROADMAP THAT I CAN SEE IN ANY SHORT WINDOW OF TIME. THEY ARE EMPLOYING ALL OF OUR FRIENDS AND FAMILY, THEY ARE THE, THE MACHINE THAT CREATES SENSE OF PLACE FOR OUR COMMUNITY I'D. IS AN IMPORTANT FACT OF WHAT WE DO FOR OUR COMMUNITY AND AS A

[00:20:03]

WHOLE. I'M RELUCTANT TO ORDER A SHELTER IN PLACE.

MY HOPE IS WE CAN EFFECTIVELY MANAGE WHAT IS IN PLACE NOW BECAUSE I DON'T WANT TO CREATE CURFEWS, I DON'T WANT TO DO ALL THE THINGS I CAN DO UNDER THIS EMERGENCY DECLARATION.

I WANT TO STAY AWAY FROM THAT, BUT WE'VE GOT TO COME TOGETHER. WE HAVE TO BRING THIS TO AN END. WE HAVE TO BREAK THE CYCLE BECAUSE IF WE DON'T WERE ONLY GOING TO COST PEOPLE'S LIVES AND YES THERE ARE SOME PEOPLE THAT STILL BELIEVE THIS IS A HOAX.

I HAVE TO DEAL WITH THAT REALITY AS WELL. THE BEAUTIFUL THING ABOUT OUR COMMUNITY IS WE HAVE A MYRIAD OF PERSONALITIES AND AN ASSORTMENT OF TEMPERAMENTS AND PERSPECTIVES. MY HOPE IS I CONVEY DIRECTION IN A WAY THAT'S MOST USEFUL AND MOST PRODUCTIVE AND IN EVERY WAY POSSIBLE PROVIDE THE MOST INFORMATION.

I CAN'T GIVE EVERYBODY EVERYTHING BECAUSE SOME THINGS I'M NOT SUPPOSED TO SAY, SOME THINGS I'M NOT ALLOWED TO SAY AND NOW THAT I'M IN THAT SEAT I UNDERSTAND WHAT THAT MEANS AND WHAT THAT IMPLIES. THAT'S IMPORTANT. BUT WE HAD OUR FIRST CASE OF POSITIVE CORONA IN DRIPPING SPRINGS IT GOT OUT A LITTLE TOO EARLY AND DRIPPING SPRINGS WASN'T ALWAYS READY FOR IT AND I HEARD THAT IT WASN'T USEFUL FOR THEM AND THEY WOULD'VE LIKED A LITTLE HEADS UP THAT IT WAS GOING TO BE ANNOUNCED BECAUSE THEY WANTED TO GET A MOMENT TO PREPARE. I HAVE A REAL DESIRE TO PROVIDE US WHAT WE NEED AS A COUNTY.

WE ARE TRULY LACKING IN PPE. THAT'S MY NEW WORD. I NOW KNOW ALL TOO WELL, PERSONAL PROTECTIVE EQUIPMENT. WE DO NEED IT, THE STORIES YOU ARE HEARING NATIONALLY ARE TRUE, AND HERE AT HOME WE DO HAVE A MASS SHORTAGE. BEFORE THE DECLARATION LAST SUNDAY THAT I SIGNED, I STARTED HEARING THE LACK OF PPE. I STARTED WORKING ON IT AND I WILL TELL YOU THAT BARELY YESTERDAY I GOT TO THE PLACE WHERE, WHEN I SPOKE TO THE TRAVIS COUNTY JUDGE, WILLIAMSON COUNTY JUDGE, WHEN I WAS TALKING TO MY COUNTERPARTS IN THE REGION AND I WAS TALKING TO OTHER PEOPLE EVEN IN OUR OWN OPERATION AND TELLING THEM SOME OF THESE THINGS THAT I HAVE MANAGED TO ACCOMPLISH BY THE GRACE OF GOD BECAUSE TRULY, I'M CALLING OTHER COUNTRIES TO HELP US. YOU GET AN OPPORTUNITY, YOU GET A STRING AND YOU KEEP GOING BECAUSE I HAVE ONE JOB AND THAT'S THE RESIDENCE OF HAYS COUNTY AND THAT'S WHAT I'M CHARGED WITH AND THAT'S WHAT I'M DOING. AS THE GOVERNOR SO ELOQUENTLY SAID I AM A GOVERNOR OF 254 COUNTIES AND MY DECLARATION WILL BE THIS AND I EXPECT AND HOPE AND APPLAUD IF AND WHEN EACH COUNTY TOUGHENS OR MODIFIES OR IMPROVES, HOWEVER YOU SEE IT, THEIR SPECIFIC FOOTPRINT. SO WHEN SOMEONE SAYS I'M GOING AGAINST THE GOVERNOR WITH WHAT I'M DOING, ACTUALLY NO. IF YOU LOOK AT SUNDAY'S CONFERENCE THAT HE GAVE OUT IT'S ACTUALLY NOT. WE ARE ENCOURAGED AND I GOVERNOR.

WE ARE ENCOURAGED TO BE A LOCALLY CONTROLLED GOVERNMENT. THAT'S HOW IT SHOULD BE.

WE KNOW AND I AM DOING MY VERY BEST TO PASS THAT ALONG AND LET THE MAYORS HAVE THAT CONTROL AS WELL. THAT'S WHY I'M WORKING CONTINUOUSLY WITH THE MAYORS.

WE HAVE THIS COUNTYWIDE FOOTPRINT AND THEN A BREAKOUT ARTICULATION FOR EACH MUNICIPALITY TO DO AND GIVE THE PRIVILEGE AND HONOR THAT THE GOVERNOR GAVE TO ME AS ONE OF THE COUNTY JUDGES OF THE STATE. I DON'T KNOW IF I SHOULD SAY NUMBERS ALEX, GIVE ME A NOD OF HOW THINGS ARE. I JUST DON'T KNOW WHAT I SHOULD SAY AND SHOULDN'T SAY TO CAUSE ALARM BUT WE ARE DAYS AWAY FROM RUNNING OUT OF SOME OF OUR SUPPLIES.

IT'S JUST A FACT BUT I AM SO LUCKY THAT SINCE THE VERY BEGINNING AND BEFORE THIS ORDER WAS SIGNED I WAS WORKING ON GETTING SUPPLIES TO US. I HAVE A VERY, I DON'T COUNT MY CHICKENS UNTIL THEY HATCH BUT I HAVE A VERY POSITIVE RESULT ON WHAT WE ARE DOING BOTH ON CO COVID-19 TEST AND I'M GRATEFUL BUT I DON'T WANT TO COUNT ON UNTIL THE TRUCK PULLS UP.

I'M ALSO REACHING OUT TO THE SHERIFF, I'LL SAY THIS ONE MORE THING.

I'M REACHING OUT TO THE SHERIFF AND OUR ENTIRE COURT SYSTEM. I'M LIKE GUYS, I KNOW THIS MIGHT

[00:25:01]

SOUND OPPORTUNISTIC BECAUSE I'M ABOUT MODERNIZING.

BUT IS THERE ANYONE IN OUR JAIL WE CAN GET RID OF. I DON'T MEAN GET RID OF IN A BAD WAY BUT LET LOOSE. THE PERSONAL RECONNAISSANCE, IS THERE SOMETHING WE CAN DO TO DIMINISH OUR LOAD ON THAT FRONT. THERE ARE ALL KINDS OF FRIENDS THAT WERE HITTING THAT PEOPLE DON'T EVEN KNOW ABOUT. I'LL KEEP GOING BUT FOR THE FOR

THE SAKE OF TIME YOU CAN GIVE US THE TRUEST HIGHLIGHT. >> CHIEF OF STAFF, EMERGENCY COORDINATOR. OUR CURRENT STATISTICS ARE STILL SEVEN CONFIRMED, 69 NEGATIVE TEST CAME BACK. WE HAVE TEN PENDING CURRENTLY. ON A POSITIVE NOTE WE HAVE ONE THAT HAS COMPLETELY RECOVERED AND I THINK MAYBE THE FOURTH OR FIFTH DAY AFTER RECOVERY WITH NO SYMPTOMS, NO FEVER SO THAT'S A POSITIVE NOTE. THESE NUMBERS THOUGH, IN REGARD TO ASSESSING THEM IT SHOULDN'T GIVE US A FALSE COMFORT. THESE NUMBERS ARE RESULT OF LACK OF TESTIN, WE ARE ONLY TESTING PEOPLE WITH SIGNIFICANT INDICATORS OF ILLNESS OR RISK.

WE ARE UNDERSTANDING THE SIGNIFICANT NUMBER THAT CAN BE ASYMPTOMATIC MEANING PEOPLE WITH NO INDICATORS OF BEING ILL BUT STILL HAVE THE VIRUS IN OUR REGION.

IF YOU'RE LOOKING AT THE HEAT MAP, THE REASON I PROVIDED THE HEAT MAP TO YOU IS BECAUSE IF

YOU LOOK ALONG THE CORRIDORS, IF YOU CAN SEE THAT. >> WOULD YOU HOLD IT UP, DO YOU

HAVE ONE. >> THESE ARE THE DIFFERENT POPULATED AREAS THROUGHOUT.

THESE ONLINE WITH THE COURT ORDERS OF TRANSPORTATION. I 35, I10, TRANSPORTATION BETWEEN HOUSTON AND GALVESTON, THE DFW AREA, THOSE PARTICULAR ITEMS. THE ONLY REASON I BRING THAT UP IS BECAUSE IT'S A SIGNIFICANT INDICATOR OF HOW WERE ALL CONNECTED AS A COMMUNITY. ONE OF THE CREATIVE THINGS THAT SOME OF THE MAYORS ARE DOING IS HAVING A TOUCH POINT CAMPAIGN IN THEIR AREAS AND THEIR ASKING THEIR BUSINESSES, MAINLY SHORT STORES, SMALL STORES, GAS STATIONS ALONG THE WAY TO PICK UP THEIR GAME WITH REGARDS TO SANITIZING THOSE PARTICULAR TOUCH POINTS AND IF WE CAN DO THAT, I THINK THAT LESSENS OUR EXPOSURE TO A CERTAIN DEGREE, GAS STATION PULL HANDLES, DOORS, ANYTHING WERE TOUCHING ON THE WAY SO THOSE ARE SOME AREAS THAT SOME OF THE MAYORS HAVE DISCUSSED AND THEY ARE ACTIVELY WORKING TO HAVE THOSE BUSINESSES LOOK AT THEIR TOUCH POINTS SO WE CAN MITIGATE THAT PEACE AND SLOW DOWN THE SPREAD. I CAN TELL YOU THAT AS A COORDINATING THIS PARTICULAR EFFORT AROUND WITH MY COUNTERPART THE CITY RACHEL INGLE, WE'VE HAD FULL SUPPORT OF THE GOVERNMENT, REGIONALLY, NATIONALLY. I'VE BEEN TALKING TO THOSE IN NEW YORK CITY AND IN BETWEEN.

DECISION-MAKING GOALS TO STAY AHEAD, NOT JUST TO RESPOND BUT TO STAY AHEAD.

I'M LOOKING AT THOSE FACT PATTERNS. PERSONAL PROTECTION EQUIPMENT, MASKS AND LACK OF HAND SANITIZER. SOME OF THOSE THINGS ARE BEING ADDRESSED WITH THE ORDER OF PRESIDENT AND TRANSPORTATION ROUTES THAT THE GOVERNOR.

LOTHERE ARE HEALTHCARE WORKERS OUT THERE TAKING THIS ON A VERY CLOSE HELP POINT.

VERY CONCERNED ABOUT THAT. THE REASON WHY WE WOULD CONSIDER AREAS WHERE WE CAN BE TOGETHRHE- IS THAT WHEN THEY SAY TO SLOW DOWN THE SPREAD IT ALLOWS ARE HEALTHCARE WORKERS TO SORT OF CATCH UP AND OUR FIRST RESPONDERS. IT'S PUSHING HARDHE EFFORT IN

[00:30:04]

RESPONSE TO COVID-19 WE ARE ALSO LOOKING AT RECOVERY. WE WERE HAPPY TO INCLUDE MANY.

MANY OF IT IS PASSING FORWARD THROUGH OUR CHAMBERS AND OUR PARTNERSHIP TO POT OUT INFORMATION FOR SOME OF OUR BUSINESSES TO START APPLYING FOR CERTAIN TYPES OF NEEDS AND HELP. ANSWERING A SURVEY SO YOU CAN SEE WHERE THE GAPS ARE AND THE INDUSTRY BEING AFFECTED IN THIS SITUATION SO WE CAN GET UP RECOVERY FOR THEM AND BE IN THE POSITION TO MAKE THE BEST DECISIONS FOR OUR ECONOMY. WE APPRECIATE ALL THE SUPPORT WERE GETTING FROM ALL THE DIFFERENT ORGANIZATIONS. ALTHOUGH PRIVATE ORGANIZATIONS ARE BEING VERY HELPFUL ON HELPING US IN RESPONDING, WE CONTINUE TO HAVE MULTIPLE MEETINGS A DAY BOTH AT THE LOCAL, REGIONAL, NATIONAL LEVEL, AND IT'S BEEN A VERY INTERESTING POSITION TO BE IN TO KIND OF GARNER THE SUPPORT THAT WE NEED HAS BEEN TREMENDOUS, STAFF MEMBERS HAVE BEEN HERE, WORKING AROUND THE CLOCK. I CAN DO A LOT OF THINGS THAT I'M DOING BUT THEY CONTINUE TO BE AVAILABLE AT THE DROP OF A HAT AND ALLOW US TO CONTINUE DOING THE RESPONSE. I WOULD BE REMISS TO SAY I WOULD INCLUDE ALL OF OUR FIRST RESPONDERS, SOME OF THEM THAT HAVEN'T FARED VERY WELL YESTERDAY THAT ARE RECOVERING AND AGAIN ARE HEALTHCARE WORKERS THAT ARE OUT ON THE FRONT LINES THAT WE ARE HAVING TO FIND WAYS CREATIVELY TO GET THEM THE THINGS THEY NEED TO PROTECT AND BETTER ASSIST OUR PEOPLE.

I CAN'T SAY ENOUGH THANKS FOR THAT. THANK YOU ALL.

>> THANK YOU. DO YOU HAVE ANY QUESTIONS BEFORE HE WALKS AWAY FROM THE PODIUM.

>> YES ALEX THIS IS COMMISSIONER SMITH. IF YOU COULD FORWARD THAT

INFORMATION THAT YOU JUST HANDED OUT, THAT WOULD BE GREAT. >> THANK YOU.

>> I LIKE TO TAKE AN OPPORTUNITY TO THANK ALEX AND THE JUDGE AND THE WORK THEY BEEN DOING IN ALL OF OUR STAFF THAT'S BEEN ASSISTING THEM, ESPECIALLY ERIC SCHNEIDER WITH OUR HELP DEPARTMENT. I KNOW HE HAS PUT A LOT OF WORK IN AS WELL SO I JUST WANTED TO TELL EVERYBODY APPRECIATE WHAT THEY'RE DOING. IT'S REQUIRED A LOT OF PEOPLE TO STEP UP AND TAKE ON DIFFERENT ROLES. I ALSO WANTED TO THANK ALL OF OUR CHAMBER OF COMMERCE PRESIDENTS, ALEX MENTIONED THAT TASK FORCE AND THEY HAVE BEEN WORKING DILIGENTLY TO GET THE SURVEY READY FOR OUR COMMUNITY AND GET SOME RESOURCES PUT TOGETHER. WORKFORCE SOLUTIONS AND THE PARTNERSHIP HAS BEEN TOASTING THAT ON THEIR WEBSITE AND HELPING ORGANIZE. IT'S REALLY GOOD TO SEE EVERYONE COMING TOGETHER FROM THE BUSINESS COMMUNITY TO RECOGNIZE THE IMPACT THAT WE ARE EXPERIENCING AND GOING TO UNFORTUNATELY EXPERIENCE FOR SOME TIME TO BOTH EMPLOYERS AND EMPLOYEES. WE REALLY APPRECIATE THE WORK EVERYBODY IS DONE ON THAT.

ALSO ALL CHAMBER PRESIDENT STEPPING UP. >> I WOULD JUST ECHO WHAT THE COMMISSIONER SAID. I WANT TO THANK YOU AND ALEX. I KNOW YOU BEEN PUTTING IN A LOT OF TIME AND EFFORT TO WHAT IS HAPPENING HERE LOCALLY AND REGIONALLY AND STATEWIDE AND NATIONALLY AND I JUST APPRECIATE ALL THE HARD WORK. THANK YOU SO MUCH, AND TO OUR STAFF I WANT TO THANK YOU ALL ALSO. I KNOW YOU'VE DONE A LOT OF BEHIND-THE-SCENES WORK AND I REALLY APPRECIATE EVERYBODY COMING TOGETHER AND WORKING AS A

TEAM. >> AND THE WHOLE OFFICE OF EMERGENCY MANAGEMENT IS FAIRLY THIN RIGHT NOW SO THEY REALLY STEPPED UP. I SEE SCOTT RAVEN IN THE ROOM TODAY SO I APPRECIATE EVERYONE STEPPING UP TO DO THAT. MIKE JONES AS WELL, EMERGENCY

PREPAREDNESS CORRELATOR. >> I HAVE HIM ON MY LIST. IT'S MIKE JONES, HE WAS HELPING ME, LIKE ALEX SAID I'LL GET RIGHT BACK TO YOU, WE HAVE TWO PLAN, EVERYTHING ABOUT TODAY WE HAVE FAILED. WE HAVE TO THINK ABOUT WEEKS AND MONTHS FROM NOW BECAUSE THAT'S WHERE THIS THING IS GOING. JUST THINK, WE COULD GO IF WE HAD ONLY MADE OUR DECLARATION.

THAT'S A BLINK. MIKE JONES IS ACTUALLY, I WAS WITH HIM YESTERDAY MORNING SETTING UP AND PLANNING A TESTING, A DRIVE-THROUGH TESTING SITE, THAT PLACE THAT WE SEE ON TV WITH ALL THESE LONG LINES FOR EVERYBODY TO GET TESTED, WE ARE ACTUALLY CREATING A MOCK SET UP

[00:35:01]

A BIT YESTERDAY. WE WERE IN KYLE YESTERDAY DOING THAT THING THAT ALEX WAS DESCRIBING ABOUT THOSE CRITICAL PIECES STAYING OPEN, HOW DO WE MAKE SURE WE STOP THE SPREAD, WHAT CAN WE DO, HOW DO WE MANAGE, HOW DO WE CARE FOR IT AND I WILL TELL YOU THAT KYLE'S MAYOR HAS BEEN IMPRESSIVE IN EVERY WAY ON THIS FRONT. HE IS RUNNING IN BOLDLY, BUT WELL-INFORMED AND TRAVIS MITCHELL HAS JUST BEEN EXCEPTIONALLY IMPRESSIVE TO ME ON THIS FRONT. I CAN KEEP GOING BECAUSE I HAVE COMPLEMENT ONE I THINK ABOUT THE OTHER ONE BECAUSE THE OTHER LOOKS AT ME LIKE HEY, WHAT ABOUT ME.

I'M THINKING OF FLORIO WHITEHEAD WHO IS THE MAYOR OF WOODCREEK. SHE SAID RESIDENTS OF WOODCREEK, PLEASE VOLUNTEER, SHELTER IN PLACE. THE AGE OF THAT POPULATION IS,

WHAT YOU THINK IS THE AVERAGE, 70? >> IT'S DEFINITELY ONE OF THE OLDER COMMUNITIES IN THE COUNTY AND VERY VULNERABLE. I DO APPRECIATE WHAT SHE HAS BEEN ABLE TO DO THERE. I KNOW THEY ARE DOING THE BEST THEY CAN TO STAY SAFE.

>> AND I COULD GO ON AND I COULD SAY ARE MAYOR FROM WIMBERLY HAS BEEN CONSTANTLY SAYING JUDGE, WHATEVER YOU NEED FROM US WE ARE HERE, WE SUPPORT WHAT YOU'RE DOING, AND EVERYWHER YOU LOOK SOMEONE IS DOING SOMETHING PHENOMENAL AND OF COURSE, IT JUST KEEPS GOING.

THERE IS ONE MORE I WANT TO SAY, I'VE NEVER WORKED SO MUCH SO WELL WITH OUR PIO.

I'M WORKING ALONGSIDE WITH LORENA AND WERE LITERALLY AT THE EMERGENCY OPERATIONS CENTER AND JUST SITTING THERE, CRAFTING MORE DOCUMENTS AND THEY ARE CHANGING AS WE SPEAK AND WERE ABOUT TO HIT SEND TO A DOCUMENT THAT WILL GO.

AND WAIT, WE HAVE TO EDIT IT BECAUSE IT HAS CHANGED SINCE WE RIGHTED STARTED WRITING IT.

THAT'S HOW FLUID AND DYNAMIC THE SITUATION IS. >> ONE OF THE CRITICAL POINTS THAT I THINK WE STILL NEED HELP WITH IS THE PRIVATE SECTOR AND DOCTORS WHEN THERE GETTING A POSITIVE TEST BACK. THEY'VE GOT TO LET HER HEALTH DEPARTMENT NO SO WE CAN GET LET OUR FIRST RESPONDERS KNOW IF THEY GET CALLED THEY HAVE TO HAVE THE PPE READY AND NOT SOMETHING WE STILL NEED HELP WITH AND HELP GETTING THE WORD OUT FOR THOSE PROVIDERS.

IF YOU DO GET A POSITIVE, LETTER HEALTH DEPARTMENT NO. WERE NOT GONNA LET THE PUBLIC KNOW WHERE ANY IDENTIFYING MARKERS OR ADDRESS BUT OUR FIRST RESPONDERS NEED TO KNOW BEFORE

THEY GO INTO THOSE RESIDENTS. >> THAT'S A VERY GOOD POINT. I'M JUST THINKING, HEARING OUR COMMISSIONER SPEAK, HE IS CALLING ME IN THE MORNING, JUDGE, WHAT CAN I DO TO HELP.

HOW'S IT GOING, WHAT YOU NEED. I CAN'T POINT TO A SPOT THAT ISN'T ALL HANDS ON DECK, FULLY SUPPORTED AND THAT IS A GREAT POINT. AS HER CHIEF OF STAFF HAS POINTED OUT, THE ONLY REASON WE HAVE SEVEN CONFIRMED POSITIVE CORONAVIRUS TESTS IS BECAUSE WE DON'T HAVE TESTS. WE HAVE TO TELL YOU ONCE WE START TESTING MORE PEOPLE THE NUMBER WILL CLIMB AND YOU HAVE TO KNOW THIS, DO NOT BE ALARMED, THIS IS INFORMATION, HOPEFUL TO BE INFORMATION SHARING SO YOU COULD BE INFORMED. WE WILL HAVE CONSERVATIVELY 50 PEOPLE IN OUR COUNTY, 50% OF THE PEOPLE IN OUR COUNTY WALKING AROUND, TESTING POSITIVE FOR CORONAVIRUS. MOST OF THOSE PEOPLE WILL BE A SYMPTOMATIC.

WHAT ASYMPTOMATIC MEANS IS YOU WILL WALK AROUND WITH CORONAVIRUS AND THAT EVEN THOUGH YOU HAVE IT. MY PERSONAL GOAL, MY PERSONAL HOPE IS TO BRING ENOUGH TESTING TO FIGURE OUT A MAP, AND I HAVE ONE, TO MAKE THEM AVAILABLE TO THE CITIZENS OF HAYS HAYS COUNTY SO IF YOU ARE TRULY POSITIVE YOU CAN SHELTER IN PLACE. MORE CAUTIOUSLY THAN IF YOU JUST THINK MAYBE. SO THE HOPE IS TO SAY WE DO HAVE SEVEN AT THIS MOMENT, BUT WHEN THE TEST BECOME AVAILABLE YOU MAY SEE THAT NUMBER JUMPED 200. PLEASE DO NOT BE ALARMED.

ALL YOU'RE DOING NOW, ALL WE ARE DOING NOW BECAUSE WERE IN THIS TOGETHER, WHETHER YOU LIKE IT OR NOT, ALL WE ARE DOING IS DETERMINING WHO IS ACTUALLY WALKING AROUND POSITIVE VERSUS RIGHT NOW NOT KNOWING. SO WHEN THE TEST BECOME AVAILABLE, AND I WILL BE MAKING AN ANNOUNCEMENT VERY SOON, AND WHEN THESE NUMBERS SPIKE AGAIN THIS IS JUST CONFIRMING WHAT WE HAVE SCIENTIFICALLY KNOWN IS GOING ON. YOU WANT TO ADD?

>> I JUST WANTED TO REITERATE WHAT THE COMMISSIONER SAID THAT WE DO NEED TO HAVE THAT INFORMATION AND THAT ALLOWS US TO DETERINE WHAT RESPONSE WE WILL HAVE AND CRITICALLY GIVES INFORMATION FOR OUR FIRST RESPONDERS WHEN IT'S MAKING IT SEEM, IT'S ALSO CRITICAL FOR GPS WHO ARE MAKE MAKING SCENES BEFORE THEY GET THERE. THEY'RE PROTECTING THEMSELVES

[00:40:04]

BUT THERE ON THE FRONT LINE AND WE PROVIDED THEM WITH EQUIPMENT TO MAKE THOSE SCENES STILL BUT AGAIN, THOSE ARE THE THINGS WE DON'T SEE, WE DON'T UNDERSTAND MOST OF THE TIME BUT IT'S CRITICAL THAT WE GET THAT INFORMATION SO WE CAN DETERMINE THE RESPONSE FOR OUR FIRST RESPONDERS AND HOW WE RESPOND AS EMERGENCY MANAGEMENT. CRITICAL INFORMATION.

>> JUST SO YOU KNOW, OUR LAW ENFORCEMENT DOES HAVE A WAY OF IDENTIFYING CALLS.

THEY HAVE SHARED WITH ME THEY WILL NOT LET ONE OF OUR JUSTICE OF THE PEACE SHOW UP SOMEWHERE WITHOUT KNOWING AND OUR LAW ENFORCEMENT IS WORKING PREVIOUSLY TO MAKE SURE IF A CALL IS MADE TO A HOME WHERE THEY ARE SELF QUARANTINING BECAUSE OF EXPOSURE THAT THEY ARE MADE AWARE OF IT BUT LIKE YOU BOTH NOW SAID IT IS CRITICAL THAT WE HAVE THESE ORGANIZATIONS TESTING PEOPLE THAT WE KNOW. EVEN IF IT'S A NEGATIVE. IT HELPS OUR EQUATION.

IF YOU'VE TESTED 50 PEOPLE AND FIVE ARE POSITIVE, WE NEED TO KNOW.

IF YOU'VE TESTED 50 PEOPLE AND THEIR ALL NEGATIVE WE NEED TO KNOW.

PLEASE LOOP IN OUR LOCAL HEALTH DEPARTMENT. THAT IS WHERE THE RUBBER MEETS THE ROAD AND WE NEED THAT INFORMATION SO WE CAN GET A TRUE ASSESSMENT BECAUSE IT HELPS

SHAKE THE MOVEMENT OF PEOPLE. >> I WANT TO THINK ONE OTHER GROUP, OUR SCHOOL DISTRICTS BECAUSE NOT ONLY ARE THEY CONINUING TO FEED OUR KIDS DURING THIS TIME BUT WHEN WE'VE ASKED THEM IF THERE FACILITIES ARE AVAILABLE FOR DRIVE-THROUGH TESTING THEY ARE IDEAL FOR THAT TYPE OF SETUP THEY SAID NO PROBLEM. ALL THEIR CAMPUSES ARE AVAILABLE TO US AND I WANT TO THINK THE DISTRICT SUPERINTENDENTS FOR BEING SO HELPFUL.

>> I'M JUST GOING TO MENTION THAT ALSO. OUR HOSPITALS, JUDGE EVEN THOUGH WE MENTIONED HEALTHCARE PROVIDERS I KNOW ARE HOSPITALS HAD BEEN COLLABORATING AND MEETING TO DISCUSS THIS ISSUE. I KNOW THERE WAS AN ARTICLE IN TODAY'S PAPER ABOUT THEM COMING TOGETHER AND ANALYZING EVERYTHING THAT'S GOING ON SO THEY BEEN WORKING VERY HARD ALSO

ON THIS ISSUE. >> HERE SOMETHING THAT MAY NOT BE VERY PUBLIC BUT I BELIEVE IT WILL BE USEFUL TO SHARE. ON THAT HOSPITAL FRONT, SOME OF THESE DECISIONS WERE MAKING OUR NECESSARILY BECAUSE WE ONLY AT THIS MOMENT HAVE SEVEN CONFIRMED TESTED POSITIVE CASES, BUT IT'S ALSO CONSIDERING LIKING CHEMISTRY IT'S CALLED YOUR LIMITING AGENT.

IT'S ALSO CONSIDERING WHAT CAN OUR HOSPITALS DO, WHAT IS THEIR THRESHOLD, AT WHAT POINT WILL THEY REACH CAPACITY AND WE DO WE WANT TO HAVE THAT CRITICAL SPACE OCCUPIED BY SOMEONE WITH A FLU WHICH IS THAT, BUT IT'S NOT CORONAVIRUS, AND SO WE ARE TRYING TO COME ALIKE OUR GOVERNOR FROM NEW YORK HAS DONE, ASKING 50% OF THEIR BEDS TO BE OPENED UP, GET RID OF NONESSENTIAL PROCEDURES AND EVERYONE'S WORKING HARD TO BE EFFICIENT IN EVERY FRONT AND ABSOLUTELY RIGHT OUR HOSPITALS ARE PART OF IT. BUT I KNOW THEY ARE, NATIONWIDE, REACHING THEIR LIMIT AND WE HAVEN'T SEEN THE PEAK. THAT'S WHAT WE ARE TRYING TO HELP MITIGATE. DOES NOT LOWER THE PEAK AND PUSH IT OUT FURTHER.

FLATTEN THE CURVE AND MAKE THE PEAK BE OUT AS FAR AS POSSIBLE SO WE CAN MAKE IT MANAGEABLE BECAUSE IN ONE'S KNEES WE CAN INUNDATE OUR MEDICAL CENTER AND THEY CAN'T KEEP UP AND WERE IN A BAD PLACE. ANY OTHER COMMENTS ON THIS PRESENTATION?

>> THIS IS COMMISSIONER SMITH. I JUST WANTED TO SAY THANK YOU FOR ALL YOUR WORK AND THAT OF MY COLLEAGUES. I SPECIFICALLY WANT TO SAY I KNOW IT'S A TOUGH DECISION RELATIVE TO CLOSING BUSINESSES.

PUBLIC. I WOULD ENCOURAGE AND REITERATE, I KNOW YOU ARE SUPPORTIVE OF ENSURING THOSE BUSINESSES ARE ABLE TO OPEN AS SOON AS POSSIBLE TO LIMIT THE IMPACT ON OUR SMALL BUSINESSES AND COMMUNITY. I APPRECIATE THAT. I REALLY APPRECIATE THAT AS A SMALL BUSINESS OWNER BUT MORE IMPORTANTLY ABOUT CITIZEN OF OUR COMMUNITY BECAUSE I AM DEFINITELY CONCERNED ABOUT WHAT THE ECONOMIC IMPACT WILL BE ON OUR BUSINESSES AND WHETHER WE WILL HAVE THOSE SERVICES AVAILABLE ONCE THIS THING IS OVER.

IF WE DON'T TRY TO TAKE CARE OF THOSE FOLKS. I APPRECIATE THE FACT THAT YOU'RE LOOKING INTO THAT AND JUST WANT TO MENTION THAT IN OUR CONVERSATIONS YOU ARE VERY, FOR THOSE OF YOU WHO MAY BE QUESTIONING THAT, THE JUDGE HAS BEEN VERY ADAMANT IN THE FACT THAT HE WANTS TO ENSURE THAT THE VIABILITY OF OUR RURAL COMMUNITIES.

>> THANK YOU COMMISSIONER. THANK YOU VERY MUCH. I'D LIKE TO ADD ONE MORE THING BEFORE WE MOVE ON. BECAUSE ONE OF THE IMPACTED SEGMENTS OF WHAT WERE TRYING TO DO IS THE CHILDCARE SPACE, I WOULD LIKE TO, I WOULD LIKE TO TAKE THIS MOMENT TO SAY, IF A

[00:45:02]

MUNICIPALITY HAS MADE A DECISION TO MODIFY THE ROADMAP THAT WE HAVE AS A GROUP OF PROFESSIONALS FEEDING MY THOUGHT PROCESS. IF YOU DECIDE TO PROVIDE WHATEVER YOU CALL IT, DAY CAMP, DAYCARE, SEMANTICS ARE USED TO COMFORT THE DECISION-MAKERS. IF YOU WANT TO CREATE SOMETHING FOR FIRST RESPONDERS CRITICAL INFRASTRUCTURE, I BELIEVE THE PERSON WORKING TO GET YOU GROCERIES IS CRITICAL INFRASTRUCTURE AND THE NURSE AT THE HOSPITAL IS CRITICAL INFRASTRUCTURE. NOT JUST THE FRONT LINE, I WORK FOR THE GOVERNMENT, I'M CRITICAL. I BELIEVE THERE ARE SO MANY CRITICAL UNSUNG HEROES WORKING AROUND THAT NEED THE SUPPORT BUT IF WE ARE GOING TO FIND A WAY AROUND THIS ORDER AND PROVIDE CHILDCARE IN AN ACTIVITY CENTER OR OTHER SETTING, FIRST I STRONGLY DISCOURAGE IT, BUT IF YOU ARE GOING TO DO SUCH A THING, FOR CRYING OUT LOUD, WE HAVE CREATED HARDSHIP FOR THESE H CHILDCARE FACILITIES. I KNOW IT. LET'S USE THEM.

SHOP LOCAL. I'VE SAID IT ALL MY LIFE. SHOP LOCAL.

THESE LICENSE CREDENTIALED ORGANIZATION, CHARGED WITH, EQUIPPED WITH LOWER SINKS AND EVERYTHING ELSE TO DEAL WITH EVERYTHING ELSE AND HELP CONTROL THE YOUNGER POPULATION, USE THEM INSTEAD OF CREATING YOUR OWN ENVIRONMENT. THAT IS MY HOPE.

I KNOW WIRES HAVE BEEN CROSSED ON CERTAIN COMMUNICATIONS. THAT IS CLEAR AND CONCISE AS I CAN BE. ANOTHER MESSAGE AS A FINAL PIECE TO PUSH OFF ON THIS IS I WAS LOOPED IN AS PART OF A GROUP THAT WAS GOING TO SIGN IN ORDER OF SHELTER IN PLACE FOR HAYS COUNTY AND I WANT YOU TO KNOW RIGHT HERE, RIGHT NOW, THAT IS NOT SO.

THE MESSAGES OUT THAT I AM COMING OUT WITH WILLIAMSON COUNTY AND TRAVIS COUNTY AND THAT IS INACCURATE, THAT IS NOT TRUE, AND THAT IS WHY THIS ORDER HAS BEEN SIGNED THAT THE GENERAL COUNSEL HELPED ME METH, ASKING THAT WE DO EVERYTHING WE CAN BEFORE WE DO THAT BECAUSE I DON'T WANT TO DO THAT AND THAT IS NOT TRUE, I AM NOT DOING IT AND BEFORE I EVER DO SOMETHING

LIKE THAT YOU WILL KNOW. >> I JUST LIKE TO CLARIFY ONE OTHER THING ON EARTH TESTING SITE IT'S ONLY FOR FIRST RESPONDERS AND ONCE IT'S OPEN IT WILL BE BY APPOINTMENT ONLY AND ONLY IF YOU HAVE A DOCTOR'S CONSENT THAT YOU NEED THAT TEST.

I JUST WANTED TO CLARIFY THAT. >> THANK YOU. I WILL BE CREATING SOME FORM OF COMMUNICATION TO ADD TO WHAT HE JUST SAID, THAT I BELIEVE, ONCE I CONFIRM ADDITIONAL INFORMATION GIVE US SOME BREATHING ROOM IF NOTHING ELSE AS A COUNTY, AS RESIDENTS OF HAYS COUNTY I AM LOOKING OUT FOR YOU. KNOW THAT I AM WORKING FOR YOU, YOU ARE MY PRIORITY WHETHER YOU AGREE WITH ME OR NOT, WHETHER YOU VOTED ME OR YOU'RE GOING TO HAVE ME REMOVED IN FOUR YEARS OR WHATEVER IS LEFT OF MY TERM, I'M STILL GOING TO WORK FOR YOU. MY HOPE IS THAT WE PUT SOMETHING OUT BEFORE THE STATE IS DONE ANNOUNCING VERY GOOD NEWS BUT I WANT TO TALK TO THE COURT PRIVATELY FIRST. YOU PLEASE OPEN AGENDA ITEM NUMBER TWO.

>> JUDGE. >> OH, SORRY. >> JUST PERSONAL PREFERENCE BEFORE WE MOVE ON I RECEIVED A FEW QUESTIONS AND I WANTED TO CLARIFY BEFORE I MOVED OFF THIS TOPIC AS TO WHY I WASN'T IN COURT TODAY. I FIRST WANT TO THANK JEFF MCGILL FOR ARRANGING IT FOR ME TOO JOIN IN REMOTELY TODAY, BUT JUST BY WAY OF BACKGROUND, AS THIS STARTED AS OUR SPRING BREAK STARTED HERE IN DRIPPING SPRINGS, MY FAMILY AND I ACTUALLY TRAVELED TO UTAH FOR A COUPLE DAYS AND I DON'T KNOW IF ALL OF YOU KNOW BUT IN 2005 I WAS DIAGNOSED WITH THE PITUITARY BRAIN TUMOR. I DON'T TALK ABOUT IT MUCH BUT OVER TIME IT HAS SOMEWHAT HAMPERED MY IMMUNE SYSTEM SO OUT OF AN ABUNDANCE OF CAUTION AFTER SPEAKING WITH OUR EPIDEMIOLOGIST, HE ASKED, HE TOLD ME IT WAS FINE TO INTERACT, BUT I AM GOING TO TAKE, I HAVE DECIDED TO TAKE THE TWO WEEK TIMETABLE BEFORE DOING OTHER INTERACTIONS, AND SO I ANTICIPATE I'LL BE THERE, MAYBE NOT THIS COMING WEEK BUT THE FOLLOWING WEEK IN PERSON BUT I AM APPRECIATIVE FOR MAKING THE ARRANGEMENTS THIS WEEK AND IF

[00:50:09]

ANYBODY HAS ANY QUESTIONS RELATIVE TO THAT I'M MORE THAN HAPPY TO ANSWER THEM OFF-LINE.

>> THANK YOU COMMISSIONER. THANK YOU FOR THAT CLARIFICATION AND UPDATE.

THERE IS ANOTHER ONE. IT GOES WITHOUT SAYING, JEFF MCGILL AND HIS STAFF HAVE BEEN WORKING TIRELESSLY BECAUSE THE GOVERNMENT AT THE COUNTY LEVEL THAT YOU HAVE COME TO EXPECT A CERTAIN LEVEL AND RECEIVE A CERTAIN LEVEL OF SERVICE AND CARE IS STILL FUNCTIONING.

WE MAY HAVE CLOSED SOME FACE-TO-FACE CONTACT SPACES, BUT THERE IS A WHOLE LOT OF MOVEMENT TO REMOTE WORKING, AND JEFF MCGILL HAS BEEN AT THE HEAD OF THAT WITH HIS TEAM.

THERE ARE MORE MOVING PARTS ON THIS THAN WE COULD EVER TELL YOU, BUT JUST KNOW THAT THE ENTIRE GOVERNMENT OF HAYS COUNTY IS WORKING FOR YOU IN A WAY THAT I AM SO PROUD TO REPRESENT.

YOU KNOW THIS, IF IT WASN'T I WOULD TELL YOU AND IT IS DOING A WONDERFUL JOB AND EVERYBODY INVOLVED IS ALL HANDS ON DECK AND HAVE NOTHING BUT PRAISE IS TO GET UP.

HISTORICALLY THAT MAY NOT ALWAYS BE THE CASE IN THE PARTICULAR ISSUE OR MOMENT OR TIME, BUT I DON'T CARE ABOUT THAT. WHAT I CARE ABOUT RIGHT NOW IS GETTING THROUGH THIS TOGETHER IN THE MOST USEFUL AND EFFICIENT MANNER. WE ARE ALWAYS OPEN TO IDEAS, I'M SURE QUARTERBACKS ARE ABUNDANT, BUT SUGGEST, E-MAIL US IDEAS THAT YOU YOU THINK WE MIGHT BE ABLE TO BENEFIT FROM BECAUSE WE REPRESENT EVERYONE ON THIS FRONT.

WE HAVE ONE CITIZEN SIGNED UP TO SPEAK. >> THIS AGENDA ITEM, COMING UP HERE TUESDAY AFTER TUESDAY, HEARING CITIZENS. AND SHARE WITH Y'ALL THEIR HORRIBLE EXPERIENCE ABOUT WHAT'S GOING ON IN THE DISTRICT ATTORNEY'S OFFICE, MY QUESTION TO YOU IS WHAT YOU GONNA DO ABOUT IT. IS THERE ANY ACCOUNTABILITY, IS THERE GOING TO BE ANY CONSEQUENCES FOR THE ALLEGATIONS IN THE COMPLAINTS THAT THESE CITIZENS. AND SHARE WITH Y'ALL? I'LL TELL YOU TWO WEEKS AGO I WENT UP TO THE GOVERNMENT CENTER AND I HATE TO TELL YOU ALL THIS, BUT WE'VE GOT LOTS OF PROBLEMS. ADDING MORE PEOPLE IS NOT THE SOLUTION. GETTING YOUR MONEY'S WORTH OUT OF THOSE THAT ARE THERE, THAT'S SOMETHING Y'ALL MIGHT WANT TO START LOOKING INTO BECAUSE THERE IS A LOT OF SLACKING GOING ON. ONE OF THE THINGS THAT I REMEMBER A COUPLE WEEKS BACK WAS THE GUY THAT CAME UP HERE, HE WORKS FOR THE DISTRICT ATTORNEY'S OFFICE AND HE WAS BEING ASKED ABOUT HOW MANY MORE POSITIONS THEY NEEDED AND ALL THAT STUFF AND HIS RESPONSE WAS SOMETHING ALONG THE LINES THAT THEY WEREN'T SURE. THAT REMINDS ME OF A WORKSHOP I WENT TO FOR THE CITY WHERE ONE OF THE COUNCILMEMBERS WAS TALKING ABOUT A BOND ITEM THAT WAS BEING PUT ON THE BOND FOR CITIZENS TO VOTE ON BUT THEY DIDN'T HAVE ANY IDEA WHAT THEY WERE DOING ONE OF THEM PUT IT ON THERE AND IT WAS LIKE 10 POUNDS OF MANURE BEING STUFFED INTO A 5-POUND BAG. THAT'S WHAT ONE OF THE COUNCILMEMBERS SAID.

ALL THESE REQUEST FOR MORE PEOPLE, BE CAREFUL BECAUSE I CAN TELL YOU YOU CANNOT JUSTIFY A LOT OF THESE THINGS AND I WILL SIT DOWN WITH ANY OF Y'ALL ANY DAY WITH DISTRICT ATTORNEY AND STATE MY POSITION AS TO WHY I. AND ASK Y'ALL TO VOTE AGAINST US.

>> WILL YOU PLEASE OPEN NUMBER EIGHT. >> APPROVE AND ACCEPT THE UPDATED 2019 RACIAL PROFILING REPORT FOR THE HAYS COUNTY OFFICE PRECINCT THREE.

>> AND WE HAVE ONE PERSON SIGNED UP TO SPEAK. >> THANK YOU AGAIN JUDGE, COURT,

[01:00:09]

AGAIN I ASK THAT YOU PLEASE CONSIDER THE SOURCE OF THIS SUBMISSION.

AS I SAID BEFORE I AM DEEPLY CONCERNED AND TROUBLED BY THE THINGS THAT HAVE HAVE BEEN HAPPENING UP IN WIMBERLEY. THERE'S QUITE A BIT OF SERIOUS ALLEGATIONS AGAINST THIS OFFICE. I DON'T KNOW IF THEY'RE STILL GOING TO HABIT, BUT I'M SO CONCERNED ABOUT THIS THAT ON THH OF APRIL, AS I TOLD Y'ALL BEFORE, I'M GOING UP BEFORE THE DPS COMMISSION AND I'M GOING TO ASK THAT THE COMMISSION TO ASK THE COLONEL AS TO WHY THERE'S NO CONSEQUENCES FOR SOME OF THESE ALLEGATIONS AND ACTIONS THAT THIS INDIVIDUAL HAS BEEN PARTICIPATING IN. THIS IS NOT SOMETHING THAT WAS CREATED OVERNIGHT.

I'VE HEARD STORY AFTER STORY ABOUT THIS CONSTABLE THAT Y'ALL SHOLD BE WORRIED ABOUT AND DO SOMETHING ABOUT IT, EVEN BETTER. Y'ALL KNOW Y'ALL GOT A PROBLEM.

I KNOW Y'ALL DO, AND PUTTING A LITTLE BAND-AID ON IT AND GONNA DO ANY GOOD.

I'VE GOT CITIZENS THAT HAVE COME UP AND SAY HOW HE'S BEEN RETALIATED AGAINST AND HIS& HORRIBLE EXPERIENCE DEALING WITH THE DISTRICT ATTORNEY'S OFFICE TO SO AGAIN, PLEASE CONSIDER THE SOURCE OF WHO'S SUBMITTING THESE THINGS BECAUSE I CAN ASSURE YOU THERE ARE SOME QUESTIONABLE CONDUCT THAT'S HAPPENING OVER THERE. THANK YOU.

>> THANK YOU. DO WE HAVE A MOTION. >> SO MOVED.

>> AND A SECOND. >> WE HAVE A MOTION AND A SECOND, NOW WE HAVE COMMENTS.

>> THE CONSTABLE HAS ASKED US TO ACCEPT THIS AMENDED REPORT, HE MADE A MISTAKE ON HIS INITIAL FILING AND HAS REFILED THIS WITH THE STATE AND HAS ASKED US TO ACCEPT THIS AMENDMENT.

>> AND YOU, I'M SORRY WHEN THIS WAS ORIGINALLY FILED I WAS OUT OF THE STATE.

CAN YOU HELP US, IF YOU KNOW, IF IT'S AVAILABLE TO YOU, AND IF YOU DON'T THAT'S OKAY, BUT CAN YOU HELP US UNDERSTAND SOME STARK DIFFERENCE BETWEEN THE ORIGINAL HERE.

THIS IS SIMPLE PROOF THAT EVEN WHEN WERE DEALING WITH CORONAVIRUS, THE GOVERNMENT STILL GOES ON, WE STILL HAVE TO DO THESE ESSENTIAL SERVICES. THIS IS A REMINDER, WHAT CAN WE SAY ABOUT THE STARK DIFFERENCE BECAUSE WHEN I SAW THE ORIGINAL REPORT IT WAS ALARMING TO ME, TO SAY THE LEAST AND THEN WHEN I SAW THE REVISED IT WAS DIFFERENT IN MANY WAYS AND SO I COULD SEE A TRANSPOSING OF NUMBERS, I CAN SEE I MIX UP TWO LINES, BUT THIS HAD, FROM WHAT I REMEMBER THIS HAD SEVERAL THROUGHOUT EDITS. DO YOU KNOW ANYTHING ABOUT THAT.

>> ALL I CAN TELL YOU IS I WAS TOLD THEY ENTERED THE NUMBERS IN THE WRONG COLUMNS.

I'M NOT A LAW ENFORCEMENT OFFICER, I DON'T EVEN HAVE ACCESS TO THESE RECORDS, THIS IS PURELY OUR RESPONSIBLE WAY TO ACCEPT WHAT IS FILED WITH US AND, LIKE YOU I DID NOTICE THERE ARE SOME DRAMATIC CHANGES IF YOU COMPARE THIS TO WHAT WAS UP FOR PREVIOUS APPROVAL.

I AM TOLD THESE ARE THE ACCURATE NUMBERS AND THEY HAVE BEEN RESUBMITTED TO THE STATE AND

BEEN ASKED TO ACCEPT IT. >> SO MY QUESTION IS, MAYBE TO MR. KENNEDY, DO WE HAVE THE AUTHORITY TO ASK FOR THE DOCUMENTATION THAT CREATED THIS DOCUMENT TO BEGIN WITH SO WE CAN

VERIFY ITS VALIDITY OR WHOLESOMENESS OR COMPLETENESS. >> THERE WAS AN EXPLANATION PROVIDED BY CONSTABLE HELM BY E-MAIL TO THE COURT OR AT LEAST I RECALL SEEING ONE.ESSENTIALLY THE NUMBERS HAD BEEN RECORDED BACKWARDS. I DON'T KNOW IF THAT'S BECAUSE

IT WAS WRONG COLUMN OR JUST CHECK THE BOX. >> I THINK HE PUT THE PERCENTAGES ON THE WRONG, THE REASON THIS, I BELIEVE IS NOT OF PARTICULAR CONCERN TO THIS COURT IS THAT THIS REPORT IS FILED WITH.

AND THEY HAVE THE AUTHORITY OR ABILITY TO AUDIT THAT NUMBER. THE STATUTE REQUIRES THAT BE REPORTED HERE AND I'VE ALWAYS INTERPRETED THAT TO MEAN THAT IT IS MEANT TO CREATE AN ANNUAL RECORD FOR THESE LAW ENFORCEMENT AGENCIES, AND IT WAS NOT ANTICIPATED THAT THE COURT WOULD LAUNCH AN INVESTIGATION AND GO INTO THAT BECAUSE THAT'S THEIR JOB IF THEY SEE FIT TO DO SO.

[01:05:03]

>> THAT'S A GOOD WORD CHOICE, I WOULD BE LAUNCHING AN INVESTIGATION, THAT'S TRUE,

WHICH I DON'T HAVE THE AUTHORITY TO DO. >> CERTAINLY NO PROBLEMS WITH YOU ASKING QUESTIONS AND IF YOU WANT TO INQUIRE I'M SURE THEY WOULD BE HAPPY TO EXPLAIN FURTHER. BUT AS FAR AS THE AUDIT GOES, I'VE ALWAYS INTERPRETED THAT TO

BE THEIR JOB TO DO. >> THANK YOU FOR THAT CLARIFICATION.

BUT YOU GOTTA KNOW, MY EAR WAS ALMOST SNAPPED OFF FROM HOW MUCH IT WAS BENT ON THIS ORIGINAL REPORT. I WOULD LIKE TO SEE IF THEY COULD PROVIDE, AND IT'S NOT AN INVESTIGATION, BUT THANK YOU FOR THAT WORD CHOICE CLARIFICATION, I'M NOT TRYING TO INVESTIGATE BECAUSE THEY MAY NOT HAVE THE AUTHORITY TO INVESTIGATE FROM WHAT I'M HEARING, NEVERTHELESS I'D LIKE TO SEE IF OUR CONSTABLE OR OUR COMMISSIONER, SINCE THAT MAY BE THE SPACE WHERE YOU MIGHT SEE HIM MORE OR, I DON'T KNOW THE RELATIONSHIP POTENTIALLY, I'M NOT TRYING TO LOOP YOU IN ANY WAY BUT IF THERE'S A WAY I COULD GET ACCESS TO THE INFORMATION THAT GENERATED THE REPORT, I THINK IT WOULD PACIFY A LOT OF CONCERNS THAT HAVE BEEN SHARED WITH ME, AND IF I COULD, WITHOUT MAKING AN INVESTIGATION, GET SOME LEVEL OF COMFORT HOW THIS REPORT CAME TO BE I THINK

IT WOULD BE VERY USEFUL. IF YOU DON'T THINK THAT'S. >> YOU CAN WHAT ASK ANY OF THE QUESTIONS WE'D LIKE TO. AGAIN, THIS IS THE RESPONSIBILITY OF AN ELECTED CONSTABLE TO KEEP THESE RECORDS JUST LIKE OUR SHERIFF AND TO SUBMIT THEM, AND IF THEY MADE A MISTAKE, AT LEAST HE'S TRYING TO FIX THAT, AGAIN I DON'T KNOW, WE DON'T HAVE ACCESS TO THOSE REPORTS AND I DON'T BELIEVE WERE SUPPOSED TO, I THINK MR. KENNEDY SAID IT BEST, THIS IS PROBABLY HERE BECAUSE THEY WANT TO GET THIS INTO THE RECORD. I DON'T BELIEVE WE HAVE, I DON'T TO INVESTIGATE LAW ENFORCEMENT OFFICIALS RECORDS. I DON'T THINK THAT'S WHY THIS IS HERE. I THINK IT'S TO PUT IT IN THE RECORD, AND IF IT WAS WRONG, I'M HOPING THIS ONE WAS CORRECT, AND IF NOT I'M HOPING IT IS CORRECTED SOON.

>> YES, I THINK THE UPDATED RECORD HAS BEEN SUBMITTED. >> YES, THAT REPORT IS IN BACKUP

WHICH LOOKS LIKE IT WAS FILED MARCH THE SEVENTH. >> SO MY FINAL PIECE ON THIS SO WE CAN VOTE ON IT IS NOT BECAUSE YOU HAVE TO, BUT BECAUSE I'M ASKING YOU TO, TO PROVIDE ME WHATEVER YOU FIND USEFUL TO HELP VALIDATE THIS UPDATED REPORT, WILL YOU PLEASE CALL THE ROLL.

>> I HAVE CLARIFICATION, MARK, WERE JUST ACCEPTING IT WERE& REALLY NOT APPROVING IT, ARE

WE. >> THAT'S RIGHT. HOW DOES THE ITEM READ.

>> APPROVE AND ACCEPT. >> I REALLY THINK YOU'RE JUST RECEIVING OR ACCEPTING IT.

>> OKAY AND I THINK, COMMISSIONER SHOW ME THE MOTION WILL YOU PLEASE CALL THE ROLL.

I'M NOT TRYING TO CAUSE CONFLICT. I'M JUST WERE JUST GOING TO

CHANGE THAT TO ACCEPT, IS THAT ALL RIGHT MR. COMMISSIONER. >> YES OKAY.

PLEASE CALL THE ROLL. >> COMMISSIONER INGLEBY, COMMISSIONER JONES, COMMISSIONER SHALL, COMMISSIONER SMITH JUDGE.

IT HAPPENS RIGHT HERE BY THE PARK SO I KNOW THERE'S A LOT OF PRESSURE, I KNOW THERE'S GOING TO BE A LOT OF PRESSURE WITH THIS COVID 19 SITUATION. SOME FOLKS CAN HANDLE IT, SOME FOLKS CAN'T. I JUST WANT TO MAKE SURE, I'M ALL ABOUT SAFETY AND IF SHE'S IN-AND-OUT OF TRAFFIC, FAILING AND VIOLATING TRAFFIC LAWS, I JUST WANTED TO TELL YOU THAT IS NOT MY JOB TO COME APPEAR AND I GUESS RAT ON PEOPLE, IT'S NOT MY JOB, BUT AS A TRANSPORT OF STUDENTS HERE IN THIS AREA, ESPECIALLY WHEN IT HAPPENS THERE, I'M GONNA BRING IT TO

WE WILL LOOK INTO IT. >> OUR CAR HAS A CAMERA IN IT SO WE CAN ALWAYS AUDIT JUST TO VERIFY BECAUSE WE DON'T ENCOURAGE PEOPLE BEING ON THE PHONE WHILE DRIVING.

>> ANYWAY, BECAUSE OF THE ORDER, JUDGE LIMITING THE GATHERING OF TEN PEOPLE, SHE SUGGESTED WE USE THOSE FUNDS FOR SOCIAL MEDIA OUTREACH. I KNOW SHE IS GOING TO GET WITH EACH COMMISSIONER COURT MEMBER TO HAVE THEM MAKE A PRESENTATION THEY CAN THEN RELEASE AND SO I THINK THIS IS ANOTHER WAY WE CAN GET THAT INFORMATION OUT AND MAKE SURE AS MANY PEOPLE AS WE

CAN GET COUNTED FOR THIS CENSUS OUTREACH. >> THIS IS A GOOD TIME TO FILL OUT YOUR FORM, A LOT OF PEOPLE ARE HOME AND THAT'S EXACTLY RIGHT COMMISSIONER.

I DO HAVE A CONCERN, AND I WOULD ASK AGAIN THAT.

JUST WANT TO LET Y'ALL KNOW THAT I'LL NEVER BE ABLE TO SIT HERE AND SAY THIS IS A GOOD IDEA FOR THIS MAGISTRATE AND DIVISION. THAT'S WHAT YOUR GPS ARE FOR. THIS IS COSTING US LOTS OF MONEY AND Y'ALL NEED TO BE CAREFUL ABOUT THESE REQUESTS COME IN BEFORE Y'ALL.

>> THANK YOU. COMMISSIONERS, I KNOW THIS WAS PART OF OUR ROADMAP TO HAVE THE MAGISTRATES AND CREATED WITH TWO PART-TIME MAGISTRATE'S AND THE SUPPORTING TOOLS, COMPUTERS, ET CETERA TO DO THIS, AND I KNOW IN MY VERY FIRST BUDGET AS COUNTY JUDGE I ALLOCATED $4 MILLION TO OUTSOURCING, THAT'S A SHOCKING NUMBER, IT'S HIGH AND I AM GRATEFUL, ALREADY DURING THIS CORONAVIRUS SITUATION JUDGE MORE, ALONG WITH JUDGE SPIEL AND OUR JUDICIAL SYSTEM HAVE FOUND WAYS TO HELP WITH THE ASK AND THEY HAVE BEEN VERY EFFECTIVE IN HELPING US SIFT THROUGH ANYTHING THEY CAN DO TO HELP US IN THIS OVERALL PROCESS, AND SO, I BELIEVE THAT JUDGE MOORE'S DEDICATION TO THIS SPECIFICALLY, EXCLUSIVELY WITH HIS TWO PART-TIME ASSISTANTS TO MAKE SURE WE HAVE SEVEN DAY A WEEK COVERAGE TO BRING DOWN THAT POPULATION THAT DOESN'T NEED TO BE THERE IS ACTUALLY VERY GOOD USE OF OUR TAXPAYER DOLLARS BECAUSE MY HOPE IS WE SOON GET RID OF THE 4 MILLION-DOLLAR OUTSOURCING LINE ITEM WHICH CAN BE VERY, VERY BENEFICIAL TO US

AND THE CITIZENS WE ARE CHARGED WITH SERVING. >> JUDGE I AGREE WITH THOSE COMMENTS. I THINK WE'VE CREATED THIS DEPARTMENT SO THAT WE COULD, MY VISION WAS TO LOWER THE NUMBER OF INMATES ARE PEOPLE THAT WE WERE MAGISTRATE AND OR SENDING, BEING PROCESSED THROUGH OUR COUNTY JAIL. WHEN I SAW THIS AGENDA ITEM, I KNOW WE HAD FIRST LOOKED AT INDIVIDUALS THAT WOULD WORK THE WEEKEND SO WE COULD HAVE AS MUCH OF A 24 HOUR COVERAGE AS WE NEEDED, AND I SEE WITH THE BACKUP, THE SUMMARY DOES SAY BECAUSE OF IRS REGULATIONS IT WAS DETERMINED THAT THESE DUTIES WOULD NEED TO BE CLASSIFIED AS PART-TIME, AND SO I GUESS I WAS JUST, YOU HAD ASKED LANE VERY WELL OR ARE WE HAVING TWO

PART-TIME. >> I DON'T BELIEVE THE NUMBER HAS BEEN SET AT THIS TIME.

IT COULD CHANGE DEPENDING ON SCHEDULING AND I GUESS SOME BACKGROUND INFORMATION IS THAT THE MENSTRUATION HAS DONE WITHIN 48 HOURS. BY LAW WE TRY TO DO IT EVERY DAY

[01:25:03]

SEVEN DAYS A WEEK 3625.DAYS A YEAR AT LEAST ONE TIME A DAY. SOMETIMES WE DO IT MORE THAN ONE TIME A DAY. THAT'S BEEN HANDLED BY THE GPS AND MUNICIPAL PART TRAIN COURT JUDGES OF THE COUNTY. THEY RECENTLY HAVE DIFFERENT DAYS THEY WERE ASSIGNED TO AND THEN THEY TAKE A CALENDAR FOR ALL THE WEEKENDS AND HOLIDAYS AND SPLIT THOSE UP EQUALLY SO THERE IS SOMEONE WHO DOES REGISTRATION EVERY DAY FOR THE ENTIRE YEAR DURING THE BUDGET PROCESS WE'VE DISCUSSED THE ABILITY TO CREATE AN OFFICE OF MAGISTRATES AND TO HAVE SOME CONSISTENCY ON HOW THAT IS DONE, ALSO HELP US ON SOME OF THE OTHER REFORM MEASURES WE WERE PUTTING IN PLACE AT THE JAIL THAT ARE CLOSELY ASSOCIATED WITH THIS OFFICE AND WORK TOGETHER WITH THIS OFFICE. WE BUDGETED THOSE FUNDS TO CREATE THE POSITION AND THESE PART-TIME POSITIONS WE HAD JUST BUDGETED THE FUNDS, WE HAD NOT CREATED ANY POSITIONS.

A FEW WEEKS AGO WE FORMALLY CREATED THE CHIEF MAGISTRATE POSITION THAT IS NOW BEEN JUDGE MORE. THOSE OTHER FORMS ARE STILL THERE BUT TODAY WERE BUDGETING THEM INTO A SHARED PART-TIME POSITION THAT THEY WILL THEN FILL WITH OTHER MAGISTRATES.

THOSE WOULD BE ATTORNEYS, LOCAL ATTORNEYS THAT ARE VETTED THROUGH THE COURTS, BOTH OUR COUNTY AND DISTRICT COURTS. SOME OF THE ISSUES THAT THIS HELPS SOLVE IS WHEN A MAGISTRATE ISSUES A BOND ON AN INMATE, IF THAT INMATE AND THEIR ATTORNEY THEN GO TO THE COURT TO ARGUE THE REDUCTION IN THAT IN THE EFFORT TO TRY TO GET THAT INMATE OUT OF THE FACILITY AND SUPERVISE POTENTIALLY THROUGH OUR COMMUNITY SUPERVISION DEPARTMENT, THEN THAT ORIGINAL MAGISTRATE IS THE ONE THAT HAS TO PROVE THAT. SO WE ARE NOW HAVE A MAGISTRATE THAT HAS THAT AUTHORITY THROUGH BOTH OF THE COURTS, DISTRICT AND COUNTY COURTS WHICH WILL STREAMLINE THAT PROCESS AND HOPEFULLY ALLOW THAT TO HAPPEN QUICKER WHEN ALL PARTIES AGREE THAT IS SOMETHING THAT SHOULD BE DONE INSTEAD OF A JP WHO IN THEIR PRECINCT DOING OTHER DUTIES AT THAT TIME, HAVING TO BE BROUGH INTO THAT LOOP. THAT IS ONE OF THE REASONS I BELIEVE THIS ONE WILL IMPROVE SOME EFFICIENCIES AND THEN ALL OF THE OTHER DIFFERENT MEASURES WE BEEN WORKING ON, ONE IS THE COUNCIL AND REGISTRATION STUDY, THIS WILL WORK VERY WELL WITH THAT, HAVING A CONSISTENT PROCESS FOR REGISTRATION, IT WILL ALLOW US TO GET VERY GOOD DATA AND TO TRULY ANALYZE NOT JUST THE EFFECTIVE COUNSELOR MAGISTRATE SHOULD BUT ALSO OTHER MEASURES THAT WE ARE TAKING WITHIN OUR CRIMINAL JUSTICE SYSTEM BECAUSE THEY WILL BE MEASURING THE OUTCOME OF EVERYTHING A PERSON THAT GOES THROUGH OUR JAIL.

I THINK THIS WILL ALSO HELP FACILITATE THAT. >> AND TO ANSWER YOUR QUESTION, IF I'VE MISSED IT AND WHAT ARE COMMISSIONER JUST SAID, THE ORIGINAL ROADMAP IS ONE CHIEF

MAGISTRATE AND TWO-PART TIMES. THAT WAS THE ORIGINAL MESSAGE. >> I THINK SO.

IT JUST DEPENDS ON HOW THEY DO IT. THE MONEY IS THE SAME REGARDLESS OF THEY HAVE MORE IT WILL BE SPLIT UP IN DIFFERENT WAYS. THE MONEY WILL BE FIXED.

ALSO. SHE OR HE HAS BEEN HIRED, IS THAT CORRECT?

>> I KNOW WE ARE SURROUNDED BY GOOD PEOPLE. WE ARE REARRAGING THE SEATS JUST TO CREATE A DIFFERENT DYNAMIC, DIFFERENT WAY OF LOOKING AT THINGS, TO MOVE THINGS ALONG IN A DIFFERENT MANNER SO I WOULD LIKE TO SAY, AS ARE JP AND MUNICIPAL COURT JUDGES HAVE HANDLED THIS, IT IS BECAUSE OF OUR JAIL POPULATION ISSUE, IT HAS PUT QUITE A BURDEN ON THAT. WHEN YOU'RE GOING TO DO THAT IT MEANS YOU HAVE TO BE AVAILABLE TO DO IT, AND IF THE JAIL CALLS AND SAYS WE NEED TO DO A SECOND REGISTRATION THIS AFTERNOON, THEN YOU HAVE TO BE AVAILABLE TO DO IT ON CHRISTMAS DAY YOU HAVE TO BE AVAILABLE TO DO THEM.

THEY'VE BEEN ABLE TO MANAGE THAT THROUGHOUT ALL OF THESE YEARS SO I ALSO WANT TO THANK THEM FOR TAKING THAT ON AND BEING WILLING TO DO THOSE SERVICES ON WEEKENDS, HOLIDAYS AND SHOW UP WHEN CALLED. THEY SAY WE NEED TO GET A GROUP OF PEOPLE THROUGH MAGISTRATE AND GET THEM OUT OF HERE SO I DO WANT TO THANK THEM FOR DOING THAT FOR THOSE YEARS IN A VERY

DIFFICULT TIME AS FAR AS OUR JAIL OVERCROWDING. >> ABSOLUTELY DIFFICULT.

WHEN I GOT MY TOUR WHEN I WAS FIRST ELECTED I WENT TO VISIT AS MANY OFFICES AS I COULD, AND I'LL NEVER FORGET, WHEN I WALKED INTO THE JUDGE SMITH'S OFFICE, SHE HAD US OVER THERE AND SHE TOLD ME JUDGE, MAYBE I SHOULDN'T OF SET IT BUT TOO LATE NOW I'VE STARTED, SHE SAID THAT JUDGE DON'T SAY ANYTHING BUT WHEN I HAVE A LONG DAY AND I'VE GOT A SIT DOWN FOR A MINUTE THAT'S WHERE I TAKE THEM OUT BEFORE I HAVE TO GO BACK TO THE JAIL. IT IS AN AROUND-THE-CLOCK JOB

[01:30:08]

AND IT IS A THANKLESS JOB VERY OFTEN. >> AND JUDGE SMITH ALSO TOOK ON

THE RESPONSIBILITY OF DOING THAT ON THE WEEKENDS. >> SHE'S DONE A GREAT JOB ON MANY FRONTS AND ALL THE GPS ARE VERY PRODUCTIVE AND THEY DO MANY OTHER THINGS, I HAD THEM ALL IN MY OFFICE JUST LAST WEEK TALKING ABOUT HOW TO HANDLE COVID-19 AND DIFFERENT TYPES OF CALLS.

I WON'T GET INTO THAT BUT THEY DO A LOT OF WORK THAT NO ONE EVER SEES.

>> AND JUDGE ALSO ABOUT BEING MORE EFFICIENT WITH THIS MAGISTRATES INCOME YOU TALK ABOUT OUTSOURCING BUT EVEN IF IT KEEPS A PERSON OUT OF OUR COUNTY JAIL THERE IS A COST TO THAT ALSO. SO ANY SAVINGS WHETHER IT'S OUTSOURCING OR IN-HOUSE.

>> WE'VE BENEFITED. THE FASTER WE PROCESS OF BOOKING, THE BETTER.

SO WILL YOU PLEASE CALL THE ROLL.

[Items 26 & 27]

>> WILL YOU PLEASE OPEN 26 AND 27. >> NUMBER 26, AUTHORIZED BUILDING MAINTENANCE TO ACCEPT 815,800-DOLLAR PROPOSAL FROM THE BPS OF TEXAS, THE HAYS COUNTY JANITORIAL CONTRACTOR TO DISINFECT ALL COUNTY BUILDINGS WITH EARTH SAFE PRO TAB DISINFECTANT RELATED TO THE COVID-19 PREPAREDNESS AND RESPONSE FOR BUILDING SANITATION. 27, APPROVED SPECIFICATION FOR ISP 2020, ROADWAY STRIPPING AND

AUTHORIZED FOR BIDS AND ADVERTISEMENTS. >> FOR GOOD MEASURE COURT, ON ITEM 26 WE WOULD ASK THAT YOU ADD TO YOUR MOTION AND EXEMPTION UNDER 26 2.0 24 IN THIS CASE IT WOULD BE A2 WHICH IS WHEN WE DON'T USE VERY OFTEN, THAT IS A& ITEM NECESSARY TO PRESERVE AND

PROTECT THE PUBLIC SAFETY OF THE RESIDENTS OR COUNTY. >> CAN WE GET A MOTION AND

SECOND, I WANT TO CALL TAMMY UP. >> WE HAVE A MOTION AND SECOND PERIOD WILL YOU EXPLAIN AND EXPAND ON NUMBER 26, THE PBS PROPOSAL.

>> IN OUR CURRENT CONTRACT, THIS IS ONE OF THE SERVICES THAT'S PROVIDED AS EXTRA SERVICE THEY OFFER. THE INITIAL QUOTE WE RECEIVED WAS 35 CENTS.

SQUARE FOOT BECAUSE IN TOTALITY WE HAVE ALMOST 400,000 SQUARE FEET WE WERE ABLE TO GET THAT DOWN TO FOUR CENTS. SQUARE FOOT. THIS WOULD COVER ALL OF OUR COUNTY BUILDINGS ARE UNDER CONTRACT AND THEY WOULD DO THIS AT NIGHT WHEN THERE WAS NO, THERE ARE NO OCCUPANTS IN THE BUILDING. I ALSO UNDERSTAND WE CAN LIST IT

AS PART OF OUR POTENTIAL REIMBURSEMENT. >> YES, MA'AM.

THANK YOU. THAT'S GREAT NEWS. >> IF YOU HAVE ANY QUESTIONS ON

THE PRODUCT ITSELF, IT IS IN BACKUP. >> COMMISSIONERS, ANY QUESTIONS.

>> THANK YOU FOR REACHING OUT AND LOOKING INTO THAT ABILITY. THAT'S VERY, ABSOLUTELY USEFUL

AT THIS TIME. >> AND IT CAN GET DONE AS EARLY AS THIS WEEK, AS EARLY AS

TOMORROW. >> AS EARLY AS TONIGHT. THANK YOU.

PLEASE CALL THE ROLL.

[28. Ratify the purchase of one (1) Clorox Total 360 Sprayer for $5,610.22 related to COVID-19 preparedness and response for building sanitation. BECERRA/VILLALOBOS]

28, RATIFIED THE PURCHASE OF A 360 SPRAYER FOR 5610 AND 22 CENTS RELATED TO COVID-19

PREPAREDNESS AND IN RESPONSE FOR BUILDING SANITATION. >> WE HAVE ONE PERSON SIGNED UP

TO SPEAK. MR. DAN LYON. >> THANK YOU JUDGE, COMMISSIONER AND VIRTUAL COMMISSIONER SMITH. COLD DRY AIR IS CONDUCIVE TO THE SPREAD OF CORONAVIRUS.

COULD WE DIAL THE AC BACK TO SEAL. I BELIEVE THIS PROPOSAL IS RIDICULOUS AND HERE'S WHY. WE DON'T HAVE THE MONEY. THE GOOD TIMES IN HAYS COUNTY ARE PROBABLY OVER. WE MIGHT BE GOING INTO A DEPRESSION RIVALING THAT OF THE GREAT DEPRESSION. ALSO, AEROSOLIZED CLOROX IS DANGEROUS, CLOROX, CHLORINE, ANYWAY, I'M ONE OF THOSE DELI ACRES THAT THE JUDGE WAS REFERRING TO LAST NIGHT, I ATE SOME SALAD WHICH WAS PAST ITS PRIME, I DID NOT WANT TO WASTE IT BECAUSE WE HAVE SHORTAGES AT THE GROCERY STORE. THE REASON THE GROCERY STORES ARE BEING EMPTIED IS BECAUSE THE PUBLIC DOES NOT TRUST THE GOVERNMENT. ESPECIALLY WHEN WE HEAR WILDLY CONFLICTING INFORMATION. SHOULD WE NOT QUARANTINE THOSE THAT TEST POSITIVE AS WELL THOSE THOSE WHO ARE IN HIGH RISK CATEGORIES. IF THERE IS MORE TO THIS

[01:35:02]

CORONAVIRUS THEN WE HAVE HEARD IN THE NEWS MEDIA, AND THIS VIRUS IS WORSE THAN THE PUBLIC HAS BEEN TOLD, AND YOU JUDGE HAVE INFORMATION ON IT WHICH, IF IT WERE TO BE SHARED WOULD SAVE LIVES, THEN YOU HAVE A HIGHER OBLIGATION TO SHARE WITH THE PUBLIC.

I DO NOT BELIEVE THE SNAKE AND BAT STORY. I THINK IT'S A BUNCH OF COTTON BOWL PERSONALLY. BUT THAT'S MY OPINION. AS YOU SAID MORE THAN 50% OF THE CASES THAT WILL BE DISCOVERED POSITIVE ARE OF PEOPLE THAT ARE ASYMPTOMATIC.

THAT MEANS TO ME THAT MEANS THAT THE VIRUS IS NOT AS SERIOUS AS WE HAD BEEN LED TO BELIEVE.

WE HAVE HAD SEVEN CONFIRMED CASES OF COVID-19 IN HAYS COUNTY SO FAR, I KNOW YOU SAID WHAT TESTING IT WILL GO UP, I BELIEVE YOU, BUT WE HAVE HAD EIGHT CONFIRMED RATTLESNAKE BITES ON THE COUNTIES NATURE TRAIL. HAVE WE OUTLAWED RATTLESNAKES OR ARE WE GOING TO SHUT DOWN THE NATURE TRAILS, I DOUBT EITHER ONE OF THOSE ARE GOING TO HAPPEN.

LET ME JUST SAY, THIS IS JUST ANOTHER THING THAT WE ARE SPENDING MONEY THAT WE DON'T HAVE, WERE JUST ADDING IT TO THE DEBT AND WERE ALREADY PAYING $40 MILLION TO SERVICE THAT DEBT EVERY YEAR, AND IT'S WELL OVER 500 MILLION WHICH IS OVER HALF A BILLION, AND WE CAN'T DO THIS.

WE CAN'T KEEP DOING THIS. WE HAVE GOT TO CUT DOWN ON SPENDING SOMEWHERE.

LIKE I SAID WE ARE POSSIBLY GOING INTO A DEPRESSION, WORSE THAN THE GREAT DEPRESSION.

THANK YOU VERY MUCH. >> THANK YOU MR. LYON. I'M SORRY YOU WENT SO FAR AWAY,

BUT WE YOU APPROACH THE PODIUM. >> I BELIEVE THAT THIS SPRAYER, OR HOW ABOUT I JUST ASK YOU, CAN YOU EXPAND ITS VALUE AND PLAN FOR THIS SPRAYER ON A COUNTYWIDE EFFORT.

>> IT WOULD BE HOURS AND WE COULD USE IT AS OFTEN AS WE WOULD NEED TO.

IT WOULD ALSO BE ABLE TO SPRAY VEHICLES ON A REGULAR BASIS THAT ARE TRANSPORTING INMATES IN COUNTY VEHICLES THAT PEOPLE ARE IN-AND-OUT OF PUBLIC BUILDINGS. I DON'T KNOW, ALEX DO YOU KNOW,

MY COMPUTERS DOWN. >> IT SAYS 5600 FOR THE SPRAYER.

>> THE PRODUCTS THAT GO IN IT. >> OH, I DON'T NEED THE SPECS, BUT I WANTED TO ASK YOU JUST TO

DOUBLE CHECK. >> I KNOW IT COVERS ABOUT 18000 SQUARE FEET.

SPRAY OR. SOLUTION AND IT. >> AND THIS WOULD BASICALLY PUT

IN-HOUSE WHAT PBS IS GOING TO DO FOR US. >> YES WE WOULD USE IT DURING THE FLU SEASON, WE COULD'VE USED IT A GREAT DEAL DURING THAT TIME, WE HAD OFFICES THAT WERE ALMOST COMPLETELY DOWN, EMPLOYEES THAT COULD SANITIZE AN ENTIRE OFFICE, BUT JUST HAVING ONE ON HAND OURSELVES, I THINK WOULD HAVE MADE A HUGE DIFFERENCE.

>> WE CAN USE THIS EVEN WHEN THIS IS OVER. >> ABSOLUTELY.

>> PERFECT. THAT'S GREAT. >> WE CAN GET AHEAD OF THE ISSUE

INSTEAD OF FALLING BEHIND. >> AND ITS AVAILABLE? I WOULD THINK THERE'S A BACKLOG

ON THESE BABIES. >> IT WAS AVAILABLE AT THE TIME OF THE AGENDA ITEM.

>> WHERE THE FUNDS COMING FROM. >> WE ARE CODING IT TO THE EMERGENCY DISASTER AND WERE

HOPING TO GET REVERB FIRST. >> I WAS JUST CAN ASK ALEX, I KNOW YOU AUTHORIZE THE

PURCHASE. WHO CONTACT YOU REGARDING THIS. >> IT'S A MACHINE THAT CAN BE DEPLOYED ANYWHERE, NOT ONLY JUST FOR HAYS COUNTY BUT IT CAN ALSO BE DEPLOYED TO SOME OF OUR REGIONAL PARTNERS WHO NEEDED IF THEY HAVE SOME INFECTIONS AND THINGS THAT NEED TO BE DONE THERE. IT'S SOMETHING NOT JUST FOR US, BUT FOR OUR REGION AND COMMUNITY. TYPICALLY YOU WANT ONE OF YOUR OWN BECAUSE EVERYBODY ELSE HAS THEIRS AND THEIR UTILIZE IN DIFFERENT WAYS FOR EMS, FIRE, THOSE KINDS OF THINGS AND IN OUR RECENT EXPOSURE FOR FLU THAT WAS ONE OF THE THINGS WE HAD TO WAIT TO GET OURS TO COME IN AND

[01:40:03]

DISINFECT SOAP WE COULD'VE ACTUALLY TAKEN CARE OF THAT RIGHT AWAY.

THAT HAPPENED IN A DISPATCH OFFICE WHICH KIND OF ERADICATED SOME OF THE ISSUES WE WERE HAVING THERE. THIS ALLOWS US TO RESPOND AND USE IT AS REQUESTED IN CERTAIN

TIMES OF ITS FREE FOR WHOEVER NEEDS IT. >> AND WE HAVE THAT ON HAND NOW,

IS THAT CORRECT. >> WE DON'T HAVE IT, WE ARE ORDERING IT.

>> AND I KNOW WE TALKED ABOUT IT. >> IT SAYS RATIFIED THE

PURCHASE. >> THE PURCHASE ORDER HAS BEEN SENT BUT IT HAS NOT BEEN

DELIVERED. >> SORRY COMMISSIONER. I INTERRUPTED YOU.

EITHER ONE OF YOU. >> IT WAS NOT ON BACK ORDER AT THE TIME.

>> I KNOW WE TALKED ABOUT IT AND I WAS IN FULL SUPPORT WHEN IT WAS BEFORE ME, BUT I DON'T REMEMBER SEEING A PICTURE OF IT. CAN YOU GUYS JUST DESCRIBE IT OR WHAT IT LOOKS LIKE HER ANYTHING TO GIVE ME A VISUAL. THAT WOULD BE AWESOME.

SORRY. THANK YOU MR. RAVEN. I WANT TO KNOW IF IT'S LIKE A WAND OR IF IT'S LIKE A BUS. BEAUTIFUL. VERY MANAGEABLE.

WHAT I'M BEING SHOWN BY OUR FIRE MARSHAL IS A MACHINE THAT COULD LOOK LIKE A SMALL PRESSURE WASHER. THAT'S GOOD. THAT'S VERY MANAGEABLE, AND MAYBE WE CAN CREATE A ROTATION COUNTYWIDE SO WE JUST KEEP UP WITH THIS REGULARLY BECAUSE I'M SURE WE CAN TABULATE WITH OUR HR DIRECTOR HOW MANY SICK DAYS WE CAN PROBABLY AVOID IF PEOPLE

HAVE THIS IN ROTATION SOMEHOW. >> IF I COULD JUST ADD TO IT JUST A LITTLE BIT, SO IT IS UNDER THE BRAND NAME OF CLOROX. IT IS NOT A BLEACH THAT THEIR SPRING IN THE AIR.

IT'S MORE LIKE A LYSOL SPRAY AND THIS ATOMIZER IS THAT THROUGH THE AIR SO A GOOD EXAMPLE IS OUR EMS AGENCY USES THIS RIGHT NOW TO DISINFECT THEIR AMBULANCE. THEY CAN STICK THIS THING INTO AN AMBULANCE AND THEY CAN DISINFECT THE BACK ABOUT IF SOMETHING WAS IN THERE WITH SICKNESS OR SOMETHING. JANUARY OUR HAYS COUNTY DISPATCHER WAS TRANSMITTING THE FLU AMONGST OUR DISPATCHERS BECAUSE OF THEIR CLOSE PROXIMITY IN THAT SMALL SPACE.

THEY WOULD GET WELL, THEY COME BAC TO WORK, THEY WOULD GET IT AGAIN.

EVERYBODY WAS GETTING SICK. THEY FOUND OUT ABOUT IT, THEY TRANSFERRED ALL THE CALLS AND SAID TO TAKE A 30 MINUTE BREAK AND IN FIVE MINUTES HE DISINFECTED THE WHOLE SPACE.

THE DISPATCHERS WENT BACK TO WORK, THEY GOT WELL AND IMMEDIATELY STOPPED PASSING THE FLU BACK AND FORTH. THAT'S WHAT THAT CAN DO TO A WORKSPACE.

IMAGINE ALL THESE PUBLIC SPACES WE HAVE COME OF THESE PRECINCT OFFICES OR COURTROOM, THIS COURTROOM WHERE EVERYBODY'S EXCHANGING IN-AND-OUT, IT COULD THAT SPACE, JUST RECENTLY WE HEARD FROM ONE OF THE COUNTY JUDGES THAT SAYS A JUROR HAD THE FLU, THE COURT REPORTER THAT SAT RIGHT NEXT TO THE JUROR, SHE GOT THE FLU AND HAD TO BE OUT, WE HAVE TO GO IN THERE AND DISINFECT THAT COURTROOM AND KEEP THIS TRANSMITTING OF COMMON THINGS LIKE FLU AND OTHER THING

FROM GOING PERSON-TO-PERSON. >> BEAUTIFUL. THANK YOU FOR YOUR LEADERSHIP.

I APPRECIATE IT. WE HAVE A MOTION AND A SECOND PERIOD PLEASE CALL THE ROLL.

>> COMMISSIONER SHALL, COMMISSIONER INGLEBY, COMMISSIONER SMITH, COMMISSIONER

DISCUSSION OF POSSIBLE ACTION TO AUTHORIZE THE COUNTY JUDGE TO EXECUTE A PROFESSIONAL SERVICE AGREEMENT WITH ASSOCIATES FOR DESIGN SERVICES RELATED TO THE PARKING LOT EXPANSION OF THE

>> HAPPILY. >> PLEASE OPEN NUMBER 45. >> NUMBER 45, DISCUSSION OF POSSIBLE ACTION TO AUTHORIZE THE EXECUTION OF $1 MILLION LETTER AND CENTRAL TEXAS FOR FY 2020NT-

STEPHANIE WOULD YOU LIKE TO COME UP, AND THIS AGREEMENT IS APPROVED EVERY YEAR, NORMALLY AT THE END OF OUR FISCAL YEAR AND

[01:45:08]

REIMBURSE FOR HEALTHCARE COSTS BECAUSE OF THE TRANSITION OF OWNERSHIP OF THE HOSPITAL, WE HAVE PRORATED THE AMOUNT WE BUDGET FOR THAT YEAR TO SIX MONTHS OF THAT AMOUNT TO REIMBURSE SEE TMZ FOR THOSE COSTS AND THAT REMAINING $1 MILLION WILL BE LEFT IN THE BUDGET FOR THE REMAINDER OF FISCAL YEAR 2020. THE FUNDS, WE ALSO HAVE A LOCAL PROVIDER PROTESTED PATIENT FUND, THOSE ARE OFTEN THE FUNDS WE SENT TO BE MATCHED THROUGH THE 1115 WAIVER. THESE HAVE BEEN BUDGETED FOR YEARS.

ALSO TO BE MATCHED IF POSSIBLE, THE WAY THINGS HAVE BEEN GOING THE WAY THOSE OPPORTUNITIES HAVE DWINDLED, WHAT WE DO IS WE HOLD ONTO THEM AND REIMBURSE AT THE END OF THE YEAR END AT THE END OF SIX MONTHS BECAUSE OF THE CHANGE OF OWNERSHIP. ANY QUESTIONS?

I'M SURE STEPHANIE WOULD BE HAPPY TO ANSWER. >> HE TOOK ALL YOUR WORDS.

DO YOU HAVE ANYTHING TO ADD. >> I'M STEPHANIE NELSON, CFO AT SEE TMZ.

I WOULD LIKE TO INTRODUCE THE PEOPLE WHO REALLY ARE MAKING IT HAPPEN WHICH IS KATHLEEN SCHIMMEL IS OUR LIVE OAK HEALTH PARTNERS ADMINISTRATOR. Y'ALL PROBABLY KNOW KATHLEEN.

AND, AS A MATTER FACT, BUT KATHLEEN IS AN ADMINISTRATOR DOING AN AWESOME JOB.

SHE IS RUNNING THAT COMMUNITY CLINIC OUT THERE WHERE THESE PATIENTS ARE BEING SEEN BY DOCTOR RICHARDSON WHO'S BEEN THERE FOR YEARS. I DON'T EVEN KNOW HOW LONG DOCTOR RICHARDSON HAS BEEN THERE BUT THAT'S A GREAT CONTINUITY OF CARE FOR THOSE PATIENTS TO HAVE THE SAME PRIMARY CARE PHYSICIAN. AND MILLER, YOU PROBABLY REMEMBER HER, SHE IS RESPONSIBLE FOR REALLY MANAGING THE COLLABORATIVE WHICH IS THE ORGANIZATION THAT DOES THE FUNDING FOR THE SPECIALISTS AND THE PHARMACY CARE THAT THESE PATIENTS ARE RECEIVING. THAT OF COURSE THEY GET THERE HOSPITAL CARE AND OUTPATIENT TESTING AT SEE TMZ. I DO WANT TO INTRODUCE THOMAS MCKENNEY, THOMAS IS WITH CHRISTUS AND HE'S GOING TO BE THE CEO APRIL 1, NEXT WEDNESDAY. OF OUR HOSPITAL, YOUR HOSPITAL SO I WANTED TO INTRODUCE HIM AND JUST KNOW THAT I JUST WANTED TO EXPRESS MY APPRECIATION FOR YOU ALL AND THE GREAT PARTNERSHIP THAT SEE TMZ HAS HAD WITH THE COUNTY AND THAT WE WERE ABLE TO FIND A SYSTEM THAT INITIALLY ALIGNED WITH US THAT HAS BASICALLY THE SAME MISSION STATEMENT THAT WE HAVE, OUR MISSION STATEMENT IS ADVANCING THE HEALING MINISTRY OF CHRIST.

THEIRS IS EXTENDING THE MISSION OF JESUS CHRIST. IT'S A GOD THING SO IT'S DEFINITELY A GREAT COMPANY TO BE COMING IN AND RUNNING THIS HOSPITAL.

WE ARE LOOKING FORWARD TO A LOT MORE YEARS OF SERVICE TO HAYS COUNTY SO I JUST WANT TO LET

THOMAS INTRODUCE HIMSELF AND SAY HI. >> JUDGE, COMMISSIONER, THANK YOU STEPHANIE, I APPRECIATE THAT. I'VE BEEN WITH THEM FOR 20 BEEN HERE THIS LONG, I BELIEVE IN OUR MISSION AS OUR FRIENDS HERE AT ADVENT HAVE DONE FOR MANY YEARS AS WELL. ALWAYS HAD A GREAT WORKING RELATIONSHIP WITH MY COUNTY AND LOOK FORWARD TO DOING THE SAME THING HERE AND MAKING SURE WE ARE TAKING CARE OF DECISIONS HERE IN YOUR COUNTY AS YOU WOULD EXPECT. SO LOOKING FORWARD TO IT.

>> THANK YOU. WHERE HAVE YOU BEEN. >> I HAVE BEEN THERE FOR 20 YEARS BUT CAME FROM SOUTH TEXAS AT SPOHN ALICE AND SPOHN CLAYBURGH.

BEFORE THAT I WAS AT NORTHEAST TASKS THIS MANAGING SOME OF OUR HOSPITALS.

>> WONDERFUL. >> WELCOME. AT SOME POINT WE WOULD LOVE, I WOULD LOVE TO SIT DOWN AND TALK WITH YOU JUST TO SEE HOW WE CONTINUE OUR PARTNERSHIP.

IT HAS BEEN A GREAT ONE AS WAS MENTIONED, AND ONE OF THE THINGS THAT I REALLY APPRECIATE THROUGH THIS PARTNERSHIP IS THE ACCESS TO THOSE SPECIALTY DOCTORS THAT WE NEVER HAD IN THE PAST FOR THOSE CLIENTS THAT COME IN AND VISIT OUR CLINIC AND SO IT'S SOE SPECIFIC NEEDS.

I KNOW THAT MARGIE RODRIGUEZ WOULD TELL ME, DEBBIE, I WOULD HAVE TO BEG DOCTORS TO SEE OUR PATIENTS BECAUSE THEY NEEDED SPECIALTY CARE AND THROUGH THIS PARTNERSHIP WE HAVE BEEN ABLE TO ACCESS THOSE DOCTORS AND SO I REALLY APPRECIATE THAT. I HOPE THAT WE CAN CONTINUE THIS

[01:50:02]

PARTNERSHIP. >> IT'S AN OUTSTANDING STRUCTURE THAT THE COUNTY HAS WORKED OUT.

WE HAD A SIMILAR MODEL IN CASS COUNTY WHERE I WORKED WITH OUR COUNTY JUDGE IN VIRTUALLY THE SAME EXACT PROGRAM. IT'S A BEST PRACTICE IN TAKING CARE OF CARE HERE IN THE COUNTY

SO I LOOK FORWARD TO CONTINUING THE PARTNERSHIP. >> HAVE BEEN ASKED IF BUYING A HOSPITAL IS COMPLICATED. IT IS, IT TURNS OUT IT'S MORE COMPLICATED DURING A PANDEMIC.

IT'S LIKE JUMPING FROM ONE TRAIN TO THE OTHER WHILE THEY ARE MOVING IN OPPOSITE DIRECTIONS.
