>> THANK YOU, JUDGE BECERRA. I WAS VERY INTERESTED TO HEAR WHAT MR. WEBB MILLER HAD TO SAY REGARDING HAYS FINANCIAL ST STATUS. HE POINTED THAT HAYS COUNTY HAS A DOUBLE A BOND RATING WHICH YOU POINTED OUT, JUDGE BECERRA, THE HIGHEST BOND RATING THAT A COUNTY CAN HAVE.

LET ME BE CLEAR, THIS RATING HAS LITTLE TO DO WITH THE FINANCIAL ACUMEN OF THE COMMISSIONERS COURT.

IT HAS MORE TO DO WITH THE IMPRESSIVE TAXATION IN NEW YORK AND CALIFORNIA. YOU WILL HAVE A CONTINUAL INFLUX OF THESE IMMIGRANTS TO SUPPORT THE BANKERS, BUILDERS, AND BLOATED AND GROWING COUNTY PURE ROCK IS A SEE.

YOU TALK SO MUCH ABOUT THE QUALITY OF LIFE IN HAYS COUNTY.

WHILE YOU STRUCTURED THE DEBT IN SUCH A WAY TO ENSURES ITS DESTRUCTION IF THERE IS ANY SLIGHTEST CHANCE OF PAY BE IT OFF. YOU GIVE THE CITIZENS' MONEY TO THE GRAND SAN MORE COS BUSINESSES THAT TURN AROUND AND GIVE TAX REBATES. HOW DOES THIS GROW OUR TAX B BASE. I KNOW YOU ALL ARE TIRED OF HEARING IT, BUT I AM GOING TO SAY IT UNTIL IT SINKS IN.

ACCORDING TO THE TEXAS COMPTROLLER'S OFFICE, HAYS COUNTY IS $522 MILLION IN DEBT. THIS DEBT IF HELD TO MATURITY THREE QUARTERS OF A BILLION. HAYS COUNTY DOES NOT HAVE ANY MONEY. TALL HAS IS A DISPUTED ABILITY TO EXTORT MONEY OF THE CITIZENS UNDER THE COLOR OF THE LAW.

HAYS COUNTY IS NOT ONLY ONE OF THE FASTEST GROWING COUNTIES IN THE NATION BUT HAS THE HIGHEST PER CAPITA DEBT IN THE STATE OF TEXAS. I THINK YOU SHOULD STOP SPENDING SO MUCH. WE GO BANKRUPT, YOU WILL NEED TO FIND A REAL JOB. LAST WEEK YOU APPROVED ANOTHER $400,000 IN CHANGE ORDERS. ARE YOU REALLY THAT BAD AT ESTIMATING THE WORK THAT NEEDS TO BE DONE?

OR IS THIS JUST ANOTHER SCAM. HOW ABOUT GIVING THE CITIZENS A BREAK INSTEAD OF BREAKING THEM FINANCIALLY.

ONE OF THEM WAS FROM THE FIRE MARSHAL.

AS YOU WERE APPROVING THE POLICIES ON WHAT WARRANTED INVESIGATIONS OF STRUCTURES AND STUFF LIKE THAT.

FOR ME TO HEAR THAT THE COUNTY HAVEN'T BEEN DOING THINGS AFTER HE DID SOME RESEARCH, THAT'S VERY CONCERNING, CONSIDERING THE AMOUNT OF MONEY THAT Y'ALL OKAYED FOR LAW ENFOR ENFORCEMENT-RELATED PURPOSES EVERY WEEK.

WIN HAVE THAT KIND OF DEDICATION FINANCIALLY AND YOU SUPPORT THE BLUE LIKE THAT, THESE KINDS OF THINGS SHOULDN'T BE POPPING UP RIGHT NOW. THEY SHOULD HAVE BEEN TAKEN UP A LONG TIME AGO. YOU ASKED HIM WHERE HE GOT THAT $5,000 CUTOFF FOR -- FOR INVESTIGATION PURPOSES AND HIS RESPONSE IS THAT IS WHAT OTHER COUNTIES USE.

WELL, WE ARE NOT OTHER COU COUNTIES, WE ARE WORRIES ABOUT HAYS COUNTY WHERE WE LIVE. FOR ME SOMEONE TO RESPOND LIKE THAT CLEARLY HAVE ME CONCERNED. ALL THIS STUFF YOU APPROVE REGARDING FAKE IT UNTIL YOU MAKE IT HAS GOT TO CHANGE.

AGAIN, I HAVE A BIG PROBLEM WITH THE WAY THINGS ARE DONE ON THE LEGAL SIDE OF BUSINESS FOR THE COUNTY COUNSELOR COMES IN LATE JUST ABOUT EVERY WEEK AND EVERY TIME I ASK HIM SOMETHING FROM THE STATE POLICIES TELL HIM HE HAS TO BE COMPETENT AND READY TO RESPOND. EVERY TIME HE IS ASKED SOMETHING, ALL I HEAR IS, I BELIEVE, I THINK, I DON'T REMEMBER, I DIDN'T DO THIS, I DIDN'T DO THAT.

THAT IS NOT THE QUALITY OF A COMPETENT COUNSELOR.

THAT RIGHT THERE, AGAIN, I AM WAITING ON MY LOSS-RUN REPORTS SO I CAN SHOW Y'ALL HOW MANY MILLIONS OF DOLLARS ADDI ADDITIONALLY ASIDE FROM THE $1 MUCH 2 MILLION LOST BY THE DEAL THAT -- THAT WE LOST. $1.2 MILLION YOU LOSE ON THE WATER DEAL. WHAT ARE THE CONSEQUENCES.

WE REACHED OUT TO THE FBI AND OTHER FEDERAL AGENCIES TO ASK FOR ASSISTANCE ON THEIR CONCERNS AND BECAUSE THEY ARE CRIMES. JUST BECAUSE YOU ARE OKAY WITH THEM DOESN'T MEAN THEY ARE NOT CRIMES.

WE PUT A BILLION PEOPLE BEHIND THE IDEA AND IF THAT IDEA IS WRONG, IT WILL ALWAYS BE WRONG. I REALLY HOPE THAT THINGS CHANGE HERE VERY SOON, BUT THESE KIND OF THINGS SHOULD BE SOMETHING THAT Y'ALL WORRY ABOUT BECAUSE, YOU KNOW, IT'S BEEN LONG OVERDO FOR ACCOUNTABILITY TO COME INTO HERE. I DIDN'T THINK I WOULD BE ABLE TO WAIT, BUT COMMISSIONER JONES INFORMED ME THAT YOU MAY MOVE THAT ITEM UP, YOUR HONOR.

I JUST WANT TO SAY ON THAT ITEM THAT IT IS A VERY BAD PROCLAMATION. I HAVE SEEN THAT PROCLAMATION, COMMISSIONER SHELL THAT COMES FROM TESLA AND GAVE ALMOST THE SAME SPEECH THE GMA 9 MEETING. YOU ARE PROPOSING TAKE WATER AWAY FROM THE NORTHERN HAYS COUNTY.

YOU HAD A $4.5 MILLION EXCESS IN YOUR BUDGET THROUGH GROWTH.

THAT GROWTH DOESN'T COME FOR FREE.

YOU HAVE PEOPLE WORKING VERY HARD.

I LIVE AND BREATHE WATER. I HAVE BEEN INVOLVED FOR TWO YEARS, SEVEN YEARS ON THE DRIPPING SPRINGS.

AND EVERY SINGLE MEETING STARTS AND ENDS HOW DO WE GET MORE WATER. WHERE CAN WE GET MORE WATER.

BRING FROM AUSTIN TO THE PUA. WE HAVE A PERMIT WITH THE HAYS COUNTY GROUNDWATER DISTRICT. IF YOU LOWER THAT DRAWDOWN, WHAT YOU ESSENTIALLY DONE IS CUT THE AMOUNT OF WATER.

I HAVE SUBMITTED A LETTER OF COMMENTS REGARDING THIS ISSUE BUT I WOULD LIKE TO READ TO PUBLIC COMMENT. AND I WAS GENERAL MANAGER AT GROUNDWATER CONSERVATION DISTRICT FOR OVER TEN YEARS. I KNOW FIRST HAND OF THE TRIALS AND TRIBULATION HAS IN WENT TO CREATE THE CURRENT 30-FOOT DRC.

THE MULTITUDE OF PUBLIC MEETINGS, E-MAILS AND POSTINGS REQUIRED BY THE STATE FOR APPROVAL OF GMA 9 DFC.

AS YOU ARE WELL AWARE, WATER IS ESSENTIAL FOR LIFE AND THE CORP IS IN IF YOU WILL AGREEMENT THAT PROFESSIONAL MANAGEMENT OF THE VITAL RESOURCES ARE KEY FOR TODAY AND TOMORROW'S WATER USE.

THE PROFESSIONALS CONSIST OF NINE DIFFERENT COUNTIES PLANNING FOR THE WATER NEEDS OF THE PEOPLE THEY SERVE.

EACH GROUNDWATER DISTRICT MANAGES THEIR SEPARATE ALLOCATION OF GROUNDWATER A MAG.

THIS MAG IS FOR EACH GR GROUNDWATER DISTRICT TO PERMIT TO THE PEOPLE TO PRODUCE -- THIS IS IMPORTANT -- TO ACHIEVE A BAG. AND NOT ONLY IMPROVING GR GROUNDWATER PERMITS SINCE 2001 BUT APPROVING THE DRILLING OF DOMESTIC AND RESIDENTIAL GR GROUNDWATER WELLS ALL WITHIN THE WATCHFUL EYES AND APPROVAL. THESE IMPROVED GROUNDWATER WELLS ARE PART OF THE 30-FOOT ADMINISTRATION TO ACHIEVE THE MAG.

IT IS IMPORTANT UNDERSTAND THAT THESE APPROVED GROUNDWATER W WELLS, COMMERCIAL AND DOMESTIC, ARE CONNECTED DIRECTLY TO THE MAG AND THE 30-FOOT DFC AS A WATER COMMITMENT -- A COMMITMENT TO THE PEOPLE OF HAYS COUNTY.

REDUCING THE DFC TO ANYTHING OTHER THAN A 30-FOOT DFC WILL BE TAKING COMMITTED -- THAT IS IMPORTANT "COM "COMMITTED"GROUNDWATER AWAY FROM THE PEOPLE AND BUSINESSES OF WESTERN HAYS COUNTY. TODAY'S PROPOSED RESOLUTION SUPPORTING THE DFC MOVING ZERO OR ANY NUMBER OTHER THAN 30-FOOT DFC WILL BE TAKING AWAY THE RIGHTS OF THE PEOPLE OF HAYS COUNTY AND THE WATER COMMITMENT OF HAYS TRINITY FOR THE BASIC RIGHT FOR WATER. I RESPECTFULLY ENCOURAGE TO YOU POSTPONE THE RESOLUTION AND REEVACUATE YOUR POSITION AND WORK WITH THE CHAIRMAN OF DFC 9 AND LOOK OF THE SURROUNDING COUNTIES OF GMA 9 AND FOR PEOPLE'S ACCESS TO WATER.

THE MEASURE BEFORE YOU TODAY DEALS WITH GROUNDWATER MANAGEMENT AREAS. THE TEXAS WATER DEVELOPMENT BOARD HAS CREATED. OUR G MA 9 WHERE HAYS TRINITY GROUNDWATER DISTRICT IS ONE. I WILL CUT TO THE CHASE AND GO TO THE FINAL STATEMENT AND SAYS THAT IT MENTIONS REASONABLE AND PRUDENT REQUEST AND THAT'S WHAT THESE ARE.

DOES NOT ASK FOR TAKING THIS 10 -YEAR-OLD 30-FOOT DRAWDOWN AND TAKING IT ALL WAIT TO ZERO AND IT SAYS LET'S MOVE IN A REASONABLE DIRECTION AND LET'S LOOK AT THE OBSERVATIONING THAT WE HAVE BEEN ABLE TO MAKE, THE UNSUSTAINABLE TREND OVER THE LAST TEN YEARS AND THE RAPID POPULATION GROWTH THAT WE OBVIOUSLY SEE. AND WE NEED TO EMPHASIZE THAT WHETHER IT IS SURFACE WATER OR EVEN MORE PREFERABLY RAIN WA WATER, GRAY WATER REUSE, AQUIFER STORAGE AND RECOVERY AND DIRECT POTABLE USE. OUR ONE WATER SCHOOL IN WIMBERLY, WE HAVE SEEN THAT YOU CAN RUN AN ENTIRE ELEMENTARY SCHOOL ON THE SAME GROUNDWATER SUPPLY OF TWO SINGLE FAMILY HOMES. SO THERE IS WORK TO BE DONE.

AND THESE DESIRED FUTURE CONDITIONS ARE ONE WAY.

AND THIS PUBLIC COMMENT PERIOD IS ONLY OPEN UNTIL JUNE 30.

THE 30-FOOT AVERAGE DRAW DOWN IS, I BELIEVE, FOR THE ENTIRE TRINITY WITHIN THE GMA 9. IT WOULD BE DIFFERENT IF YOU JUST FOCUS ON THE TRINITY IN COMAL, HAYES, BLANCO AND THE WATER PLANNING GROUP. YOU CAN SEE A BUNCH OF DIFFERENT NUMBERS WHEN YOU LOOK AT DRAW DOWN.

30 FOOT IS THE AVERAGE LOOKING OUT TO 2060.

THEY HAVE TO SERVE THEIR CUSTOMERS IN THEIR AREA AND PROVIDE WATER, BUT ALSO FROM JUST THE DOMESTIC EXEMPT USE SIDE THAT THAT THAT THE DEMANDS ON THE QUACK QUESTION OFFICER ARE GETTING -- ON THE AQUIFER AND HOW MUCH HAVE DROUGHT IN.

DISPARITY AND GROUNDWATER D DRAWDOWNS ARE USED FOR GREATER ATTENTION TO SPECIFIC MEASURES AND ADDITIONAL DFCS RELATED TO SPRING FLOW.

HEALTH OF SPRING FLOW IS A MEASURE OF OVERALL GROUND SYSTEM HEALTH AND DIRECTLY OBSERVER TO BE USED AS A DROUGHT TRYINGER TO PROTECT GROUNDSWATER RESOURCES, MOD EDGE TO HAVE THE BLANCO AQUIFER AND DYE TRAITS AND OTHER STUDIES OF MOST MORE CONCENTRATED GROUNDWATER.

AND UNTIL THE BRAT IS COMP COMPLETED.

JUDICIAL SYSTEM AND THE BACKLOG.

SOME OF THE MEDICAL ISSUES IN OUR COUNTRY ARE COUNTYWIDE.

HEALTH ISSUES ARE COUNTYWIDE ISSUES THAT WE ALWAYS AS A GROUP HAVE -- I WOULD LIKE TO THINK WE AS A TEAM HAVE REALLY STRIVE TO ADDRESS THOSE IN A HOLISTIC WAY WHEN WE LOOK AT OUR COUNTY. WHAT I WILL SAY IS THAT WE KNOW OUR DISTRICTS AND OUR PRECINCTS VERY WELL AND I CAN TELL THE YOU SOME OF THE VERY DIRECT NEEDS THAT ARE IN CERTAIN AREAS OF SAN MARCOS RELATIVE TO THIS RECOVERY ARE VERY, VERY DIFFERENT THAN THOSE NEEDS THAT ARE IN DRIFT, THAT ARE IN DRIPPING SPRINGS AND KYLE AND BUDA.

IN LOOKING AT THIS FUNDING THE ONE THING THAT WE CAN ALL AGREE THAT OUR AUDITOR'S OFFICE IS EXTREMELY OVERWORKED AND UNDERSTAFFED AT THIS POINT AND NOT BY ANY FAULT OF THEIRS.

THEY HAD A -- THEY HAVE A DIRTH OF STAFF NOW, AND I THINK OUR DEPUTY AUDITOR WILL AGREE WITH THAT STATEMENT.

THEY NEED ALL THE HELP THEY CAN GET.

THE DIRECTION BY THE GOVERNMENT, SPECIFICALLY CONGRESS TO THE DEPARTMENT OF TREASURY OF HOW THESE FUNDS SHALL BE ALLOCATED AND HUE THEY SHOULD BE SPENT.

THEY HAVE GIVEN A LOT OF LEEWAY TO OUR LOCAL AUTHORITIES AND GOING TO ALLOW US AS A COUNTY TO ADDRESS A LOT OF NEEDS.

I BELIEVE THAT WE HAVEN'T BEEN ABLE TO DO IN THE PAST.

BUT ALSO I AM VERY COGNIZANT THAT THESE NEEDS -- THIS IS NOT A NEVER-ENDING FUNDING SOURCE FOR OUR COUNTY.

A ONE-TIME THING VERY MUCH. WE CAN USE IT TO BACK UP MONEY, EXAMPLE, OR SOME OF THE RECOVERY MONEY WE HAVE GOTTEN IN THE PAST BUT THIS WILL BE ALLOCATED IN A DIFFERENT WAY.

IF YOU LOOK AT THE STATUTORY LEGISLATION PASSED IT WAS VERY, VERY DIVR DIFFERENT. I BELIEVE THAT GIVING SETTING ASIDE FUNDS IS A PRUDENT WAY TO GO ABOUT IT AND I BELIEVE THAT JUST AS STRONGLY THAT EACH ONE OF OUR INDIVIDUAL PRECINCTS HAVE NEEDS THAT YOU MAY IN YOUR PRECINCT THAT I TRUST EACH OF MY COLLEAGUES TO TRY TO ADD ADDRESS.

I AEVRPTED IT WITH THIS RESOLUTION TO GIVE EACH ONE OF US THE ABILITY TO ADDRESS ON A COUNTYWIDE BASIS AND ON AN INDIVIDUALIZED BASIS WITH EACH OF OUR PRECINCT WHILE WORKING WITH THE AUDITOR'S OFFICE. AND WHAT I WOULD LIKE TO SEE IN OUR DISCUSSION IS POSSIBLY TALKING ABOUT GOING OUT AND HELPING TO FIND SOMEONE TO HELP THEM ADMINISTER THESE FUNDS.

I THINK WE WOULD BE SHORT SIDED IF WE DON'T HAVE THE SAME LEVEL OF EFFORT AND SAME LEVEL OF OVERSIGHT WITH THIS ENORMOUS AMOUNT OF FUNDING WE ARE ANTICIPATING FROM THE FEDERAL GOVERNMENT. AND AS COMMISSIONER STATED, IT CLEARED -- IT APPEARS TO HAVE CONSIDERABLE FLEXIBILITY TO ADDRESS CRITICAL NEEDS AND CORE GOVERNMENT SERVICES.

AND ONE OF THE PERSONS THAT WAS SPEAKING SAID THAT -- THAT IT SUPPORTS THE PUBLIC HEALTH RESPONSE EFFORT.

WE GAVE COME EXAMPLES. SHE MENTIONED COVID MITIGATION MET CAL EXPENSES, VENTILATION. BEHAVIORAL HEALTH NEEDS.

SECOND THING THAT SHE MENTIONED WAS ADDRESSES THE ECONOMIC IMPACTS OF THE PANDEMIC AND SERVING THE HARDEST HIT COMMUNITIES AND THEIR FAMILIES PROVIDING PREMIUM PAY FOR ESSENTIAL WORKER, SPECIALTY -- ESPECIALLY FOR THOSE WITH LOWER INCOME WORKERS FOR THE LOWER INCOME WORKERS, INVESTING IN WATER AND SEWER INFRASTRUCTURE AS WELL AS BROADBAND.

THEY ARE REAL SPECIFIC WHEN IT RELATES TO THE INFRASTRUCTURE AND THOSE ARE THE THREE RIGHT NOW THAT WE KNOW THAT ARE CONCERN. AND REPLACING REVENUE LOSSES ASSOCIATED WITH THE PANDEMIC SHE GAVE AN EXAMPLE THAT THE PROCEDURE DOES ALLOW FOR COMPARISON TO AN ALTERNATIVE REVENUE GROWTH MODEL THAT MAY HAVE BEEN COUNTYED OF THE PANDEMIC. SHE MENTIONED SOME OF THE THINGS THAT ARE INELIGIBLE USES THE FUNDS CANNOT BE USED TO OFF SET A TAX RATE. CAN'T BE DEPOSITED INTO A STATE OR LOCAL PENSION FUND, CAN'T BE USE FOR DEBT SERVICE OR DEP DEPOSITED INTO A RAINY DAY F FUND.

I THINK ULTIMATELY, THIS ISN'T A SLUSH FUND OF A POT OF MONEY, YOU KNOW, COUNTY COMMISSIONERS CAN GO FUNDING THINGS WITH.

I DON'T WANT THAT RESPONSIBILITY.
