[E. PUBLIC COMMENTS]
>> SIGNED UP TO SPEAK IN PERSON AND REMNANTS OF COVID, WE STILL ALLOW FOR WRITE- INS, E- MAIL VERSIONS TO BE READ IN COURT. SO THERE'S SOME THINGS WE FIND A LITTLE HARDER TO SHAKE.
>> THANK YOU, JUDGE BECERRA AND COMMISSIONERS.
GOOD MORNING, AND WELCOME TO THE CONTINUING FINANCIAL DISASTER, OTHERWISE KNOWN AS THE HAYS COUNTY COMMISSIONER'S COURT. WE ARE 1 1/2 BILLION DOLLARS IN DEBT, AND WE HAVE FUNNELED $540 MILLION TO THE BANK OF NEW YORK MELON FOR ENTERING A LOAN IN THE LAST SIX MONTHS, AND WE HAVE OVER 100 PAGES OF DEBT, WHICH CAN BE VIEWED IF YOU GOOGLE HAYS COUNTY FINANCIAL TRANSPARENCY. WITH BONDS OUT TO $2,054, AND I'LL TELL YOU THE TRUTH, THIS FEVER IS GETTING TO ME, SO I'M GOING TO CUT IT HERE.
>> APPRECIATE THAT, SIR. PLEASE.
I THINK THAT WAS THE ONLY ONE IN PERSON, AM I RIGHT? ALL RIGHT. SO WE HAVE AN E- MAIL, MEGAN OSBORN, IF YOU'LL START A TIMER FOR THAT ONE AND READ MEGAN'S COMMENTS.
>> TO WHOM IT MAY CONCERN, ON BEHALF OF THE CALDWELL WOMEN'S CENTER, I'M SUPPORTING THE PARTNERSHIP, THE INITIATIVE EXEMPLIFIES THE COLLABORATIVE EFFORT ESSENTIAL TO CREATING COMMUNITIES THAT DON'T TOLERATE VIOLENCE.
AT HCWC, WE ARE SUPPORTING INDIVIDUALS WHO HAVE EXPERIENCED ABUSE, AND ONE OF OUR MOST MEANINGFUL COLLABORATIONS IS WITH THE CORE 4 PARTNERSHIP YOUTH TASK FORCE. TOGETHER WE HAVE FACILITATED YOUTH- LED ACTIVITIES THAT PRIORITIZE POSITIVE YOUTH DEVELOPMENT AND ADDRESS CRITICAL TOPICS SUCH AS BYSTANDER INTERVENTION. CONSENT AND SELF-COMPASSION.
THESE INITIATIVES EQUIP YOUNG PEOPLE WITH PRACTICAL TOOLS, BUT ALSO EMPOWER THEM TO BE AGENTS OF CHANGE WITHIN THEIR COMMUNITIES.
THE SUSTAINABILITY HINGES ON ADEQUATE FUNDING, RESOURCES PROVIDED THROUGH THE CORE 4 PARTNERSHIP ARE ESSENTIALLY TO ENSURING THAT WE CAN CONTINUE TO MEANINGFULLY ENGAGE WITH YOUTH THROUGH WORKSHOPS, PEER- LED DISCUSSIONS, ACTIVITIES AND CREATIVE PROJECTS. HCWC'S STANDS AS A TESTAMENT TO WHAT WE CAN ACHIEVE WHEN WE UNITE AROUND A SHARED VISION. HCWC IS PROUD TO BE A PART OF THAT TRANSFORMATIVE WORK WITH YOUTH.
WE ARE COMMITTED TO CONTINUING OUR COLLABORATION TO CREATE A FUTURE FREE OF VIOLENCE AND ABUSE. THANK YOU FOR YOUR CONSIDERATION AND RECOGNIZING THE IMPORTANCE OF SUPPORTING INITIATIVES LIKE THE CORE 4 PARTNERSHIP. SINCERELY, MEGAN
OSBORN. >> THANK YOU, WELL DONE.
[00:05:01]
AND OUR FINAL E- MAILED VERSION, SPEAKER, GLORIA RAMOS, PLEASE.>> DEAR, HONORABLE JUDGE BECERRA AND COUNTY COMMISSIONERS, I HAVE COLLABORATED WITH CRYSTAL LOPEZ, THE DIRECTOR OF YOUTH SERVICES.
I HAVE BEEN A MEMBER OF THE COALITION AS A SUBJECT EXPERT CONSULTANT AND COMMUNITY VOLUNTEER.
THE CORE 4 COALITION YOUTH AND YOUNG ADULT PROGRAM OFFERS A WIDE RANGE OF ACTIVITIES FOR YOUTH AND YOUNG ADULTS, FAMILIES AND LARGER COMMUNITY TO RECEIVE IMPORTANT EDUCATION INFORMATION AND PROGRAMS THAT SUPPORT THEIR SOCIAL AND EMOTIONAL HEALTH.
ACADEMIC ACHIEVEMENT, CIVIC ENGAGEMENT AND LEADERSHIP DEVELOPMENT. ADDITIONALLY, THE CORE 4 IS A VERY SPECIAL COALITION, WHEREBY KEY STAKE HOLDERS FROM DIFFERENT BACKGROUNDS, SUCH AS TEACHERS, COUNSELORS, COMMUNITY LEADERS, GOVERNMENT, FIRST RESPONDERS AND PARENTS LIKE MYSELF COME TOGETHER TO PROVIDE OPPORTUNITY TO RECEIVE SUPPORT FOR CONDUCTING COMMUNITY PARTNERSHIPS AND COLLABORATIONS. AS AN EXPERT CONSULTANT, I ALONG WITH MY COLLEAGUE, DR.
TONY WATT, AND UNDERGRADUATE STUDENTS IN OUR STUDENT OPPORTUNITY FOR APPLIED RESEARCH AND SOCIOLOGY HAVE ASSISTED CRYSTAL LOPEZ IMPLEMENTING THE NEEDS ASSESSMENT THAT HAS INCLUDED MANY VOICES, YOUTH, YOUNG ADULTS, PARENTS, GUARDIANS, COMMUNITY LEADERS, STAKE HOLDERS ABOUT MENTAL HEALTH AND ACCESS TO HEALTH CARE. IN 2024, THE RESULTS OF OUR FIRST ASSESSMENT YIELDED IMPORTANT BASELINE INFORMATION FOR EVIDENCE- BASED ACTION THAT IS UNIQUE TO OUR COMMUNITY. IN SPRING 2025, A SECOND ASSESSMENT WILL SURVEY YOUTH AND YOUNG ADULTS TO GATHER MORE DETAILED INFORMATION ABOUT SOCIAL RELATIONSHIPS, FEELINGS OF SAFETY, BASIC NEEDS, MENTAL HEALTH, AND SOCIAL SUPPORT IN SCHOOLS IN THEIR COMMUNITIES. THE RESULTS OF THIS SURVEY WILL BE ANALYZED AND BE COMPLETED BY THE SUMMER OF 2025. THESE EFFORTS SUPPORT THE COALITION IN CREATING A CULTURE OF HEALTH WHICH IS BROADLY DEFINED BY THE ROBERT WOOD JOHNSON FOUNDATION AS ONE IN WHICH GOOD HEALTH AND WELL BEING FLOURISH ACROSS GEOGRAPHIC, DEMOGRAPHIC, AND SOCIAL HEALTH SECTORS, AND EVERYONE HAS THE OPPORTUNITY TO MAKE CHOICES THAT LEAD TO HEALTHY LIFESTYLES. THE EXACT DEFINITION OF A CULTURE OF HEALTH CAN LOOK VERY DIFFERENT TO DIFFERENT PEOPLE, AND NECESSITATES US TO EMBRACE A WIDE VARIETY OF BELIEFS, CUSTOMS, AND VALUES WHILE MAKING YOUTH AND YOUNG ADULTS A SHARED VALUE IN OUR SOCIETY. I WANT TO EXPRESS MY SINCERE GRATITUDE TO JUDGE BECERRA AND HAYS COUNTY COMMISSIONERS FOR THEIR PARTNERSHIP AND LOOK FORWARD TO OUR CROSS SECTOR COLLABORATION WITH CORE 4 TO PROMOTE HEALTH AND WELL BEING. THANK YOU, GLORIA P. MARTINEZ RAMOS.
>> WELL DONE. THIS INCLUDES OUR PUBLIC COMMENT IN THE GENERAL AREA. THERE

I WANT TO SAY THANK YOU FOR EVERYTHING THAT YOU HAVE DONE.
>> HELLO, QUICKLY, I JUST WANT TO SAY TO ALL THE RETIREES, I DON'T THINK THERE'S ONE HERE WHO HASN'T TOUCHED MY LIFE PERSONALLY, THROUGH FRIENDSHIP OR PROFESSIONALLY THROUGH MY JOB. EVERYBODY HERE HAS HAD A ROLE FROM JERRY AND ERIN, PUTTING ASPHALT DOWN AND SIGNS UP IN HIS ELECTION.
STEVE AND HIS NEVER ENDING HELP DURING REDISTRICTING, WHICH WAS VALUABLE.
TO THE CONSTABLE'S OFFICE AND SHERIFF'S OFFICE PROVIDING SUPPORT DURING ELECTIONS AND COMMISSIONER SHELL AND HIS SUPPORT THROUGH THE COURT. JENNIFER, EVEN THOUGH THE TAX OFFICE DOESN'T HAVE ANYTHING TO DO WITH ELECTIONS, SHE SAT ON THE COMMISSION. I APPRECIATE HER SUPPORT THERE.

STEVE, THANK YOU SO MUCH FOR YOUR HARD WORK AND DEDICATION TO US AND THE CITIZENS OF HAYS COUNTY. YOU'RE TRULY APPRECIATED AND I KNOW YOU'RE NOT GOING TO MISS REDISTRICTING. WE HAVE TALKED ABOUT THAT MANY TIMES. I REALLY APPRECIATE YOU AND ALL THE HARD WORK. SHERIFF, CONSTABLE, JENNIFER, THANK YOU SO MUCH FOR YOUR LEADERSHIP, I DON'T KNOW, JUST THE WORK THAT YOU'VE DONE FOR THE CITIZENS OF HAYS COUNTY.
I REALLY APPRECIATE IT. TRUE PUBLIC SERVANTS AND I WISH YOU ALL THE VERY BEST. JERRY, THANK YOU SO MUCH FOR ALL THE HARD WORK, ALL THE COMPLAINTS THAT YOU HAVE TAKEN THROUGHOUT THE YEARS, AND YOU KNOW, IT'S A DIFFICULT JOB, BUT I REALLY DO APPRECIATE YOU AND WISH YOU THE VERY BEST.
TO MY COLLEAGUE, I JUST WANT TO THANK YOU.
I'M GOING TO MISS YOU. AND I TRULY ENJOYED WORKING WITH YOU. I'VE LEARNED SO MUCH FROM YOU. I JUST APPRECIATE THE CARE, THE COMPASSION. THE HONESTY, THAT YOU'VE SHOWN ME, THE EMPLOYEES OF THE COUNTY AND THE PEOPLE THAT YOU SERVE. I TRULY BELIEVE THAT YOU ARE THE BEST EXAMPLE OF A PUBLIC SERVANT THAT I'VE MET.
SO THANK YOU SO MUCH. AND I WISH YOU THE BEST.
THANK YOU, JUDGE. >> I WANTED TO GO BEFORE.
YOU KNOW, I JUST WANT TO THANK YOU ALL THE RETIREES FOR THEIR HARD WORK AND DEDICATION TO THE COUNTY. I KNOW WE CAN'T BE SUCCESSFUL HERE WITHOUT YOUR WORK, AND IT'S DEFINITELY GOING TO LEAVE A MARK WITH US AND DEFINITELY WITH ME. THANK YOU, JERRY, YOU KNOW, HELPING ME IN MY TRANSITION AS A NEW COMMISSIONER.
YOUR WHOLE TEAM HAS ALWAYS BEEN WONDERFUL TO ME, AND I JUST APPRECIATE YOU SO MUCH, AND THANK YOU, AND I HOPE YOU ENJOY YOUR RETIREMENT. AND DO GOOD THINGS.
AND, YOU KNOW, JENNIFER, THANK YOU FOR ALL OF YOUR SUPPORT AS WELL. YOU HAVE BEEN GREAT TO WORK WITH, AND I DO APPRECIATE YOU SO MUCH. CONSTABLE, THANK YOU FOR, YOU KNOW, REACHING OUT AND BEING THERE WHENEVER I NEEDED ANYTHING, AND I DO APPRECIATE THAT.
SHERIFF CUTLER, THANK YOU, SIR, SO MUCH FOR YOUR HELP AS WELL. YOU HAVE ALWAYS BEEN WILLING TO LISTEN TO ME. I TRULY APPRECIATE THAT VERY MUCH. AND STEVE, THANK YOU, SIR, FROM WHAT I HEAR YOU HAVE DONE A LOT OF GREAT THINGS HERE. AND COMMISSIONER INGALSBE THINKS HIGHLY OF YOU. AND COMMISSIONER SHELL, I RECOGNIZE THERE WILL BE A HOLE IN THE COURT WHEN YOU'RE GONE.
WHEN YOU SPEAK, I LISTENED, AND I LEARNED THAT PRETTY QUICKLY ON COURT, THE KNOWLEDGE THAT YOU POSSESS AND THANK YOU FOR ALWAYS BEING THERE FOR ME AS WELL, JUST AS A NEW COMMISSIONER AND JUST SUPPORTING ME AS A COLLEAGUE, AND I HOPE YOU CONTINUE TO DO GREAT THINGS IN THE COUNTY, SO
THANK YOU SO MUCH. >> COMMISSIONER
SHELL. >> THANKS, JUDGE, I HAVE NEVER BEEN MORE LOOKING FORWARD TO THE REST OF AN AGENDA FOR. MR. LION COMES BACK SO YOU CAN GET ME STRAIGHT AGAIN. FIRST, YOU KNOW, TO EVERYBODY THAT'S LEAVING, JUST, I THINK, JEFF SAID IT RIGHT, YOU KNOW, REALLY AMAZING.
AMAZING PEOPLE. STEVE, YOU KNOW, HE MIGHT HAVE STAYED FOR ANOTHER ONE, EXCEPT THE LAST REDISTRICTING, I THINK I WAS HIS FINAL STRAW ON THAT ONE. I'M GLAD I'M THE REASON THAT HE FINALLY DECIDED ENOUGH WAS ENOUGH, BUT, YOU KNOW, HE'S A LEGEND, I DON'T THINK THERE'S ANY OTHER WAY TO DEFINE WHAT HE'S BEEN ABLE TO ACCOMPLISH.
HIS CONSISTENCY IN ALWAYS STICKING WITH US, AND NEVER LEAVING US BEHIND.
THANKS, STEVE. CONSTABLE WOODS, JUST AN AMAZING CONSTABLE. SERVES THAT AREA LIKE YOU WOULD EXPECT SOMEONE TO DO, TREAT IT LIKE IT'S THEIR HOME. TREAT EVERYBODY LIKE THEY'RE THE MOST IMPORTANT PERSON IN THE WORLD.
[00:45:01]
THAT'S WHY HE'S DONE AN AMAZING JOB. THANK YOU, CONSTABLE.SHERIFF, NOT JUST LOSING OUR SHERIFF, AMAZING GUY. WE KIND OF CAME ON TOGETHER HERE. BUT OBVIOUSLY SOME OF HIS KEY STAFF, SORRY THAT THE CHIEF ISN'T HERE.
AND THEN I'M STILL SHOCKED THAT CAPTAIN CUMBERLAND IS STILL HERE.
I THOUGHT HE WOULD HAVE ALREADY BEEN OUT THE BACK DOOR.
I LIKE TO CALL HIM THE NINJA, ANYWHERE YOU'RE AT, WHERE'S CAPTAIN CUMBERLAND, HE ALWAYS FINDS A WAY TO ESCAPE. BUT JUST AN AMAZING COMMAND STAFF. I HAVE LEARNED SO MUCH FROM THEM. AND THOSE THAT WILL ASSUME THOSE ROLES, THEY HAVE ALL BEEN HERE SERVING THIS COUNTY FOR A LONG LONG TIME. IT SAYS A LOT ABOUT THAT AGENCY TO SEE PEOPLE DEDICATE THEIR ENTIRE LIVES TO IT.
SO THANK YOU ALL, AND, JERRY, OF COURSE, I'LL MISS YOU.
HAD A GREAT RUN, I THINK HE STARTED TALKING ABOUT RETIREMENT SOMETIME AROUND EIGHT YEARS AGO. WE WERE ALL WONDERING IF IT WOULD EVER ACTUALLY REALLY HAPPEN, AND IT IS. BUT YOU'RE LEAVING AN AMAZING LEGACY IN THE OFFICE. STAFF THAT YOU HAVE DO AN AMAZING JOB. THEY OFTEN, KIND OF LIKE OUR LAW ENFORCEMENT OFFICIALS, THEY GET TO BE THE ONES THAT COME IN CONTACT WITH OUR CITIZENS, ESPECIALLY THOSE OUT THERE DOING THE HARD WORK, AND THEY REALLY REPRESENT THIS COUNTY, AND THAT'S BECAUSE OF JERRY AND THE LEADERSHIP AND THOSE THAT WORK IN THE OFFICE, THE SUPERINTENDENTS, ERIN JONES, HIS STAFF, THEY REALLY TREAT OUR CITIZENS RIGHT.
SO SOMETHING TO BE PROUD OF. AND, JENNIFER, WE KIND OF HAD THE SAME TIME LINES HERE AT THE OFFICE OR AT THE COUNTY, AND SHE'S -- WHAT A NICE PERSON. I MEAN, WHAT A PROFESSIONAL OFFICE, A JOB THAT IS HARD TO DO AND AT TIMES IS OVERWHELMING WITH THE GROWTH OF THIS COUNTY, BUT TO KEEP UP WITH EVERYTHING THAT SHE HAS SHOWS THAT SHE'S A TRUE PROFESSIONAL, VERY CARING INDIVIDUAL, I'M VERY HAPPY FOR HER.
YOU KNOW, LIKE MYSELF, I THINK SHE MADE THE RIGHT DECISION AND DECIDED THAT SHE HAD DONE HER JOB, DONE IT THE RIGHT WAY, AND IT WAS TIME TO MOVE ON. THANK YOU FOR EVERYTHING THAT YOU HAVE DONE WITH THAT OFFICE.
IT IS AN AMAZING GROUP OF PEOPLE THAT REALLY DO GOOD WORK FOR THE COUNTY.
UNFORTUNATELY HER NAME HAS TO BE ON THAT BILL THAT EVERYBODY GETS TO PAY THEIR TAXES.
SHE'S SO NICE, NO ONE CAN BE MAD AT HER FOR THAT EITHER.
THANK YOU, JENNIFER. AND JUDGE, WHO'S NOT HERE, A SHORT TERM HERE, I THINK HE DID AN AMAZING JOB, YOU KNOW, DOING HIS JOB SO MUCH AS HE COULD AND EVEN KNOWING THAT IT WAS GOING TO BE DIFFICULT.
HE SPENT THE YEARS HE HAD HERE, I THINK, DOING A GOOD JOB. THANK YOU ALL, THANK YOU, EVERYBODY, ALL THE KIND WORDS, OBVIOUSLY I LOVE YOU ALL, AND I'M NOT MOVING, BUT I DON'T EXPECT THAT YOU'LL SEE ME HERE TOO MANY TIMES. ALTHOUGH THERE MIGHT BE A REASON TO MAKE A PUBLIC COMMENT NOW AND THEN. YOU KNOW, I'VE ALWAYS WANTED TO BE ON THE OTHER SIDE THERE ON SOME OF THOSE COMMENTS. I MIGHT GIVE THAT A SHOT. THANK YOU ALL SO MUCH.
. >> I'M GOING TO MAKE IT THROUGH THIS.
I WANT TO, STEVE, THANK YOU FOR EVERYTHING.
EVEN UP TO HIS LAST WEEK, I WAS GIVING STEVE A HARD TIME ABOUT ADDRESSING IN SOME PLACE, SO I APPRECIATE ALL YOU DO, AND IT'S ONE OF THOSE JOBS THAT UNEQUIVOCALLY IS SO, SO IMPORTANT TO OUR COUNTY FROM EMERGENCY SERVICES, TO THE SHERIFF'S DEPARTMENT, THEY ALL DEPEND ON YOU, AND IT'S A PIVOTAL ROLE THAT VERY FEW KNOW OUTSIDE OF THE COUNTY. THE STRUCTURE IN THE COUNTY, AND JUST KNOW THAT ALL THE WORK THAT YOU'VE DONE TO TRY TO ESTABLISH AN OFFIC THAT WE CAN BE PROUD OF, NOT ONLY HERE BUT REGIONALLY, IT REALLY MEANS SOMETHING, AND WHENEVER I'M FORTUNATE ENOUGH TO SIT ON THE CAP COG EXECUTIVE BOARD, AND WHENEVER WE DID A NOMINATION TO REPLACE YOU ON THE GIS BOARD REGIONALLY, I HAD SEVERAL QUESTIONS BEFORE I LEFT, WHERE'S STEVE GOING, WHAT'S GOING ON WITH STEVE.
IF YOU WANT FUTURE EMPLOYMENT OUT THERE, I'M SURE THERE'S PLENTY OF MUNICIPALITIES THAT WOULD BE HAPPY TO HIRE YOU. OUR COMMAND STAFF, I CAN'T SAY ENOUGH FOR YOU GUYS, AND I'M SORRY THAT DAVENPORT'S NOT HERE.
IT'S BEEN A TOUGH YEAR FOR US IN THE LAW ENFORCEMENT REALM, AND AT EVERY POINT, Y'ALL HAVE STEPPED UP WHEN NEEDED, WHETHER IT'S THE JAIL, WHETHER IT'S THIS EXPLOSIVE POPULATION AND
[00:50:05]
STAFF SHORTAGES AND RETIREMENTS AND THOSE KIND OF THINGS, OUR COMMUNITY REALLY APPRECIATES YOU. AND I KNOW GENERALLY COMMISSIONER SHELL SAID THIS ONE OF THE FIRST TIMES I WAS HERE, I TOOK IT TO HEART, YOU ALL SEE PEOPLE ON THEIR WORST DAYS, AT THE WORST TIME, AND Y'ALL ARE THE BEST PEOPLE TO DO IT BECAUSE YOU CARE ABOUT THEM.OUR OFFICERS NEED TO KNOW THAT, BUT YOU ALL ARE A SHINING EXAMPLE FOR OUR RANK AND FILE WHEN THEY HAVE THOSE INTERACTIONS.
I APPRECIATE YOU ALL. I KNOW I DON'T KNOWTHE PERSONAL SACRIFICE THAT THE YEARS OF SERVICE Y'ALL PUT IN PUTS NOT ONLY ON YOU BUT ON YOUR FAMILY. I WANT TO ESPECIALLY RECOGNIZE OR SAY SOMETHING ABOUT CUMBERLAND.
I APPRECIATE YOUR WHOLE FAMILY'S SERVICE TO OUR COUNTY. I GET TO WORK WITH YOUR WIFE NOW THAT SHE'S AT THE ISD IN IRVING, AND THEY COULD NOT ASK FOR A BETTER PERSON, A FORMER, YOU KNOW, RETIREE FROM THIS DEPARTMENT, THIS SHERIFF'S DEPARTMENT TO WORK WITH.
AND I SINCERELY APPRECIATE THAT, AND THE KNOWLEDGE SHE BRINGS TO THAT JOB, HOPEFULLY SHE SHARES SOME OF THAT WITH YOU IN RETIREMENT, HOW TO DO IT. BECAUSE SHE'S DONE A PHENOMENAL JOB WITH IT.
AND I JUST REALLY APPRECIATE YOU ALL AGAIN. I WISH DAVENPORT WAS HERE.
I HAVE A HEART FOR YOU GUYS THAT I CAN'T REALLY EXPRESS. JERRY, YOU KNOW, JERRY AND I HAD A -- THANK YOU. THANK YOU.
IT'S NOT THE EASIEST RELATIONSHIP SOMETIMES WITH TRANSPORTATION. BUT I CAN TELL YOU THAT THEY ALWAYS HAVE OUR CONSTITUENTS IN MIND, AND JERRY HAS A HEART AND A PASSION FOR WHAT HE DOES HERE. A DEEP HEART AND PASSION, AND LON BEAT ME TO THE JOKE ABOUT WHEN YOU WERE GOING TO RETIRE. I THINK YOU TOLD ME TWO WEEKS AFTER I GOT ELECTED THAT YOU WERE PROBABLY GOING TO BE HERE FOR A YEAR. THAT WAS SIX AND A HALF YEARS AGO, AND WHEN I KNEW IT WAS COMING, I STILL DIDN'T WANT TO HEAR IT. SO I APPRECIATE YOU. JENNIFER, A LOT OF DOOR KNOCKING TOGETHER. A LOT OF -- I PUT UP A LOT OF JENNIFER O'CANE SIGNS, I DID THAT BECAUSE AT THE TIME I KNEW YOU CARED ABOUT THE OPERATION OF THAT OFFICE.
I CAN'T TELL YOU THAT LITERALLY HUNDREDS, HUNDREDS OF CONSTITUENTS WHO HAD AN ISSUE WITH A BILL OR HAD ONE PROBLEM WITH THEY COULDN'T FIGURE OUT, AND JENNIFER WOULD PERSONALLY TAKE CARE OF THEM OR HAVE STAFF PERSONALLY REACH OUT AND THAT MEANS SO MUCH TO EXPLAIN SOMEBODY'S BILL TO THEM OR TO CORRECT AN ERROR THAT Y'ALL DIDN'T EVEN MAKE. Y'ALL TOOK CARE OF IT.
THINGS LIKE THAT. THE TRUE PASSION FOR FOLKS HERE. I APPRECIATE YOU. AND -- MORE THAN YOU KNOW. NEXT ONES ARE HARD.
GARY AND RON. I'M LOSING A SHERIFF AND A CONSTABLE, BUT I'M LOSING MY FRIENDS.
YOU HAVE NO IDEA HOW MANY NIGHTS I'VE CALLED THEM WITH ISSUES RELATED TO OUR COUNTY THAT HOPEFULLY -- HOPEFULLY THAT THERE ARE THINGS THAT HAPPEN IN OUR COUNTY THAT NOBODY KNOWS ABOUT THAT THEY PURSUE ON BEHALF OF OUR CITIZENS ON A DAILY BASIS. THEY ALWAYS ANSWERED THE PHONE.
WHETHER IT WAS SOMETHING AS MINUTE AS A NEIGHBOR'S INTERACTION OR AN EVICTION OR A HORRIBLE WRECK WITH FATALITIES IN MY PRECINCT, THEY WERE ALWAYS THERE. I WISH CAROL WAS HERE. SHE'D BE SO PROUD OF YOU.
THE PERSONAL SACRIFICE OF THESE TWO GUYS, NOBODY KNOWS IN THIS ROOM. I KNOW I DON'T. BUT IT'S SINCERELY APPRECIATED. AND THE DEDICATION YOU PUT
[00:55:02]
INTO YOUR JOB AND TO REALLY REALLY TOUGH TIMES IN YOUR LIFE. YOU KNOW THAT WE'RE ALL FAMILY, EVEN AS YOU WALK OUT THE DOOR.WE EXPECT YOU BACK HERE. THE NEXT ONE'S THE HARDEST.
SO I'M GOING TO TELL ONE STORY.
THE NIGHT THAT I GOT ELECTED IN 2018, THERE WAS ONE BOX OUTSTANDING, AND I DEVELOPED A RELATIONSHIP WITH COMMISSIONER SHELL DURING THAT CAMPAIGN, AND AS HARD AS JENNIFER WAS WORKING, THERE WAS ONE BOX OUTSTANDING, AND IT WAS AT LIKE 10:00 AT NIGHT THAT IT HADN'T BEEN COUNTED. AND AT THE TIME, I WAS SITTING WITH COMMISSIONER SHELL AT AN EVENT, WE WERE WATCHING RETURNS COME IN. HE LOOKED AT ME AND SAID THE LAST OUTSTANDING BOX I'M GOING TO LOSE, AND YOU'RE GOING TO LOSE IT, BUT YOU'RE GOING TO LOSE THE BOX, NOT BY ENOUGH TO LOSE. YOU'RE GOING TO WIN YOUR RACE. HE SAID, BUT I WOKEN N'T BE HERE IN JANUARY WHEN YOU GET SWORN IN, AND HERE'S WHAT I WANT YOU TO DO, AND HE PULLED OUT A NOTE PAD, HIS EVER PRESENT NOTE PAD THAT YOU GOT FOR TEN YEARS, AND HE STARTS WRITING DOWN NAMES. AND I SAID WHAT ARE THESE NAMES. HE SAID THESE ARE OUR EMPLOYEES. THESE ARE THE PEOPLE THAT YOU HAVE TO TAKE CARE OF BECAUSE I CAN'T BE THERE TO TAKE CARE OF THEM ANYMORE.
AND THE LAST BOX CAME IN, AND HE LOST IT. I LOST IT TOO.
BUT HE WON BY 43 VOTES. IN THE END, IT WAS ONLY 37, BUT, YOU KNOW, IT WASN'T THE LANDSLIDE WE ANTICIPATED AT
43. >> I WASN'T VERY WELL LIKED, OBVIOUSLY.
>> BUT WHEN THE NUMBERS WENT UP ON THE BOARD, I JUST REMEMBER YELLING, YOU WON, AND HE TURNED AROUND, HE GAVE ME A HUG, AND HE SAID, WE TAKE CARE OF THEM TOGETHER, AND HE GAVE ME A BIG HUG. THAT'S WHERE HIS HEART S. HIS HEART IS WITH EVERY EMPLOYEE IN OUR COUNTY.
WHENEVER I TOOK OFFICE, I PUT A NOTE, AFTER MY SECOND COURT DATE, I WROTE A NOTE IN MY OFFICE AND I PUT IT IN MY TOP DESK DRAWER AND IT SITS THERE TODAY. IT SAID I WANTED THE COMMUNITY INVOLVEMENT, AND MARK JONES, I WANTED THE HEART OF DEBBIE INGALSBE, AND I WANTED THE HEART AND PASSION OF LON SHELL, AND I ASPIRE TO THAT STILL AS A COMMISSIONER, AND HE'S HAD THAT SAME EFFECT ON EVERY INDIVIDUAL EMPLOYEE THAT WE'VE HAD THAT EVER MET. AND ONE OF THESE DAYS, I'M GOING TO HANG THIS UP. AND I JUST PRAY THAT AT THE TIME, I KNOW HALF OF WHERE YOU AND DICKY HID THE MONEY, BECAUSE LET'S BE HONEST, YOU'RE THE ONLY ONE WHO KNOWS, AND HALF THE PASSION AND RESPECT THAT YOU'VE EARNED IN THIS JOB.
AND I LOVE YOU, YOU'RE MY BROTHER.
THIS IS THE MORE IMPORTANT THING.
I'M GOING TO BE VERY LONELY COME FOOTBALL SEASON WITH THE THREE OF Y'ALL GONE.
WE'RE LOSING THREE AGGIES HERE AND I'M GOING TO BE THE LONE ELECTED OFFICIAL.
>> SO I'M GOING TO DO A LITTLE DIFFERENT APPROACH TO IT BECAUSE OF COURSE I LOVE JENNIFER, AND SHE IS EXACTLY EVERYTHING THEY'VE SAID, WONDERFUL, AND EVERY TIME I EVER TEXTED HER, SHE IMMEDIATELY REPLIED, HEY, JUDGE, WHAT'S GOING ON, HOW CAN I HELP YOU.
ALWAYS HAS BEEN THAT AWESOMENESS.
EVERY SINGLE ONE OF YOU HAS SAID EVERY SINGLE WONDERFUL THING ABOUT EVERYONE WHO'S LEAVING. I CAN POINT TO EVERY TIME I HAPPENED TO, YES, IT IS REAL, 2018 MARKED THAT SIX AND A HALF YEARS AGO THAT YOU MENTIONED COMMISSIONERS SMITH WAS THE TURNING OF THE PAGE, THE USHERING IN OF A NEW WAVE OF PERSPECTIVES, IF YOU WILL, THERE WAS A LOT OF NERVOUSNESS AS I GOT INTO OFFICE, AND A LOT OF APPREHENSION AND A LOT OF CONCERN, AND COMMISSIONER SHELL SAYS IT, FEAR, CHANGE IS A FEARFUL THIRNG FEARFUL THING FOR FOLKS.
I CAN POINT TO ANY TIME AND DATE, I CAN POINT EASILY, SHERIFF CUTLER.
WE'VE BUILT A RELATIONSHIP WHERE, HECK,
[01:00:01]
MANAGING COVID. WE'RE LITERALLY IN ONE MOMENT AT ODDS WITH EACH OTHER, AND THE NEXT, WE ARE SHAKING HANDS, BEING RESPECTFUL AND SHOWING UP TO EACH OTHER'S EVENTS. IN SUMMARY, I CAN SAY THE SAME ABOUT JERRY. COMMISSIONER SHELL, I'M IN A FAVORITE SPOT, MY FAVORITE COMMISSIONER, HE'S LEAVING. HE'S MY FAVORITE COMMISSIONER FOR THE REASONS THEY SAID, FOR THE KNOWLEDGE, FOR THE UNDERSTANDING, THE DRIVE AND THE TENACITY BECAUSE I AM NOT PATIENT, AND I DON'T LIKE WAITING, AND I DON'T APPRECIATE THE PACE AT WHICH GOVERNMENT MOVES AND COMMISSIONER SHELL AND I HAVE THIS RUNNING JOKE, YOU WANT TO GET IT DPOEN DONE BUT I GOT TO SLOW IT DOWN. WE THINK THAT WAY.AND IT'S TRUE, WE NEED ALL OF US TO DO EVERYTHING. WE'RE A KALEIDOSCOPE, WE SERVE THIS WONDERFUL GIFT OF A PLACE CALLED HAYS COUNTY.
EVERY RESIDENT IS A BEATING HEART THAT'S SOMEONE'S LOVED ONE. AND I PROMISE EVERYONE HERE IS LOVED AND WE ALL HAVE THE GIFT OF HAVING DYNAMIC LIFE EXPERIENCES THAT ALLOW US TO WORK TOGETHER TO SERVE YOU, AND MOST IMPORTANTLY, WHETHER WE LIKE IT OR NOT, CHANGE IS HAPPENING. AND THIS IS A GREAT EXAMPLE OF CHANGE, AND SO THE BEST THING I CAN ENCOURAGE EVERYONE COMING IN AND EVERYONE LEAVING IS TO EMBRACE, EMBRACE CHANGE BECAUSE THAT IS A CONSTANT.
IF WE SEE EACH OTHER WITH LOVING EYES, IF WE APPROACH EACH OTHER WITH HEART, COMPASSION AND THE TRUEST, MOST SINCERE WAY OF WORKING TOGETHER, WE CAN'T GO WRONG.
WE CAN'T GO WRONG. I REALLY DO SAY TO EVERYONE LEAVING, AND WE HAVE SOME, I KNOW THEM, RIGHT, COMING IN. THANK YOU GOING OUT. THANK YOU COMING IN. THANK YOU FOR RESPECT FOR YOUR OFFICES AND THANK YOU FOR THE RESPECT OF OUR OFFICES, AND THANK YOU FOR RESPECT OF ONE ANOTHER BECAUSE REMEMBER, WE'RE ALL SOMEONE'S LOVED ONES. WE'RE GOING TO TAKE A FIVE-MINUTE RECESS, AND I WANT TO GET THE SHERIFF AND SHERIFF ELECT, IF I CAN GET A PICTURE WITH YOU GUYS BEFORE WE WALK AWAY.
WE'LL TAKE A FIVE-MINUTE RECESS.
>>> THANK YOU, GUYS, THANKS AGAIN.
ALL RIGHT, WE ARE BACK FROM A SHORT RECESS, AND JUST SO FOLKS UNDERSTAND, I'M GOING TO CHERRY PICK THROUGH ITEMS THAT FOLKS HAVE SIGNED UP FOR AND THEN I'LL GO BACK AND RUNNING OF THE SLATE. SO WE WILL BEGIN.

I HAVE HAD A LOT OF COFFEE THIS MORNING.
SO PLEASE EXCUSE ME, BUT THE CHANGES ARE ALL ON THE FIRST PAGE, I'M GOING TO GO THROUGH THEM REALLY QUICKLY.
THE FIRST PAGE, WE'RE GOING FROM TREASURY BILLS TO TREASURY SECURITIES. THAT UPDATES THE VERBIAGE THAT IS BEING USED NOW.
WE'RE GOING TO ADD MUTUAL FUNDS TO MARKET FUNDS.
LET'S SEE. THE NEXT CHANGE DOES NOT APPEAR UNTIL PAGE 10, UNDER H, WE ARE GUARANTEEING INVESTMENT CONTRACTS ARE ACCEPTABLE INVESTMENTS FOR BOND PROCEEDS, IF THE GUARANTEED INVESTMENT CONTRACT IS, A, HAS A DEFINED TERMINATION DATE. WE ARE ADDING A MAXIMUM OF TWO YEARS PER EACH CONTRACT. WE ARE ALSO GOING TO PAGE 12.
CURRENTLY IT READS A WRITTEN COPY OF THE INVESTMENT POLICY WILL BE PRESENTED TO ANY PERSON.
WE ARE STRIKING PERSON AND ADDING LOCAL GOVERNMENT INVESTMENT POOL OR INVESTMENT ADVISER, AS THOSE ARE WHO ACTUALLY DO OUR INVESTING FOR US.
I HAVE ALSO STRUCK OUT THE WORD, SO THE QUALIFIED REPRESENTATIVE OF THE BUSINESS, AND INSTEAD OF IT BEING THE BUSINESS, IT WILL BE SAID BUSINESS.
UNDERNEATH PROOF OF CERTIFICATION BY THE NATIONAL ASSOCIATION OF SECURITIES DEALERS. WE ARE STRIKING THAT AND REPLACING IT BY THE FINANCIAL INDUSTRY REGULATORY AUTHORITY, WHICH IS IN COMPLIANCE WITH THE STATE REGULATIONS. AND WE HAVE ANOTHER CHANGE ON PAGE 18. UNDER MONTHLY REPORTING NUMBER 8A, IT WILL READ THE INVESTMENT STRATEGY EXPRESSED IN THE COUNTY'S INVESTMENT POLICY AND WHAT I'M ADDING IS WE ARE REVIEWING AND UPDATING IT ON A DAILY BASIS. AND THOSE ARE MY CHANGES FOR THIS YEAR'S INVESTMENTS POLICIES.
>> COMMISSIONERS, ANY QUESTIONS? THANK YOU FOR TAKING THIS ON.

THEY'RE REALLY NOT VERY MUCH MONEY.
WE COULD DO THESE AS MUCH AS WE CAN SHOW DEMAND, QUARTERLY, BIMONTHLY, AND I WOULD ALSO LIKE TO PUT IN A GOOD WORD FOR PREVENT A LITTER FOR THE OTHER THINGS THEY DO AS FAR AS SPAY, NEUTER, AND VACCINATION. [I.4. Discussion and possible action to authorize the execution of an Interlocal Agreement between Hays County and the City of Buda for a signal at Firecracker and Main Street and amend the budget accordingly. COHEN/BORCHERDING]
SHELL SHELL YES. AND THEN WE HAVE I.4.
WE'LL GO BACK AFTER THOSE THAT SIGNED UP AND SWIPE THE ENTIRE SECTIONS SHELL I. 4 DISCUSSION AND POSSIBLE ACTION TO AUTHORIZE THE INTERLOCAL AGREEMENT BETWEEN HAYSCOUNTY AND THE CITY OF BUDA FOR A SIGNAL AT FIRE TRACKER AND MAIN STREET AND AMEND THE BUDGET ACCORDINGLY SHELL SO MOVED SHELL SHELL.
>> GOOD MORNING, JUDGE BECERRA, AND THE COURT.
I WANT TO EXPRESS SUPPORT FOR THE LOCAL AGREEMENT BETWEEN HAYS COUNTY AND THE SIGNAL LIGHT AT MAIN STREET AND FIRE CRACKER ROAD.
THIS TRAFFIC CONTROL IS DESPERATELY NEEDED AT THIS INTERSECTION. HOWEVER, I DO ASK THE COURT THAT IN CONJUNCTION WITH THE SIGNAL, THERE BE COORDINATION AND CONSIDERATION FOR THE ROADWAY ADJACENT TO WHERE THE SIGNAL IS BEING INSTALLED. THE CITY IS WORKING ON, ALTHOUGH A TEMPORARY FIX FOR THE AREA BETWEEN FIRE CRACKER AND THE ULTIMATE PLAN, THOUGH NOT FUNDED YET, FOR A TOTAL OF FIVE- LANE WIDTH.
ALSO ADJACENT TO THE INTERSECTION IN THE OTHER DIRECTION BETWEEN FIRECRACKER AND CAMPO DELL SOL, THAT ROADWAY ULTIMATELY WILL NEED TO BE WIDENED. THIS INTERSECTION WHERE THE STOPLIGHTS ARE GOING HOPEFULLY WILL BE BUILT IN A WAY THAT CAN ACCOMMODATE THE FUTURE WHICH REALLY SHOULD BE NOW, I MEAN, NOW IS THE FUTURE, WIDENING OF MAIN STREET BETWEEN FIRE CRACKER AND FULLY SUPPORT THE INTERLOCAL AGREEMENT AND THE FUNDING THAT HAS BEEN WORKED OUT. I WANT TO SAY THANK YOU, THANK YOU TO THE COURT AND ALSO TO THE CITY OF BUDA FOR WORKING TOGETHER TO BRING THIS ABOUT AND HAVE AN AGREEMENT WHERE BUDA CONTRIBUTES THEIR PORTION AND THE COUNTY CONTRIBUTES THEIR PORTION TO MAKE THIS A REALITY. IT'S THAT KIND OF COORDINATION WE NEED BECAUSE THERE ARE OVER A DOZEN DIFFERENT ENTITIES THAT ULTIMATELY CAN IMPACT WHAT NEEDS TO BE DONE WITH ROADWAYS FROM THE MUDS TO TRAVIS COUNTY, TO HAYS COUNTY, TO BUDA
[01:15:01]
OR AUSTIN, IT'S A REAL CACOPHONY OF OVERSIGHT, AND WE NEED THIS COORDINATOR COORDINATION. THANK YOU FOR MAKING THE INTERSECTION TRAFFIC CONTROL SIGNAL POSSIBLE.>> BEAUTIFUL. AND THANK YOU, SIR.
COMMISSIONER. >> THANK YOU, JUDGE.
YES, DEFINITELY A SIGNAL IS NEEDED AT THIS INTERSECTION THAT HAS BEEN EXPRESSED OVER AND OVER BY THE RESIDENTS OF SUNFIELD, AND I'M GLAD TO SEE THAT WE WERE ABLE TO WORK AN AGREEMENT WITH THE CITY OF BUDA AS WELL. WITH THE GROWTH THAT'S HAPPENING IN OUR COUNTY, WE CANNOT DO THIS ALONE, WE NEED THESE PARTNERSHIPS ACROSS THE CITIES TO HELP EACH OTHER WITH MANAGING THAT GROWTH, AND THIS IS JUST ONE GREAT EXAMPLE OF THAT.
[J.1. PLN-2528-PRE; Ratify Approval of the Sunfield Self Storage, Preliminary Plan. COHEN/PACHECO K. | MISCELLANEOUS ||]
SHELL.>> KNOCKING THEM OUT. NO WAITING TODAY.
>> HOLD ON, I'M LETTING YOU KNOW YOUR ITEM IS COMING UP.
I THOUGHT YOU CALLED JAY PLN 25, RATIFY APPROVAL OF THE SUNFIELD SELF-STORAGE PRELIMINARY PLAN.
>> SORRY FOR BEING CONFUSING. WE'LL GIVE HIM HIS CHANCE TO SPEAK, AND WE'LL GO TO YOU. MR. HUGH DANIEL.
>> HERE NEUTRAL ACTUALLY ON THIS, NEITHER IN SUPPORT OR AGAINST IT. BUT JUST WANTING TO REITERATE WHAT WAS COMMENTED PREVIOUSLY IN ANOTHER INTERSECTION. SUNFIELD SELF- STORAGE PRELIMINARY PLAN IS LOCATED ALONG FM 2001. IF APPROVED AND CONSTRUCTED, ACCESS WILL BE VIA COMPASS PLANT ROAD A NEW ROADWAY, WHICH WILL RUN BETWEEN RAY ROMERO ROAD, AND NEW FM 2001, DIRECTLY ACROSS FROM SUN BRIGHT ROAD A MAJOR ENTRANCE TO SUNFIELD. THIS INTERSECTION IS CURRENTLY PLANNED BY TXDOT TO RECEIVE TRAFFIC CONTROL SIGNAL LIGHTS IN MID 2006. TO WORK WITH TXDOT AND BUDA FOR LIGHTINGS. AN EXAMPLE OF WHICH CAN BE FOUND AT KYLE AT THE INTERSECTION OF KOEHLER'S CROSSING AND KYLE CROSSING.
THIS INTERSECTION, THE INTERSECTION OF 2001 IS CURRENTLY A THREE-WAY STOP AND IS QUITE DANGEROUS. ADDING A FOURTH POINT OF ACCESS AND CONSTRUCTION TRAFFIC WILL CERTAINLY MAKE THIS INTERSECTION EVEN MORE DANGEROUS.
SO THAT'S WHY THERE IS A REQUEST TO NOT WAIT UNTIL THE MID- 2006 TIME FRAME WHEN TXDOT WILL BE PUTTING TRAFFIC SIGNAL LIGHTS IN THAT INTERSECTION, THOUGH WE'LL BE ABLE TO GET TEMPORARY TRAFFIC SIGNAL LIGHTS THERE IF THIS IS APPROVED AND CONSTRUCTION IS CONDUCTED.
THANK YOU VERY MUCH. >> THANK YOU, SIR.
>> THANK YOU, JUDGE, THANK YOU, COMMISSIONERS, I WANT TO MAKE SURE WE'RE CLEAR, I THINK THE TIME FRAME WOULD BE MID- 2026 THAT WE'RE TALKING ABOUT TRAFFIC CONTROL SIGNALS THERE. WE CAN COORDINATE THROUGH MY OFFICE, AND TRANSPORTATION WITH TXDOT AND TEMPORARY MITIGATIONS IN BETWEEN NOW AND THE FINAL PLAT AND ULTIMATE PERMANENTING OF THE SITE. THIS IS FOR A PRELIMINARY PLAN.
I WILL EMPHASIZE THATTHAT DEVELOPMENT, WE'RE JUST IN THE PRELIMINARY PLAN STAGE. THEY WILL HAVE TO SUBMIT A PLAT TO OUR DEPARTMENT FOR VIEW, AND SUBMIT PERMITS.
IT'S FOR A ONE-LOT PIECE OF PROPERTY THAT'S APPROXIMATELY 6. 8 ACRES. IT'S LOCATED ALONG FM 2001 IN BUDA, AND WASTE WATER IS ACCOMPLISHED THROUGH THE SUNFIELD, THIS IS FOR RATIFICATION OF THE PRELIMINARY PLAN THAT HAS BEEN APPROVED ADMINISTRATIVELY.

>> ALL RIGHT. ANY COMMENTS OR QUESTIONS?
>> YES, JUDGE, I HAVE A COUPLE OF COMMENTS.
ON G.6. I WANT TO THANK OFFICER MARTIN RODRIGUEZ, AND I NOTED THE COURT, WHENEVER WE APPROVED THESE, LIKE A LITTLE BIT OF A BIO.
I WOULD LIKE TO READ A COUPLE OF THINGS HERE.
OFFICER MARTIN RODRIGUEZ IS FROM PORT ISABEL, TEXAS, MARRIED 23 YEARS, AND HAS FOUR CHILDREN. HAS BEEN A PEACE OFFICER FOR 16 YEARS, WORKING FOR THE CITY OF SOUTH PADRE ISLAND, AND HIDALGO COUNTY SHERIFF'S OFFICE.
PRIOR TO BECOMING A POLICE OFFICER, HE WORKED FIVE YEARS IN CORRECTION, AND ANOTHER FIVE YEARS IN COMMUNICATIONS. HE ATTENDED PORT ISABEL HIGH SCHOOL. HE HOLDS AN ADVANCED PEACE OFFICER LICENSE AND IS WITHIN 40 HOURS OF RECEIVING HIS MASTER PEACE OFFICER CERTIFICATION.
HE HAS FIELD TRAINING OFFICER, COURT SECURITY SPECIALIST AND A MENTAL HEALTH OFFICER.
>> HE IS CURRENTLY THE VICE PRESIDENT FOR THE BUDA POLICE OFFICERS ASSOCIATION AND MEMBER OF THE PEER SUPPORT TEAM.
I APPRECIATE HIS WILLINGNESS TO COME OVER TO HAYS COUNTY AND WORK IN PRECINCT FIVE.
>> WELL DONE. COMMISSIONERS ANY OTHER ITEMS YOU WANT TO DISCUSS?
>> ONE OTHER CLARIFICATION. ON ANY OF THE ITEMS, IN THE RECORD, IT'S FISCAL YEAR, NOT FEDERAL YEAR.
>> TELL US ABOUT THE CAMERA, SINCE WE'VE GOT THAT MOMENT.
>> GOOD MORNING, COMMISSIONERS, THE CAMERA I'M REQUESTING IS -- IT SHOOTS VIDEO.
WHICH IS SOMETHING OUR OLD CAMERA DOESN'T DO.
[01:30:04]
ONE IS FOR HEAD SHOTS, WHICH I HAVE BEEN TAKING FOR OUR WEB SITE. THE IS A GENERAL NICE LENS FOR COMMISSIONERS COURT, GOD FORBID WE HAVE A WILDFIRE I HAVE TO GO OUT TO. JUST AN ALL AROUND GREAT CAMERA, AND B AND H IS A GREAT SERVICE, AND THAT'S THE CAMERA.[I.1. Discussion and possible action authorizing the execution of an Agreement between Hays County and Blanco River Ranch Properties, LP concerning the donation of property to Hays County related to the Yarrington Road (FM 150/FM110) extension project. SHELL]
>> I.1. DISCUSSION AND POSSIBLE ACTION AUTHORIZING THE EXECUTION OF AN AGREEMENT BETWEEN HAYS COUNTY AND BLANCO RIVER RANCH PROPERTIES LP RELATED TO THE YARINGTON ROAD FM 150- 110
>> THANK YOU, JUDGE. THIS PROJECT WHICH WE'RE CALLING THE EXTENSION HAS BEEN NAMED SEVERAL THINGS IN ITS PAST.
IT'S BEEN AROUND FOR A LONG TIME.
IT'S BEEN A TRANSPORTATION PLAN FOR A LONG TIME.
IT'S FOR THE MOST PART, THE EXTENSION OF WHAT IS NOW 110 AND YARRINGTON WEST, AND CONNECT UP WITH 150 AS IT IS WEST, NORTH OF THE CITY OF KYLE. WE USED TO CALL IT A BYE, 150 EXTENSION AND NOW I'M SURE IT'S NAME WILL CHANGE AT SOME POINT IN TIME. THIS ITEM CONCERNS A GOOD CHUNK OF THE RIGHT-OF-WAY NEEDED FOR THAT ROAD. THE LANDOWNER WHO HAS A REPRESENTATIVE HERE, IF THERE'S ANY QUESTIONS, IS WILLING TO DONATE THAT RIGHT-OF- WAY TO THE COUNTY, AND THAT'S WHAT THIS AGREEMENT WOULD ALLOW. AND THAT IS EXTREMELY IMPORTANT, THE VALUE OF THAT PROPERTY IS IMMENSE, AS WE ALL KNOW. AND IT IS A LOT OF RIGHT-OF-WAY, AND IT'S A GOOD CHUNK OF THAT EXTENSION. I WANT TO THANK THE LANDOWNER FOR THE WORKING WITH THE COUNTY. WE HAVE BEEN TALKING ABOUT IT FOR YEARS. FOR MANY YEARS.
IT'S BEEN IN, I THINK, THREE DIFFERENT PRECINCTS IN THIS EXISTENCE, MAYBE
FOUR. >> YEAH, THREE PRECINCTS.
>> IT HAS A HISTORY. I WANT TO THANK THE LANDOWNER FOR BEING WILLING TO WORK WITH US. IT WAS COMPLICATED WITH THE PIPELINE, WHICH GOES THROUGH THE MIDDLE OF THEIR PROPERTY, AND IS RIGHT ALONGSIDE OF OUR RIGHT-OF- WAY, SO THAT WAS COORDINATED AND THAT WAS VERY COMPLICATED AS WELL.
THAT'S COST US SOME TIME. AND ALSO BECAUSE OF THAT RIGHT-OF-WAY, WE HAVE BEEN HAVING TO SORT OF TWEAK OUR ALIGNMENTS, AND THIS AGREEMENT ENTERING THROUGH THIS AGREEMENT, THE OWNER OF THE PROPERTY WILL BE REPLATTING THE RIGHT-OF- WAY THAT WE NEED TO CONSTRUCT THE ROAD AS IT WILL BE DESIGNED. WE WILL REIMBURSE THEM FOR THAT. THAT WAS DUE TO OUR CHANGES IN DESIGN. AND THERE'S A FEW OTHER ISSUES AND I'LL LET JORDAN GO THROUGH DETAILS. THE OWNERS ASKED IF THEY CHOOSE TO CREATE A PUBLIC IMPROVEMENT DISTRICT THAT THE COUNTY WOULD CONSIDER SUPPORTING THAT.
SO THAT IS PART OF OUR AGREEMENT TO ACCEPT THIS AND DRAINAGE, THE RIGHT-OF-WAY OBVIOUSLY WILL ACCOMMODATE THE DRAINAGE FOR THE ROADWAY CONSTRUCTION.
WE AGREED IF ANY DRAINAGE FROM DEVELOPMENT COULD BE ACCOMMODATED, WE WOULD ALLOW THAT TO HAPPEN AS WELL, AND OBVIOUSLY ONCE THIS BECOMES PUBLIC RIGHT-OF-WAY, ANY UTILITIES COULD BE RUN THROUGH THE RIGHT-OF- WAY FROM ANY PUBLIC UTILITY ENTITIES, WHICH IS BY STATE LAW.
WE ARE CLEARING THAT UP. WE DON'T WANT THE DEVELOPER, THE LANDOWNER TO THINK BY NOTING THAT PROPERTY, THERE WILL BE A PROBLEM WITH THEM PUTTING UTILITIES IN THE FUTURE. WE AGREED TO THAT AS WELL. ANYTHING I'M MISSING,
JORDAN? >> I DON'T THINK SO, COMMISSIONER. THERE'S TWO SMALL THINGS I'M GOING TO ADD. ONE WE WORK CLOSELY WITH HMTV ON THIS PROJECT. SECONDLY, IN RELATION TO WHAT COMMISSIONER SHELL MENTIONED ABOUT THE UTILITIES, SINCE POSTING THE AGENDA, WE MADE ONE SMALL AMENDMENT THAT I WANT TO DICTATE, ARTICLE 3 SECTION 8, WE ADDED A SUBSECTION I THAT READS THE COUNTY SHALL NOT UNREASONABLY WITHHOLD ITS APPROVAL OF LOCATION OF FUTURE WATER, WASTE WATER OR OTHER UTILITIES ON THE PROPERTY, AND THAT IS UPDATED IN YOUR PACT FOR SIGNATURE TODAY.
>> WHAT ABOUT THE POTENTIAL CONVERSATION, HOW MUCH ACREAGE IS THERE FOR THAT CONVERSATION, COMMISSIONER?
>> IT DEPENDS ON THEIR DEVELOPMENT PLANS WHICH HAVEN'T NECESSARILY BEEN SET, SO, YOU KNOW, THERE IS SOME DEVELOPMENT OCCURRING, WHICH IS THE WATER RIDGE. PIECE OF THEIR PROPERTY.
[01:35:02]
THEY HAVE MANY LAND HOLDINGS. I DON'T THINK THEY HAVE DECIDED HOW THOSE ARE GOING TO BE DEVELOPED. IN THE EVENT THEY WANT TO ESTABLISH A PID WITH THE CITY OR COUNTY OR BOTH OF US, WE WOULD CONSIDER THAT.THAT'S A PROJECT THAT WOULD DEFINITELY FIT OUR CONSIDERATION, ESPECIALLY UNDERSTANDING THE IMPORTANCE OF GETTING THIS RIGHT-OF- WAY PRESERVED BEFORE THAT TYPE OF DEVELOPMENT OCCURS, AND I THINK THAT'S REALLY WHAT'S THE BEST PART ABOUT THIS IS IF WE DIDN'T HAVE A WILLING LANDOWNER TO WORK WITH US, THEY COULD HAVE ALREADY DEVELOPED PIECES OF THIS PROPERTY, AND WE WOULD BE STUCK AT THAT POINT, TRYING TO ACQUIRE RIGHT-OF-WAY.
THAT PID CONSIDERATION, I THINK, IS GOOD FOR BOTH PARTIES. IT WILL DEPEND ON THE TYPE OF DEVELOPMENT, THOUGH, WHETHER THERE'S A PID OVER ALL OF THEIR PROPERTIES, SECTIONS OF THEIR PROPERTY AND WHAT'S THE BEST METHOD TO FINANCE THE DEVELOPMENT OF THE STRUCTURE. I DON'T THINK THEY HAVE ANY PLANS ON THAT YET, WE WANTED TO GET AHEAD OF THIS, ESPECIALLY ONCE THE BOND PASSED. THIS PROJECT WAS ONE OF THE BOND PROJECTS. I WANTED TO GET THAT RIGHT-OF- WAY PRESERVED, AND WE HAVE ANOTHER ITEM THAT WILL TAKE US THROUGH DESIGN ON THAT
ROADWAY. >> FOR SITY SAKE, IF IT WERE TO INCORPORATE ALL OF THE PROPERTY, WHAT WOULD BE THE BALLPARK.
>> WE CAN ASK THE REPRESENTATIVE.
ALBERT, WOULD YOU MIND ANSWERING THAT
QUESTION. >> THE GENERAL FOOTPRINT.
UNDERSTAND. >> ALBERT CORTEZ, PROJECT MANAGER FOR BLANKET RIVER RANCH WHO OWNS THE PROPERTY. TO ANSWER DIRECTLY, IT'S 1,100 ACRES CURRENTLY THAT'S OUTSTANDING THAT COULD HAVE A PID, SO IT'S JUST ONE TOOL, THAT HAS AN OPPORTUNITY TO HELP FORMULATE A STRATEGY IN TERMS OF HOW WE WOULD DEVELOP THE PROPERTY, GIVEN THAT WE HAVE SET ASIDE THE LAND, ROUGHLY 65 ACRES FOR THE RIGHT-OF-WAY.
AND SO IT KIND OF GAVE US AN OPPORTUNITY TO SAY HOW DO WE GO AHEAD AND CODIFY THIS TRACT OF LAND FOR THE ROAD, AND THEN HOW DO WE DESIGN THE ROAD GIVEN THE DEVELOPMENT REQUIREMENTS OF THE PROJECT, SO IT WOULD ESSENTIALLY MAKE IT MORE EFFICIENT IN WHAT WE'RE DOING. AND I THINK ALL OF THE ENGINEERS, INCLUDING COUNTY ENGINEERS AND OUR ENGINEERS FROM DIFFERENT DEVELOPMENTS THINK THAT'S THE RIGHT APPROACH. IT'S THE RIGHT APPROACH BECAUSE NOW WE CAN CONSIDER ALL THE ASPECTS OF A DESIGN OF A ROAD, CONSIDERING OUR DEVELOPMENT REQUIREMENTS AND THE ROAD REQUIREMENTS. AND INCLUDING THE KINDER MORGAN PIPELINE WHICH CREATES A HARD CONSTRAINT ON HOW WE DESIGN THE PROJECTS. WE REACHED IN A SEPARATE DISCUSSION, WE HAVE A SETTLEMENT WITH KINDER MORGAN THAT DESIGNS THAT ROADWAY, AND INCLUDING OUR UTILITY REQUIREMENTS OF OUR DEVELOPMENT.
SO THAT'S PART OF THIS AGREEMENT AS WELL, WHICH IS REALLY
SIGNIFICANT. >> I REMEMBER THAT WHOLE CONVERSATION AS THAT WAS BEING DISCUSSED AND COMING THROUGH. I REALLY APPRECIATE THAT LONG GAIN LENS, NOT ONLY THAT I HAVE FROM SEEING IT MOVING DOWN THE PIPELINE, PUN INTENDED AND ALSO THE WAY YOU'RE SEEING IN A HOLISTIC APPROACH IN THE DEVELOPMENT OF IT. YOU CAN STILL, AS YOU KNOW, STILL MAKE A GREEN SPACE ABOVE THAT PIPELINE.
>> IN FACT, I THINK COMMISSIONER SHELL HAS A GREAT IDEA THAT WE WOULD LIKE TO TAKE THAT DRAINAGE AREA AND AMENTIZE IT. HOW DO WE CREATE IN TERMS OF A -- LIKE A TRAIL SYSTEM IN A SENSE, RIGHT? AND THAT AREA THERE, THAT SHALLOW SYSTEM, IT'S ABOUT 100 -- THERE'S A CREEK OF SORTS, 150 FEET WIDE, 12 INCHES DEEP. THE IDEA WOULD BE HOW DO YOU RECHANNELIZE THAT DRAINAGE AND THEN ESSENTIALLY CREATE A NEW DO YOU MEAN, A CAPACITY SO THAT YOU COULD TAKE ON THE ROAD DRAINAGE AND THE DEVELOPMENT DRAINAGE, AND IF WE SHIFT THE DRAINAGE FROM OUR DEVELOPABLE AREAS INTO THE AREA, WHAT THAT WOULD DO WOULD ESSENTIALLY HELP CREATE MORE VALUE FOR DEVELOPMENT. WHAT THAT MEANS IS MORE TAX DOLLARS FOR SCHOOL DISTRICTS.
ONE OF THE BIGGEST BENEFACTORS OF THIS DEVELOPMENT IS THE SCHOOL DISTRICT.
YOU KNOW, I'VE BEEN AROUND THIS FOR A LONG TIME.
WE LOOKED AT THIS AS BRINGING A $3 BILLION PROJECT DEVELOPMENT MASTER PLAN COMMUNITY FOR HAYS COUNTY. AND SEE NOW THE NEXT PROJECT IS
[01:40:03]
TOLL BROTHERS BRING A HOME DEVELOPMENT PROJECT.AND THIS IS MOVING TOWARD FROM COACH ROAD TOWARD THE RIVER. AND SO WE'RE REALLY EXCITED WITH THAT.
>> IF YOUR PLANS ARE TO DIAL IN THE AMENITIES AS YOU'RE DESCRIBING WITH THE POTENTIAL, YOU KNOW, GREEN SPACE, TRAIL SYSTEM, ET CETERA, WE'VE PROVEN THIS SUPPORTS PITS.
>> I THINK THE OTHER THING WE ASKED FOR IN THIS AGREEMENT WOULD BE WE WOULD CREATE A WATER CONTROL IMPROVEMENT DISTRICT BECAUSE WE WANT TO BE ABLE TO HAVE THE HOMEOWNERS OR COMMERCIAL SIDE OF IT COST PARTICIPATE IN THE COST OF DRAINAGE, RIGHT? BECAUSE THIS IS A PARTNERSHIP BETWEEN HAYS COUNTY AND THE DEVELOPMENT. AND IF ALSO CREATE THE DRAINAGE AREA, AND HIS AMENITY, THAT'S OUR GOAL.
COMMISSIONER. >> THANKS, JUDGE, AND MR. CORTEZ. THAT'S A GREAT POINT USING THE DRAIN AGE AREA FOR THE AMENITY. WE OBVIOUSLY WANT TO TAKE CARE OF DRAINAGE THE BEST WE CAN. WE'RE GOING TO USE BEST PRACTICES IN ALL OF THOSE DESIGNS.
WE WANT TO CREATE SOMETHING THAT ISN'T JUST THIS GIANT CONCRETE AND ASPHALT ROAD. MAKE IT SOMETHING THAT'S NOT JUST PLEASING BUT RESPONSIBLE FOR THE ENVIRONMENT THAT IT'S PLACED AND I THINK THAT MANAGEMENT OF THAT DRAINAGE AND HAVING A DISTRICT THAT WILL ALLOW THE HOMEOWNERS TO SHARE IN THE COST OF MAINTENANCE AND ONGOING, THE CONSTRUCTION AND ONGOING MAINTENANCE OF THAT DRAINAGE SYSTEM AND THE AMENITIES ASSOCIATED WILL BE GOOD FOR EVERYBODY. I THINK IT WILL BE A REALLY NICE PLACE, ENJOYED BY NOT JUST THE RESIDENTS BUT ALL CITIZENS OF THE AREA.
>> I THINK THAT WILL JUST ELEVATE THE OVERALL, WHICH IS ALREADY IN THAT DIRECTION, ANYWAY.
SO THIS IS GREAT. GOOD JOB. MAYBE YOU CAN SEND ME AN UPDATED ROAD MAP. A LONG GAME VISUAL.
>> ALLOW ME, IF I COULD, TO THANK ALL THE -- THIS COURT AND THIS COUNTY FOR ALL THE WORK THAT'S GONE ON FOR THIS PROJECTS, AND THIS IS PAST AND PRESENT, YOU KNOW, COMMISSIONERS JONES AND THANK THEM FOR WHAT THEY STARTED. THE FIRST TIME WE ACQUIRED THE LOAN, THE COMMISSIONERS CAME UP AND SAID, HI, WE'RE COMMISSIONERS, AND WE'RE GOING TO PUT A ROAD THROUGH THE LAND YOU JUST ACQUIRED. OKAY WE SAID.
OKAY WE'LL FIGURE THIS OUT AND.
CURRENT COMMISSIONERS, INGALSBE AND COMMISSIONER SMITH, AND PARTICULARLY YOU COMMISSIONER SHELL, THANK YOU SO MUCH FOR YOUR LEADERSHIP AND DETERMINATION, AND RECOGNIZE HOW IMPORTANT THIS PROJECT WAS.
I ALSO WANT TO THANK PREVIOUS STAFF THAT I WORKED WITH, YOU KNOW, THAT GOES FROM CLINT GARZA, STRICKLAND, TAMMY, DEBRA.
EVERYBODY HAS BEEN SO KIND. JERRY, FOR YOUR HELP.
MARCUS, AND JORDAN FOR, YOU KNOW, TAKING OVER FOR MARC KENNEDY. AND THANK MARK KENNEDY, BECAUSE HE HAD TO PUT UP WITH ME OVER THE YEARS, AND TRYING TO FIGURE OUT HOW DO WE ACHIEVE WHAT THE COUNTY HAS BEEN WANTING TO DO AND HOW DOES IT WORK FOR OUR DEVELOPMENT. SO I THINK THIS IS GOING TO SERVE AS A TEMPLATE NOT JUST FOR OUR PROJECT AND OUR DEVELOPMENT, BUT THE REST OF THE COUNTY, IN TERMS OF THIS ROADWAY SYSTEM.
>> I THINK THE PORTION OF RETIREMENT AND APPRECIATION SPEECHES IS PAST, SO YOU'RE OUT OF ORDER. JUST KIDDING.
>> THANK YOU, GUYS. AND THANK YOU FOR YOUR KIND WORDS.
>> THANK YOU. >> JUDGE, I JUST WANT TO THANK COMMISSIONER SHELL FOR ALL OF HIS LONG AND HARD WORK AND ALBERT, THANK YOU SO MUCH ALSO AND I APPRECIATE THE OWNERS, DEVELOPERS AND THEIR WILLINGNESS TO PARTNER WITH THE COUNTY AND TO DONATE THE PROPERTY FOR THE ROAD.
IT'S EXTREMELY IMPORTANT BUT IT'S A GREAT PARTNERSHIP, AND, YOU KNOW, WE APPRECIATE IT, SO THANK YOU.
>> I WANT TO SAY TWO THINGS, NUMBER ONE, I KNOW THAT BOTH OF YOU ALL MENTIONED IT.
I WANT TO MAKE SURE THERE'S AN APPRECIATION OF WHAT KIND OF IMPACT THAT PIPELINE HAD ON THIS ROADWAY. WE HAD THE RIGHT-OF- WAY PRETTY MUCH SET, AND KINDER MORGAN LITERALLY PUT OUR ROAD MAP AND PUT A PIPELINE DOWN THE MIDDLE OF IT AND TOOK WHAT WE COULD HAVE USED IN A VERY GENERAL SENSE FOR A LONG SECTION OF THIS EXTENSION, NOT JUST THROUGH THIS PROPERTY BUT IN OTHER PROPERTIES AND HAD A DIRECT IMPACT AND AT THE END OF THE DAY, THE DECISION BY THAT PIPELINE COMPANY WILL END UP COSTING EVERY TAXPAYER IN HAYS÷÷ COUNTY ADDITIONAL MONEY IN THIS PROJECT. IT HAS NOTHING TO DO WITH Y'ALL.
Y'ALL DID A PHENOMENAL JOB WORKING WITH US.
I CAN'T SAY THANK YOU ENOUGH FOR
[01:45:03]
ALL YOU DID. AT THE ND O.-- OF THE DAY IT'S GOING TO COST TAXPAYERS BECAUSE OF THE DECISIONS THEY MADE.
I APPRECIATE IT BEING CALLED YARRINGTON. FOR SIX YEARS IT WAS THE WEST 150 EXTENSION, AND HAVING WEST 150 WHERE IT DEAD ENDS IN A WESTERN PART OF MY PRECINCT, I PROBABLY HAD NOT IN A JOKING SENSE, I PROBABLY HAD 100 CONSTITUENT PHONE CALLS RELATED TO, WELL, I LIVE IN WEST 150, WHY AREN'T WE HAVING PUBLIC MEETINGS.
WHY ISN'T THIS BEING TALKED ABOUT IN DRIPPING SPRINGS, AND WHEN I TELL THEM 16 MILES FROM THERE, WHY IS IT NAMED THAT.
APPRECIATE IT. >> AND WE HAVE AN EXIT RAMP NAMED YARRINGTON, SO IT HELPS PEOPLE CREATE THAT ORIENTATION. THANK YOU AGAIN.
>> COMMISSIONER SHELL. >> YES.
[I.2. Discussion and possible action to authorize the Court to execute a Contract Amendment No. 1 to revise language under Article 5 -- Compensation and Expenses in the Professional Services Agreement for engineering design services and to authorize Work Authorization 3 for PS&E services in the amount of $6,651,124.10 with American Structurepoint, Inc. (ASI) for the RM 150 Realignment Project from I-35 (at Yarrington Road) to RM 150 at Arroyo Ranch Road in Precinct 3. SHELL/BORCHERDING]
>> TO AUTHORIZE THE COURT TO EXECUTE A CONTRACT AMENDMENT TO REVISE LANGUAGE UNDER ARTICLE 5, COMPENSATION AND EXPENSES IN THE PROFESSIONAL SERVICES AGREEMENT FOR ENGINEERING AND DESIGN SERVICES AND TO AUTHORIZE WORK AUTHORIZATION 3 FOR PS AND E SERVICES IN THE AMOUNT OF $6,651,124. 10 WITH AMERICAN STRUCTURE POINT INC. FOR THE RM 1R50 150
REALIGNMENT PROJECT. >> COMMISSIONER.
>> THANK YOU, JUDGE. THIS IS THE YARRINGTON EXTENSION, AND THIS IS TO COMPLETE OUR AGREEMENT FOR DESIGN, SO THE COURT'S APPROVED THE AMOUNT SEVERAL MONTHS AGO, AND WE HAVE DONE TWO WORK AUTHORIZATIONS. THIS IS FOR THE THIRD WORK AUTHORIZATION. WE WERE OBVIOUSLY WAITING ON THE ELECTION TO SEE IF THE BOND PASSED AND THIS PROJECT COULD BE FUNDED AND SINCE IT WAS, WE'RE GOING TO GO AHEAD WITH THIS, AND THIS WOULD ALLOW US TO DESIGN THE ENTIRE ROADWAY AND SO THAT'S WORK AUTHORIZATION NUMBER 3, AND THEN THE CONTRACT AMENDMENT NUMBER 1 I'M GOING TO LET JORDAN TALK A LITTLE BIT ABOUT THAT.
SO THERE'S KIND OF TWO PIECES OF THIS.
ONE IS AN AMENDMENT TO ARTICLE 5 OF THE CONTRACT AND THEN THE SECOND PIECE IS FOR WORK AUTHORIZATION NUMBER 3, WHICH TAKES US THROUGH PS AND E.
>> FOR CONTRACT AMENDMENT NUMBER ONE, WE UNDER ARTICLE 5 AS COMMISSIONER SHELL MENTIONED, THE CONTRACT AMENDMENT WILL ALLOW FOR EACH INDIVIDUAL WORK AUTHORIZATION THAT THE COUNTY ISSUES TO -- THERE ARE TWO DIFFERENT METHODS -- PAYMENT METD METHODS PER INDIVIDUAL WORK AUTHORIZATION.
ONE IS A SPECIFIED RATE, WHICH IS TYPICAL WHERE THEY'RE BASED ON TIME SHEETS, ACTUAL HOURS WORKED, NONLABOR COSTS, ET CETERA.
ANOTHER METHOD, WHICH THIS CONTRACT AMENDMENT WOULD ALLOW FOR IS A LUMP SUM METHOD. THAT METHOD HAS A DIFFERENT REQUIRED SUBMITTALS, BASED ON PERCENTAGE TABLES THAN INDIVIDUAL TIME SHEETS.
THOSE WOULD BE PER WORK AUTHORIZATION.
THERE HAS BEEN A SLIGHT CHANGE IN LANGUAGE SINCE YOU'LL RECEIVE BACKUP.
IT'S IN RELATION TO SECTION B ON THAT CONTRACT AMENDMENT NUMBER ONE. THE VERY LAST SENTENCE, INSTEAD OF READING BUT MUST SUBMIT BILLING INFORMATION IN A FORM ACCEPTABLE TO THE COUNTY AS REQUIRED IN ARTICLE 6 SHOULD ACTUALLY READ BUT MUST COMPLY WITH THE PROVISIONS OF ARTICLE 30 ALLOWING FOR REVIEW OF ACCOUNTING RECORDS.
NOTHING ELSE IN RELATION TO ARTICLE 5 IS CHANGING.
COMPENSATION CAP IS REMAINING THE SAME.
AND EVERYTHING ELSE RELATED TO WORK AUTHORIZATIONS AND WHAT DOCUMENTS ARE REQUIRED FOR SPECIFIED RATES ARE UNCHANGED. AND THAT IS SEPARATE AND ASIDE FROM WORK AUTHORIZATION NUMBER 3 THAT COMMISSIONER SHELL MENTIONED. BUT WORK AUTHORIZATION NUMBER 3 IS BASED ON CONTRACT AMENDMENT NUMBER 1. HOPEFULLY THAT MAKES SENSE.
>> LUMP SUM VERSUS SPECIFIED RATE.
TXDOT USES LUMP SUM QUITE OFTEN, ESPECIALLY FOR LARGE DESIGN PROJECTS.
AND I KIND OF WENT BACK AND FORTH WITH IT WITH OUR TEAM FROM HNTB, CARLOS SPENT A THE LOT LOT OF TIME WITH IT. AS YOU KNOW IN A NORMAL DESIGN PROCESS, YOU KNOW, WE HAVE RATES FOR THE DIFFERENT STAFF MEMBERS, ENGINEERING LEVELS, ADMINISTRATIVE STAFF WITHIN A FIRM.
THEY TURN IN HOW MANY HOURS, THEY MULTIPLY THAT BY THE RATE, AND WE PAY THOSE BILLS.
[01:50:03]
AND THERE'S A NOT-TO-EXCEED FEE WHICH EXISTS IN BOTH OF THOSE SCENARIOS.THEY'RE WORKING WITHIN IN THAT.
THE IDEA OF LUMP SUM IS TO INCENTIVIZE THE DESIGNER TO GET THE WORK DONE AS SOON AS POSSIBLE, AND TO AGREE ON THE LUMP SUM AMOUNT THAT WE BELIEVE IS FAIR.
AND SO OUR TEAM HAS SPENT A LOT OF TIME NEGOTIATING WHAT THAT SHOULD BE, AND GETTING TO A POINT WHERE WE THINK IT IS A BENEFIT TO THE TAXPAYER, INSTEAD OF GETTING, YOU KNOW, HOURS TIMES RATES, HOURS TIMES RATES, DESIGNER KNOWS THIS IS THE AMOUNT OF MONEY THAT WE HAVE TO GET THIS JOB DONE, AND WE CAN'T THAT AMOUNT, AND THEY ARE THEN INCENTIVIZED TO MAKE SURE THEY DO ITIT AS TIMELY A FASHION AS POSSIBLE, AND AS EFFICIENTLY AS POSSIBLE FOR US IN OUR WORK SCHEDULE AND OVERALL COST TO THE TAXPAYER. THAT'S THE REASON TXDOT USES THAT IS TO PROVIDE THAT INCENTIVE, AND I THINK IN THIS TYPE OF A PROJECT, AS LARGE AS IT IS, AND AS LONG AS IT'S GOING TO TAKE, THAT WILL HELP US GET THE ROAD DESIGNED AND EVENTUALLY BUILT SOONER. WE HAVE OTHER RIGHT-OF- WAY TO MAKE OUTSIDE OF THE HAVE - PROPERTY THAT WE DISCUSSED, AND THE SOONER WE GET THAT DESIGN FINALIZED AND NEGOTIATE WITH THOSE LANDOWNERS, THE BETTER IT WILL BE FOR OUR TAXPAYERS.
THE LONGER THAT TAKES, THE MORE MONEY WE SPEND, AND I DON'T WANT TO SEE THIS JOB, THIS PROJECT WHEN I'M A CITIZEN OFF DOING WHATEVER I'M DOING, PAYING ATTENTION, THAT IT'S NOT BEEN BUILT IN A FEW YEARS, AND THAT IF IT IS, IT'S DELAYED AND OVER BUDGET.
THIS IS THE BEST WAY TO KEEP US ON TASK AND GET THIS DONE AS FAST AS POSSIBLE.
>> IT REMINDS ME OF THE P 3 EFFORT, PUBLIC/PRIVATE PARTNERSHIPS, WHICH IS EXACTLY WHAT THIS IS, AND WE SHOULD BE GETTING EFFICIENCIES WHICH TRANSLATE TO TAXPAYER SAVINGS.
>> THERE'S SEVERAL PROJECTS THAT WERE BOND PROJECTS THAT I HAVE GONE THROUGH AND DISCUSSED WITH TXDOT, THE BENEFITS OF THIS TYPE OF FUNDING STRUCTURE AND I WOULD IMAGINE THAT WHEN WE COME BACK AND START DOING THE AWARDS FOR THOSE PROJECTS, I'M GOING TO TAKE A HARD LOOK AT THOSE AS WELL. AND I JUST WANT TO REITERATE THAT, BECAUSE WE HAVEN'T DONE VERY MANY OF THEM. I DO THINK IT ADDS SOME SERIOUS EFFICIENCY. AT THE END OF THE DAY, IT'S GOING TO SAVE QUITE A BIT OF TAXPAYER MONEY. THAT'S VALUABLE.

Discussion and possible action to authorize the execution of Contract Amendment No. 9 in the amount of $150,000.00 to the Professional Services Agreement between Hays County and LJA Engineering, Inc. for professional design services on the FM 110 North project in Precinct 1, as part of the TxDOT/Hays County Partnership Program, utilizing a discretionary exemption pursuant to Texas Local Government Code Ch. 262.024(a)(4) and amend the budget accordingly. >> JUDGE, THIS IS FOR ADDITIONAL SURVEYING AND ENGINEERING SERVICES THAT IS NEEDED TO CLOSE OUT THIS PROJECT. WE'RE ON THE LAND PARCEL, STILL TRYING TO WORK THROUGH A FEW THINGS, AND HOPEFULLY THIS WILL CLOSE THIS OUT.
AND WE CAN TURN IT OVER TO TXDOT AFTER THAT.

>> MR. MILLER. STATE YOUR NAME AND TITLE FOR THE VIEWING PUBLIC.
>> I DO HAVE A PRESENTATION. MY NAME IS NATALIE FRILS, THE HAYS COUNTY COMMUNICATIONS MANAGER. I'M EXCITED TO BE HERE BEFORE Y'ALL TODAY.
HOPEFULLY I KNOW HOW TO WORK THIS. IT'S BEEN A WHILE SINCE I HAD A POWER POINT PRESENTATION.
WE'RE BRINGING BEFORE YOU WHAT WE HAVE ACCOMPLISHED AS A BRANDING COMMITTEE SINCE WE REFORMED IN EARLY APRIL.
I WOULD LIKE TO INTRODUCE THE BRANDING COMMITTEE.
IT'S MYSELF, WITH HUMAN RESOURCES. TUCKER FURLOUGH WITH THE CIVIL DIVISION OF THE DISTRICT ATTORNEY'S OFFICE.
MATTHEW GONZALEZ WITH THE HEALTH DEPARTMENT. MICHAEL WITH DEVELOPMENT SERVICES. CHRIS WITH ELECTIONS. AND STEPHANIE HUNT WITH PURCHASING.
WHAT I WANTED TO COVER IS THE EMPLOYEE BRANDING SURVEY RESULTS, THE SLOGAN/TAG LINE, INTRODUCTION, MISSION, AND VISION STATEMENTS, SOCIAL MEDIA POLICY, COLOR PALETTE. I WANT TO GO OVER THE BRANDING SURVEY RESULTS. THAT'S WHAT I UTILIZED IN WRITING THE MOST IMPORTANT THINGS, I THINK, WHICH IS THE INTRODUCTION, MISSION AND VISION STATEMENTS. LET ME GIVE AN INTRODUCTION TO THE SURVEY. THE EMPLOYEE BRANDING SURVEY WAS SENT TO ALL EMPLOYEES IN EARLY MAY ASKING FOR THE INPUT ON THE HAYS COUNTY BRAND.
THIS INCLUDED DESCRIPTIONS OF THE HAYS COUNTY GOVERNMENT AS AN ENTITY. WORDS AND PHRASES THAT COME TO MIND. AND STRENGTHS AND WEAKNESSES.
RECEIVED MORE THAN 50 RESPONSES, WHICH SEEMS MINIMAL COMPARED TO HOW MANY EMPLOYEES WE HAVE. BUT WE ASKED A LOT IN OUR SURVEY. AND WE GARNERED MORE RESPONSES THAN EXPECTED.
THIS IS THE WORD CLOUD. SO THIS SHOWS OBVIOUSLY WHICH KEY WORDS CAME UP THE MOST. AND AS YOU'LL SEE GROWTH IS THAT BIG OLD KEYWORD THERE.
OTHER RESPONSES WERE CHANGE, CULTURE, HISTORY, CONNECTION, AND PROFESSIONAL. THIS SHOWS EXACTLY HOW MANY TIMES THOSE WORDS WERE USED.
YOU'LL SEE GROWTH GROWING WAS USED 28 TIMES.
THEN WE GET DOWN TO THE LOWER NUMBER OF RESPONSES, DEPENDABILITY, HOME, AGAIN, THESE ARE ALL THE WORDS THAT I USED TO WRITE THOSE IMPORTANT THINGS I'LL ADDRESS LATER.
THANK YOU. SO THESE ARE THE POSITIVE ATTRIBUTES. THESE ARE THE ACTUAL RESPONSES LINKED TO THE POSITIVE ATTRIBUTES, WE ASKED EMPLOYEES TO DELINEATE. I'LL READ OFF A COUPLE FOR THE VIEWING PUBLIC IF THEY CAN'T SEE THAT. STRONG COMMITMENT OF SERVING THE COMMUNITY WITH INTEGRITY, EMPATHY AND DILIGENCE, A SPIRIT OF SAFETY AND SERVICE. VALUES DIVERSITY WHILE HOLDING TO ITS ROOTS, ALL COLLECTIVELY COME TOGETHER FOR THE BETTERMENT
OF THE COUNTY. >> IT IS VISIBLE TO EVERYONE.
>> IT IS, GREAT. SO THIS NEXT SLIDE ARE THE NEGATIVE ATTRIBUTES, COMMENTS ON THE CHARACTERISTICS OF THE HAYS COUNTY GOVERNMENT AND WHAT HELPS STAND IT APART WERE MIXED.
WITH A SMALL MAJORITY OF COMMENTS LANDING ON THE NEGATIVE SIDE.
HOWEVER, MANY OF THOSE NEGATIVE COMMENTS WERE DIRECTLY RELATED TO THE COUNTY'S RAPID GROWTH, AND I'LL JUST NAME A FEW. CAPABLE BUT STRUGGLING.
SEEMS THE HANDS AND ARMS DON'T NECESSARILY WORK TOGETHER AS A WHOLE. IT'S A SMALL COUNTY GOVERNMENT THAT IS QUICKLY GROWING BIGGER AND BIGGER AND NEEDS TO MODERNIZE AND MY FAVORITE RESPONSE, AND WHY WE'RE HERE TODAY IS LACKING IN A
[02:05:08]
COHESIVE BRAND.SO LOOKING TOWARDS THE FUTURE, WE ASKED RESPONDENTS TO DELINEATE THE MAJOR THEMES THAT THEY WANT TO SEE IN THE BRAND. AND THAT SHOWED UP IN QUALITY OF LIFE, SERVICES, TRADITIONS AND IMAGES. MOST COMMENTS THAT RELATE TO THE QUALITY OF LIFE HAD THE FOLLOWING AT FWUT FOLLOWING ATTRIBUTES, SAFE PLACE TO LIVE.
SMALL TOWN, BIG CITY FEEL. WELCOMING PLACE AND SO ON.
THIS SLIDES COMBINES THE SERVICES AND TRADITIONS.
AS A BRAND, HAYS COUNTY SHOULD INCLUDE A CARING LOCAL GOVERNMENT WHO SEES TO THE NEEDS OF THEIR RESIDENTS, AS A BRAND, HAYS COUNTY SHOULD CONSIDER TRADITIONS OF PEOPLE WHO HAVE BEEN HERE FOR GENERATIONS TO HAVE OLD VALUES. I WOULD LOVE TO SEE AN EMPHASIS ON HISTORICAL SITES. THOSE WERE SOME OF THE RESPONSES WE RECEIVED. WHEN WE ASKED ABOUT PERSONALITY ATTRIBUTES, THERE WERE FIVE THAT CAME UP MOST OFTEN. INNOVATIVE AND PROGRESSIVE, RELIABLE AND TRUST WORTHY, FRIENDLY AND WELCOMING, OUTDOOR ENTHUSIAST AND AUTHENTIC AND HISTORIC. KEY WORDS OF THE BRAND.
PERCEPTIONS OF HOW BRANDING MIGHT HELP THE COUNTY ACHIEVE ITS FUTURE WERE MIXED.
MANY DON'T UNDERSTAND WHAT A BRAND IS.
HOWEVER, THOSE WHO RESPONDED NOTED THESE KEY WORDS SHOULD BE PROGRESSIVE, KIND, ENVIRONMENTAL, UNIFIED, SAVING CLEAN.
WELCOMING TO DIVERSITY, PRIDE, CONNECTION, UNIQUE AND BEAUTIFUL, PORTRAYING THE TRUE ESSENCE, TRADITIONAL VALUES, AND I LOVE THE GLOWING STAR OF CENTRAL TEXAS. THESE KEY WORDS, IN WRITING THE SLOGAN OPTIONS, MISSION AND VISION STATEMENTS WHICH I'LL ADDRESS SHORTLY. SO TO SUM IT UP FOR THE SURVEY RESPONSE, SURVEY PARTICIPANTS FELT THE NEED TO UPDATE THE BRAND AND LOGO TO REPRESENT THE COUNTY THAT VISUAL LY CAPTURES THE UNIQUE POSITION, AND FOR ESTABLISHING A HOMETOWN FEEL RECOGNIZING ITS PLACE AMONG OTHER CITIES.
SO OF COURSE THE BIGGEST SENTIMENT CAPTURED IN THE SURVEY WAS THE NEED TO KEEP UP WITH THE FAST PACE OF GROWTH. FOR THESE CHANGES TO OCCUR, IT WAS RECOMMENDED THAT PLANS SHOULD INCLUDE TRAINING FOR EMPLOYEES, AND THE MISSION STATEMENT CREATING SERVICE ORIENTED MINDSETS. THIS IS BEING ADDRESSED IN THE EMPLOYEE ORGANIZATION PROGRAM PRESENTED BY HUMAN RESOURCES FOR NEW EMPLOYEES. IT WAS RECOMMEND THE COUNTY ESTABLISH A GOAL TO CREATE A STRONG COMMUNICATIONS SYSTEM WITHIN ITS OFFICES AND FROM THE RESPONSES IN THE SURVEY, WE FOUND THAT CREATING A CENTRAL FUNDING SOURCE FOR CLOTHING FOR THE HAYS COUNTY BRAND WOULD GO FAR IN MORAL.
DO YOU HAVE QUESTIONS ABOUT THE SURVEY AND ANALYSIS?
>> HOW MUCH LONGER DO WE HAVE ON THIS PRESENTATION?
>> NOT MUCH LONGER. I'M GETTING TO THE MEAT OF
SO AS I MENTIONED, I USED THE SURVEY FOR THE INTRODUCTION, MISSION AND VISION STATEMENTS.
THE SLOGAN OPTIONS THAT THE COMMITTEE DECIDED ON AND WE ARE LOOKING FOR FOR YOUR RECOMMENDATION TODAY IS HAYS COUNTY, THE STAR OF THE HILL COUNTRY.
AND HAYS COUNTY UNITED IN GROWTH, COMMITTED TO COMMUNITY.
THE INTRODUCTION, I BELIEVE, IS IMPORTANT BECAUSE IT'S INTRODUCING OUR MISSION AND VISION STATEMENTS. FOR THE SECOND TIME, I CAN LEAVE IT THERE AND NOT READ IT, AND THEN SORRY, NEXT SLIDE. THESE ARE THE MISSION AND VISION STATEMENTS, AGAIN, THESE WERE CREATED USING THESE SURVEY RESULTS.
I WANT TO THANK MATTHEW GONZALEZ FOR HELPING WITH THIS.
WE HAD A GREAT DISCUSSION ABOUT THIS.
KEY CHANGES INCLUDE BEST PRACTICES, IF I SHARE A PROCLAMATION PHOTO FROM THE HAYS COUNTY PAGE AND THE SHERIFF'S OFFICE WANTS TO POST THE SAME PHOTO, WE SHOULD BE CROSS PROMOTING OUR BRANDS, RATHER THAN ONE ENTITY TAKING MY PHOTO, AND ALSO PUBLISHING IT AS THEIR OWN. WE'RE CROSS PROMOTING THOSE ACCOUNTS. I BELIEVE THAT REQUIRES COMMUNICATION BETWEEN ALL SOCIAL MEDIA ADMINISTRATORS ON BEHALF OF THE COUNTY, AND ALSO ALL POSTS WILL BE IN AP STYLE, AND WE HAVE CREATED A QUICK REFERENCE GUIDE TO ACCOMMODATE AP STYLE RULES WHICH WILL BE
[02:10:01]
AVAILABLE TO ALL ADMINISTRATORS.THE DOCUMENT'S ORDER WAS REARRANGED TO INCLUDE PURPOSE AND S AT THE TOP.
WE DISCUSSED A DISCIPLINARY ACTION THAT IS LESS PUNITIVE AND MORE GOAL-ORIENTED.
WE ADDRESSED ARCHIVING AND THE PUBLIC INFORMATION ACT, AS WELL AS A MEANS FOR DEPARTMENTS WITH THEIR OWN SOCIAL MEDIA PAGES TO REQUEST POSTS TO THE OFFICIAL HAYS COUNTY PAGES. WE REITERATED THE FACT THAT ANY ANY ACCOUNT NEEDS TO BE APPROVED BY THE COURT PRIOR TO ITS CREATION.
OVERALL, THE SOCIAL MEDIA POLICY CHANGES ARE INTENDED TO FOCUS MORE ON THE ADMINISTRATORS OF HAYS COUNTY SOCIAL MEDIA ACCOUNTS RATHER THAN EMPLOYEES WHO USE SOCIAL MEDIA PERSONALLY.
NEXT WE HAVE THE COLOR PALETTE. IN THIS SLIDE YOU'LL SEE THE COLOR PALETTE I PERSONALLY HAVE BEEN USING ACROSS INTERNAL COMMUNICATIONS. YOU'LL RECOGNIZE THE FIRST TWO COLORS. THOSE ARE ON OUR WEB SITE, THE BLUE AND THE GREEN.
IT'S COME TO MY INTENTION THAT THE GREEN USED ON THE WEB SITE IS NOT NECESSARILY ADA FRIENDLY.
THUS WE VOTED ON A NEW COLOR PALETTE.
THIS IS THE COMMITTEE APPROVED COLOR PALETTE.
IT'S A LITTLE MORE REGAL, A LITTLE MORE IN LINE WITH WHAT OTHER MUNICIPALITIES IN HAYS COUNTY USE. I NEED TO DISCUSS CHANGING THE COLORS ON THE WEB SITE WITH THE CEO OF MUNITION, THAT I HAVE BEEN TOLD IT'S AN EASY CHANGE.
AND FINALLY, THE LOGO, WE AS A COUNTY HAVE NOT REALLY A LOGO, WE HAVE A SEAL.
AND IT'S APPROPRIATE FOR FORMAL USE.
BUT THE COMMITTEE AGREED THAT A MORE INFORMAL GO WOULD BE MORE APPROPRIATE ON CERTAIN MATERIALS, PRESS RELEASES AND OFFICIAL DOCUMENTS SHOULD REQUIRE THE SEAL. E- MAIL SIGNATURES DON'T NECESSARILY NEED THAT. STEPHANIE, COULD YOU ADDRESS THE PROCESS OF SEEKING OUT A GRAPHIC DESIGNER AND OBTAIN
AGO QUOTE? >> STEPHANIE HUNT, PURCHASING AGENT. IT WOULD BE UP TO THE COUNTY ON WHETHER OR NOT THEY WANTED TO POTENTIALLY DO A LOGO, WHAT THAT MIGHT LOOK LIKE, IF Y'ALL WANTED TO GO THAT ROUTE, THEN WE WOULD SEEK A INDIVIDUAL GRAPHIC DESIGN COMPANY WHO WOULD POTENTIALLY COME UP WITH SOME OPTIONS THAT WE WOULD THEN PRESENT TO COURT TO SEE IF IT WAS SOMETHING THAT YOU WANT TO TWEAK IT, AND THEN IMPLEMENT IT. IF WE WANTED TO GO OUTSIDE OF THE COUNTY SEAL AND UTILIZE A LOGO.
>> I WOULD SAY THERE'S OTHER OPTIONS OTHER THAN GOING WITH ONE GRAPHIC DESIGNER. I HAVE USED SERVICES IN PRIVATE BUSINESS WHERE YOU CAN SUBMIT YOUR CONCEPT OR YOUR THEME AND GET SUBMISSIONS FROM 80 GRAPHIC DESIGNERS AND MULTIPLE SUBMISSIONS FROM 80 GRAPHIC DESIGNERS, AND THE COST ON THAT IS MUCH MUCH LESS THAN HIRING ONE GRAPHIC DESIGN FIRM.
SO IF WE DO DECIDE TO DO THAT, I WOULD BE WILLING TO -- MORE THAN HAPPY TO SHARE THOSE PLACES WITH YOU.
BUT THEY OUTSOURCE THOSE, AND THE INDIVIDUALS ACTUALLY COMPETE AND ONCE YOU GET THOSE 80 SUBMISSIONS, YOU'RE ABLE TO SELECT, OKAY, WELL, I LIKE THESE FIVE OR SIX, THEN WE CAN GO TO A COMPETITIVE SITUATION. BUT IT'S COMPETITIVE.
>> SO WHAT WE NEED APPROVAL FOR IS THE SLOGAN OPTION, MISSION STATEMENT, VISION STATEMENT. THE SOCIAL MEDIA POLICY CHANGES, WHICH ARE SUBJECT TO CHANGE.
IT'S WITH TUCKER FURLOW RIGHT NOW.
HE'S NOT GOTTEN BACK TO ME ON LEGAL CHANGES.
THE NEW COLOR PALETTE, AND AN OFFICIAL INFORMAL COUNTY LOGO GOING OUT AND SEEKING THAT.
>> I'M NOT PREPARED TO MAKE ANY DIRECTION AT THIS TIME.
THIS IS THE FIRST TIME I GET TO SEE IT.
I DON'T BELIEVE ANY OTHER COURT MEMBER -- ALL THE COURT FEELS THE SAME.
THANK YOU FOR THE PRESENTATION.
>> COMMISSIONERS, ANY QUESTIONS FOR HER?
>> I WAS GOING TO THROW COMMENTS OUT THERE, AND IF THE COUNTY WISHES, YOU KNOW, WOULD LIKE TO GO OUT FOR PROFESSIONAL HELP, THE PARTNERSHIP RENT DID THIS, A LITTLE BIT MORE DEPTH, INCLUDING NAME CHANGE AND STAKE HOLDERS, YOU COULD GET AN IDEA OF WHAT THESE THINGS COST.
THEY GOT PROPOSALS ON MULTIPLE FIRMS, IF Y'ALL WANT TO GO FURTHER WITH LOGO, COMMISSION STATEMENT. MY INPUT ON THE MISSION STATEMENT WAS, YOU KNOW, SUGGESTIONS, AS ONE OF THE FASTEST GROWING COUNTIES BECAUSE THAT
IT'S NOT FACTUAL ANYMORE. I LIKE IT AS ONE OF THE FASTEST GROWING COUNTIES IN THE NATION, HAYS COUNTY, WHILE MAINTAINING A DEEP CONNECTION TO OUR RICH
[02:15:01]
HISTORY, I WOULD ADD COMMA CULTURE, AND NATURAL RESOURCES OR SOMETHING THAT POINTS TO THAT BALANCING ACT, GROWTH, WE WANT TO RECOGNIZE HISTORY, CULTURE, DIVERSITY, HAYS COUNTY, WHICH IS VERY RICH, AND WE WANT TO RESPECT OUR NATURAL RESOURCES AS WE PLAN FOR THAT GROWTH. THOSE ARE MY SUGGESTIONS.OTHERWISE I THINK IT LOOKS GOOD.
>> IT'S REALLY GOOD, AND MY HOPE IS AS PROBABLY THE PREMIERE OFFICE THAT WOULD BE ASKED TO SHAPE SOME OF ITS COMMUNICATIONS STYLE, BECAUSE I TAKE THAT HAPPILY. I WOULD ENCOURAGE YOU TO FIND WAYS TO INCORPORATE THOSE PEOPLE YOU TRIED TO SHAPE THE COMMUNICATION STYLES INTO THE CONVERSATION AND THE SECOND OF THOSE TWO STATEMENTS WAS ALSO MY PICK ALSO IN THE GENERAL SCHEME OF THINGS BECAUSE IT IS REFERENCING COMMUNITY AND REFERENCING THE PEOPLE THAT LIVE HERE. I THINK IT'S AWESOME. IT'S TOO EASY TO GET INTO A VACUUM, BREATHE THEIR OWN AIR OR BE IN A SILO AND THEN WE'RE HOMOGENIZING, NOT CAPTURING THE

TRUE ESSENCE OF THE CHUNT.COMMUNITY.>> K.6. DISCUSSION AND POSSIBLE ACTION TO CONSIDER GRANTING A VARIANCE TO THE 2014 HAYS COUNTY ON SITE SEWAGE FACILITY RULES. TABLE 10-1 AND ALLOW ISSUANCE OF AN ON SITE SEWAGE FACILITY PERMIT TO THE OWNER OF THE PROPERTY AT 3280 DAISY LANE, KYLE, TEXAS.
>> OUR DEPARTMENT DID RECEIVE A PERMIT FOR AN ADDITIONAL TWO RESIDENCES ON THAT PIECE OF PROPERTY LOCATED AT 3280 DACY LANE. IT WAS CREATED IN 2008, IN 2015 PORTION, MORE SPECIFICALLY, . 09 ACRES OF THAT PROPERTY WAS TAKEN FOR A RIGHT-OF- WAY FOR DACY LANE, AS A RESULT, THE PROPERTY USED TO BE 1.
5 ACRES, WHICH MEETS OUR CURRENT RULES FOR THE PERMIT. HOWEVER, SINCE THE RIGHT-OF- WAY WAS TAKEN IN 2015, THEY DO NOT MEET THE RULES IN TERMS OF MINIMUM LOT SIZE.
PRESENTED BEFORE YOU IS A VARIANCE REQUEST TO GET A SEPARATE PERMIT IF THE ADDITIONAL TWO RESIDENCES ON THE PROPERTY.
>> AND WE HAVE OFTEN WORKED WITH PROPERTY OWNERS TO HELP THEM, YOU KNOW, A COUPLE OF THINGS THAT I WILL MENTION IS THAT THE VARIANCE WILL BRING THE OWNERS INTO COMPLIANCE WITH THE HAYS COUNTY DEVELOPMENT RULES REGULATIONS WHICH MARCUS MENTIONED, WHEN THE EXISTING SYSTEM FAILS, IT WILL BE REPLACED WITH AN ADVANCED SYSTEM, AND THE PROPOSE OSFF ON SITE SEWAGE FACILITIES SERVING THE TWO NEW RESIDENTS WILL BE AN ADVANCED SYSTEM, SO --
