[PUBLIC COMMENTS]

THOSE IN THE AUDIENCE WHO HAVE SUBMITTED A PUBLIC PARTICIPATION WITNESS FORM WILL NOW HAVE THROW MINUTES TO SPEAK ON NONAGENDA RELATED TOPICS. UNFORTUNATELY NO ACTION MAY BE TAKEN BY THE COURT DURING PUBLIC COMMENTS, AS WE'RE EXPECTED NOT TO RESPOND.

ANY QUESTIONS WILL BE TAKEN AS RHETORICAL. ALL COMMENTS ARE THE OPINIONS OF THE SPEAKER AND ARE NOT MEANT T BE NECESSARILY CONSTRUED AS TRUTH.

PLEASE KEEP YOUR COMMENTS AND LANGUAGE CIVIL AND RESPECTFUL OR YOU WILL FORFEIT THE REMAINDER OF YOUR TIME. IN THE SPIRIT OF RESPECT, PLEASE SILENCE YOUR CELL PHONES.

FIRST UP IS MR. HARVEY JENKINS. >>SERS, GOOD MORNING. I WANT TO SPEAK TO Y'ALL ABOUT THE WINTER STORM. DURING THE WINTER STORM ON THE COLDEST NIGHT OF THIS YEAR, WHEN IT WAS 2° FAHRENHEIT AT MY HOUSE. MY 70-YEAR-OLD HISPANIC DAD WHO HAS TYPE 2 DIABETES HAD TO SLEEP IN MY TRUCK. WE WERE WITHOUT POWER FOR MORE THAN 51 HOURS. WE HAD PIPES BURST IN OUR HOUSE. THE MAJORITY OF OUR FOOD ROTTED.

WE HAD NO DRINKING WATER. AND WE HAD NO WAY TO GET DOWN THE HILL.

THIS IS A CLASSIC EXAMPLE OF FAILURE TO PLAN. Y'ALL WERE NOT READY.

NO ONE WAS READY. HOWEVER, WE HAVE THE RELIABILITY COMMISSION OF TEXAS WHO DURING

[00:05:02]

THIS WINTER STORM IS WANTING TO RAISE OUR RATES AND THEY WERE SOLELY RESPONSIBLE FOR THE ROLLING BLACKOUTS. NOW THE BOARD OF DIRECTORS AND THE CHAIRWOMAN AND THE CO-CHAIRMAN ALL LIVE OUT OF STATE. AND I TELL YOU THIS BECAUSE THEY WERE SOLELY RESPONSIBLE FOR THE CRUEL AND INHUMANE CONDITIONS THAT WE HAD TO ENDURE.

DUE TO THEIR DEPRAVED INDIFFERENCE TO OUR SUFFERING. AND THIS GOES FOR -- THIS GOES FOR OUR DISTRICT 45 STATE REP THIS. GOES FOR THE CITY ADMINISTRATORS THROUGHOUT THE MUNICIPALITIES IN THE COUNTY OF HAYS. EITHER HOLD THESE PEOPLE HOLY RESPONSIBLED LOCK THEM UP AND PU THEM IN FRONT OF A -- AND PUT THEM IN FRONT OF A PROSECUTOR OR MAGISTRATE OR FEEL FREE TO STAND IN THEIR PLACE AND BE PROSECUTED AND INCARCERATED AND I HATE TO COME HERE AND SAY THAT, BUT THIS IS THE TRUTH. WHEN MY 70-YEAR-OLD DAD HAD TO SLEEP IN MY TRUCK WITH THE ENGINE RUNNING FOR 30 MINUTES AT A TIME, THAT MAKES ME WANT TO FILE CHARGES ON SOMEBODY. SO PLEASE DO SOMETHING. DO NOT MAKE ME THINK LESS OF THE PEOPLE THAT CIVIL -- DO SOMETHING. ACT NOW.

THANK YOU. >> THANK YOU, SIR. NEXT UP WE HAVE MR. RODRIGO

AMAYA. >> THANK YOU, JUDGE, COMMISSIONERS.

LAST TIME WE WERE HERE I HAD TO LEAVE BECAUSE Y'ALL TOOK A LONG TIME IN EXECUTIVE SESSION.

I HOPE IT WASN'T ABOUT TRYING TO JUSTIFY MORE EMPLOYEES FOR VETERANS AFFAIRS BECAUSE THERE'S A LOT OF FREE TIME THAT I NOTICE FOLKS IN THAT OFFICE. BUT ANYWAYS, BACK TO THAT AGENDA OF THAT WEEK TWO, WEEKS AGO I WANT TO BRING UP I WAS GOING TO BRING UP SOME ISSUES ON NUMBER EIGHT. Y'ALL HAD A RACIAL PROFILING SUBMITTED FROM RON HOOD'S OFFICE. IT WAS FILLED WITH ALL KINDS OF INCONSISTENCIES AND I HAD LOTS OF QUESTIONS. THE OTHER THING IS NUMBER NINE WAS ABOUT THE GALLONS Y'ALL WERE GOING TO BUY FOR THE SURROUNDING AREA HERE IN THE COURT. TOOK $8,000 FOR 12 GALLONS.

THERE WAS NO PICTURES SUBMITTED AND IT SAID ON THERE THERE WERE PICTURES SUBMITTED AND THAT WAS FROM MISS CRUMLEY. THAT'S UNACCEPTABLE FOR THE DIRECTOR TO SUBMIT SOMETHING LIKE THAT. THE OTHER HER IS ON NUMBER 37 ON THAT AGENDA SEPTEMBER 2002.

I DON'T KNOW THAT'S THE TIME. THERE'S ANOTHER TYPE OWE FROM THE DIRECT -- TYPO WHICH IS UNACCEPTABLE, NUMBER 27. THE OTHER THING I WANTED TO BRING UP NUMBER 30 FROM JERRY, Y'ALL HAVE, I DON'T KNOW WHAT IT'S GOING TO TAKE FOR Y'ALL TO HOLD THESE INDIVIDUALS ACCOUNTESS SPECIALLY WHEN THEY MAKE DECISIONS ANYTHING THAT HAS TO DO WITH ROAD INSTRUCTION -- HE HAS AN AMOUNT REQUESTED TO BE DETERMINED UNCHANGED. I DON'T KNOW WHERE IS THE TRANSPARENTS ANY THERE? WHAT'S TO BE DETERMINED? HE GETS TO GO OVER THERE AND GET A BLANK CHECK AND ORDER WHATEVER? WE HAVE BEEN LOOKING INTO PAYING THE PERSONAL D -- WITH FRIENDS ON COUNTY MATERIALS AND STUFF, SO WE'RE CONCERNED ABOUT THAT.

THE OTHER THING IS MR. KENNEDY NUMBER TWO, $846 AN HOUR FOR THE DISCOUNT FOR PERMISSION TO ASK FOR AN ATTORNEY TO HELP HIM? Y'ALL ARE PAYING HIM LOTS OF MONEY.

HE'S GOT SO MUCH FREE TIME HE GETS TO TEACH THE AT UNIVERSITY BUT HE'S NEED HELP -- LUCKILY WE HAVE A 10% DISCOUNT OPPOSED TO THE $984 AN HOUR. MR. SMITH YOU WERE REPORTED AS SAYING WE HAVE TO DO A BETTER JOB. I WROTE THAT DOWN BECAUSE I BELIEVE THAT WITH ARE YOU GOING TO DO ABOUT THAT? DON'T JUST SAY IT.

I WANT TO SEE IT. I'M NOT GETTING THERE. THE OTHER THING IS LIKE RIGHT NOW YOU GOT A COUPLE OF DEPUTIES SITTING AROUND DOING SECURITY HERE.

WHY DO YOU NEED TWO, THREE OF SNEM ONE SHOULD BE ENOUGH. I WAS OUT RUNNING AROUND PICK UP RECORDS DURING INCLIMATE WEATHER AND STUFF. I DIDN'T SEE ANY LAW ENFORCEMENT PRESENCE. LIKE I WAS THE SHERIFF'S OFFICE NOT GOING TO BE RESCUE ANYBODY SO DON'T GET IN TROUBLE. WE NEED BETTER LEADERS THAN THAT.

THEY ARE NOT DOING THEIR JOB AND IT'S Y'ALL'S RESPONSIBILITY TO MAKE SURE -- I'VE GOT ALLDS OF INFORMATION AND EVIDENCE THAT SHOULD ENCOURAGE YOU OF DOING A BETTER JOB OF OVERSEEING THESE DEPARTMENTS AND FOR SOME REASON LIKE MR. JENKINS ASKED YOU TO, DO HE SAID TO ACT.

Y'ALL NEED TO ACT WITH RESTRAINT AND BE MORE RESPONSIBLE. THANK YOU.

[00:10:01]

>> THANK YOU MR. AMY YEAH. NEXT UP WE HAVE MR. DAN LYON. >> THANK YOU VERY MUCH, JUDGE BECERRA. I THANK MY CREATOR THAT WE HAVE CAPABLE AND COMPETENT MEN OF GOODWILL SUCH AS RODRIGO AMAYA, WHO AT TIMES WHEN LOCAL GOVERNMENT IS IN NEARLY TOTAL CHAOS STEP UP SELFLESSLY TO THE PLATE IN SERVICE OF THE CITIZENS OF HAYS COUNTY.

MEN AND WOMEN SUCH AS MR. AMAYA NEVER GIVE A SINGLE THOUGHT AS TO WHAT IS IN IT FOR THEM, BUT ONLY ASK HOW THEY CAN HELP. THE PEOPLE OF HAYS COUNTY IN GENERAL AND COMMISSIONERS COURT, IN PARTICULARS OWE MR. AMAYA FOR A PROFOUND DEBT OF GRATITUDE. I WOULD JUST LIKE TO THANK MR. BORCHARD FOR CLEARING THE ICE OFF THE INTERSECTION OF MUSTANG AND CHEVRON LANES SO NO ONE SLID INTO MY MAILBOX. NOW WAIT A SECOND. HE DIDN'T HAVE THAT INTERSECTION CLEARED. I CLEARED IT WITH A GUARD. I'M NOT SINGLING OUT MR. BORCHARD OR ANYTHING. GOVERNMENT IN GREAT ARE OR LESSER DREEGDS ALL THE WAY TO THE WHITE HOUSE, FAILED -- FAILED THUS PAST WEEK. -- DEGREES IN.

MY MIND URCOTT IS GUILTY OF MURDER. WE DRESS UP THE BAIL OF GOVERNMENT WITH SILVER AND GOLD OR AT LEAST FEDERAL RESERVE NOTES ANDIN TIME OF NEED THEY FAIL US. ON THE SUBJECT OF THE CENTRAL APPRAISAL DISTRICT, THEY HAVE YET TO RESPOND TO MY CHARGE THAT THEY ARE VIOLATING SECTION 41.43-B OF THE TEXAS PROPERTY TAX CODE. BY NOT CONSIDERING THE AGE OF RESIDENTS WITH CALCULATING THE VALUE OF SANE. IN A COURT OF LAW IF THE CHARGE IS MADE AGAINST YOU AND IT IS NOT REFUTED BY THE DEFENDANT, THAT CHARGE STANDS. FURTHERMORE, IT IS MY BELIEF THAT THE HAYS COUNTY COMMISSIONERS COSHT IS IN LEAGUE WITH -- COURT IS IN THE LEAGUE WITH THE HAYS COUNTY CENTRAL APPRAISAL DISTRICT IN USING MONEY OBTAINED THROUGH FRAUDULENT MEANS, MAKING THE HAYS COUNTY COMMISSIONERS COURT AN ACCESSORY AFTER THE FACT TO THE COMMISSION OF CRIME. LET ME JUST SAY THAT I WAS TOTALLY DISAPPOINTED IN THE WAY THAT THE LOCAL GOVERNMENTS, ESPECIALLY, FAILED US THIS PAST WEEK.

PEOPLE DIED BECAUSE OF LACK OF PREPARATION AS MR. JENKINS SAID. IF PEOPLE MYSELF DID NOT LOOK AFTER THE RESIDENTS OF HAYS COUNTY, THE ELDERLY RESIDENTS, I THINK PEOPLE WOULD HAVE DIED HERE, TO TELL YOU THE TRUTH. THANK GOD WE'VE GOT PEOPLE THAT WILL LOOK OUT FOR EACH OTHER.

BUT IT BRINGS TO MIND WHAT ARE WE PAYING YOU PEOPLE FOR? YOU KNOW, PEOPLE COULD GET ALONG REAL WELL WITHOUT ALL THIS GOVERNMENT. WE DON'T NEED MORE GOVERNMENT.

WE NEED A LOT LESS. I TELL YOU WEEK AFTER WEEK PLEASE QUIT SPENDING.

BUT YOU DON'T LISTEN. THANK YOU VERY MUCH. >> THANK YOU, SIR.

THAT CONCLUDES OUR PUBLIC COMMENTS. WILL YOU PLEASE OPEN AGENDA ITEM

[1. Recognize Judge Scott Cary for his 11 years of service to the Justice of the Peace Precinct 5 office.]

NUMBER ONE. >> NUMBER ONE RECOGNIZE JUDGE SCOTT CARY FOR HIS 1 YEARS OF

SERVICE TO THE JUSTICE OF THE PEACE PRECINCT 5 OFFICE. >> I'LL START OFF JUDGE IF

THAT'S OK. >> COULD WE JUST GET A MOTION? >> SO MOVED.

>> WAIT, I'M SORRY. IT'S JUST A PRESENTATION. I'M SORRY.

WE DON'T NEED ONE. >> THAT'S ALL RIGHT. >> JUDGE, I APPRECIATE IT.

TODAY WE'RE HERE TO RECOGNIZE JUDGE SCOTT KARI -- CARY. IT SAYS 11 YEARS BUT WHEN HE FINISHES HIS WORK TODAY IT WILL BE 12 FULL YEARS OF DEDICATED SERVICE TO HAYS COUNTY.

I THINK EVERYBODY UP HERE KNOWS HOW GOOD A JUDGE HE'S BEEN, AND HE'S BEEN A GREAT JUDGE.

BUT FOR ME, HE'S A BETTER FRIEND AND A BETTER PERSON THAN A JUDGE.

SCOTT AND I HAVE BEEN FRIENDS FOR A LONG TIME. WE'VE WATCHED EACH OTHER'S KIDS GROW UP TOGETHER. WE'VE DONE LITTLE DRIBBLERS TOGETHER.

WE'VE WATCHED A LOT OF HAYS REBEL FOOTBALL GAMES. I HAVE SEEN YOU ALMOST THE IN A FIGHT WITH HENRY OVER A BALLOON AT A FOOTBALL GAME. THAT WOULD HAVE BEEN A HECK OF A FIGHT, TOO. I TOLD SCOTT ONE TIME OR I DON'T KNOW IF IT WAS ME OR CARY TOLD HIM HE WAS TELLING BUT IS ONE OF HIS TRIPS TO THE GRAND CANYON, AND I THINK KERRY SAID MARK AND I HAVE ALWAYS WANTED TO DO SINCE WE GOT MARRIED. SIX MONTHS LATER I GOT A CALL AND SAID I GOT Y'ALL SIGNED UP WE'RE GOING TO THE GRAND CANYON FOR FOUR DAYS AND THREE NIGHTS.

SO HE MADE ONE OF OUR BUCKET LISTS. HE ALMOST KILLED KERRY ON THE SECOND DAY ON IT THOUGH. BUT SCOTT, I CAN'T TELL YOU HOW MUCH I APPRECIATE YOUR SERVICE

[00:15:05]

TO HAYS AND TO ME AS A FRIEND. HOPEFULLY WHAT YOU AND I CAN SHOW PEOPLE AS A REPUBLICAN COMMISSIONER AND DEMOCRATIC JP CAN GET OUT AND SUPPORT EACH OTHER AND WORK TOGETHER FOR THE BETTERMENT OF HAYS COUNTY. THAT'S WHAT UFO ALWAYS DONE. YOU HAVE BEEN AN OUTSTANDING JUDGE FOR US AND I APPRECIATE FOR ALL THIS WORK CONGRATULATIONS AND I HOPE YOU ENJOY A WELL DESERVED RETI RETIREMENT.

>> MR. CARY, WOULD YOU LIKE TO APPROACH THE PODIUM AND SAY A FEW WORDS?

JUDGE CARY. >> WHEN YOU SAY A FEW, HOW MANY IS THAT?

>> BUDDY, YOU'VE EARNED AS MUCH TIME AS YOU'D LIKE TO TAKE. >> WELL I DON'T MEAN TO CORRECT MY FRIEND COMMISSIONER JONES, BUT ON FEBRUARY 10TH I HIT THE 12 MARK AND THE FAMILY COACH SAID AT 12 YEARS I CAN BE A JUDGE FOR LIFE IF I'M HONORABLY RETIRING AND I HOPE I'M

HONORABLY RETIRING ON THE 28TH OF THIS MONTH. >> AND SCHERY IS GOING TO MAKE

SURE THAT. >> ALL RIGHT. SO I JUST WANT TO THANK A FEW PEOPLE AND THE FIRST PERSON I WANT TO THANK IS MY WIFE. WE HAVE BEEN MARRIED -- I JUST ASKED HER RIGHT NOW HOW MANYS HAVE WE BEEN MARRIED? I SAID 44? SHE SAID, NO, 4 1/2. -- 44 1/2. I'VE ACTUALLY BEEN IN PUBLIC SERVICE 44 YEARS. I WAS A POLICE OFFICER 230R 2 YEARS AND NOW I HAVE 12 AS A JP.

BUT DURING THOSE YEARS I'VE PROBABLY BEEN ON CALL 30 OF THEM.

24-7. I WORKED HOMICIDE, S.W.A.T. TEAM PEER SUPPORT, BOMB SQUAD, AND MY WIFE HAS ALWAYS BEEN AT HEM WITH THE KIDS, RAISING THE KIDS -- HOME WITH THE KIDS RAISING THE KIDS WHILE I'VE BEEN DOING MY JOB. SHE'S MY ROCK.

I LOVE HER. I GUESS SHE'S MY BOSS NOW TOO, MY REAL BOSS.

RECOGNIZE ARE MY STAFF, CHRISTINE, PAMELA AND ANGIE, STAND UP.

APPLAUSE] THEY ARE THE ONES THAT RUN THE JP OFFICE IN BUDA.

NOT JUDGE CARY. IT'S THESE THREE LADIES. THEY DO AN OUTSTANDING JOB FOR NOT VERY MUCH PAY, SO REMEMBER THAT WHEN IT COMES TIME FOR A PAY RAISE.

BUT THAT'S REALLY ALL I HAVE. I'D LIKE TO THANK HAYS COUNTY FOR THE OPPORTUNITY.

12 YEARS AGO, WHEN I TOOK THIS JOB I HAD NO IDEA WHAT I WAS GETTING INTO.

IT'S BEEN A WONDERFUL SCOMEERNTS -- EXPERIENCE, AND IT'S JUST TIME FOR ME TO MOVE ON.

SO Y'ALL HAVE APPOINTED A VERY CAPABLE REPLACEMENT JUDGE DOYLE. BEEN WORKING WITH HER BRINGING HER UP TO SPEED, AND SHE'S GOING TO BE AN OUTSTANDING JUDGE. THANK YOU.

>> BEFORE YOU GO, I'D LIKE TO ADD A LITTLE CONTRIBUTION LIKE OUR COMMISSIONER HAS AND YOU AND I RAN AT THE SAME TIME WHEN HES UP REPUBLICAN AND DEMOCRAT. YOU AND I IMMEDIATELY GOT ALONG WHEN WE MET, AND I THINK THAT IT'S IN GREAT PART BECAUSE OF OUR PASSION TO SERVE OUR COMMUNITIES THAT TO US BECAUSE WE HAD LOTS OF CONVERSATIONS CAMPAIGNING.

IT'S PEOPLE OVER POLITICS. IT'S HOW CAN I HELP YOU? IT DOESN'T MATER IF YOU'RE A REPUBLICAN. IT DOESN'T MATER IF YOU'RE A DEMOCRAT.

IT'S HOW BEST CAN WE SERVE YOU? YOU HAVE BEEN SUCH AN AMAZING EXAMPLE TO ME AS A NEW JUDGE TO SEE SERVANT LEADERSHIP AT WORK, AND YOUR LEVEL-HEADEDNESS, EVENHANDEDNESS ON APPROACHING EVERYONE, NOT CARING PARTY AFFILIATION AS IT SHOULD BE. IF I HAD ONE WISH IT WOULD BE TO ELIMINATE PARTY LINES AND PARTY LABELS, AT LEAST AT THE COUNTY LEVEL BECAUSE WE ARE TRULY GRATEFUL. I SAY WE AS MY WIFE AND MY FAMILY BECAUSE I GOT IT MEET YOUR FAMILY DURING THE CAMPAIGN TRAIL AND WE ARE GRATEFUL TO HAVE HAD YOUR EXAMPLE USHER MY TIME IN OFFICE AND YOU'VE LED AS A RETIRING JUDGE, YOU LED A NEW JUDGE IN A WAY THAT HAS BEEN MAGNIFICENT, AND I JUST WANT TO PERSONALLY THANK YOU FOR THE EXAMPLE BECAUSE YOU NEVER KNOW WHO IS WATCHING, AND I WANT YOU TO KNOW AT EVERY TURN I WATCHED YOU AND I APPRECIATE YOU AND EVERYTHING THAT YOU HAVE DONE FOR OUR COMMUNITY. I JUST WANT TO SAY FROM THE BOTTOM OF MY HEART, THANK YOU AND THANK YOU TO YOUR LOVELY TEAM.

>> WHERE IS MARY? SOMEONE TAKE THE PICTURE. >> WILL YOU PLEASE OPEN AGENDA

[00:30:10]

>> GOOD MORNING. FIRST I WANT TO START BY THANKING THE JUDGE AND COMMISSIONERS. YOU ALL HAVE BEEN AMAZING PARTNERS OF OURS THROUGHOUT THE YEARS. AS I WAS SITTING BACK THERE I WAS THINKING ABOUT THIS TIME LAST YEAR WAS THE LAST TIME WE HAD THIS PROK NATION ABOUT THE SHUTDOWN AND HOW MUCH HAS CHANGED AT THE YEAR AT CENTER. ONE THING THAT'S CERTAINLY HAS NOT CHANGED IS THE COMMITMENT TO SERVING THE COMMUNITY AND AND THOSE SUFFERING FROM ABUSE. THIS MONTH IN PARTICULAR IS IMPORTANT TO US BECAUSE IT SPEAKS TO PREVENTION WE KNOW IT'S IMPORTANT FOR THOSE SUFFERING FROM ABUSE BUT IN ORDER TO CHANGE WE HAVE TO ADDRESS IT IN THOSE YEARS IN ORDER TOP EFFECT SOME REAL IMPACT OF CHANGE. I SUPPORT THE -- TO DO THAT WORK IT'S BEEN A WONDERFUL INTERESTING YEAR BUT WE'VE DEFINITELY MOVED FORWARD AND DO THAT WITH THE SUPPORT OF THE COMMUNITY THIS. WEATHER EVENT WAS NO EXCEPTION.

WE HAD A LOT OF SUPPORT FROM THE COMMUNITY ALREADY REACHING OUT US TO TO FIND WAYS THEY CAN H HELP. SO HAZE COUNTY IS DEFINITELY A GREAT PLACE TO BE AND WE

APPRECIATE EVERYTHING. >> WOULD YOU BE INTERESTED IN A QUICK PHOTO.

>> SURE. >> OKAY. DWOIL THIS REAL ZBHIK BEFORE WE MOVE ON TO I WANT TO SAY THANK YOU ALL SPECIFICALLY FOR THE DATING VIOLENCE AND THE WORK Y'ALL DO IN DRIPPING SPRINGS. SPECIFICALLY Y'ALL BOARD MEMBER SARA IS AMAZING AND I NOE THAT'S HER BABY BUT BETWEEN I DON'T KNOW IT'S THE REST THE COURT KNOWS BUT WE ACTUALLY JUDGE BURNS INTEREST PRECINCT FOUR IS ACTUALLY PARTICIPANTS THIS IT AND HAS HELPED THE WORK THAT DHO THERE IS ABSOLUTELY AMAZING IN TRYING TO EDUCATE YOUNG FOLKS AT A HIGH SCHOOL LEVEL ON WHAT TO EXPECT, AND IT'S A TRUE MOCK TRIAL. THOSE STUDENTS CONDUCT THE TRIAL. THEY ARE THE JURORS. THEY ARE THE WITNESSES.

THEY ARE THE JUDGES. THEY ARE THE ATTORNEYS AND THEY GO REAL WORLD SCENARIOS.

EVEN ONE OF OUR ESP DIRECTORS DAN O'BRIEN FROM ESD-1. HE'S HELPED PARTICIPATE THIS IT TOO. I REALLY DO APPRECIATE HOPEFULLY SOMEDAY WE CAN EXPAND THAT ALL COUNTYWIDE. IT WOULD BE AMAZING BUT I KNOW IT'S A LOT OF WORK AND I DO

APPRECIATE IT. >> THANK YOU:. >> THANK YOU SO MUCH.

>> THANK YOU. I APPRECIATE IT. >> APPRECIATE ALL YOU DO.

[4. Presentation by the Greater San Marcos Partnership regarding the Emergency Cash Assistance Program (ECAP) fund.]

WILL YOU PLEASE OPEN AGENDA ITEM NUMBER FOUR. >> NUMBER FOUR PRESENTATION BY THE GREATER SAN MARCOS PARTNERSHIP REGARDING THE EMERGENCY CASH ASSISTANCE

PROGRAM FUND. >> OK. WE'RE READY FOR YOU.

P. >> MORNING. I'M BARBARA THOMPSON, GREATER SAN MARCOS PARTNERSHIP. THANK YOU JUDGE BECERRA AND COMMISSIONERS FOR THE OPPORTUNITY TO REPORT ON THE COMPLETION OF THIS PROJECT, EMERGENCY CASH ASSISTANCE PROGRAM. I BELIEVE THAT YOU HAVE SOME SLIDES.

THAT ARE TO GO BEFORE. WE'RE LOOKING AT THOSE, I DID WANT TO ACKNOWLEDGE THE WONDERFUL COMMITTEE THAT YOU ALL APPOINTED, TO MAKE SHE PROJECT HAPPEN.

HEY WERE A WONDERFUL TEAM. SO THANK YOU FOR THAT. THAT COMMITTEE WAS TRACY ANDERSON FROM THE BUDA EDC. SUSAN CORRIN FROM CORRIN FINANCIAL.

CARA RYAN IF WORKFORCE SOLUTIONS RURAL CAPITAL AREA. JR GONZALEZ FROM THE BUDA

[00:35:06]

CHAMBER. SCOTT GREGSON FROM GREGSON REALTOR ADVISERS.

KIM FLANKS WHIM HOSPITALITY. JOE HARPER FROM THE SMALL BUSINESS DEVELOPMENT CENTER AT TEXAS STATE UNIVERSITY. P TRACY SHIELD, WHO IS FORMER CITY OF KYLE COUNCILWOMAN, AND KATHY MORNL ON -- MORE MONDAY WHO HAD TO STEP DOWN EARLY ON DUE TO A FAMILY TRAGEDY.

THIS WAS OUR WONDERFUL COMMITTEE AND WE WERE JOINED BY KATHERINE SOBEL WITH PEOPLE FUND TO EXECUTE THIS PROJECT. DO WE HAVE SOME SLIDES? NO?

I'LL JUST TALK THROUGH THEM THEN. >> I CAN PUT IT UP.

>> WHILE YOU'RE TALKING SHE'S TRYING TO PUT THEM UP. >> OK.

WELL THE EMERGENCY CASH ASSISTANCE PROGRAM WAS $600 AWARDED TO 92 BUSINESSES.

THAT IS $500,000 FROM HAYS COUNTY. 100,000 FROM THE CITY OF KYLE.

IT WAS A COLLABORATION BETWEEN HAYS COUNTY, THE CITY OF KYLE THE GREAT ARE SAN MARCOS PARTNERSHIP. THE GRANT FUND WAS INTENDED FOR SMALL BUSINESSES THAT HAD BEEN IMPACTED BY COVID AND THOSE GRANTS WERE ANYWHERE FROM SMALL AMOUNTS UP TO $10,000 FOR QUALIFYING SMALL BUSINESSES ON A FIRST COME, FIRST SAVE BASIS. WHAT WE EXPERIENCED WAS OVER 400 APPLICATIONS AND WE HAD 92 AWARDS ISSUED OVER THE COURSE OF PERIOD OF TIME WHICH BEGAN LAST AUGUST AND WAS CONCLUDED HERE AT EARLY PEB. -- FEBRUARY.

WE HAD SOME RECOMMENDATIONS THAT WE WANTED 20 OWE THAT WE WANTED IT MAKE TO THE COURT.

SOME PEOPLE TAKE RESPONSIBILITY FOR SOME WE WILL LAY OUT OTHERS TO TAKE RESPONSIBILITY FOR BUT THEY ARE A RESULT OF LEARNING IN THIS PROCESS. ONE OF THESE RECOMMENDATION THAT AND I'M SURE YOU ALL KNOW THIS, THAT OUR SMALL BUSINESS POPULATION, PARTICULARLY THOSE THAT REACHED OUT TO APPLY, THEY DESPERATELY NEED INSTRUCTION AND HOW TO MANAGE AND RECORD THEIR FINANCES. SO WE THRAEMED IT WOULD BE VALUABLE TO FOLLOW UP -- RECOMMENDED THAT IT WOULD BE VALUABLE TO FOLLOW UP ON THIS PROGRAM FOR FREES TO PREVENT POTENTIAL PROBLEMS WITH THEIR BUSINESS. WHAT WE HOPE TO DO IS OFFER AT LEAST A WEBINAR THIS SPRING PERHAPS APRIL OR SMA FOR THESE SMALL BUSINESSS TO TAKE A WEBINAR OR OTHER RESOURCES THEY CAN ACCESS. THE SMALL REPORTS WERE IN DISARRAY. SHOE BOXES, THINGS LIKE THAT. WE WORK TO BE FORGIVING BECAUSE WE KNEW THEY NEEDED ASSISTANCE. ANOTHER LEARNING IN THIS IS THAT THE CHILD CARE INDUSTRY DID NOT TAKE ADVANTAGE OF THE E-CAP PROGRAM OF THE NOT SURE WAS. MAYBE THEY WERE STRESSED AND COULDN'T FOCUS ON IT. THIS INDUSTRY IS COMPOUNDING OUR PROBLEMS BECAUSE EXPERIENCED INCREASE THE ADMINISTRATIVE COST AS A RESULT OF REDUCED CHILD SPEECHER RATIOS INCREASED COST OF HEALTH AND SAFETY SUPPLIES AND ALREADY EXTREME THIN MARGINS.

SO WE BELIEVE THAT ADDITIONAL TARGETED SUPPORT IS NEEDED FOR THE CHILD CARE SECTOR.

AND THAT WE WILL IF WE DO THAT WE WILL EXPERIENCE SOME POSITIVE RESULTS FOR THE ENTIRE WORKFORCE THE ENTIRE COMMITMENT. THE E-CAP FUND WAS SUCCESSFUL IN SUPPORTING SMALL BUSINESSES, BUT WE BELIEVE THAT CITIZENS ARE CONTINUING TO FALL THROUGH THE CRACKS MUCH THOSE ARE DISPLACED SECTORS SUCH AS RETAIL AND HOSPITALITY. THE MEDIA HAS BEEN GOOD ON REPORTING THAT. SO HELP IS NEEDED TO HELP THESE INDIVIDUALS MAKE THE TRANSITION.

THE GREAT THER SAN MARCOS PARTNERSHIP HOSTING A JOB AND TRAINING FAIR ON MARCH 30TH THAT

[00:40:02]

WILL BE ONE EVENT TO HELP BUT WE KNOW THERE NEEDS TO BE ONGOING RESOURCES TO ASSIST.

SO WE HAVE THESE RECOMMENDATIONS. I DO WANT TO RECOGNIZE A COUPLE OF INDIVIDUALS THAT CAME TODAY THAT ARE RECIPIENTS. OF COURSE, THERE WERE 92 OF THEM BUT TWO OF THEM JOINED. CORRINA, BOSTON WHO IS THE OWNER OF SPLASH CO WORKING.

AND I BELIEVE SIMONE IS HERE. THIS IS ONE OF OUR NONPROFIT RECIPIENTS SO THEY CAME TODAY TO VISIT WITH US AND TO TALK TO IMMEDIATE REPRESENTATIVE LATER. SO THIS PROGRAM CAN BE PUT OUT THERE ON THE MEDIA SO THE GOOD REPORT TO BE. SO I'M HAPPY TO FIELD ANY

QUESTIONS THAT YOU MIGHT HAVE OF ME. >> I WOULD LIKE TO APOLOGIZE OUR TECHNOLOGY DIDN'T WORK AS WE WOULD HAVE HOPED BUT DID YOU A GREAT JOB OF RECAPPING, AND I HAVE A CONTINUED PASSION TO SUPPORT OUR SMALL BUSINESS COMMUNITY.

IT'S EASY FOR ME BECAUSE THAT'S WHERE I'VE BEEN ALL MY LIFE. THAT'S WHERE I RAISED MY FAMILY.

SO I SEE THESE EFFORTS BECAUSE I SEE THEM UNFOLD AND I KNOW THAT IT WAS A LOT OF TOUGH CONVERSATIONS COMMISSIONER SHELL AND I HAD, FOR EXAMPLE, BECAUSE WE WERE HOPING TO SHAPE THIS AND I WANT TO THANK COMMISSIONER SHELL FOR BEING PATIENT WITH ME WHILE I WAS -- I JUST GOT TO BE HONEST, GRILLING THE HECK OUT OF OUR PROCESS. I WAS JUST LIKE NO, LET'S DO THIS. IT WAS JUST ME WALKING THROUGH SEEING THIS THROUGH THE LENS OF OURS THE CLEANERS, ALL OF THE -- I CAN JUST GO DOWN THE LIST. I'M JUST GRATEFUL HAD A AS THIS THING UNFOLDED WE EVOLVED IT FURTHER AND INCORPORATED NONPROFITS BECAUSE HERE'S A GREAT WITNESS OF THAT DECISION. OF COURSE EVERYONE ON THIS COURT HAS A TRIANGULATION TO NAVIGATE.

WE'RE ALL IN A KALEIDOSCOPE OF LOOKING GLASSES TRYING DO THE MOST GOOD THROUGH ITS CHALLENGES I'M VERY GRATEFUL FOR THE BUSINESS COMMUNITY STEPPING UP AS THEY CAN CHAMBER OF COMMERCE OUR ECONOMIC DEVELOPMENT MACHINES. I CONSIDER THIS A MACHINE BECAUSE IT KEEPS ONGOING IN A BONDSERFUL WAY. I'M JUST GLAD UNDER THESE STRESSFUL TIMES. I NEVER THOUGHT WOULD GET MORE STRESSFUL BUT PUT A FREEZE ON US. UNDER THESE STRESSFUL TIMES WE CAME TOGETHER AS A BUSINESS COMMUNITY TO HELP ONE ANOTHER. NOBODY CARED JUST TO ECHO THE EARLIER PART OF JUDGE CAREY.

NOBODY CARED IF THE BUSINESS OWNER WAS A REPUBLICAN OR DEMOCRAT.

I'M JUST GRATEFUL WE SHOWED ANOTHER EXAMPLE OF HOW WE CAN COME TOGETHER AS A COMMUNITY.

WE ARE LOADED WITH STRESS AND MANY OF US AREN'T EASILY IDENTIFIABLE, MANY OF US WALKING THROUGH THEM, IN THEM. AS YOU SAID THE LION'S SHARE OF THE BUSINESS COMMUNITY STARTED WITH SOMEONE'S PASSION. IF YOUR SPATION TO SERVE IN SOME TYPE OF WAY IT'S NOT ALWAYS YOUR PASSION TO BE A BOOKKEEPER. AND SO I TOTALLY UNDERSTAND WHAT YOU'RE SAYING ABOUT NEEDING HELP TO FOLLOW UP WITH ADDITIONAL TARGETED SUPPORT. I THINK THAT'S KEY AND CRITICAL BECAUSE WE'RE ALL IN THIS TOGETHER AND THE BETTER WE CAN SUPPORT OUR SMALL BUSINESS THE MORE AT PEACE THEY WILL BE AND THE BETTER THEY WILL SERVE OUR COMMUNITY I'M SURE COMMISSION

EARLY SHELL WOULD LIKE TO ADD SOMETHING AS WELL. >> THANK YOU, JUDGE.

THANK YOU FOR THE PARTNERSHIP TO TAKE HAD ON AND IT WAS QUITE A BIT OF WORK TO ALL THE CITIZENS WHO SERVED, THEY SPENT A LOT OF TIME GENERAL COUNCIL'S OFFICE AND JONES' OFFICE PARTICIPATED IN THOSE. SHE LET ME KNOW THERE'S A LOT OF HARD WORK AND DECISIONS BUT I WANTED TO THANK THEM FOR DOING THAT IT TOOK US A WHILE TO GET IT GOING.

WE WILL FIND WE WERE ABLE TO HELP. APPRECIATE THE SUPPORT.

>> I WANT TO THANK MARK FOR HIS SUPPORT THROUGHOUT THE PROCESS. WE DID HAVE ONE LITTLE BLIP IN THAT WAS I BELIEVE AN AGENDA ITEM LATER IN THE MEETING AND THAT BLIP WAS $100,000 WAS

[00:45:11]

ALLOCATED IN CISMT ONE OF THEIR GRANTS WERE JUST OUTSIDE THE CITY LIMITS THAT WAS NOT DETECTED UNTIL RECENTLY. TRY AND FIX HAD A SOMEHOW. TALK ABOUT THAT LATER.

>> YOU GOT IT. BEFORE WE GO I WANT TO OFFER THE COMMISSIONERS AN OPPORTUNITY TO

OFFER ANY COMMENTS. >> THANK YOU SO MUCH BARBARA FOR YOUR LEADERSHIP AS WAS MENTIONED EVERYONE WHO PARTICIPATED FOLLOWING THESE BUSINESSES. I REALLY APPRECIATE IT AND I APPRECIATE THE REVISION THAT'S WERE MADE THAT ENABLED MORE PEOPLE TO COME IN AND PARTICIPATE IN THE PROGRAM. IT'S UNFORTUNATE WE FEEL SOME WHO FELL THROUGH THE CRACKS AND HOPEFULLY YEARS TO COME WE CAN DO SOMETHING TO HELP THOSE BUSINESSES OUT BUT I REALLY APPRECIATE Y'ALL ALL THE WORK THAT'S BEEN DONE. THANK YOU TO THE TWO THAT ARE HERE REPRESENTING SOME OF THESE WERE AWARDED THOSE. THANK YOU.

>> AGAIN I WANT TO THANK YOU ALL -- APPRECIATE Y'ALL BEING ABLE TO WORK WITH US AND GETTING

THOSE GRANTS OUT. >> COMMISSIONER SMITH. >> THANK YOU FOR THE HARD WORK.

YOU RAN THROUGH A LOT OF PEOPLE. THERE I WANT TO THANK THES OFFICE BECAUSE PHYSICALLY GETTING THOSE CHECKS OUT WOULDN'T HAPPEN WITHOUT THEM. I KNOW WE'RE GOING TO RECOGNIZE THEM IN A MOMENT. IT'S A LONG LIST OF JOBS THAT THEY HAVE ASSUMED AND DONE A

GREAT JOB WITH. THANK YOU FOR THE WORK. >> ALL TO THE CITY OF KYLE.

>> THAT'S RIGHT. HERE'S JUST ANOTHER EXAMPLE OF THE FABRIC OF OUR COMMUNITY.

AND I SPEAKING ABOUT A SPECIAL LENS NOT ONLY AS A FORMER BUSINESS I SAY FORMER BUT MY SON NOW THE FRONT LINE ON THAT EFFORT SMALL BUSINESS LIFE. I WAS A CHAIR OF THE MAINSTREAM ADVISORY BOARD. I'VE LIVED THROUGH ALENS FOR DECADES.

NOT JUST THE FABRIC. SMALL BUSINESS IS THE FABRIC OF OUR COUNTRY SO EVERYTHING THAT WE CAN DO TO SUPPORT EVERYTHING WE CAN DO TONE COURAGE DREAMS AND PASSION MAN, THAT'S WHAT DREAMS ARE MADE UP THANK YOU GUYS IN 12 DIFFERENT WAYS FOR PARTICIPATING IN THIS THANK YOU

FOR THE OPPORTUNITY. >> THANK YOU. I DO HAVE ONE PUBLIC COMMENT.

MR. DAN LYON IF YOU WILL GIVE HIM THREE MINUTES ON THE TIMER. >> THANK YOU JUDGE BECERRA.

I'M SURE PARTNERSHIP DOES GOOD WORK. THAK SAID THIS IS NOT THE PLACE THE COMMISSIONERS COURT TO BE A BUSINESS ASSISTANCE AGENCY. THE COURT HAD ITS OPPORTUNITY TO ASSIST THE RESIDENCE OF HAYS COUNTY AND BUSINESSES WHO SET THIS YEAR'S TAX RATE INSTEAD OF LOWERING IT YOU RAUZ OF RAISED IT IN THE MIDDLE OF A PANDEMIC MY VIEWS ON PUBLIC PART SLIPS WELL KNOWN. WE PAID THE SAN MARCOS PARTNERSHIP $100,000 A YEAR FOR THEIR SERVICES IT'S NOT THE PLACE FOR THE COMMISSION ERLS COURT TO ATTRACT BUSINESS.

THAT'S THE JOB OF COMMERCE. PUBLIC PARTNERSHIPS UNDULY INFLUENCE LOCAL GOVERNMENTS CAUSING THEM TO SPEND BEYOND THEIR MEANS. WILL THEIR LARGE VOICES MONEY TALKS LOUDLY. BUSINESSS ARE LURED TO HAZE COUNT WAY TAX ABATEMENT AND INFRASTRUCTURE PAID BY THE CITIZENS. THE STROO UTH THAT MOST OF THESE BUSINESSES WOULD COME TO HIS COUNTY BY DEFINITION THE REST THE BUSINESS WOULD COME HERE SOLELY FOR THE BENEFITS ARE UNUS ISABLE. OWL FORGIVE ME.

I DIDN'T CATCH WHETHER IT WAS PAID BY HAYS COUNTY OR SAN MARCOS.

IT'S TAKEN DIRECTLY OUT OF POCKETS OF CITIZENS. IT'S GIVING TO SELECT BUSINESS AND YOU CAN SAY THOSE ARE DESERVING AND BUSINESSES NEED TO CONTINUE I WOULD AGREE WITH ALL OF THAT MAYBE THEY WERE DESERVING. MAYBE THEY WEREN'T.

I DON'T KNOW. ANYWAY THEY SHOULD NOT BE IN POSITION TO CHOOSE WHICH BUSINESSES SHOULD BE SUBSIDIZED AND WHICH SHOULD NOT AND NEITHER IS THE COUNTY.

[00:50:06]

THIS IS ANTIFREEZE ENTERPRISE. TARGETED SUPPORT MEANS PREFERENTIAL TREATMENT WHICH SMEENS MORE THAN OTHERS. THIS IS ANTI-COMPETITIVE IN MY MIND AND IT ALSO MEANS IT MY MIND IT'S ANTI-AMERICAN. MAYBE THEY DON'T MEAN IT. BUT LET'S FACE IT.

THIS 1 GIVING SOME ADVANTAGE OVER OTHERS, THAT IS JUST NOT FAIR.

THEY SHOULDN'T BE DOING WITH MY MONEY TOO THANK YOU VERY MUCH MR. LIE YOCHBLET PLEASE OPEN

[5. Presentation regarding the Hays County 2016 Road Bond Program SH 21 Corridor Preservation Study Project: Right of Way Preservation Recommendation Report.]

AGENDA ITEM NUMBER FIVE. >> NUMBER FIFE PRESENTATION REGARDING THE HAYS COUNTY 2016 ROAD BONGED PROGRAM SH-21 CORRIDOR PRESERVATION STUDY PROJECT.

RIGHT OF WAY PRESERVATION RECOMMENDATION REPORT. >> PRESENTATION.

>> GOOD MORNING, JUDGE, COMMISSIONERS. >> YES, SIR.

GIVE ME ONE SECOND. YES, MA'AM. >> I NO HE THE LAST ONE IT'S ON THE LAPTOP BUT NOT PRESENTING TO THE SPEAKER I CAN TRY IT ONE MORE TIME BUT IT MIGHT NOT WORK

AGAIN. >> YOU KEEP TRYING AND HE'LL KEEP TALKING LIKE THE LAST PRESENTER. THANK YOU. I KNOW YOU'RE DOING YOUR BEST.

>> I DID PROVIDE HARD COPIES OUT THEREP I THINK THAT WILL WORK. >> THANK YOU GUYS.

>> I LEARNED FROM THE LAST COUPLE OF MONTHS NOT TO TRUST TECHNOLOGY.

>> GOOD JOB. >> ONE ZOOM TOO MANY RIGHT. >> IT'S KICKED ME IN THE BUTT A FEW MANY TIMES HERE LATELY. SO SO I'M HERE TO PRESENT AN UPDATE FOR THE STATE HIGHWAY 21 CORONER PRESERVATION STUDY PROJECT. AS WELL AS A SUMMARY FROM THE RECOMMENDATION REPORT WHICH WAS SUBMITTED A COUPLE OF MONTHS AGO NOW.

THIS COVERED THE STATE 21 CORRIDOR PERFECT STATE HIGHWAY 80 JUST TO THE NORTH AND EAST OF SAN MARCOS ALL THE WAY THROUGH THE INTERSECTION OF STATE HIGHWAY 1306789 WHEN WE KICKED OFF THE STUDY WE WANTED TO DO A QUICK VALUATION AND USE THE CAMO MODELS AS WELL AS ADDITIONAL METHODS WE DID TO SEE WHAT COULD BE ALONG THE CORPS DOMPLT AS YOU CAN SEE THERE THE POPULATION INCREASE IS TO BE A 150% INCREASE AND TRAFFIC ON STATE HIGHWAY 41 IS EXPECTED TO DOUBLE AS WITH. LOOK AT GRAPH IT IS THE INTERSECTION OF THE ROADWAY DIVIDING LINE 50. ONE OF THOSE SECTIONS IS MORE THAN TRIPLE ANTICIPATED THERE YOU CAN SEE BE THREE WHAT THE POPULATION HAS BEEN OVER THE PAST 30 YEARS FROM 2035 TO 2035.

BASED ON THE INFORMATION WE HAVE HAD TO DATE ONLY ANTICIPATED TO CONTINUE GOING.

WITH THAT WE DID A QUICK ANALYSIS OF EXISTING ROAD CONDITIONS AS WELL AS THE 2040 TRAFFIC VOLUMES AND PRESENTED THOSE, TERMS OF LOCAL SERVICE SIMPLY PUT THE AMOUNT OF DELAY THAT A MOTORIST CAN EXPECT ALONG THE CORRIDOR. ALL THE MAJOR INTERSECTION THERE'S. YOU CAN SEE UNDER EXISTING CONDITIONS FOR THE MOST PART IT'S DOING OK A FEW AT LEVELER IS VILS F. IF YOU START LOOK AT TRAFFIC PROJECTIONS OF 2040 THE ENTIRE CORPS ZOR AT LEVEL SERVICE F WHICH IS UNACCEPTABLE DELAY ON THE ROADWAY. AND THEN WE ALSO JUST AND WE WANTED TO LOOK AT A NUMBER OF THINGS BEING ADDRESSED AND THIS WAS ACCIDENT HISTORY, SO WE DONE EVALUATION.

YOU CAN SEE FROM THE HEATED MAP WE HAVE THERE. THIS IS ALL DATA TRASH DATA FROM THE STATE OF TEXAS RECORDS. CRASHES CREASED FROM 68% FROM 20,000 FROM WHICH HE STARTED

[00:55:09]

THIS. YOU CAN SEE THE BRIGHT RED SPOTS.

THIS IS WHERE THE HIGHEST INCIDENTS OCCURRED. EVERYBODY IS FAMILIAR WITH THOSE INTERSECTIONS WHAT HAPPENS WITH THE TRAFFIC WE HAVE. THERE WE CONDUCTED COUPLE OF TOWN HALLS. WE WERE HAVING IN-PERSON EVENTS UNTIL COVID-19 CAME ON THE SCENE AND WE RAPIDLY DID VIRTUAL TOWN HALLS. WE FEEL THE PARTICIPATION WE OBTAINED DURING BOTH OF THESE ARE VERY GOOD. AS YOU CAN SEE WE HAD NEARLY 1400 VISITORS TO THE FIRST TOWN HALL IN ABOUT 800 IN THE SECOND. 88 DURING THE SECOND.

>> ONE MORE CLOMPLT I SAW ONE OF THOSE POSTS. THEY WANT MORE COLOR IN YOUR IMAGE. SO YOU CAN SEE HERE YOU CAN SEE THE OTHER STATISTICS OW PEOPLE ACSESD. TOWN HALLS WERE CONDUCTSED AND PRESENTED IN ENGLISH AS WELL AS SPANISH. WE DID NOT HAVE THAT MANY USERS ACCESSING THE SPANISH DOCUMENTS.

I THINK WAS ROUGHLY 5 TO 6% DURING TWO TOWN HALLS. ALL IN ALL I THINK WE HAD MUCH BETTER PARTICIPATION THAN WE WOULD HAVE HAD IN PERSON. GENERALLY THIS IS THE VIRTUAL TOWN HALLS RUN FOR A LONGER TIME VERSUS HAVING A VERY SPECIFIC DAY AND TIME THAT IS OFTEN DIFFICULT FOR PEOPLE TO ATTEND. WHAT WE HEARD FROM THE TOWN HALLS CAN BE SUMMED NUMB SEVERAL DIFFERENT ITEMS. ONE OF COURSE EVERYONE IS OUT THERE IS CONCERNED ABOUT THE POPULATION INCREASE AS WELL AS THE TRAFFIC INCREASE ON STATE HIGHWAY 21.

THE IDENTIFIED. MUCH NEED TURN LANE SAFETY IMPROVEMENTS SOLDIER.

SOME OF THESE ARE CURRENTLY BEING WITH THE SUPER 2 PROJECT WHICH IS RIGHT NOW ADD SOMETHING SOLDIERS AND DEDICATED TURN WHILE IT WILL BE WE'LL HELP SOME OF THE SAFETY ISSUES IT'S NOT GOING TO HELP FOR THE LONG-TERM ALONG THE CORPS NOR. OF COURSE WE GOT PEOPLE WHO WERE CONCERNED AND RIGHT OF WAY WOULD IMPROVE PROPERTIES WOULD ACCESS HIGHWAY 1 TRYING TO MAINTAIN THE SMALLTOWN FEEL AND DARK SKY INITIATIVE. THIS IS DURING THE INITIAL TOWN HALL WE DISCUSSED THE CONCEPT OF BYPASSS THE FIRST WAS AROUND THE STIFF -- TO SEE WHAT WOULD HAPPEN THERE ONE OF THE MAJOR ENTERIES THAT WOULD HAVE BEEN IPACTED AND HAYS WAS ON FAVOR AND ONBOARD WITH THAT CONCEPT. IS THERE WERE HERE'S HAD CONCERNS ABOUT THE CONCEPT OF SOME OF THE BYPASSS. AM THE ROADWAY WHICH WAS CONSIDERED AS PARTS OF THE STUDY TO POSSIBLY BE UNITEDIZED TO ADDRESS THE PARTICIPATED GROWTH. WITHIN THE CAMPO PLAN OR HAYS COUNTY PLAN THE PROPOSED WOULD BE A SIX-LANE DIVIDED MAD SIX. WE DID AN ANALYSIS ON THAT WE LOOKED AT WILL FOUR LANE NOITION TWO MANAGED LANES AND ALSO LOOKED AT THE A FREEWAY SECTION THROUGH THE CORRIDOR. WE GET TO ON THE NEXT PAGE THE DISCUSSION OF THE BYPASSS.

WE LOOKED AT A BYPASS ON BOTH THE WESTERN SIDE AS WELL AS THE EASTERN THE ONE ON THE WEST RN

[01:00:06]

SIDE RUNDS EFFECTIVELY BEHIND THE NEW BUS FACILITY AND ELEMENTARY SCHOOL.

THAT IS THERE. DRAWING A BLANK AT MOMENT BUT BASICALLY RUNS BETWEEN THOSE TWO FACILITIES. IT'S RELATIVELY SHORT BUT DOES GET AROUND THE MAIN CORE OF THE CITY. TOM PROPERTIES ALONG 2 1. IN YELLOW WE SHOWED EFFECTIVELY THE AMENT ON THE EXISTING 21 ALIGNMENT, WE WOULD IMPACT 66 PARCELS AND HAVE EIGHT LOCATIONS. WITH THE WESTERN BYPASS WE'RE REDUCING PARCEL TAKES BY 60%.

FROM 62 TO 8-2. A GOOD PORTION OF THAT BYPASS WOULD BE ON THEIR PROPERTY.

P HOWEVER THEY ARE VERY MUCH IN FAVOR AND TAKE THEM ON THAT. THEY FELT WAS IMPROVED SAFETY GETTING TO AND FROM THE CORRIDOR IT SELF. THE CITY IS UNDECIDED AS TO WHETHER THEY LIKE THE EASTERN BIS OR NO BYPASS. AND THE IMPACT OF PARSE ELGZ AS WELL. THERE ARE NO KNOWN PLANNED STHREMENTS ON THE EASTERN SIDE.

AND IT CAN ALSO BE COMBINED WITH A BYPASS IN THE NEEDERWALL AREA FOR ADDITIONAL REDUCTION IM IMPACTS. AGAIN THE CITY ITSELF. WE HAVE NOT GOT ONE OF THE

INFORMATION ONE WAY ARE ANOTHER FROM THAT AS TO WHAT WILL BE. >> WE HAVEN'T GOTTEN A UNITED.

>> WE HAVEN'T GOTTEN A UNITED DECISION. >> WHITE YOU'RE ON THAT I KNOW PEOPLE CAN'T SEE IT RIGHT NOW BUT I'M SURE WE'LL LOAD IT LATER.

WHEN MUCH I LOOK AT ILLUSTRATION YOU PROED I SEE THE EASTERN I'M LOOKING AT A PRINTSED PURPLE LINE AS A BYPASS TO 21. IT SURE IS A LONG STRETCH. I SURE DON'T LIKE TRAFFIC.

I'M WONDERING WHAT WOULD BE THE CONTRAST OR COMPARISON TO TURNING THAT WHOLE PART OF 21 INTO A HIGHWAY INSTEAD OF CREATING A WHOLE ANOTHER ROAD ALONGSIDE IT FOR SO LONG?

HAVE YOU LOOKDS AT THAT? >> THAT'S WITH A WE WERE LOOKING AT.

WE STAYED EFFECTIVELY ON THE 21 ALIGNMENT. TAX WOULD IMPACT 62 PARCELS.

>> BY THE EXPANSION BECAUSE I KNOW YOU MENTIONED HIGHWAY EARLIER 21.

I JUST WASN'T SURE. >> RIGHT. THAT WAS BY THE ZMOONTION TO DO WHAT WE KNOW IS GOING TO BE NEEDED TO BE DONE IN THE NEAR FUTURE WITH THAT ROAD.

WE TO HAVE TO TAKE OUT THEMES HAVE BEEN THERE PROBABLY 80S, SMIZS SOME HISTORIC BUILDINGS

ALSO. >> OKAY. HAVEN'T REAL YOU DISCUSSED IT YET. IT'S PART OF THE RECOMMENDATION. BUT JUST BASED ON TRAFFIC VOLUMES WE'RE SEEING AND ANTICIPATED GROWTH. IT CONTINUES TO GROW.

>> THAT IS WHAT I WAS THINKING AND LEANING TO. >> JUDGE JUST MORE ON YOUR COMMENT THAT WE DO THERE SBHR COUNCIL MEMBERS THAT ARE WANTING US TO STILL GO THROUGH DOWNTOWN.

THERE'S NOT A UNITED FRONTP BECAUSE OF THE WAY THAT PROPERTIES WERE SITUATIONS ON THERE AND IT WOULD MAKE A MINOR DIFFERENCE TO THIS NUMBER. BUT IF YOU STAYED ON THE EXISTING ALIGNMENT IT WOULD IMPACT 90 PARSE NELDS THAT AREA. IF WE LOOKED AT GOING, IF WE

[01:05:03]

LOOKED AT GOING EAST OR WEST WE COULD DRASTICALLY REDUCE THAT PARTIAL IMPACTS OF 29-41.

THAT NUMBER IS A LITTLE FUZZY AT THIS STAGE BECAUSE IF YOU LOOK AT THE GRAPHIC ON THE NORTHERN END OF THAT BYPASS THERE A NEW DEVELOPMENT THERE. ALL WE HAD WAS THE OUTLINE BOUNDARY OF IT. WE DON'T KNOW HOW MANY PARCELS EXACTLY COULD BE IMPACTED.

THERE BUT IT WAS WOULD IM-- IT WOULD CHANGE THAT NUMBER A LITTLE BIT.

HOWEVER, GOING TO THE EASTERN SIDE WAS AGAIN, HAD A SIGNIFICANT IMPACT.

IT CAN GREATLY REDUCEP 90 IMPACTED PARSEELS TO 28, 29 LOCATIONS TO ONE.

SO. >> I SEE MY FAVORITE. >> WHILE IT LOOKS FAVORABLE WE HAVE A HARD TIME WE COULDN'T MAKE THE RECOMMENDATION TO DO THAT BECAUSE IT'S NOT IN HAYS

COUNTY. >> I SAW THE FOOT SFLINT AT THIS POINTED WE WILL COUNTY IS NOT IN FAVOR OF THIS SO JUST GETTING TO THE SUMMARY RECOMMENDATIONS. WHAT WE DID WAS CONDUCT THE TWO VIRTUAL TOWN HALLS CULTURAL HISTORICAL ENDANGERED RESOURCES. FOR THE ENVIRONMENTAL PART WE DID WHAT IS CALLED A -- OUR ENVIRONMENTAL STAFF AND DATABASES THAT ARE KNOWN SO THEY CAN PLOT THOSE OUT. IF THERE'S KNOWN SEMTERS OR HABITAT OR SOMETHING LIKE THAT THEY COULD PLOT THOSE OUT AND SEE WHAM PACT WE HAVE ON THOSE COORDINATION WITH DEVELOP ERRS.

AS EVERYBODY KNOWS HAYS COUNTY IS GROWING JUST WILDFIRE BASICALLY.

DEVELOPMENT ALONG THIS CORRIDOR IS GROWING LIKE WILDFIRE. AS A PROCESS OF DISCUSSING WE FOUND OUT THAT NEW DEVELOPMENT WAS JUST APPROVED THAT WAS FLIGHT THE MIDDLE OF ONE OF OUR PROPOSED POLLUTIONS SO WE HAD TO SCRATCH THAT OFF. SO THEIR DEVELOPMENTS OCCURRING UP AND DOWN HAD A CORRIDOR DAILY IT SEEMS LIKE. IF YOU DRIVE IT YOU CAN SEE IT.

THERE ARE NEW HOUSES POPPING UP LEFT AND RIGHT THERE. WITH DO HAVE THAT RAILROAD CROSSING ON THE SOUTHERN END OF THE BOREDER BUT THE KEY COORDINATION WITH THE FAA.

THAT COMES DOWN WE STARTED INITIAL DISCUSSIONS WITH SAN MARCOS AIRPORT AS WELL AS THE FAA BECAUSE THEY DO HAVE A RUNWAY PERSON INDICK THROOR 21. IT ENCOMPASSES 21.

SO ANY -- PER PEN DICK LAR TO 21. WE WERE WORKING TO IDENTIFY THE ROADWAYS 20 30, YEARS DOWN THE ROAD. AS WE IDENTIFIED THE RIGHT OF WAY IMPACTS ALONG THE CORRIDOR FOR THESE VARIOUS DIFFERENT ALTERNATIVES.

WE HAVE PRESENTED ALL THESE VARIOUS FINDINGS TO THE VARIOUS GOVERNMENT ENTITIES, CITY OF -- WE HAVE HAD PRESENTATIONS AND MULTIPLE MEETINGS WITH THEM. ALL THAT.

AND THEN, OF COURSE, WE SUBMITTED THEIR RECOMMENDATIONS REPORT.

AND AS YOU CAN SEE OUR CURRENT RECOMMENDATIONS ARE FOR THE FREEWAY SECTION PHASED IN OVER TIME. I KNOW TXDOT IS LOOKING NORTH OF 130 PROJECT LOOKING TO TURN HAD A INTO A DIVIDED FOUR-LANE SECTION ROADWAY THERE. AND THAT IS KIND OF HOW WE ENVISIONED THIS OCCURRING IS THAT OVER TIME YOU ACQUIRE RIGHT OF WAY FOR THE FULL RIGHTS OF WAY SECTION THE FULL FREEWAY SECTION. THE MAINWAY -- YOUR MAIN LANES NEXT PHASE YOU CAN COME IN AND DO OVERPASSES AT THE MAJOR INTERSECTIONS IN JUST THOSE OVERPASSES SO THE ROADWAY AND AND THROUGH THERE. OF COURSE, THIS IS A TXDOT ROADWAY. SO SUBSTANTIAL ADDITIONAL COORDINATION WOULD BE TO THOSE

[01:10:07]

TXDOT WITH IT BEING THE TYPE OF FACILITY THAT IT IS. IT WOULD NEED 20 THE ENVIRONMENTAL PROCESS MORE IN-DEPTH STUDY OF THE ENVIRONMENTAL CONCERNS OUT THERE MUCH MORE PUBLIC INVOLVEMENT SECURITY ON ANY POTENTIAL IMPROVEMENTS.

P OF COURSE WE'RE GOING FORWARD AND BHUFGHT FAA RUNWAY PROTECTIVE ANALYSIS THAT IS TO SUM IT UP IN SIMPLE TERMS WOE HAVE TO PROVE THERE'S NOT AN ALTERNATIVE TO EXPANDING IN THAT REGION, SO WE WOULD HAVE TO HAVE DOCUMENTATION BEFORE THEN WHICH IS FAIRLY STRAIGHTFORWARD IN THIS SECTION SO THAT YOU EITHER BYPASS THE GOLF COURSE SAN MARCOS OR SAN MARCOS AIRPORT THERE CAN TO THE EAST AND TRYING TO GO ON THE WEST RN SIDE THERE ARE NUMEROUS SUBDIVISIONS AND ANYTHING ELSE. IT WOULD BE SUBSTAN STHOOL DO THAT THERE.

SO WITH THAT THAT WAS OUR OH, THE NEXT STEPS AS WE TALKED ABOUT IS WHEN FUNDING BECOMES AVAILABLEP ADDITIONAL COORDINATED ACTS WE'LL HAVE MEETINGS WITH THOSEP HERE IN THE NEXT MONTH OR TWO TO PRESENT THE SAME INFORMATION TO THEM THAT WE HAVE THAT.

AS FUNDING IT BECOMES AVAILABLE WE WANT TO GET IN AND ESTABLISH THE DESIGN AND EVALUATION CRITERIA FOR THE ALTERNATIVES SO YOU CAN DOCUMENT AND COMPARE APTOLLS APPLES BECAUSE AT THAT POINT YOU'D RILE BE LOOK AT SPECIFIC ENVIRONMENTAL IMPACTS IN THE BIG PICTURE.

PEP RAFTION THE RUNWAY ANALYSIS REPORT FOR THE FAA WE WOULD MOVE FORWARD WITH THE UPR WHATEVER AGREEMENT. I YOU'VE SEEN SOME OF THESE HERE LATELY.

IT TAKES AN EXTENSIVE PERIOD OF TIME TO GET THESE APPROVED. >> BUT THEY ARE MORE FAVORABLE.

>> YES. PART OF THE PROCESS MORE DETAILED ANALYSIS AND WE'D LIKE TO UPDATE OUR INFORMATION AND THEN OF COURSE HAVING A SEL SELECTEDP AN ALTERNATIVE SCHEMATIC FOR THAT. AS I MENTIONED EARLIER ANTICIPATED TO OCCUR UNDER HER TRACT HAVING UPDATED MEETINGS AT CALDWELL COUNTY FOR THOSE WITH THAT FP Y'ALL HAVE ANY QUESTIONS

I'LL BE MORE THAN HAPPY TO ANSWER THEM. >> DO ANY YOU GUYS HAVE ANY

ITEMS TO ADD FIRST. >> IS THERE SOMETHING YOU MAY HAVE LEFT OUT YOU WANT TO

HIGHLIGHT? >> I DON'T BELIEVE SO, JUDGE. I JUST WANT TO THANK ALLEN AND OUR TEAM FOR ALL THE WORK THAT THEY HAVE DONE AS MENTIONED IT IS THE CORRIDOR PRESENTATION PROJECT. WE HAVE BEEN TALKING ABOUT THIS FOR A VERY LONG TIME.

WE'LL SEE THE PRO EKSS. >> OF GROWTH AND I APPRECIATE THE CONTINUED SUPPORT ON THIS PROJECT. WE HAVE VERY IMPORTANT SUPPORT ON THIS ROADWAY.

>> THERE WAS A FATALITYY -- IF A THE IN BUDA I BELIEVE. IT WAS A UNIVERSITY PROFESSOR.

>> AND AS WE CONTINUE THESE DECISION WTZ OTHER ENTITIES WE HOPE TO BRING BACK

[01:15:04]

RECOMMENDATION FROM THE COURT TO ACCEPT THAT PREFERRED ALIGNMENT. SO THERE'S STILL WORK TO BE DONE

AND WE'LL COME BACK AT SOME POINT. >> ANY OTHER COMMENTS?

>> NO. >> ANY QUESTIONS? >> APPRECIATE THE WORK AND 30 YEARS NOW PRETTY REGULARLY. IT'S PROBABLY A BYPASS 35 WHERE SOME PEOPLE ARE REAL YOU AMBITIOUSLY CONTINUE AND WE HAVE A SAN MARCOS STUDENT KILLED IT'S ALWAYS BEEN A DANGEROUS ROAD WITH THE AMOUNT OF TRAFFIC AND HOPE IT WILL ALLEVIATE THAT AND IT'S EXTREMELY DANGEROUS.

I THINK YOU POINTED OUT A LOT OF CONSTRAINTS IF STATES COUNTY AND LOCAL AND PREEVERYONE SOME KIND

-- APPRECIATE THIS PROJECT. VERY GOOD PROJECT. >> I WAS LOOKING AT THIS PRESENTATION. THE ONE THING I WOULD SAY IS POSSIBLY THE EXCEPTION OF WIMBERLEY YOU CAN TAKE NOT KNOWING WHERE THE MAP IS AND DROP IT ANYWHERE IN HAYS COUNTY AND HAVE THE SAME CONCERNS. WE HAVE SO MANY ISSUES WITH POP 4R5TION AND DEVELOPMENT RELATED TRYING TO LAY OUT THESE CORRIDORS AND PRESERVE THEM THAT AGAIN, IF YOU TOOK THE LABELS OFF THIS MAP IT COULD BE DRIPPING SPRINGS, KYLE, BUDA I KNOW THE COLLEGE WORKED VERY

HARD ON IT AND IT'S GOOD TO SEE. >> I KNOW IT'S INTERESTING. THE CORRIDOR HAS HAD A BIT OF A REPRIEVE BECAUSE OF THE WAY CALDWELL COUNTIES HAS NOT BEEN AS RAMPANT OUT THERE THAT IS RAPIDLY CHANGE AS WELL MUCH AS THAT AREA ALONG THE BORDER THERE IS GOING TO EXPLODE OVER THE

NEXT FEW YEARS. >> THE DOWNSIDE OF THIS IS AS A FISCAL CONSERVATIVE THE DOWNSIDE OF TAKING THE EASTERN EXPANSION ALL THAT IS THROUGH CALDWELL COUNTY.

THANK YOU FOR THAT PRESENTATION. WE LOOK FORWARD TO SEEING THE REST OF IT AS IT UNFOLDS.

THANK YOU. WILL YOU PLEASE OPEN AGENDA ITEM NUMBER SIX.
