>> JUDGE BECERRA: GOOD MORNING, I WOULD LIKE TO CALL THIS MEETING TO ORDER. AND I THINK BASED ON A PREVIOUS CONVERSATION I WILL LEAD THIS MORNING'S INVOCATION, IF YOU'LL PLEASE ALL RISE.

MY HOPE IS TO SAY THINGS THAT ARE UNIFYING AND HARMONIZING FOR US IN THE COMMUNITY.

DEAR LORD, PLEASE GIVE US OUR MOMENT UNDER THE SON WITH YOUR PEACE AND HARMONY SO WE MAY FIND THE HIGHEST AND BEST VALUE AND USE OF OUR TIME HERE AND NOW.

PLEASE ALLOW US TO SEE EVERYONE WITH LOVING EYES.

EVERYONE IS SOMEONE'S SON, FATHER, BROTHER, MOTHER, LOVED ONE. SO PLEASE HELP US MAKE DECISIONS WHERE WE SEE ONE ANOTHER IN THE MOST USEFUL AND HIGHEST MANNER IN JESUS' NAME WE PRAY UNDER A GIVE

THANKS, AMEN >> I PLEDGE ALLEGIANCE TO THE FLAG OF THE UNITED STATES OF AMERICA, AND TO THE REPUBLIC FOR WHICH IT STANDS, ONE NATION UNDER GOD, INDIVISIBLE, WITH LIBERTY AND JUTICE FOR ALL.

HONOR THE TEXAS FLAG, I PLEDGE ALLEGIANCE TO THEE, TEXAS, ONE STATE UNDER GOD, ONE AND INDIVISIBLE.

>> I DON'T -- FRAMING THAT IS CATHOLIC OR ANYTHING ELSE BUT UNIVERSALLY BENEFICIAL. SO HOPE THAT WORKED OUT FOR EVERYONE. DR. CARDENAS PLEASE CALL THE ROLL.

[PUBLIC COMMENTS]

>> THOSE IN THE AUDIENCE WHO HAVE SUBMITTED A PUBLIC PARTS WITNESS FORM WILL HAVE 3 MINUTES TO SPEAK.

UNFORTUNATELY NO ACTION MAYBE TAKEN BY THE COURT DURING PUBLIC COMMENTS AS WE'RE EXPECTED NOT TO RESPOND. ANY COMMENCE WILL BE TAKEN AS RHETORICAL. ALL COMMENTS ARE THE OPINIONS OF THE SPEAKER AND ARE NOT MEANT TO BE NECESSARILY CONSTRUED AS TRUTH.

PLEASE KEEP YOUR COMMENTS AND LANGUAGE CIVIL AND RESPECTFUL OR YOU WILL FORFEIT THE REMAINDER OF YOUR TIME. IN SPIRIT OF RESPECT PLEASE SILENCE YOUR CELL PHONES. FIRST PERSON SIGNED UP TO SPEAK IS MR. DAN LYON. YOU'LL HAVE 3 MINUTES.

>> GOOD MORNING, YESTERDAY WE'RE CELEBRATING THE DREAM OF FLEEDOM AND LIBERTY. TODAY THIS AWAKE TO THE HARSH -- OFFICIALLY IT'S JUST OVER HALF A BILLION DOLLAR. HOWEVER IF IT'S HELD TO MATURITY IT'S CLOSE TO 3 QUARTERS OF A BILLION DOLLAR. EACH YEAR WE'RE PAYING $20 MILLION TO SERVICE THIS DEBT.

KING GEORGE THE 3 WOULD HAVE BEEN ENVIOUS OF THIS COURT AND THE ABILITY TO CONVINCE THE PEOPLE OF HAYS COUNTY THAT THE HEAVY CHAINS OF IRON THAT BIND THEM ARE REALLY JUST BEAUTIFUL SILVER BRACELETS.

WE NOW HAVE A PROPOSAL TO BUILD A $23.6 MILLION DOLLAR ANIMAL SHELTER. IT WOULD BE A NO KILL SHELTER. I'M AS MUCH FOR THIS CONCEPT AS ANYONE ELSE, HOWEVER, WE SIMPLY DO NOT HAVE THE MONEY. I WONDER HOW MANY PEOPLE WHO ARE AGAINST ANIMAL EUTHANIZATION AS A FORM OF POPULATION CONTROL ARE FOR HUMAN ABORTION AS A FORM OF BIRTH CONTROL? FOLKS, THE FACT IS PEOPLE IN HAYS COUNTY ARE STRUGGLING FINANCIALLY.

AND THAT EXACERBATES ALL THE OTHER PROBLEMS THEY HAVE BETWEEN TAXES FROM THE CITIES, COUNTIES, SCHOOL DISTRICTS, STATES AND THE FEDERAL GOVERNMENT, PEOPLE ARE GOING UNDER FOR THE LAST TIME.

YOU HAVE THE POWER TO SET YOUR OWN SALARIES AND GIVE YOURSELVES RAISES. VERY FEW OTHERS HAVE THAT LUXURY. YOU ARE IN YOUR OWN REALITY LARGELY INSULATED FROM THE FINANCIAL HARDSHIPS OF OUR CONSTITUENTS. WHAT SOMETIMES SEEMS LIKE A GOOD IDEA TO YOU MIGHT JUST BE THE EXPENSE THAT PUTS SOMEONE OUT OF THEIR HOUSE. I'VE BEEN HERE YEAR AFTER YEAR QUESTIONING EXPENDITURES WHICH I CONSIDER UNNECESSARY. BUT I NEVER HEAR ANY RESPONSE. WHAT COULD BE MORE IMPORTANT THAN KEEPING PEOPLE IN THEIR HOUSES AS THE LEADERS OF HAYS COUNTY, THIS SHOULD BE PRIORITY NUMBER ONE FOR YOU PEOPLE. BUT YOU SEEM TO JUST THINK

[00:05:02]

THAT, YOU KNOW, IT'S A JOKE. IT'S NOT A JOKE.

PEOPLE ARE SUFFERING. PEOPLE ARE OUT ON THE STREETS. AND YOU CAN'T TELL ME THAT HAYS COUNTY DOES NOT HAVE A HOMELESS PROBLEM.

WE'VE GOT A BIG HOMELESS PROBLEM.

I SEE THEM ALL THE TIME DOWN AT, DOWN AT THE LIBRARY.

I SEE THEM WAL-MART. I SEE THEM EVERY WHERE.

AND I DON'T THINK MOST OF THOSE PEOPLE REALLY AND TRULY WANT TO BE HOMELESS. BUT YOUR POLICIES ALONG WITH THE OTHER POLICIES OF LOCAL GOVERNMENTS AND THE STATE AND FEDERAL GOVERNMENT HAVE MADE IT SO THAT PEOPLE CAN'T AFFORD TO LIVE IN DECENT HOUSING ANY MORE.

AND I WOULD APPRECIATE IT IF YOU WOULD THINK ABOUT THAT FOR A WHILE AND CONSIDER WHAT YOU ARE DOING TO PEOPLE. THANK YOU VERY MUCH.

>> JUDGE BECERRA: THANK YOU, MR. DAN LYON.

ABOUT THE I ITEM ABOUT THE NO KILL ANIMAL SHELTER THE HOPE IS TO CAPTURE FEDERAL FUNDS IF WE DON'T DRAW THEM DOWN THEY'LL GO TO ANOTHER MUNICIPALITY OR COUNTY OR GOVERNMENTAL AGENCY. AND ALSO MY FAVORITE THE P.

3 PUBLIC PRIVATE PARTNERSHIPS SO THE AIM AND THE HOPE IS TO BE AS LIGHT PHANDED ON TAXPAYERS AS POSSIBLE. OUR NEXT SPEAKER IS MR. RODRIGO AMAYA, I DON'T SEE HIM HERE.

WE'LL MOVE ON. SO I HAVE BEEN ASKED TO PULL TWO ITEMS. PRESENTATIONS AND PROCLAMATIONS ON THE PARKS ITEM I'VE BEEN ASKED TO PULL THAT AND IF THERE IS ANYONE HERE TO SPEAK ON J. 1, I'VE BEEN ASKED TO PULL THAT AS WELL.

SO WE'RE NOT GOING TO TALK ABOUT THOSE TWO ITEMS. IS THERE ANYONE THAT WAS PLANNING ON SPEAKING ON ANY OF THOSE? NO. OKAY.

[INAUDIBLE] >> WE HAVE ONE E-MAILED PUBLIC COMMENT. I'M GOING TO READ THAT.

THIS IS FROM SHANNON GRAHAM. THIS IS A PUBLIC COMMENT FOR AN ORDINANCE TO BAN THE RETAIL SEAMS OF DOGS AND CAT IN PET STORES. PICK A PET -- START THE TIMER. THE OWNER OF THE STORE IS JONATHAN GALLON VONN FROM CALIFORNIA.

HE HAS BEEN CONNECTED TO RICKEY OUT OF ARIZONA.

RICKEY IS A DEFENDANT IN A FEDERAL LAWSUIT INVOLVING PUPPY MILLS SELLING SICK PUPPIES.

THE STORE SELLS PUPPIES FROM GLASS TANK LIKE CLOSURES FOR THOUSANDS OF DOLLARS. THEY DON'T INDICATE WHERE THE PUPPIES COME FROM. THIS WAS APPROVED FROM A PICK A PET IN DECEMBER OF 2021.

THE FED DEGREE WAS GIVEN TO THE CUSTOMER WITH THE BRIDEAU'S INFORMATION WHITED OUT.

IS THIS BEING TRANSPARENT? WHY ARE THEY WRIGHT HOLDING THE INFORMATION FROM CONSUMERS? IS IT BECAUSE THEY USE A BROKER TO SUPPLY THEM WITH PUPPIES FROM MILLS? THE CUSTOMER REACHED OUT TO ME TO HELP FIND OUT THE BREEDER OF THE PUPPY. BUT LOOKING AT THE DOGS NAMES I WAS ABLE TO CONTACT BIG STARR KENNEL ENQUIRING IF THIS PUP CAME FROM THIS. IT WAS CONFIRMED.

BIG STARR KENNEL WILL. L. C. OUT OF IOWA U.S. D. A.

42-A. 1495. AFTER LAST INSPECTION THERE WERE 220 ADULT DOGS AND 155 PUPPIES ON SIGHT FOR A TOTAL OF 375. THE REST IS PICTURES, SNIPS OF FACEBOOK POSTS AND IT'S DESCRIPTIONS OF THE PUPPIES AND THEIR OWNERS. FINISHES OFF WITH THE LIST OF BREEDERS GOES ON AND ON. THIS STORE HAS TOLD PUPPIES FROM A.J.'S ANKLES OUT OF MINNESOTA.

THE BREEDER HAD OVER 1200 DOGS ON SITE AT HER LAST INSPECTION. ELAINE WILSON IS ANOTHER BREEDER WITH OVER 400 DOGS ON SIGHT.

CONSIDER PASSING A HUMANE ORDINANCE IN SAN MARCOS.

THE STATE OF TEXAS DOES NOT NEED UNALTERED PETS BEING SHIPPED IN WEEKLY TO PET STORES.

DALLAS IS THE 12TH CITY IN TEXAS TO DO SO.

NEW YORK SAME THE 6TH STATE TO BAN THE RETAIL

SALES OF PETS. >> JUDGE BECERRA: THANK YOU, MR. KENNEDY. THE WAY THAT WAS WORD ID THINK IS PROPER. THERE IS A MUNICIPALITY FUNCTION, NOT COUNTY AM I RIGHT?

>> YES, JUDGE. WE'RE, I DON'T BELIEVE WE

[00:10:02]

HAVE AN ITEM TO DISCUSS THIS TODAY ANYWAY BUT IF WE EVER DO YOU MAY WANT TO COMMENT WE CAN EXPLAIN ALL THOSE

THINGS. >> JUDGE BECERRA: RIGHT ON.

THAT IS FOR THE VIEWERS THIS IS A MUNICIPALITY ISSUE AND COUNTY DOESN'T HAVE THOSE AUTHORITIES AT THIS TIME.

OKAY. SO WE HAVE F. 1 PULLED,

[Items G1 - G5]

PLEASE OPEN G. 1 THROUGH 5 (READING G. 4 APPROVE THE PAYMENT OF THE JULY 15, 2022 PAYROLL DISBURSEMENTS IN AN AMOUNT NOT TO EXCEED $3,155,000 EFFECTIVE JULY 15, 202 22 AND POST TOTALS FOR WAGES, WITHHOLDINGS, DEDUCTIONS AND BENEFITS ON THE HAYS COUNTY WEBSITE ONCE FINALIZED. G. 5 APPROVE A SOFTWARE SUBSHIPS FOR THE SHERIFF'S OFFICE FOR AN S. H. I. FOR AN POWER FIELD TRAINING OFFICER AND AMENDMENT THE

BUDGET ACCORDINGLY. >> SO MOVED.

>> SECOND. >> PLEASE CALL THE ROLL.

[G6. Approve the re-appointment of Commissioner Lon Shell and Commissioner Debbie Ingalsbe to the Greater San Marcos Partnership (GSMP) Board of Directors. S H E LL]

PLEASE OPEN G. 6. >> G. 6 APPROVE THE REAIR PAYMENT OF COMMISSIONER LON SHELL AND COMMISSIONER DEBBIE INGALSBE TO THE GREATER SAN MARCOS PARTNERSHIP BOARD OF DIRECTORS.

>> SO MOVED. >> SECOND.

>> JUDGE BECERRA: WE HAVE ONE INDIVIDUAL SIGNED UP TO

SPEAK, MR. DAN LYON. >> THANK YOU, JESS ARE A.

I'VE -- JUDGE, I'VE BEEN HERE FOR PROBABLY 7 YEARS COMING FAIRLY REGULARLY. I'VE WATCHED THESE TWO YOUNG PEOPLE, COMMISSIONER INNING GELSBY AND COMMISSIONER SHELL GROW UP FROM PUPS. THAT IS JUST A FIGURE OF SPEECH. IT HAS NOTHING TO DO WITH THE NO-KILL SHELTER. ANYWAY --

>> JUDGE BECERRA: WILL YOU ADJUST TO MIKE TO MAKE SURE THE AUDIENCE CAN HEAR YOU, MOVE IT TOWARD YOU THANK

YOU. >> SURE.

ANYWAY, THE GREATER SAN MARCOS PARTNERSHIP, THEY WILL RECEIVED $300,000 PER YEAR FROM HAYS COUNTY, AND MULTIPLE THOUSANDS OF DOLLARS FROM CITY OF SAN MARCOS AND VARIOUS CITIES AROUND THE COUNTY AND I BELIEVE THEY'RE THERE TO BRING IN BUSINESS AND EMPLOYERS AND SUCH AS THAT OF COURSE, THESE BUSINESSES GET TAX REBATES AND ABATEMENTS WHILE THE INFRASTRUCTURE FOR THEIR BUSINESSES OR EXPENSES FOR THAT ARE DUMPED ON THE PEOPLE OF HAYS COUNTY WHETHER THEY WORK THERE OR NOT.

THERE IS NO VOTE FOR THE PEOPLE OF HAYS COUNTY ON THE THING THAT THE GREATER SAN MARCOS PARTNERSHIP DOES AND I KNOW Y'ALL ARE GOING TO SAY, WELL THAT'S WHY WE NEED TWO REPRESENTATIVES ON THE GREATER SAN MARCOS PARTNERSHIP. I DON'T BELIEVE WE NEED THE GREATER PARTNERSHIP AT ALL. BUSINESSES WOULD COME HERE ANYWAY AND IF WE HAVE TO GIVE ABATEMENTS AND REBATES AND THINGS LIKE THAT TO BUSINESSES TO COME TO HAYS COUNTY, PERHAPS THEY DON'T BELONG HERE IN THE FIRST PLACE. SO I MEAN WE'VE SEEN BEST BUY FOLD. WHEN THEY DIDN'T GET THEIR SPECIAL TAXING ABILITY CONTINUED, WHAT NOT.

IT'S A LONG STORY,ALL KNOW THE STORY.

A BELIEVE A LOT OF THE OTHER BUSINESSES WOULD FOLD IF THEY WANT GETTING WHAMS TO SUBSIDY.

WE DON'T GIVE MONEY DIRECTLY BUT IT AMOUNTS TO GIVING THEM MONEY. SO WHY DO WE NEED THE GREATER SAN MARCOS PARTNERSHIP AND WHY SHOULD WE FEEL AN OBLIGATION TO HAVE 2 REPRESENTATIVES ON THEIR BOARD OR WHATEVER IT IS? ANY WAY.

THANK YOU VERY MUCH. >> JUDGE BECERRA: THANK YOU, SIR. COMMISSIONERS.

COMMENTS. CONCERNS?

I ASSUME THAT THE CONTINUING EDUCATION WILL BE FOR COMMISSIONER INNING GELSBY BUT IT DOESN'T ACTUALLY SAY THAT AND IT ALSO DOES NOT SAY HOW MUCH THIS IS GOING TO COST AND EXACTLY WHAT SORT OF EDUCATION THIS IS GOING TO BE.

I WOULD LIKE THESE POINTS ELUCIDATED.

THANK YOU VERY MUCH. >> JUDGE BECERRA: THANK YOU:

COMMISSIONER INS GALLONSBY. >> THIS IS SOUTH TEXT ASSOCIATION CONFERENCE WAS HELD IN JUNE.

AND SO I DID ATTEND THAT CONFERENCE.

OF COURSE THE COURT MEMBERS NEED TO ATTEND A CONFERENCE OR MORE TO GET THEIR CONTINUING ED HOURS OF 16 HOURS PER YEAR. THIS IS ONE OF THE CONFERENCES THAT I'VE ATTENDED.

I WAS THE PRESIDENT OF THIS CONFERENCE AND CONTINUE TO SERVE ON SOME OF THE BOARDS. I FELL A LITTLE SHORT IN MY CONTINUING ED LINE ITEM. IT WAS LESS THAN $150 BUT WE'RE REQUESTING THAT WE MOVE $150 TO COVER THOSE

IF YOU LOOK AT THE BACKGROUND MATERIAL, IT DOES A PRETTY GOOD EXPLANATION OF WHAT'S EXPECTED IN THE CONTRACT AND AGAIN THIS IS NOT THE ACTUAL CONTRACT.

THIS IS THE, THE PROFESSIONAL SERVICES -- PROFESSIONAL SERVICES AGREEMENT.

>> JUDGE BECERRA: ANY OTHER COMMENTS?

>> I APPRECIATE YOU MOVING ALONG.

THERE'S A LOT OF DEVELOPMENT ALONG THE ROUTE WE NEED TO GET HAD A IS THE ACTUAL ROUTE GOING TO LOOK LIKE.

>> I THINK IT'S PURSUANT TO US TO BE AS UP FRONT AND TRANSPARENT WITH PROPERTY OWNERS AS POSSIBLE AND THOSE PROPERTY OWNERS HAVE BEEN INVOLVED IN THE PROCESS SINCE THE COUNTY FIRST STARTED TO BEING LOOK AT IT.

I DON'T WANT TO SAY THAT IT'S -- IT HAS HUNG OUT THERE BUT THERE HAS BEEN SO MUCH FACTORS GOING INTO IT WITH DEVELOPMENT IN THE AREA THAT ACTUALLY WOULD PROVIDE AS COMMISSIONER JONES SAID A DIRECT DISTINCT ROUTE THEY CAN UNDERSTAND THEY KNOW WHERE IT'S AT.

'S THE PROPERTIES MOVE INTO A INTO A VEHEMENT PHASE IT ALSO -- DEVELOPMENT PHASE IT WOULD GIVE US THE AVAILABILITY TO TRY TO RESERVE THE RIGHT OF WAY FOR THE FUTURE BECAUSE WHO KNOWS WHEN THIS PROJECT IS GOING TO HAPPEN. BUT IF AND WHEN THEY BUILD HOUSES IN THE MIDDLE IT'S GOING TO BE A PROBLEM.

THIS WILL HELP US AVOID THAT.

>> AS THE PROJECT CONTINUES, COMMISSIONER, I QUESTIONSY YOU WILL HAVE DISCUSSIONS WITH TRAVIS COUNTY.

I KNOW WE SPOKE ABOUT THAT AND THEIR CONCERN.

>> YES, ABSOLUTELY. AND TRAVIS COUNTY FOR THOSE WHO MAY NOT KNOW THIS IS ACTUALLY INCLUDED IN THE AUSTIN AND TRAVIS COUNTY MASTER TRANSPORTATION PLANS.

>> JUDGE, THIS IS JUST AN ISSUE WE'VE TALKED ABOUT FOR A WHILE IN THE CONTEXT OF PRE-TRIAL SERVICES, SOMETHING WE'D LIKE TO GET GOING IN THE EVENT THAT A JUDGE ORDERS GPS MONITORING ANKLE BRACELET THERE IS A WAY -- WE'VE FUNDS BUDGETED THAT CAN BE USED FOR THAT BUT THERE'S A WAY FOR THAT TO BE APPROVED.

I DON'T KNOW IF MR. KENNEDY HAS SPECIFICS HE WOULD LIKE FOR US TO AUTHORIZE OR IF THAT ACTION IS --

>> I THINK THAT'S IS SUFFICIENT.

>> JUDGE BECERRA: JUST FOR THE VIEWING PUBLIC TO RECAP THAT WILL HELP JUDGES AND, IN RELEASING OF FOLKS WITH AN ANKLE MONITOR THAT WILL BE ONE OF THOSE TOOLS TO

[00:40:03]

HELP US IN SUMMARY. >> NOT ONLY IN JAIL POPULATION BUT IN COST, JUDGE.

>> JUDGE BECERRA: ABSOLUTELY.

>> YOU DID. OKAY.

PERFECT. >> WE HAD THE FUNDS DESIGNATED FOR PRE-TRIAL PROGRAMS SO I THINK IT WOULD

BE GOOD FOR THE TIME BEING. >> JUDGE BECERRA: BEAUTIFUL.

THANK YOU, IF NOTHING ELSE PLEASE CALL THE ROLL.

AAPOLOGIZE, SOMETHING THAT I'VE EMPHASIZED WITH THE JUDGES THAT HAVE DISCUSSED THIS WITH AND I'LL CONTINUE TO DO SO IS THAT THIS PROGRAM IS MEANT TO ACCOMMODATE, RELEASE FROM THE FACILITY WHEN IT COULD NOT OTHERWISE BE ACHIEVED. THIS IS THE ONE THING EXTRA THAT CAN BE DONE TO HAVE SOMEONE RELEASED.

IT SHOULD NOT BE CONSTRUED AS A PROGRAM WHERE MONITORS ARE BEING USED ON PEOPLE THAT WOULD HAVE BEEN RELEASED ANY MORE. I THINK THERE'S A -- IT'S A NEBULOUS LINE. JUDGE GETS TO DECIDE THIS.

THERE'S IN THE A WRITTEN STANDARD FOR THIS, BUT THIS IS A CONVERSATION THAT WE'RE HAVING WITH THE COURTS RIGHT NOW TO TRY TO CALIBRATE THAT PROPERLY.

IF THAT MAKES SENSE. >> JUDGE BECERRA: VERY MUCH

>> YOU ARE ABSOLUTELY CORRECT.

THE SHERIFF'S OFFICE IS -- [INAUDIBLE]

-- >> JUDGE BECERRA: THAT'S A VERY GOOD POINT. SO ON THIS AGENDA ITEM AS IS AVAILABLE TO THE VIEWING PUBLIC IT DOESN'T HAVE THE DOLLAR AMOUNTS VISIBLE. DO YOU HAVE A GOAL?

>> IT'S, WELL, IT'S OVER A PERIOD OF 5 YEARS.

THE SO I DON'T KNOW. >> JUDGE BECERRA: YOU DON'T HAVE TO MISSPEAK WITH HER HERE.

>> IT'S ON THE AGENDA ITEM. IT'S PROVIDED AT $67,000

AEE, IS THAT CORRECT VICKY. >> YES, I THINK IT ACTUALLY IS A DIFFERENT AMOUNT EVERY YEAR.

IT'S $286,000 CONTRACT FOR A FOUR YEAR PERIOD.

$67,000 IS YEAR ONE BUT THERE IS A CLAUSE THAT YOU CAN TERMINATE AT ANY YEAR AS LONG AS IT'S DONE BY

FEBRUARY 1ST. >> JUDGE BECERRA: SO YES, COMMISSIONER, I WOULD REFERENCE NOT ON THE ITEM ITSELF FOR THE VIEWING PUBLIC, BUT THEN I LIKE THE POINT THAT YOU'VE MADE, CHIEF, ABOUT COUNTY WIDE SUPPORT BEHIND THIS WHICH IS REALLY USEFUL.

COMMISSIONER INGALSBE. >> I WAS GOING TO ADD, JUDGE, YOU KNOW, WE KNOW THAT A LOT OF TEXAS STATE STUDENTS AFTER THEY COME TO COLLEGE HERE THEY WANT TO STAY. BUT THEY ALSO DON'T BELIEVE THAT THE JOBS ARE AVAILABLE. I THINK THIS IS A WAY FOR US AS WAS STATED TO REUTE AND LET THEM KNOW THE OPPORTUNITIES THAT WE. I KNOW WE'VE BEEN LOOKING AT OUR POSITIONS VERY CLOSELY. WE'RE DOING THE STUDY AS YOU MENTIONED. I THINK THERE'S GOING TO BE ADJUSTMENTS THERE AND I THINK THAT PEOPLE CAN FIND THAT THEY CAN LIVE HERE AND WORK HERE AND JUST BE ABLE TO ENJOY THIS COUNTY AND HAVE A JOB THEY CAN DEPEND

[00:45:02]

ON. BECAUSE IT'S GOING TO BE USED FOR THE ENTIRE COUNTY AND I'M VERY GRATEFUL FOR THAT BECAUSE IT WAS FOCUSED FIRST ON THE SHERIFF'S OFFERS BECAUSE WE KNOW THEY HAVE SO MANY OPENINGS BUT WE'RE ALSO SEEING OPENINGS IN MANY OF OUR OFFICES.

AUDITORS IS ONE WE STRUGGLED WITH, ROAD DEPARTMENT.

SO I REALLY BELIEVE THIS CAN BE EXTREMELY HELPFUL FOR US.

AS VICKY MENTIONED WE WERE CONCERNED ABOUT A CONTRACT THAT WENT ON FOR SO LONG BUT IF WE DON'T SEE THE BENEFITS OF IT, WE HAVE THE ABILITY TO TERMINATE IF WE NEED TO.

>> JUDGE BECERRA: THAT'S VERY WELL DONE.

THERE ARE POINTS I'M SURE WITH TODAY'S TECHNOLOGY TO MEASURE THE IMPACT OF THAT EFFORT, RIGHT.

THAT THERE BE SOMETHING TO SAY THIS CAME BECAUSE OF THESE DOLLARS SPENT. SO LUCKY THAT YOU ARE WORKING WITH SHERRY BECAUSE SHE HAS THAT COUNTYWIDE LENS IN REFERENCE TO ALL THE POSITIONS.

CHIEF, THANK YOU FOR LEADING THE CHARGE ON THIS.

COMMISSIONERS, ANY OTHER QUESTIONS FOR THE CHIEF.

THANK YOU.

SHED A LITTLE LATER ON THIS ITEM.

>> JEFF MCGILL. INFORMATION TECHNOLOGY DIRECTOR. THIS IS A CONTINUATION OF US TURNING OVER OUR END OF LIFE LEGACY TO L TICKET WRITERS REPLACING THEM WITH THE I. O. S. DEVICES.

WE'RE PAIRING THE PROPOSES PRINTERS AND LICENSING WITH THE I. O. S. DEVICES AS WE PHASE OUT THE OLDER TICKET WRITERS. THIS WAS BUDGETED DURING THE BUDGET PROCESS. WE IDENTIFIED IT DURING THE BUDGET PROCESS THESE WOULD BE REPLACED BUT WE WERE WAITING FOR I. O. S. PLATFORMS TO BE COMPLETED BEFORE WE PURCHASED THESE DEVICES.

>> JUDGE BECERRA: WILL THIS ALLOW DEPUTIES TO USE

IPHONES TO WRITE TICKETS? >> YES, SIR.

>> JUDGE BECERRA: SO YOU KNOW, IF YOU SEE A POLICE OFFICER ON THE SIDE OF THE ROAD WITH AN IKNOWN, THEY HAVE THE HIGH LIKELIHOOD TO BE WRITING OF TICKET.

ODD AS IT MAYBE BUT IT'S GOOD USE OF TECHNOLOGY.

>> IT ALSO GETS US OUT OF THE CYCLE OF HAVING TO PURCHASE EXPENSE YOU EVER TICKET WRITERS EVERY FEW YEARS BECAUSE THEY'LL NATURALLY BE REPLACED WHEN I. O. S. DEVICES ARE UPGRADED.

>> JUDGE BECERRA: I REALLY APPRECIATE EVERYTHING AND ANYTHING WE CAN DO TO SAVE, AND I THINK THAT IS A WONDERFUL TOOL ON THAT FRONT.

ANY QUESTIONS FOR MR. MCGILL? THANK YOU, PLEASE CALL THE ROLL.

THE BURN BAN. >> JUDGE BECERRA: WE HAVE THE PRIVILEGE OF HAVING OUR FIRE MARSHAL HERE AFTER WHAT I WOULD CALL A SUCCESSFUL OVERALL FOURTH OF JUNE BECAUSE MY PHONE DIDN'T GO OFF WITH ANY ALERTS OF FIRES OF ANY KIND. SO IF YOU'LL STATE YOUR NAME AND TITLE FOR THE VIEWING PUBLIC.

>> GOOD MORNING, JUDGE, MARK HAYS COUNTY FIRE MARSHAL.

CURRENT HUNTY IS UNDER A BURN BAN.

I RECOMMEND THAT BE EXTENDED.

ORANT DROUGHT INDEX NUMBERS ARE AT 606.

AS STATED IN THE E-MAIL THAT I SENT TO YOU ON LAST FRIDAY I BELIEVE IT WAS. WE DID BENEFIT SOME FROM THE RAIN THAT DID COME THROUGH, HOWEVER, WITH THE TEMPERATURES THAT FOLLOWED THAT, WE QUICKLY ESCALATED BACK UP TO A HIGHER DROUGHT INDEXES.

NATIONAL WEATHER SERVICE IS LISTING HOSPITALE AS AN EXCEPTIONAL DROUGHT FOR THE MAJORITY.

OUR DRYER AREAS ARE THE SOUTHERN PORTIONS OF HAYS COUNTY PUSHING WEST INTO WESTERN HAYS COUNTY.

AS FAR AS THE WEEKEND GOES MY OFFICE WAS NOT NOTIFIED OF ANY DRASTIC OR DAMAGING FIRES.

I'M SURE THERE WERE A FEW SMALL FIRES RELATED TO FIREWORKS, BUT WE WERE NEVER REQUESTED TO COME OUT AND

VET OR ISSUE CITATIONS. >> JUDGE BECERRA: THAT'S HOW I HEARD IT. THAT'S WONDERFUL NEWS.

I KNOW BRANDAN IS HAPPY ABOUT THAT AS WELL FROM OUR OFFICE OF EMERGENCY SERVICES.

COMMISSIONERS, ANY QUESTIONS ORB COMMENTS?

>> THANK YOU. >> THANKS A LOT.

>> THANK YOU. >> JUDGE BECERRA: THANK YOU FOR BEING ON THE READY. I DO WANT TO TAKE THIS OPPORTUNITY TO SAY THAT WE AS OFFICE OF EMERGENCY

[00:50:01]

SERVICES, OFFICE OF EMERGENCY MANAGEMENT, OFFICE OF HOMELAND SECURITY, I TOUCH ALL THOSE SPACES I'M GLAD WE'RE INVESTING IN WAYS, AND THESE ARE THE RESULTS OF THAT, INVESTING 234 WAYS NOT JUST IN TIME BUT NOW LEANING IN A LITTLE MORE INTO JUST IN CASE.

THAT'S A COMMENT THAT CHIEF TEXAS CHIEF OF EMERGENCY MANAGEMENT FOR THE STATE CHIEF KIDD MADE TO ME AND IT RANG SO TRUE BECAUSE I HAVE TO REMEMBER AS A MAJOR FISCAL CONSERVATIVE TO CONTINUE TO SUPPORT FIRST RESPONSE, EMERGENCY MANAGEMENT IN WAYS THAT ARE MOST PROACTIVE IN TRAINING AND RADIOS AND IN ALL THE OTHER THINGS WE DO ON THAT FIRST RESPONSE SIDE BECAUSE IF WE DO JUST IN CASE, WE'LL DO A BETTER JOB THAN JUST IN TIME. THANK YOU.

>> JUST HAVE ONE QUESTION FOR MR. KENNEDY.% TO WE HAVE TO TAKE ACTION TO EXTEND OR IS IT JUST

STATUTELY REMAIN IN PLACE. >> I THINK IT STAYS IN

PLACE. >> IT STAY -- SORRY SORRY, THERE IS A STATUTE LIMIT TO THAT AND WE CAN LOOK AT THE CALENDAR, SEE WHAT THAT IS. WHAT THAT HAPPENS WE'LL BRING IT BACK TO COURT IF IT'S STILL NEEDED.

>> I WANTED TO MAKE SURE WE DIDN'T HAVE THE DEATHLINED.

>> JUDGE BECERRA: AND HAVING FOURTH OF JULY HAPPENING I WAS GLAD TO SEE THE FIRE MARSHAL.

I ASK QUESTIONS SO THE VIEWING PUBLIC MAYBE

INFORMED. >> HOPEFULLY WE'LL HAVE RAIN

BEFORE THAT EXPIRES. >> THAT WOULD BE NICE, THANK

DISCUSSION RELATED TO THE HAYS COUNTY INMATE POPULATION, TO INCLUDE CURRENT POPULATION COUNTS

AND COSTS. >> JUDGE BECERRA: SO I'M GRATEFUL TO THE SHERIFF'S OFFICE FOR PROVIDING ME THIS REPORT OF OUR INMATE CAPACITY AND POPULATION.

CURRENT MAXIMUM JAIL CAPACITY IS 410 INMATES.

STALE STANDARDS RECOMMENDS HOLDING OUR CAPACITY 10% OF OUR CAPACITY OPEN WHICH THE JAIL'S DAILY AVERAGE WAS 693 AND PEAK WAS 702 ON JUNE 27TH.

THE ESTIMATED COSTS OF OUTSOURCING INMATES THIS WEEK IS $120,580. LET THAT SINK N. THE AVERAGE NUMBER OF OUTSOURCED MALES IS 195.

FEMALES ARE 52. THIS WEEK'S INMATES WERE HOWARD IN BLANKO BURNETT, COMAL, FORT BEND, LEE, MAVERICK AND RED RIVER. PAPER READY INMATES, THAT IS THE TITLE GIVEN TO INMATES THAT HAVE IN COUNTY JAIL THAT ARE NOW STATE INMATES, THEY HAVE SEEN THEIR DAY IN COURT. THEY'VE BEEN FOUND GUILTY AND THEY'RE NOW STATE INMATES.

WE'RE HOLDING 48 OF THOSE STATE INMATES.

NOW WE HAVE EXECUTIVE SESSION.

IF THERE ARE NO OBJECTIONS I'LL ASK WE OPEN L. 1, 2,

AND 3. >> MAY I ASK A QUICK QUESTION. THE PAPER READY INMATES DO WE KNOW THE AVERAGE LENGTH OF STAY?

>> JUDGE BECERRA: THEY ARE AT THIS TIME STAYING JUST BELOW THE WIRE ON THE 45-DAY LIMIT THAT THE STATE HAS, AND WE HAVE A MIXED BAG RELATIONSHIP.

WE RECEIVE -- I CAN'T JUST COME AT THEM AGGRESSIVELY BECAUSE WE ALSO RECEIVE GRANTS FROM THE STATE AND OTHER SPACES. SO ALTHOUGH ONE SPECIFIC SCENARIO MAY NOT BE IDEAL FOR US BUT BENEFICIAL TO THEM, THERE ARE OTHER RELATIONSHIP TRANSACTION THAT IS ARE COMPLETELY BENEFICIAL TO US.

SO I KNOW THEY'RE TRYING. I KNOW THEY'RE DOING THEIR BEST. BUT IT'S, I SEE IT AS MY JOB

TO INFORM THE PUBLIC. >> SURE, I THINK IT'S IMPORTANT BECAUSE WE HAD HEARD THEY WERE STAYING EVEN LONGER BEYOND THE 45 DAYS OR --

>> JUDGE BECERRA: SO FAR THEY'RE JUST UP TO IT AND STAYING RIGHT UP CLOSE TO IT.

AS IT GOES OVER I'LL LET YOU KNOW.

>> I'LL TELL YOU THAT, IN SPEAKING TO SOME OF THE FOLKS, IT LOOKS LIKE THEY'RE LOOKING FOR ADDITIONAL FACILITIES ON THE STATE SIDE BECAUSE, THIS CAME FROM THE SOUTH TEXAS COUNTY JUDGES AND COMMISSIONERS' CONFERENCE, THEY'RE LITERALLY OUT OF ROOM.

WE'RE NOT THE ONLY COUNTY SUFFERING WITH THIS BUT WE

[00:55:02]

PROBABLY HAVE ONE OF THE LARGEST VOLUMES OF PAPER READIES BECAUSE WE'VE HAD SUCH A GROWTH OF POPULATION.

BUT I KNOW WE'RE NOT THE ONLY ONE WAITING ON THOSE TRANSPORTS GETTING THOSE PRISONERS OUT OF OUR SYSTEM INTO THEIRS BUT IT HAS GOTTEN TO A POINT WHERE IT'S UNTENABLE FOR COUNTIES TO CONTINUE TO TO THIS.

IT'S -- WE'RE TALKING OVER 10% OF OUR, OF OUR ACTUAL POPULATION FROM WITHIN OUR JAIL ARE PEOPLE THAT
